Abstract:
In the wake of budgetary restraints, many local government organizations are examining existing sources of revenue to exhaust available streams without increasing constituents' financial burden. Some of these revenue streams include nontraditional sources, such as traffic citations, yet little research has explored the implications of revenue generated from fines from traffic citations. Using the theory of resource dependence as the foundation, the purpose of this study was to explore the relationship between the estimated population of the county, the unemployment rate of the county, and the personal income per capita against the number of traffic citations issued and the Florida Clerk of Court and Comptroller's (FCCC) revenues and budget attributable to traffic citations for 39 of Florida's counties for the years 2005-¬ - 2014. Data were analyzed using multiple linear regression analyses. The results of this study indicate a statistically significant (p < .001) relationship between population and personal income with increases and decreases, respectively, in the issuance of traffic citations and FCCC revenues attributable to traffic citations. Likewise, there was a statistically significant (p < .001) relationship between population and personal income with increases in the FCCC budget associated with traffic citations. Unemployment rate was not statistically associated with the issuance of traffic citations, and FCCC revenues and budget attributable to traffic citations. The findings of this study may promote positive social change by providing legislative awareness that the FCCCs continue to be dependent on the bulk of their revenues, and significant portion of their budget, from a nontraditional revenue source; the traffic citation.

Au XVIIIe siècle, grâce aux efforts redoublés de l’Église post-tridentine, le clergé semble davantage formé, éduqué et moralisé, comme en atteste le topos littéraire du « bon prêtre ». L’étude d’un corpus de sources éclectiques, issues des archives de la Bastille, du parlement et de l’officialité de Paris, révèle la persistance d’un contingent non négligeable de membres déviants. Enjeux d’une surveillance multiforme de la part de leurs ouailles, de leurs pairs, de leur hiérarchie ou des instances policières, les ecclésiastiques contreviennent à l’impératif de chasteté en entretenant des relations ancillaires, sodomites et tarifées, de manière fortuite ou régulière. Outre la mise en lumière de leurs pratiques sexuelles et d’une géographie de la capitale tentatrice, la confrontation des sources souligne l’existence de plusieurs effets de seuils entraînant scandale, saisine de justice et répression, préalables indispensables à une réconciliation du corps social
During the 18th century, thanks to the efforts of the post-tridentine catholic church, the Clergy seems to be better trained, more educated and have a more ethical conduct, as confirms the figure of the “Good Priest” in French literature. Various sources from the archives of the Bastille, parliament and ecclesiastical courts reveal that a substantial number of clergy members had a deviant behavior. Some Clerics transgress chastity rules and engage in casual or regular intercourse with servants, other men or prostitutes. They are subsequently closely kept under close surveillance by their parishioners, fellow priests, hierarchy or by the police. The corpus studied has permitted to highlight their sexual practices as well as the geography of the places of debauchery in the city. It also revealed the existence of several threshold effects and the ensuing scandals, court cases and repression, which were essential for society to be reconciled with its Clergy

The role of statutory social workers is often misperceived by other role players in interdisciplinary teams; but even more so in the law fraternity spectrum. As such, social workers experience many challenges working with attorneys, magistrates and court clerks because they are often undermined by their counterparts in the interdisciplinary team. This places great strain on professional relationships in settings where these professions are required to work collaboratively, such as statutory services with children and families. Therefore, the aim of this study was to understand the role of the social worker in the interdisciplinary team providing statutory services to children and families in the Cape Metropole. The theoretical framework selected for this study is conflict theory, because it is suited to explain the often-strenuous relationship between social workers and the rest of the interdisciplinary team in the law fraternity.

Abstract:
This thesis investigates the life histories of Crown Court clerks between 1972 and 2015, and has uncovered unheard testimonies of the lived world of law. Drawing on 21 oral history interviews, it is posited that the Crown Court clerk was a pivotal player in the legal system during this period and their contribution to the performance of law has been largely neglected. Though they did not enjoy the economic, social and cultural capital of judges and barristers, or play a central role in the construction and determination of legal issues in hearings, they were chiefly responsible for the smooth functioning of the courtroom, and were constantly working to maintain order and facilitate the flow of proceedings. Court clerks can be characterised as stage managers of the courtroom drama in the sense that the onus was upon them to ensure that all the various props and parties were assembled in the courtroom at the right time, and to direct defendants, witnesses and jurors as to where and when to sit, stand, and what to say at the appropriate moment. Moreover, this thesis asserts that alongside judges and barristers, court clerks were active agents in the perpetuation of traditional practices through their use of official and formal codes of dress, speech and behaviour, and can be perceived as custodians of continuity. This finding is particularly interesting in light of scholarly accounts that have identified a period of radical change to the administration of justice following the founding of the new Courts Service in 1972. It is contended that Crown court clerks were not merely complicit in, but strongly supported a highly ritualised performance of justice. In so doing, they contributed towards upholding the authority and legitimacy of the criminal justice system in ways that have been largely unacknowledged.

