Le texte suivant a pour but d'interroger les motivations américaines à promouvoir l'instauration d'une clause sociale venant garantir le respect de quelques droits fondamentaux des travailleurs au sein des accords commerciaux et financiers qu'ils contractent depuis la fin des années 1980. Nous y abordons I'ALENA et le projet d'intégration hémisphérique comme deux cas pour lesquels les États-Unis ont tenté - et tentent encore pour ce qui est de la ZLEA - d'adjoindre une clause sociale. Pour la majorité des commentateurs de la question, une telle disposition répondrait essentiellement à des motivations d'ordre protectionniste et parfois éthique, émanant surtout des groupes d'intérêt. Nous proposons plutôt une lecture de cette question axée sur les intérêts, et dans une moindre mesure, les idéaux, de politique internationale des États-Unis et tentons ainsi d'articuler une cohérence entre « unilatéralisme agressif » en matière économique et « élargissement démocratique » sur le plan diplomatique.

Le présent article s’insère dans le cadre de la discussion quant à la possibilité d’identifier une clause sociale implicite dans le texte de l’Accord général sur les tarifs douaniers et le commerce (GATT). La reconnaissance d’une telle clause permettrait éventuellement aux États membres de l’Organisation mondiale du commerce (OMC) d’avoir recours aux exceptions prévues par l’article XX du GATT afin d’adopter des mesures commerciales restrictives à l’encontre des pays tenus responsables des transgressions des droits fondamentaux des travailleurs, parmi lesquels se trouve la protection des enfants contre le travail dangereux. L’analyse effectuée au cours de cet article s’attardera sur l’exception de l’article XX(a), qui concerne la protection de la moralité publique du pays importateur. Plus précisément, ce texte tentera de démontrer prima facie que l’exploitation des enfants par le travail, à l’occasion du processus de production des biens importés, porte atteinte à la moralité publique du pays importateur. De ce fait, des mesures visant ces biens pourraient relever de l’application de l’article XX(a) du GATT, sous réserve de satisfaire à la condition de nécessité de cette règle.

L'etablissement d'un lien entre les normes du travail sur le plan international et la politique commerciale remonte deja a la fin du xixe siecle. La creation de l'organisation internationale du travail en 1919 a l'issue du traite de versailles marque le souci d'ameliorer la situation des travailleurs comme le point de depart de toute politique du developpement en faveur d'un accroissement des niveau de vie de tous les travailleurs du monde. Les principes fondamentaux des droits du travail et des droits de l'homme sont enonces dans la constitution de l'oit de 1919, ainsi que la declaration de philadelphie de 1944 sur la liberte syndicale, le droit a la negociation collective, l'age minimum d'admission au travail, le travail force et la discrimination en matiere d'emploi. Cette polemique resurgit avec la liberalisation accrue du commerce, la multinationalisation de la production des firmes et l'acces croissant a l'information sur les conditions de vie a travers le monde. A plusieurs reprises les chercheurs ont tente en vain de mettre en evidence le lien entre le commerce international et les normes du travail, et avec l'expansion de l'activite appelee aujourd'hui globale, la meme interrogation persiste. Elle consiste en ceci, doit-t-on favoriser le principe de concurrence internationale au depens des normes internationales du travail qui fragilise la protection des travailleurs et eroder les acquis en ce domaine ? comment est-t-il possible de reconcilier ces normes du travail definies par l'oit avec le principe de commerce international, et quel sera le role des organisations mondiales et regionales en la matiere ?

