Full textThe problem related to the lack of access to justice arises in all regions of the world. To solve this issue, the National Assembly of Quebec adopted, on February 20th, 2014, the Bill n°28, An Act to establish the new Code of Civil Procedure, 1st sess, 40th lég. In this regard, the preliminary provision indicates that the new Code of civil procedure (hereafter: “NCPC”), which now governs the procedure applicable to the dispute prevention and resolution processes (hereafter: “PRD”), is “designed to ensure the accessibility, quality and promptness of civil justice […]“. Beyond these words, which have a considerable interpretative value, this study analyzes to what extent the integration of the principles of procedure applicable to PRD in the NCPC may improve access to civil justice.

Full textFace à la récurrence de la question de l’accessibilité de la justice au Québec, le législateur envisage l’adoption de dispositions légales afin d’encadrer le recours aux modes privés de résolution des conflits, tels que la médiation extrajudiciaire. L’Avant-projet de loi instituant le nouveau Code de procédure civile cristallise cette intention de rediriger la procédure civile québécoise vers une justice inclusive et consciente du rôle que jouent les justiciables, depuis la genèse jusqu’à mort du conflit. Une analyse des différentes dispositions qui portent sur l’organisation procédurale de la médiation extrajudiciaires est effectuée par le biais d’une grille analytique tirée de la psychosociologie, et particulièrement de la théorie de l’engagement. Cette approche permet d’évaluer l’efficacité des dispositions en question et d’ouvrir le débat sur certaines pistes de réflexion et d’action.

Full textThis research is on a new model of procedural code concerning the civil rights trade and administration in the ivory-coast. The study was based on two fondamental principles: swiftness in the dispensation of justice and defence rights. Decreed on 1972, this code is a large extent a product of the country's history. Although modified, or adapted to suit the local environment, signs of colonial rule are still present. In fact the study tried to show the evolution in time and space of world event of which this code is the product. An effort has been made to show the originality of this code, and the differences between it and french procedure. The originality comes from the fact that there is a common judicial procedure to all branches of law as against french's which has a specific procedure for each branch of law. However, there is still a lot to do in the technicalities of the code as many procedural rule are either not covend at all or are shallowly treated. Furthermore, inspite of the sound structure for swiftness (unified tribunals and procedures, thereby reducing the nomber of steps and time required to complete a case) adopted by the authors of the code, many juges apparently and paradoxically make it difficult for suitors, maybe as a result of their training which was not originally geared to handle the new situation. Besides, the authors of the code completely ignored the theme "defence rights" apparenteltly because they were much more preoccuped with the dispensation of justice. And that is all the more reason why (the topic of) this study was chosen -knowing fully well that swiftness can make defence rights to suffer even more. Finally, one thing that can be said is that a code exists; but to have a code is one thing, and (to know) the reality is another

Full textThe subject of this thesis is the fight between the fundamental and traditional principle of the suspensive effect produced by the main french legal remedies (appeal, stay of execution, appeal on a point of law ("cassation") and its theorical exception, the provisional enforcement, which at the beginning was conceaved to respond creditors' needs and to hinder debtors' dilatory actions. There is no exhaustive study on the rules governing provisional enforcement which has only be considered as a direct inpugner of the suspensive effect of legal remedies intended either to neutralize it (part. I) or, at the opposite, to restore it (part. II). The final ascertainment is a manifest expansion of provisional enforcement turned out as a procedural mean towards judicial efficiency, so that nowadays, it has absorbed the principle it should only have derogate and one may wonder on its constitutional aspect. The position is blamable and for the seek of the judicial machinery there is an urgent need for a reform tending to revive the suspensive effect of the legal remedies

Full textJanuary 1, 2016 marked the entry into force of the new Code of Civil Procedure, leading Québec’s civil justice system into the 21st century. This new Code is much more than a simple reform; rather, it encourages a wholly “new legal culture” by providing solutions adapted to the needs of its citizens. As such, to quote the Code itself, “appropriate technological means should be used whenever possible”, i.e. conforming to the principle of proportionality. This proposition may appear trivial upon first glance, but actually contains a fairly innovative reality: a well-established principle – that of procedural proportionality – now regulates a new area of activities – being information technologies. This thesis aims to identify all of the ramifications and implications of this application and will do so in two steps. First, we will begin by defining the legal concept of procedural proportionality, which has been relatively little studied until now. As to its origins, the concept of proportionality itself goes back millennia and, throughout time, has gained prominence in several fields of law: it is therefore the story of an ever-growing trend. That being said, it was only in the middle of the 20th century, against a backdrop of civil justice crises and under the influence of utilitarian theory, that proportionality was introduced as a matter of civil procedure (first in the United States, then in England, to finally percolate into other jurisdictions). In Québec, proportionality is today a guiding principle of procedure, which qualification has had a genuinely systemic effect. This gain is however not unanimous, as several other civil jurisdictions, France being the first, relegates proportionality to the rank of mere concept, theoretically located at the intersection of new managerial principles of civil procedure (such as quality, efficiency, celerity, etc.) In a second step, we will examine the practical technological effects of the principle of procedural proportionality. In our opinion, what we call “technological procedure” based on electronic transmission of documents and audiovisual technologies is insufficient in and by itself: it is only a mass of technical rules, without coherence or cohesion, much too mechanical. The principle of proportionality, applied to technologies, is therefore an interesting way to unify and humanise technological procedure. Concretely speaking, this means that a court should authorize, refuse or order the use of technologies according to an in concreto and in globo analysis of the interests at stake. For instance, in the case of a complex litigation, the use of Skype for the remote testimony of a main witness who lives next to the courthouse should be refused, since it is manifestly disproportional. In this manner, we are witnessing the emergence of a new sub-principle, what we call “technological proportionality” herein, which has its own definition, test and finalities. Furthermore, judges will henceforth have to assume a new role with respect to information technologies, notably by making technological choices and performing a form of “technology assessment”. In the end, such an approach, as it develops in Québec, offers a novel discussion on technology in civil procedure: neither proportionality (ancient, traditional, legal) nor technologies (futuristic, innovative, high-tech) are rejected; in fact, one cannot be dissociated from the other. The message of this thesis can therefore be summarised by three simple words: modernization in moderation