Abstract:
Is there a relationship between work role and information seeking behavior? Three behaviors were examined: choice of information channel, choice of method for information retrieval, and choice of method for storing retrieved information. The Protestant clergy was selected as a profession with clearly identified work roles, including preacher and administrator. Questionnaires were mailed to 150 randomly selected ministers in Tarrant County, Texas. Sixty-four responded. Additionally, fifteen ministers selected at random were interviewed for additional data. The data collected through the questionnaires were analyzed using nonparametric statistical techniques.

Abstract:
The English Reformation was undeniably a period of change; this thesis seeks to consider how that change was managed by those who were responsible for its realisation and by individuals it affected directly, principally during the reign of Edward VI. It also considers how the methodology adopted contributes to the historiography of the period and where else it might be applied. Central to this study is the 1548 Dissolution of the Chantries, the related activities of the Court of Augmentations and the careers of clerics from five Midland counties for whom this meant lost employment. In addition to the quantitative analysis of original documentation from the Court, counties and dioceses, the modern understanding of change management for organisations and individuals has been drawn upon to extrapolate and consider further the Reformation experience. The conclusions show how clerical lives and careers were or were not continued, while emphasising that continuation requires an enabling psychological management of change which must not be overlooked. The evidence for the state demonstrates that its realisation of its immediate aims contained enough of formal change management requirements for success, up to a point, while adding to the longer-term formation of the state in ways unimagined.

Abstract:
This qualitative study was designed to produce a theoretical model to illustrate marital adjustment as a husband becomes a bishop (a lay-clergy position) in The Church of Jesus Christ of Latter-day Saints. Individual interviews were conducted with the husband and wife of six married couples wherein the husband was currently serving as a bishop. Grounded theory methods and elements of phenomenological research were used to collect and analyze the data. The model presented depicts the adjustment process that begins with the marital relationship prior to the husband becoming an LDS bishop. The husband then becomes an LDS bishop and begins to perform the duties and responsibilities of his new lay-clergy position. Consistent with systemic thinking, the husband's acceptance of the position of bishop affects the husband and the wife individually in turn affecting the marital relationship. The mutual influences between the husband and wife as individuals and the marital relationship constantly change both in flow and direction. The effects of the calling included both points of satisfaction and points of dissatisfaction/disconnect or a parallel set of experiences both for the individual and for the marital relationship. The parallel set of experiences and the resulting effects of the husband's service as an LDS bishop on the marital relationship produce a dialectical tension between covenants or promises that both the husband and the wife have previously made. One covenant is to serve God by sacrificing to build His kingdom on earth through service to others and the other covenant is to have a strong marriage. Adjustment strategies which included both individual and couple strategies were identified. Several themes identified in this study are consistent with existing empirical and theoretical literature. However, new themes were identified including the husband experiencing increased empathy towards his wife, wives feeling "left behind" spiritually, the challenge of negotiating issues of confidentiality, the influence of family of origin and current stressors on the adjustment process, and couples seeking support from those in positions of higher authority.

Un émetteur doit en effet transmettre au récepteur une information lui permettant de décoder une communication chiffrée. Le canal d'information n'étant souvent pas physiquement sécurisé, cette information préliminaire doit être transmise sans que les interlocuteurs n'aient à se soucier qu'un autre acteur puisse intercepter cette information. Différents algorithmes ont été développés afin de rendre possible cet échange préliminaire. Parmi les algorithmes communéments utilisés, la cryptographie à courbe elliptique permet de maximiser la sécurité d'une communication avec un minimum d'échange préliminaire d'information. La cryptographie à courbe elliptique repose sur la multiplication d'un point sur cette courbe par un scalaire. Cette opération est relativement lourde au niveau logiciel. Le développement d'un co-processeur spécialisé pour cette opération devient alors pertinent. Ce mémoire résume le développement de pareil co-processeur. Ce dernier a été développé sur FPGA en minimisant les ressources logiques utilisées tout en maximisant la fréquence d'horloge opérationnelle. De plus, le nombre d'opérations sur la courbe elliptique a été minimisé en représentant l'entier multipliant le point sur la courbe elliptique sous sa forme numérique ω-NAF. Ce mémoire propose également une façon inédite pour générer aléatoirement un entier sous sa forme ω-NAF en minimisant les ressources logiques nécessaires pour pareille opération.
The encryption of a communication on a given channel may appear hazardous. An interlocutor must transmit to another one enough information allowing both interlocutors to encrypt or decrypt the communication. Since the communication channel is visible to potentially malicious actors, this preliminary information must be exchanged without worrying about others intercepting it. Several algorithms were developed making that exchange possible. Among the most commonly used algorithms, elliptic curve cryptography provides the highest strength per bit. Elliptic curve cryptography is based on the multiplication of a point on this curve by a scalar. This operation is relatively complex when implemented in software. The use of a specialized co-processor becomes an interesting approach to perform this operation. This thesis describes the development of such a co-processor. It has been developed targeting a FPGA, minimizing the use of logical resources while maximizing the operating frequency. Moreover, the number of operations on the elliptic curve have been minimized by representing the scalar multiplying the point of the elliptic curve in its ω-NAF form. A method randomly generating an integer in its ω-NAF representation is also proposed. This method can be implemented in hardware using a minimum of logical resources.