L'absence de réglementation commerciale multilatérale relative à la protection des droits des travailleurs suscite néanmoins une création normative de la part des acteurs étatiques et non étatiques. Ainsi, dans un cadre conventionnel (les accords commerciaux bilatéraux comme les accords commerciaux régionaux) ou unilatéral (le système de préférences généralisées) certains États lient leurs relations commerciales au respect de normes de travail. Par ailleurs, l'on observe l'émergence de normes privées à l'initiative d'entreprises (les codes de conduite) ou d'organisations non gouvernementales (les initiatives relatives au commerce équitable) relatives à la protection de certains droits des travailleurs. L'échec de la proposition d'insérer une « clause sociale » dans les Accords de l'Organisation Mondiale du Commerce lors de la création de cette institution internationale en 1994 et la diversité des contenus de ces « clauses sociales » ont conduit à l'adoption, lors des Conférences internationales du Travail de 1998 et de 2008, de deux instruments normatifs promotionnels rappelant aux États les principes et droits fondamentaux au travail à respecter. Le respect de ce socle de droits universels apparaît lié à l'intervention de l'État et à la coopération avec l'Organisation Internationale du Travail. La mise en oeuvre des diverses « clauses sociales » est liée à l'existence de mécanismes juridiques contraignants ou incitatifs de même qu'au rôle des acteurs étatiques et non étatiques. L'enjeu est bien que le nouvel ordre économique international assure la protection des droits fondamentaux des travailleurs
Yet, the lack of multilateral trade regulations regarding the protection of workers' rights brings a normative creation from state and non-state participants. Indeed, in a conventional context (both bilateral and regional trade agreements) or unilateral (the generalized system of preferences) some states combine trade with the respect for work standards. In addition, what is new is the emergence of private standards (codes of conduct) in companies and in nongovernmental organizations (fair trade projects) which aim to protect some workers' rights. The failure to add a "social clause" to the Agreements of the World Trade Organization when it was created in 1994 as well as the wide variety of those "social clauses" led to the adoption, during the 1998 and the 2008 International Work Conferences, of two promotional normative instruments which reminded governments to respect fundamental principles and rights at work. The respect for this base of universal rights seems to be the result of the state' s intervention and cooperation with the International Labour Organization. The implementation of various "social clauses" is the result of binding and incentive legal mechanisms as well as the role of state and non-state participants. What is really at stake here is the protection of workers' fondamental rights by the new international economic order

Les processus d'integration economique regionale entrainent des consequences dans le domaine social et du droit du travail. Cette situation a contribue a alimenter une reflexion sur une mutation du droit du travail dans laquelle s'inscrit cette these dont l'hypothese est: l'accord specifique sur que les trois etats de l'ensemble nord-americain ont choisi d'ajouter a l'integration economique de cet espace, en raison des differences economiques, politiques et des diversites juridiques constitue une reference essentielle dans le debat actuel sur la dans le commerce international. Cette derniere technique pourrait etre le vecteur d'un changement d'echelle du droit du travail requis par le processus de mondialisation. Dans un titre preliminaire, sont analyses les antecedents de cette integration economique nord-americaine, la consecration d'une integration economique silencieuse realisee autour des etats-unis. Ce processus s'accompagnant d'importantes modifications dans les relations de travail des trois pays qui sont a l'origine d'une degradation sociale au canada et aux etats-unis et d'une veritable desintegration sociale au mexique. La partie i est consacree a l'identification des asymetries entre les ordonnancements juridiques des relations de travail des trois pays. Suit un examen detaille de l'accord complementaire qui montre les specificite de cet accord. Son caractere novateur est confirme par son application au cours des deux annees qui ont suivi son entree en vigueur, et par l'examen des plaintes deposees. Ces enseignements servent de base a l'elaboration d'une doctrine de la , objet de la partie ii. Apres quelques precisions terminologiques sont examinees les differentes argumentations. L'analyse des differents types de clauses sociales (unilaterales, autonomes et multilaterales) debouche sur l'evaluation des traitements des rapports entre integration economique et normes du travail. Sont compares ceux donnes par l'integration europeenne, le mercosur et l'alena. Sont aussi examines les mecanismes mis en place par l'oit, afin de determiner le role que cette organisation devra jouer dans l'elaboration et le controle d'une clause sociale, eventuellement, liee a l'o. M. C.
Regional economic integration processes lead to consequences in the social field and in labour law; this situation has fed a debate on labour law transformation to which this thesis contributes. Its main hypothesis is the following: the naalc that the three contries decided to add to the fre-trade because of the economical, political and legal differences constitutes a main reference in the current debate about a "social clause" in international trade. This device could be the vehicle of a scale transformation of labour law that the globalization of the economy requires. In a preliminary section, the background of the north-american integration is analysed and is actually seen as a silent economic integration built around the u. S. . The process has been followed by an important transformation of labour relations in the three countries, generating a social degradation in canada and the u. S. And a real social desintegration in mexico. Part i points out the asymetries in the labour law framework of the three countries. A detailled study of the naalc follows in which the specificities of the agreement are documented. The two first years of its application have confirmed its innovative features. The analysis leads to the elaboration of a theoty of the social clause in part ii. After giving some terminological definitions, the thesis presents the pros and cons of resorting to a socialclause. The analysis of different types of social clauses (unilateral, multilateral and autonomous) leads to an evaluation of the treatment of the linkage beetween economic integration and labour standards. European integration, mercosur and the alena are compared. The ilo system is also analysed in order to specify the role it could play in the application of a social clause that could possibly be linked to the wto