Le présent travail intitulé « La procédure devant les tribunaux ecclésiastiques de l’Église de Grèce : une analyse nomocanonique de la loi étatique 5383/1932 », ambitionne d’être la première monographie consacrée à la Loi 5383/1932, loi concernant les tribunaux ecclésiastiques grecs, dite aussi, d’après la définition du Conseil d’État, loi du droit disciplinaire ecclésiastique. Elle concerne 82 métropoles et l’archevêché d’Athènes. La procédure disciplinaire est une procédure judiciaire ; elle consiste en un procès au cours duquel doivent être appliqués tous les principes d’un procès juste. Ces tribunaux aussi doivent offrir la garantie d’un jugement juste. Le critère consiste à savoir s’ils saisissent une différence selon les règles du droit, avec compétence pour cette différence dans le cadre d’une procédure préétablie. La Loi 5383/1932 est un texte juridique et, pour la traiter, nous avons appliqué les méthodes juridiques et canoniques, dites nomocanoniques, d’analyse et d’interprétation
The present work bears the title, «The Procedure before the Ecclesiastical (Church) Courts of the Church of Greece: A nomocanonical analysis of the state law 5383/1932» which aspires to constitute the first monograph devoted to Law 5383/1932, a law that concerns the Greek Ecclesiastical courts, or better yet, the law regarding ecclesiastical disciplinary law according to the case law of the Council of State. This law concerns 82 metropolises (cathedrals) and the archdiocese of Athens. The disciplinary procedure is a judicial procedure that entails a hearing during which all of the principles of a fair trial must be applied. These courts owe a duty to offer the guarantees of a fair trial. The criterion is to know whether they are vindicating a difference with the rules of law having jurisdiction over this difference in the context of an existing procedure. Law 5383/1932 is a legal text and, in order to analyze it, we have used the legal and Canon law methods otherwise known as legal rule analysis and interpretation

La grande aumônerie désigne traditionnellement, en France, le clergé chargé de l’exercice du culte auprès dusouverain et de ceux de ses sujets attachés à sa personne. Longtemps cantonné à la cour, ce service connaît, desa recréation par Napoléon au moment du passage à l’Empire jusqu’à sa suppression par la monarchie deJuillet, un développement sans précédent. L’amalgame de différentes composantes, à commencer, sous laRestauration, par l’aumônerie militaire, transforme le modeste département aulique en une institution présenteà l’échelle nationale, dont les effectifs équivalent à ceux d’un petit diocèse. Le présent travail s’interroge sur lamanière dont l’existence d’un tel clergé affecte concrètement le fonctionnement du système concordataire, àtravers l’étude de ses structures, de son personnel et de son activité pastorale. Il pose aussi la question du poidspolitique du clergé de cour dans la direction des Affaires religieuses en régime constitutionnel. Il conclut surun constat : celui de la marginalisation, avant même sa disparition, de la grande aumônerie, soulignant parcontrecoup la solidité des institutions de régulation des cultes mises en place par Bonaparte. L’antique alliancedu Trône et de l’Autel fait alors place, définitivement, à la relation purement administrative de l’Église et del’État
The “Grande Aumônerie” traditionally refers, in France, to the clergy in charge of the exercise of the ministryto the sovereign and, among his subjects, to all those attached to his person. A long time confined to the court,this service knows, from its restoration by Napoleon until its removal by the July Monarchy, an unprecedentedgrowth. The incorporation of various components, which the most important is certainly, under theRestoration, the military chaplaincy, converts the modest aulic department into a national institution, whosenumbers equall to those of a small diocese. This work examines how the existence of such a clergy actuallyaffects the running of the Concordat System, through a detailed study of its structures, its staff and its pastoralactivity. It also raises the question of the political weight of the court clergy in the management of religiousaffairs in a constitutional government. Eventually a finding stands out : the marginalization, even before itsdisappearance, of the “Grande Aumônerie”, which, by contrast, underlines the soundness of the institutionsestablished by Bonaparte in order to regulate the religions. The ancient alliance of Throne and Altar then givesway, definitively, to the merely administrative relationship between Church and State

Cette presence se manifeste egalement dans quelques motifs historiques du theatre de l'evangelisation, ainsi que dans les pieces des ecrivains francais montees par des latino-americains. The aim of this thesis is to investigate the lives of men and women living in London and Bury St. Edmunds in the late fourteenth - early fifteenth centuries. Sources studied include the administrative and legal records of the City of London and of the Abbot and Convent of St. Edmund's abbey; legislation and court records of royal government and the wills and testaments of Londoners and Bury St. Edmunds' inhabitants. Considerable research on a wide range of topics on London, but far less work on Bury St. Edmunds, has already been undertaken; however, this thesis is the first systematic comparative study of these two towns. The introduction discusses the historiography and purpose of the thesis; the methodology used, and the shortcomings of using medieval wills and the probate process. Chapter One discusses the testamentary jurisdiction in both towns; who was involved in the will making process, and the role that clerics played as both executors and scribes and how the church courts operated. Chapter Two focuses on testators' preparations for the afterlife, their choices concerning burial location, funeral arrangements and the provisions made for prayers for their souls. Chapter Three examines in detail their pious and charitable bequests and investigates what ‘good works' testators chose to support apart from ‘forgotten tithes'. The family and household relationships, including servants and apprentices, are examined in Chapter Four, exploring the differences in bequests made depending on the testators' marital status, together with evidence for close friendships and social networks. Chapter Five discusses the ownership and types of books referred to in wills and the inter-relationship between the donors and the recipients. Testators' literacy and the provision for education are also investigated.

Après un repas, la glycolyse, la lipogenèse et particulièrement 2 enzymes sont sollicitées : la GlucoKinase (GK) et la Fatty Acid Synthase (FAS) augmentant la biosynthèse des acides gras (AG). Une autre voie du glucose conduit à la O-GlcNAc, glycosylation assurée par l’OGT et l’OGA. Au vu de la relation entre le glucose, la O-GlcNAc et le métabolisme glucido-lipidique, la O-GlcNAc contrôle probablement l'expression et l'activité de la GK et de la FAS. L’objectif a été de caractériser la O-GlcNAc des 2 enzymes et l’impact de la modification sur leurs propriétés. Les niveaux de O-GlcNAc, de GK et de FAS ont été mesurés dans différents modèles : des foies et des hépatocytes primaires de souris et des lignées cellulaires hépatiques cultivés dans des conditions de O-GlcNAc variables. Nous démontrons que la FAS et la GK sont O-GlcNAc en fonction des conditions nutritionnelles, en corrélation avec une meilleure stabilité de la protéine. Un lien existerait entre l’apport excessif de glucose, l’augmentation de O-GlcNAc et la production d’AG conduisant à la stéatose. Les perspectives sont l’étude de la régulation de la FAS par O-GlcNAc au cours du cycle cellulaire. La FAS est primordiale dans la biosynthèse d’AG, composants majeurs des membranes plasmiques. Par conséquent, elle est dérégulée en cas de prolifération cellulaire anormale, caractéristique des cellules cancéreuses. Ce défaut de prolifération est accompagné d’une augmentation de la FAS, de l’OGT et des protéines O-GlcNAc. Nos premiers résultats montrent que l’expression de la FAS varie au cours du cycle. L’OGT y joue probablement un rôle puisque son inhibition dérégule les variations de la FAS au cours du cycle cellulaire
After a meal, the glycolysis, the lipogenesis and particularly two enzymes are activated: Glucokinase (GK) and Fatty Acid Synthase (FAS) causing an increase in fatty acid biosynthesis. Another pathway of glucose leads to O-GlcNAc, glycosylation catalysed by O-GlcNAc transferase (OGT) and O-GlcNAcase (OGA). In view of the relationship between glucose levels, O-GlcNAc and the glucido-lipidic metabolism, the O-GlcNAc would regulate the expression and activity of GK and FAS. The aim was to characterize O-GlcNAc of GK and FAS, and the impact of this modification on their properties. O-GlcNAc, GK and FAS levels were measured in various models: livers and primary hepatocytes of mouse and liver cell lines cultured in conditions that modulate O- GlcNAc levels.We demonstrated that FAS and GK are O-GlcNAc depending on nutritional conditions in correlation with a better stability of proteins. It must exist a link between an excessive intake of glucose, increased levels of O-GlcNAc and abundant fatty acid production leading to hepatic steatosis. In the perspectives, we focused on the regulation of FAS expression by O-GlcNAc during the cell cycle. Indeed, FAS plays a pivotal role in the biosynthesis of biological membranes fatty acids. Accordingly, FAS may be dysregulated in abnormal cell proliferation, a major characteristic of cancer cells. In addition, these cells exhibit an overall increase of OGT expression and O-GlcNAc protein. Our initial results suggest that FAS has a variable expression during cell cycle. In addition, OGT and O-GlcNAc may play a role since the use of an OGT inhibitor deregulate changes in the FAS expression in different phases of the cycle