Abstract:
L’obiettivo della ricerca è dimostrare che il concetto di oggetto sociale sia stato svuotato di significato alla luce del contesto socio-economico attuale e di quanto indicato dal legislatore. Ad esempio, l’art. 2380-bis c.c. da ultimo novellato attribuisce agli amministratori la generale ed esclusiva competenza per la gestione dell’impresa, legittimando gli stessi al compimento di tutte le operazioni necessarie per l’attuazione dell’oggetto sociale. L’attività che costituisce l’oggetto sociale di una società rappresenterebbe allora un limite meramente interno ai poteri gestori dell’organo amministrativo, ma non un limite al suo potere di rappresentanza che è invece generale. Detto altrimenti, l’oggetto sociale rileverebbe solo a livello endo-societario quale misuratore di responsabilità degli amministratori, venendo svuotato di significato sul piano esterno. Ulteriori limiti alla valenza dell’oggetto sociale possono essere rinvenuti nell’ambito dei gruppi societari. Qui il concetto di interesse di gruppo dovrebbe sempre prevalere, come affermano concordemente dottrina e giurisprudenza (che hanno individuato la teoria dei vantaggi compensativi), su quello di oggetto sociale, con l’ovvia conseguenza di lasciare a quest’ultimo un ruolo quasi del tutto marginale. A ciò si aggiunga che già altri ordinamenti hanno cominciato a rileggere il concetto di oggetto sociale per adattarlo alle esigenze di un mondo ormai diverso da quello di pochi decenni fa, come l’ordinamento britannico con la sec. 31 (1) del Companies Act 2006 e le disposizioni da esso non molto distanti adottate dal legislatore irlandese e da quello spagnolo. Da tutto quanto sopra, pare potersi concludere che l’oggetto sociale non rivesta più un ruolo di centralità all’interno del nostro ordinamento. Nuova linfa potrebbe essere data all’istituto in esame dall’introduzione di società con un oggetto sociale non limitato, ma - allo stato - questo non pare essere un punto all’ordine del giorno del legislatore.
The aim of the research is to demonstrate that the object clause is no more significant in the current social / economic framework. For instance, art. 2380-bis c.c., as currently in force, gives to the directors the general and exclusive competence for the direction of the company, legitimating them to the fulfillment of all the operations which are necessary for the accomplishment of the object clause. The activity constituting the object of the company should then represent a merely internal limit to the direction powers of the directors, but not an external limit to their general powers. In other words, the object clause would have some importance only on the internal ground as indicator of the liability of the directors, being deprived of its importance on the external ground. Other limits to the effectiveness of the object clause can be found in the matter of groups of companies. Here the concept of group interest should prevail, as scholars and case-law clearly indicate, on the object clause, with the consequence that the object clause would see diminished its role. It is worth noting that also other law systems are reviewing the concept of object clause for adapting it to a different environment, such as UK with sec. 31 (1) of the Companies Act 2006 as well as Ireland and Spain. Accordingly, it seems clear that the object clause is not currently much important in our law system. Different conclusions can be reached if the legislator introduced the possibility of companies with unrestricted object clause, but it seems that at the moment the legislator does not have the intention to intervene on these grounds.

La préoccupation concernant la loyauté dans les échanges occupe, depuis une dizaine d’années, le devant de la scène. La Clause sociale, qui constitue une garantie de mise en application de certains droits éthiques, se trouve au cœur de cette préoccupation et du lien réel ou potentiel entre la régulation sociale et la régulation commerciale à l’échelle internationale. Bien qu’ancienne, cette idée de clause sociale a pris corps à la veille de la création de l’OMC et se trouve étroitement liée à cette Institution. Dès lors une confrontation s’est installée entre les deux organisations que sont l’OMC et l’OIT. C’est cette dernière qui est aujourd’hui l’instance officiellement en charge de l’application des normes sociales fondamentales, or le débat persiste, prenant appui sur l’inadaptation ou l’insuffisance de l’action normative de cette Organisation. En effet, l’introduction d’une clause sociale qui suppose l’intervention normative de la régulation commerciale est considérée comme l’unique alternative si l’on veut voir émerger les prémisses d’une régulation sociale au niveau international apte à lier les Etats concernés. L’enjeu provisoire sera probablement défini par les limites de la capacité normative de l’OIT.

La commande publique et la contribution au développement durable relèvent a priori de deux logiques distinctes. D’un côté, les marchés publics ont pour fonction de répondre aux besoins des personnes publiques. De l’autre, la contribution au développement durable dépend traditionnellement d’actes juridiques non contractuels. Pourtant, les personnes publiques recourent de plus en plus aux contrats de la commande publique pour engager des politiques publiques de développement durable.La présente recherche identifie ce phénomène et démontre que ces contrats à objet de développement durable participent d’une modification de la fonction de la commande publique. Dès lors, ils deviennent des instruments de l’action environnementale et sociale des personnes publiques. Ce changement majeur de la fonction de l’achat public est renforcé par l’adoption des directives communautaires sur les marchés publics du 26 février 2014 et s’inscrit dans le cadre de la définition renouvelée du marché intérieur. Partant, la réussite d’une telle évolution implique nécessairement d’être accompagnée d’une réforme contentieuse afin de donner toute son efficience à cette ouverture de la commande publique aux politiques de développement durable. Plus encore, il sera démontré que cette régénération de la commande publique dépasse l’objet de développement durable et s’élargit à la mise en œuvre d’autres politiques publiques. L’ensemble du droit de la commande publique s’en trouve ainsi affecté

On the other hand, contribution to sustainability is traditionally dependent on legal, and not contractual, acts. However, public citizens increasingly use public procurement contracts to affect public policy on sustainability.This research identifies this phenomenon and shows that these contracts relating to sustainability are similar to a modification of the function of public procurement. Subsequently, they become instruments of environmental and social action for public citizens. This major change in the function of public buying is reinforced by the communal directives on public markets dated 26th of February 2014 and is recorded in the renewed definition of the domestic market. The success of this evolution necessarily implies a need for it to be accompanied by a legal reform in order for the complete efficiency of this opening up of public procurement to sustainability policies to be reached. Furthermore, this research will show that this regeneration of public procurement goes further than sustainability and reaches more widely into the sphere of other public policies. The whole body of public procurement law is as such affected