Les membres de la classe des professions, qu'ils soient narrateurs ou personnages, occupent une place à la fois centrale et équivoque dans le texte victorien, dans sa construction, sa composition. En effet, si cette place prépondérante paraît indiquer une prise de pouvoir de ces derniers, elle s'accompagne fréquemment d'une mise en question, voire d'une mise en danger de leur statut au sein du récit. Cette position paradoxale semble être le résultat du lien quasi-systématique (mais souvent sous-jacent) entre l'apparition d'un narrateur ou d'un personnage issu des professions et la déstabilisation des notions de signification et de vérité dans l'ensemble du texte. Nous étudierons les modalités et les outils de cette déstabilisation, mais aussi ses conséquences sur le corps du texte. Pour ce faire, nous nous concentrerons sur le support de la nouvelle véhiculée par les périodiques pour son caractère propice à l'expérimentation et sa grande diffusion auprès du lectorat victorien. Par ailleurs, nous avons centré notre corpus de textes sur Conan Doyle, Wilkie Collins et Le Fanu car ces derniers ont participé activement à la diffusion dans la littérature des idées propres aux classes moyennes et ont abondamment illustré les mutations sociales de cette classe durant la seconde moitié du XIXème siècle. Cela s’est fait à travers leurs nouvelles notamment, qui apparaissent comme le lieu privilégié de l’expression des interrogations concernant l'instabilité de certains discours structurants de la société : loi, religion et médecine. Ainsi, Joseph Sheridan Le Fanu, fils d’un homme d’église et féru de théologie, Arthur Conan Doyle, lui-même médecin de formation et William Wilkie Collins, homme de lettres portant un grand intérêt à la chose scientifique (comme le suggère son long roman didactique Heart and Science paru en 1883) ont tous trois contribué à la définition des relations particulières entre les membres des professions et le reste de la société victorienne. Members of the middle class, particularly clergymen, doctors, and lawyers occupy a central place in Victorian literature, both as narrators and characters. However, it seems that this prominent place fosters questioning as much as empowerment. This paradoxical position seems to stem from the recurrent appearance of members of the professions in texts within which the principles of truth and meaning are undermined. Therefore, we will show how members of the professions, both as narrators and characters, put forward discursive strategies which allow them to manipulate the notion of truth and to destabilize meaning. In order to do so, we will study predominantly short stories, as this genre was favoured by Victorian writers as the locus of narrative and literary experimentation. Besides, this genre was widely read by Victorian audiences and can be seen as a privileged media for authors to express their doubts and commentaries on contemporary society. We have chosen to study the works of three authors in particular, who played a vital role in the bringing of the middle classes on the forefront of Victorian literary representation. Indeed, we will focus on Joseph Sheridan Le Fanu, the son of a clergyman and a man fascinated by the arcana of theology, Arthur Conan Doyle, a doctor himself, before he became a writer and William Wilkie Collins, who had a passion for science and the transformations its growing influence imposed on Victorian society. What is more, these three writers' active role in the establishment of the most popular Victorian periodicals attests to their vast contribution to the development of Victorian values

Clerks of Courts in Victoria (today’s Court Registrars) occupied a relatively subordinate position within the public sector hierarchy. Despite the limited role envisaged for them by the Law Department and the statutory and administrative guidelines that framed their work, these court administrators exerted considerable influence within the busy summary jurisdiction. This thesis explores the nature of clerks of courts’ formal and informal discretionary power, and how such power evolved in the context of organisational, legal and social change culminating in the 1980s. Semi-structured interviews with registrars, former clerks, magistrates and judges were conducted to investigate the counter-intuitive concept of lower-level public servants exerting power and influence. Resulting data was analysed using primarily Michael Lipsky’s Street-level Bureaucrat framework. Findings show that, although flying under the radar, clerks were foundational and forceful actors in the provision and ongoing development of the summary court jurisdiction in Victoria. Their influence derived from a striking combination of factors: their nexus with the judiciary, their court craft and detailed knowledge of statute law, their community connections and status, and their sustained endeavour to self-organise and maintain a strong culture in the face of challenges to their role. These elements also influenced how clerks as a group and as individuals chose to employ discretion in delivering justice to citizens. At their best, they humanised and made procedurally fairer what could have been experienced as an alienating and inequitably weighted justice system.