Abstract:
Durante la primera década de los años 2000, la mayor parte de la investigación sociológica mantenía un pensamiento eminentemente aespacial. Por otra parte, la geografía humana y la demografía habían dirigido su atención sobre la inmigración, protagonista de una gran transformación en el país. Durante la década de los 2000, los estudios sobre la segregación de la población extranjera tomaron el relevo de los trabajos sobre segregación entre clases sociales, más característicos de los años noventa. Esto comenzó a cambiar a partir de la activación de las políticas de austeridad en torno a 2012. Esta tesis es también resultado de un clima en el que se renovaba el interés por las dinámicas de clase. Tanto en los estudios sobre segregación étnica, como en los de segregación socioeconómica, está presente la preocupación por las desigualdades y por la formación de concentraciones de población desfavorecida. La atención sobre los guetos amalgama una tradición de investigación reivindicativa, con una actitud de sospecha generalizada hacia las personas desfavorecidas. Esta preocupación por la localización de los grupos desfavorecidos ha ido sustituyendo a la preocupación por sus condiciones de vida y por la desigualdad que sufren. De forma similar, la preocupación por la igualdad se ha deslizado hacia la preocupación por la desigualdad de oportunidades que, supuestamente, estarían generando los guetos y los “efecto barrio”. Así, la prevención del gueto es una política transversal, capaz de generar adhesiones en todo el espectro político. Sin embargo, algunas voces destacaban los posibles beneficios en términos de empleo y oportunidades que podían tener los extranjeros gracias a su concentración territorial (Bayona, 2007) o los problemas que enfrenta la población con menos recursos cuando su entorno social se transforma y experimentan una gentrificación de usos en la que se pierde, por ejemplo, la red de comercios con productos asequibles (Slater, 2009). El interés inicial sobre el “nivel socioeconómico” se concentró en “las clases altas” a partir del artículo de (Atkinson y Flint, 2004) sobre las urbanizaciones cerradas en el Reino Unido. Ese artículo, entre otras aportaciones, sostiene que los problemas asociados a la proliferación de las urbanizaciones cerradas no se habían estudiado a causa de sesgos en la academia y la sociedad, que dificultan problematizar las acciones de las clases altas. Este sesgo aparecía también de forma clara en las investigaciones sobre segregación. Aunque los grupos privilegiados aparecen de forma sistemática como aquellos que más contribuían a las diferencias socioespaciales, los estudios de segregación denuncian, localizan, delimitan y concentran la atención (y la sospecha) sobre la segregación de los grupos desfavorecidos, la más alarmante. Estudiar las clases altas, de alguna forma, puede ayudar a distribuir la sospecha. Por otra parte, restringir el estudio a las clases altas, prometía, paradójicamente, ampliar los resultados de la investigación. En primer lugar, porque para los cálculos de segregación de las clases altas debía atenderse también al conjunto de clases y grupos; en segundo lugar, porque como su segregación se supone voluntaria, estudiar su separación del resto permitía analizar también sus motivos y razones; finalmente, aparecía una razón de peso metodológico: las clases más altas y más bajas son las que más carácter de clase inscriben en el territorio, pero es la clase alta la que está más normalizada y aparece mejor recogida en registros, censos, datos, nóminas y contratos. Ante un censo de 2011 que se anticipaba incierto, los datos y registros de la clase alta serían mejor indicador de las dinámicas socioterritoriales de clase. El último cambio de relevancia que se incorpora es el paso de la idea de segregación entre grupos, al concepto de patrones territoriales. Esta transformación fue ocurriendo durante la investigación. Los resultados del análisis de ecología factorial muestran zonas metropolitanas diferenciadas entre sí y fuertemente asociadas a determinadas clases sociales. Esta asociación entre grupos y territorios también aparece en el imaginario y los discursos recogidos por las primeras entrevistas. Además de la asociación empírica y simbólica entre grupos y zonas urbanas, el campo cualitativo apuntaba también a fuertes asociaciones entre localizaciones, funciones y prácticas. Lugar de residencia y clase social, ya de por sí fuertemente relacionados, resultaban determinantes en la configuración de determinadas pautas de ocio, movilidad, socialización… El círculo se cierra cuando sus habitantes mantienen y acondicionan el territorio de forma que siga sosteniendo estas prácticas con eficacia. Así, territorio, clase, prácticas y capital simbólico conforman diferentes patrones socioterritoriales especialmente adecuados para el análisis de las dinámicas de segregación, integración, estigmatización territorial, gentrificación…

Il lavoro di ricerca ha richiesto lo studio e l’analisi di fonti “variegate” e multidisciplinari in quanto si tratta di un fenomeno poliedrico, relativamente recente e che è stato oggetto di interpretazioni molto diverse, se non antitetiche. L’obiettivo della presente analisi è molteplice. In primo luogo, si è trattato di definire il perimetro del fenomeno, astraendone una possibile definizione, tuttora assente nel panorama normativo vigente. In secondo luogo, si è voluto, mediante una analisi comparata tra Europa e America Latina, verificare l’andamento del dumping sociale in differenti contesti, in particolare, in un Paese industrializzato e in un Paese in via di sviluppo. Con il terzo e ultimo obiettivo, facendo emergere luci ed ombre del dumping sociale, si è cercato di individuare un percorso futuro dove fosse possibile – mediante comportamenti proattivi da parte di tutti gli attori coinvolti – arginare i fenomeni negativi del dumping e tutelare sempre più i diritti sociali.

The research has required the study and analysis of "varied" and multidisciplinary reference sources, taking into account that it is a multifaceted phenomenon, which has become more common in relatively recent periods and has been the subject of very different interpretations, sometimes even antithetical. The aim of this research is multiple. Firstly, the thesis sought to define the perimeter of the phenomenon, extracting a possible legal definition, which is still absent in the existing regulatory framework. Secondly, through a comparative analysis between Europe and Latin America, the research analyzed the trend of social dumping in different contexts, in particular, in a developed and in a developing country. In its third and last objective, the thesis, by taking out the pros and cons of social dumping, tried to identify a future path in where it will be possible – through proactive behavior on behalf by all those involved – to make a positive contribution to counter the negative phenomena of dumping while increasingly protect social rights.