ABSTRACT Differences in Job-related Stress between Civil and Criminal Court Clerk by LIAO, Chun-Yu June 2008 ADVISOR(S): Dr. JOU, Susyan DEPARTMENT: GRADUATE SCHOOL OF CRIMINOLOGY MAJOR: CRIMINOLOGY DEGREE: MASTER OF LAW Those who are not in legal circles know more about jobs such as that of judge and prosecutor than clerk, and most people regard the clerk only as a recorder in the court; nothing can be farther from the truth. Partly as a consequence, there is no research focusing on role of the clerk in Taiwan, however there are researches investigating problems related to work stress in other occupations These researches show that factors related to high work stress are: female, unmarried, family conflict, interpersonal relationship, junior, insufficient professional ability, performance evaluation and work loading etc; work stress will influence the body’s physiology, psychology, behavior and interpersonal relationship. In this study, the subject was clerks in civil and criminal recording sections; the researcher introduced their tasks and compared work stress, in order to further understand the causes of stress and to propose suggestions and solutions. Therefore, there are three purposes of this study: (1) to understand the difference between the origins of clerks’ work stress in civil and criminal recording sections, (2) to understand the difference between reactions on the physiology and psychology of clerks in civil and criminal recording sections, and (3) how to reduce their work stress. This study utilized a “questionnaire survey” to investigate clerks in civil and criminal recording sections in Taiwan Taipei, Shilin, and Banciao district courts. Total valid samples were 164. The researcher used statistics analysis software SPSS to analyze the characteristics of samples, compare the origin of work stress of clerks in civil and criminal recording sections, and find out the factors influencing work stress through regression analysis. According to the results, it was found out that the work stress of clerks in civil and criminal recording sections came from: for clerks in criminal recording section, they felt burned out about their jobs; they were not satisfied with their jobs; they did not communicate well with their supervisors; they often felt burned out and did not want to go to work. The frequency of the above-mentioned of clerks of criminal recording section was higher than the one of civil recording section. They had more work stress than clerks in civil recording section when they held special courts or serious case, supported opening a court session, had loading in opening a court session, when they were on duty and when they detained criminals. The differences between clerks of civil and criminal recording sections were listed above; however, those factors did not all have significant influences on stress. Mostly, higher feeling of burnout and lower job satisfaction had significant influences on work stress. For civil recording section, clerks who had more cases, who were female and unmarried, who did not have good interpersonal relationship, who were worried about typing speed, who had long working hours, who were worried about performance evaluation, who would be influenced by judges’ mood in courts had higher stress; for criminal recording section, clerks who were female, who did not have a good family relationship, who had fewer children and who were worried about typing speed had higher stress. A number of recommendations are made: (1) Overtime policy in the court session should be minimised (2) For clerks who take night shift should take one day off on the next day. (3) A Shift system should be carried out. (4) Salary should be adjusted. (5) Shorthand typist facility should be added (6) They should establish an employee welfare committee and cooperate with hospitals. (7) The system of character identification by voice should be improved. (8) Research and evaluation should be reviewed. (9) Acting employee system should be established. This study is to understand the current status, discussion of background variables and analyzing the correlation of job stress and coping strategies of court clerks. The independent variable is the personal back grounds and dependent variables are the job stress and coping strategies. Job stress included four constructs: workloads, interpersonal relationship, professional knowledge and pressures from superiors. Four coping strategies included problem solving, searching for support, rational thinking and emotional adjustment. This study used stratified random sampling with a total 450 questionnaires and a valid return of 421 questionnaires in the central and southern areas of Taiwan targeted at court clerks. The valid return rate is 93%, and through statistical analysis of descriptive statistics, t-test, one-way ANOVA and Pearson Correlation, the results were as follow: 1.The court clerks experienced an mid-level of job stress, with “workload” as the most prominent. 2.When facing job stresses, court clerks adopt a mid-level coping strategies, with “rational thinking” as the the most prominent. 3.Younger court clerks showed higher job stress than older court clerks; unmarried clerks showed higher stress than married clerks; lower level authority showed higher job stress than higher level of authority; Record clerks showed higher level of stress than administrative clerks. 4.The results showed clerks who are married but without children have a higher tendency to adapt “searching for support”, “emotional adjustment” coping strategies than clerks who are unmarried or married with children. Clerks with working experience between 16-20 years have a higher tendency adapting “emotional adjustment” than any other experience groups. Clerks from the law faculty have a higher tendency to adapt “searching for support” than those who were not. Record clerks have higher tendency to adapt “emotional adjustment” than Administrative clerks. 5.Job stress and coping strategies showed significant correlation. Higher stress, higher frequency of adapt coping strategies. The findings and suggestions are to serve as a reference for our judiciary organizations and future studies.

This research examines whether the court clerk's preference for job satisfaction affects the turnover intention and ranks the first instance, second instance and third instance court in the northern part of the country with highest case acceptance respectively as Supreme Court, Taiwan High Court, Taipei District Court, Shihlin, New North, Taoyuan, Hsinchu and Miaoli District Court count eight court clerks for the study, the questionnaire issued 245 copies, the recovery of 231 valid questionnaires (94.29% recovery rate), the questionnaire recovery SPSS 20.0 statistical software analysis using Descriptive, one-way coefficient of variation, T test and Pearson correlation analysis, the findings and conclusions are as follows: 1.Among the personal attributes of court clerks, there is a significant difference between the "status of the minor children in the family" and the "job itself" of job satisfaction. 2.The discrepancies and the general constructions of "court trial level", "gender", "official rank", "supervisor", "service department", "official service seniority" and job satisfaction of personal attributes of court clerks are significantly different. 3.Among the personal attributes of court clerks, there are significant differences in the sub-structures of "age", "family minor children's status", "official rank", "supervisor" and turnover intention. 4.There are significant differences in the aspects of job satisfaction and turnover intention. 5.The overall work satisfaction of court clerks is negatively correlated with the overall turnover intention. In other words, the higher the job satisfaction of clerks, the lower the turnover intention; the contrary, the higher the turnover intention. According to the results of this study, relevant suggestions are put forward for reference of the law enforcement authorities and human resources management, so as to retain the excellent clerk talents.

This dissertation examines how clerics in the Lombard and Carolingian Kingdom of Italy prosecuted disputes with each other. It argues for and explores two core features of the clerical legal culture of the kingdom. The first regards the judicial institutions that clerics exploited. While the late eleventh and twelfth centuries would see the elaboration of a coherent system of ecclesiastical justice centered on the papal court, distinct from secular judicial institutions, the situation in the early Middle Ages was radically different. Early medieval Italian clerics made recourse to a wide variety of judicial forums, including both "secular" ones such as the public courts and properly "ecclesiastical" ones such as church synods. The dissertation explores these judicial pathways--some of them well-trodden and enduring ones, others more ad hoc--and the ways clerics navigated between them. Second, this study demonstrates that many early medieval Italian clerics displayed considerable skill and sophistication in crafting and delivering legal arguments against each other. Those arguments frequently hinged on substantive appeal to canon law. This finding presents a challenge to a prevailing view in legal-historical scholarship which downplays or ignores practical legal expertise in the early Middle Ages and often dismisses the period itself as an "age without jurists." This dissertation instead argues for an early medieval clerical legal culture that scholars must take seriously as a prehistory to the well-known legal and judicial developments of the eleventh and twelfth centuries. This is the first study to explore in depth the diversity of judicial pathways exploited by clerics in early medieval Italy and the legal arguments they constructed. Proceeding on the basis of case studies, it traces the threads of ecclesiastical legal culture through several genres of sources: in addition to diplomatic sources such as judicial notices, papal bulls, imperial diplomas, and private charters, it also examines the evidence to be found in works of poetry, hagiography, and historiography, and in legal compilations. Among the ecclesiastical disputes that receive extended discussion are those between the bishops of Arezzo and Siena, between the patriarchs of Aquileia and Grado, between the abbots of Nonantola and neighboring bishops, and those within the diocese of Lucca.

To design a well personnel system that can promote and pick out the talents is particularly important, especially for Taiwan’s promotion system of government has a feature that there are fewer vacancy for higher position. A sound promotion system can encourage government employees to work hard, to try hard to achieve the goals of their organization, since the workers recognize that according to the system their performance and contribution will be took into account when the higher vacancy is opened. As a result, a well-designed promotion system is the best method to encourage civil servant, and furthermore, to promote the government performance. There are six chapters in this study. The first chapter is about the motive, purpose, range, and limitations of this study. The second is about the theory and other relative research. The third is about the analysis of Taiwan’s court clerk system and the comparison between Taiwan’s system with that of American, Germany and Japan. The fourth chapter is about the notes of the interview of judges, court clerks, personnel officers and the person who charge the personnel system in Ministry of Civil Service. The fifth is the discussion and analysis of the result of the interview. The final chapter is the conclusion and suggestion. I found the promotion system of Taiwan’s court clerk have a lot of problems, I hope the suggestion of this study could be adopt by relevant personnel authorities.

And the seven profiles for job satisfaction level (including: Job itself, job environment, supervisor’s leadership, interpersonal skill, salaries and benefits, promotion and job performance in addition to social status, etc) are as dependent variables. Subjects under study were the secretaries-in-charge for elementary schools in Taitung County with 90 total samples disseminated and effective return of 71 copies. Information gathered from query survey were further processed through SPSS for Windows in order to feed to various statistical methods such as: Descriptive statistics, t Test, one way ANOVA, etc. From the findings of these analyses, then this research applied the interviewing method to further explore the underlying causes. Research findings were collectively as follow: 1. The job satisfaction levels for each profile are sequentially arranged as follow: “interpersonal skill”, “supervisor leadership”, “work environment”, “job itself”, “social status”, “salary and benefit”, “promotion and job performance” respectively. And the least satisfied profile was found to be “promotion and job performance”. 2. As for different individual background variables (gender, age, marital status, educational background, job seniority and job of responsibility), they showed little or no significant difference in regards to the attitudes for job satisfaction. Lastly, based on the findings of this research, concrete recommendations were made in regard to elementary secretary-in-charge, each elementary school and educational administrative organizations and so on for future references. This study aims to investigate the Nantou County Director of each hall to serve the first line of the village, under the current system, the role of cognitive differences between their work further by Officer role in conflict, the role and the role of fuzzy load factors and pressures that may arise feelings of correlation analysis, found the problem and seek a reasonable way to solve the problem, this research questionnaire as the main research tool, 251 questionnaires were distributed and 13 townships in Nantou City Hall, 200 valid samples, and the resulting information to descriptive statistics, crosstabs, chi-square analysis conducted, the results were as follows: 1, the role of the Director-General to work in fuzzy enhance civil pressure. 2, the role of conflict in the work of the Director-General of work increased anxiety. 3, the role of the Director-General to work in improving the work load pressure and influence lifestyle. 4, in the Director's own role identity influence attitudes and spaniels performance. The researchers found that induction into conclusions and specific recommendations based on the findings of the central government and township offices competent authorities in each Director and future researchers. In the judicial system, staffs and personnel are to lerant of various job stress. This research is based on interview chosen clerks of the Taichung High Administrative Court. The main purpose of this study is to understand and comprehend what are the causes to clerks’ job stress in the Taichung High Administrative Court.This study is trying to suggest ways of reducing and alleviating job stress of clerks of the Taichung High Administrative Court. The method of this research is qualitative approach by interview and inspection the outcomes of in-depth interview. The main interviewees are clerks of the Taichung High Administrative Court. The sampling method adopts the snowball sampling and the purposive sampling. These analyzed materials comes from 11 chosen interviewees’ feedback. The information was obtained as follows: 1.The clerk of the Taichung High Administrative Court felt a considerable degree of job stress. 2.These clerks’ responded and declared that job stress can be divided into two types: (1)Job stress is related to the judicial system. (2) Some job stress is caused by working obligations and duties. 3.The clerks’ of Taichung High Administrative Court adjust job stress by using some strategies such as combining "problem-focused" and " emotion-focused” coping strategy, and tend to positive adjusted actions. Based on the above research conclusions, this study proposes relevant recommendations for practical reference.