It has long been acknowledged that, in response to polar questions, disagreements are normatively delayed with agreements such that they are presented as modifications or exceptions rather than outright disagreements. While there is a large body of literature on how the initial element in the answer projects upcoming modifications or disagreements to come, little attention has been paid to the grammatical format in which delayed modification is presented. This study thus attempts to document how grammatical formats contribute to the interactional outcomes of modifications in this position. The focus is on three grammatical formats that are used to make such modifications following the minimal confirmation particle un in Japanese: the coordinate clause marked with demo (“but”), the subordinate clause, and clauses that are not grammatically tied to the preceding confirmation. The findings suggest that these grammatical formats are used systematically to modify the preceding confirmation to varying degrees and in different ways. Modifications made in coordinate clauses modify the degree of assessment presented in the question and/or preemptively deny a possible implication that follows the state of affairs confirmed by un without retracting or conditioning the confirmation. Modifications made in subordinate clauses, on the other hand, retract or significantly qualify the confirmation that has been conveyed with un. Finally, modifications in clauses that are not grammatically marked for their semantic relation to the confirmation address an issue with an assumption underlying the question and retroactively portray the confirmation as ostensible. It is concluded that post-confirmation modification is one environment in which a fine division of labor is assigned to different grammatical formats.

Visando formar a força de trabalho consciente da luta de classes na indústria brasileira de jogos digitais, adota-se a pedagogia histórico-crítica como base para elaboração do jogo sério educativo Luta de Classes. O método pedagógico é composto pelos momentos de problematização da prática social, instrumentalização, catarse e retorno à prática social. O objetivo é provocar o movimento no processo de consciência de estudantes de atividade acadêmica de programação do segundo semestre do curso tecnólogo de jogos digitais de universidade comunitária. Tal jogo está em fase de teste de aceitação e será aplicado como experimento de projeto de pesquisa de doutorado de informática na educação.

Remote instruction lacks shared physical space and physical social presence. This can make it difficult to incorporate embodied learning techniques, which have been shown to strengthen learning outcomes, into our lessons, and can make it difficult to feel socially connected to peers. We propose that incorporating embodiment into a synchronous lesson by engaging students in a physical task using a shared set of materials can help strengthen social and conceptual connections. We outline a high school statistics lesson on measurement error that involves building a popsicle stick catapult and measuring gummy bear launch distances. We distributed a set of all the necessary materials to the students at the start of the course. The activity simulated a sense of shared space and brought about multimodal learning and shared physical experiences. We witnessed enhanced joint attention, the development of physically grounded understanding, and increased engagement.

The paper uses microeconomic data to characterize entrepreneurs by income group and selected household, individual and business characteristics, finding that entrepreneurship is rare but more frequent in the upper class than the middle or lower classes. Middle-class entrepreneurs are, on average, better off than middle-class employees of similar characteristics but differ greatly from upper-class entrepreneurs in terms of educational attainment, the size of their businesses, and their outcomes. While entrepreneurs appear to have more income mobility than the average worker, this paper cannot establish whether this is true for middle-class entrepreneurs in particular, nor provide evidence to support the hypothesis that middle-class entrepreneurs' activity is an engine for economic growth. Instead, the findings suggest that the types of businesses run by these entrepreneurs are characterized by low productivity. Consequently, policies to increase social mobility seem to hold greater promise for promoting higher productivity and welfare than policies encouraging entrepreneurship.

The main contribution of this paper with respect to previous work is the use of data on subjective perceptions to identify the Latin American middle classes. This paper provides a set of comparisons between objective and subjective definitions of middle-class using data from the 2007 World Gallup Poll. Seven objective income-based definitions of social class are contrasted with a self-perceived social status measure. Mismatches between the objective and the subjective classification of social class are the largest when the objective definition is based on median incomes. Mismatches result from the fact that self-perceived social status is associated not just with income, but also with personal capabilities, interpersonal relations, financial and material assets, and perceptions of economic insecurity. Objective definitions of the middle class based on absolute incomes provide the lowest mismatches and the most accurate differentiation of the middle class from other classes.