Garbage pollution on the environment as the impact of growing, so "Garbage" and related environmental issues became part of the world's growing concern. In particular, science and technology city of Hsinchu in Taiwan and to green city vision, share in the global market has a certain degree of competitiveness and therefore to protect the city and maintain market position, "Environmental Protection" is imperative; Reduce waste and waste people's livelihood is also the easiest people in the most direct and contribute our efforts for global environmental protection, and the government can produce an effective treatment of municipal solid waste collection services, will better enable the earth's resources to achieve Tuoshan the use of resources, sustainable development. Therefore, the construction of a garbage removal service evaluation indicators as to strengthen the work of garbage treatment services will be an important issue. In this study, county and municipal garbage in order to assess the quality of service and to construct a set of Hsinchu City as an example of the service satisfaction index. First of all, by the related literature, set up two draft garbage service quality scale, and then with the Hsinchu City Environmental Protection Agency related to the expert in charge of interviews correction scale content, the completion of Hsinchu City garbage service quality scale. Expected to scale for future Hsinchu City trash service quality satisfaction surveys to understand the public on garbage removal service is expected to reach the target population. The subsequent analysis of the data, this study used factor analysis and the importance - performance analysis to construct indicators of municipal solid waste collection services and to identify urgent need to improve service quality factor, it is hoped to provide to the Environmental Protection Agency and the Hsinchu City county and city governments as the training of service personnel to improve the quality of municipal solid waste collection service and garbage removal service quality assessment of reference.

Vivemos numa sociedade cada vez mais complexa que exige dos tribunais uma resposta mais dinâmica, eficiente e eficaz. Muito se discute quanto aos modelos de trabalho para atingir um maior grau de produtividade dos serviços e qualidade de vida dos trabalhadores. Neste cenário encontramos a modalidade do teletrabalho que, pela sua flexibilidade, é vista por alguns autores como um bom modelo de gestão de recursos humanos. Na verdade, a par com o desenvolvimento da sociedade de informação o teletrabalho surge como uma realidade há muito presente e aceite no setor privado, especialmente em empresas viradas para as novas tecnologias, contudo o mesmo não se passa no setor público, que só com a publicação da Lei n.º 59/2008, de 11 de setembro (5 anos após o setor privado), viu esta modalidade de trabalho consagrada e aplicada ao trabalhador em funções públicas. Assim, esta pesquisa surge com a finalidade de verificar se a modalidade do teletrabalho disponibilizada aos oficiais de justiça (classe profissional indispensável para a persecução e execução da justiça), poderá ser hoje, ou num futuro próximo, um instrumento de gestão útil e viável no seio da organização judiciária, ou se pelo contrário, estamos longe, num verdadeiro plano de ficção.
We live in an increasingly complex society that requires a more dynamic, efficient and effective response from the courts. The work models are discussed to achieve a higher degree of productivity of the services and quality of life of the workers. In this scenario, we find the modality of telework that, due to its flexibility, is seen by some authors as a good model of human resources management. In fact, along with the development of the information society, teleworking has emerged as a reality that has long been present and accepted in the private sector, especially in companies focused on new technologies, but the same is not the case in the public sector, which only with the publication of Law no. 59/2008, of September 11 (5 years after the private sector), saw this method of work consecrated and applied to the worker in public functions. Therefore, this research arises with the purpose of verifying if the modality of telework available to the court clerks (professional class indispensable for the prosecution and execution of justice), may be, or in the near future, a useful and viable management tool within the judicial organization, or if, on the contrary, we are far, in a true plan of fiction.