Esta nota de clase tiene por propósito brindar a los estudiantes y futuros profesionales de la salud y a los colegas que acompañan este proceso educativo algunos elementos claves para el desarrollo y análisis de los determinantes sociales y de la salud, así como su afectación en la salud de los individuos y colectivos. El abordaje de esta temática se desarrolla paso a paso, en articulación con temas y contenidos vistos previamente en el curso. Es necesario que el estudiante recuerde el significado de salud dado por la Organización Mundial de la Salud (OMS), con el fin de vincularlo a los antecedentes investigativos, donde se relacionan la pobreza, la desigualdad y su impacto en la salud de las personas. Los modelos de determinantes sociales se usan para argumentar las causas de esa desigualdad social. De este modo, se amplía el horizonte conceptual a través de la explicación de cada uno de los determinantes sociales definidos por la OMS, mostrando sus interacciones. El desarrollo investigativo permitió concluir que los estudiantes logran identificar los determinantes sociales en una comunidad, aplicar un modelo para argumentar sus puntos de vista, e identificar la situación de salud y los riesgos personales y socioeconómicos tanto de un individuo como de una comunidad. Mediante el desarrollo de este tema, el estudiante fortalecerá su capacidad de analizar críticamente los determinantes sociales en cualquier contexto social y la afectación en la salud de individuos y poblaciones.

"Capital social y cultura: claves olvidadas del desarrollo" refleja la preocupación de su autor por examinar y redefinir al desarrollo desde una perspectiva que se despega del pensamiento económico convencional. Sin dejar de valorar el aporte de la teoría económica y la necesidad de herramientas técnicas en pos de un crecimiento económico sostenido, cuestiona su posición de privilegio dentro del proceso de desarrollo en detrimento de otros factores. A partir de aquí, el autor invita a ampliar el horizonte del desarrollo, invita a repensarlo como un proceso donde crecimiento económico sostenido y equitativo y progreso social respetuoso de lo diverso van de la mano y se potencian, con el fin de ampliar las oportunidades de los seres humanos, que es el verdadero fin del desarrollo. Cultura y capital social son, justamente, esas "claves olvidadas", esas "palancas formidables" para el desarrollo, como el mismo Kliksberg las califica. La primera, la cultura, subyace en todas las dimensiones, en todos los planos de una sociedad. Definida como "maneras de vivir juntos" por la Comisión Mundial de Cultura y Desarrollo de la UNESCO, la cultura es ese conjunto de valores, costumbres, ideas y muchos otros elementos compartidos que conforman la identidad de las personas. La cultura como "factor decisivo de cohesión social", según el mismo autor, es la base que da sustento al capital social.

Abstract:
Este documento, basado en el Documento de Marco Sectorial de Protección Social y Pobreza, tiene el propósito de mostrar el estado actual de la protección social en América Latina y el Caribe. Para ello, se analiza tanto el contexto de la región como las acciones clave emprendidas por los países en tres ámbitos específicos de acción: apoyo al ingreso de los hogares en condición de pobreza o vulnerabilidad, atención a la dependencia funcional de las personas mayores, y atención e inclusión de las personas con discapacidad. En materia de pobreza y desigualdad, los indicadores en América Latina y el Caribe quedaron estancados a partir de 2016 tras más de una década de mejora, y acusan desde 2020 el impacto de la pandemia del COVID-19. La crisis socioeconómica sumió en la pobreza a millones de personas de la clase media emergente y puso de relieve las limitaciones de los sistemas de protección social regionales.

Abstract:
En el año 2021, Mecila llevó a cabo a una encuesta sobre las consecuencias sociales de la pandemia de covid-19 en Berlín, Ciudad de México, San Pablo y Buenos Aires. En este working paper se presentan resultados obtenidos en el Área Metropolitana de Buenos Aires, y referidos específicamente a los arreglos familiares con relación a la distribución del trabajo doméstico no remunerado y al uso de espacios de la vivienda para el teletrabajo. En líneas generales, el estudio muestra la persistencia de las desigualdades de género en el reparto de las tareas domésticas y de cuidado, pone en evidencia cómo aumentó la carga de este tipo de tareas entre las mujeres en el contexto de pandemia, y destaca que fueron ellas quienes asumieron, en proporciones abrumadoras, el acompañamiento escolar de niños y niñas durante la suspensión de las clases presenciales. Estos resultados se observan en todos los sectores sociales y tipos de hogar, aunque se registran matices de acuerdo con el nivel educativo y la clase social. En todas las dimensiones analizadas, las mujeres madres de sectores vulnerables son quienes experimentan mayor desigualdad dentro de sus hogares y, a la vez, se encuentran en desventaja en relación con las mujeres de otros sectores sociales
