Full textThe « référé-liberté fondamentale » is a brand-new proceedings, introduced in litigation administrative law, by law 2000-597 of June, the 30th 2000. On one hand, this proceedings of the article L. 521-2 of the administrative justice code has been made up to struggle serious situations, considered as exceptional. Indeed, law requires that a serious and illegal damage turns out to be a fundamental liberties’ outrage, and so needs a very quick action from the judge to stop it. On the other hand, this law line derogates from the common law of the administrative process in order to give the presumed victim of this outrage a quite wide protection of her fundamental freedoms. Following the ordinary latino-american amparo logic, the « référé-liberté » offers the applicants a quick and efficient jurisdictional protection of their freedoms in exceptional situations, when they are seriously menaced by the public authority’s acts and deeds

Full textThis study is aims to demonstrate that the administrative procedures of urgency has led to a redefinition of the role of administrative judge: first, in relation to the fundamental libertie whose the administrative judge had a duty to determine this concept. Secondly, in relation to administrative authority vis-à-vis which the administrative judge withdrew an increased power that gives it the force of a administration judge. This study is presented in two parts: in the first part, we show how the urgency procedures provided by the law N° 2000-597 of 30 June 2000, allows the administrative judge to stop violations of fundamental liberties. In The second part we attempt to highlight the changing role of the administrative judge in its relations with the administration. The urgency procedures have led to the expansion of its powers, which led to a strengthening of the authority of the administrative judge against the administration

Thus, Dominique Joseph Garat, deputy of the Constituent Assembly, exclaimed in front of the national representation to affirm his opposition concerning the idea of a miner's irresponsibility based on discernment. This insurrection will not be the only one, on the contrary. Indeed, the issue of child delinquency has continued to return to public debate, and even very recently with Ordinance No. 2019-950 of 11 September 2019 on the legislative part of the Code of Juvenile Criminal Justice. The legislator, the jurisprudence and the doctrine have always endeavored since the beginning of the contemporary era to construct a legal regime peculiar to the child, basing himself particularly on the notions of “age” and “discernment”. However, the company's concern with its civil and criminal liability is not recent: the legal status of the child has been the subject, throughout history, of specific adjustments and different from that of the major. From Roman law to the 1945 ordinance, passing in particular by canon law and the Ancien Régime, the evolution of the responsibility of the one whose reason is not yet fully developed appears certainly interesting but especially indispensable in the understanding of the spirit of the rules that are applicable today.In this sense, this thesis will deal fully and chronologically with this evolution

Full textThe period going from 1887 to the independences (1960) allows us to approach the question of the justice in French West Africa by highlighting the transformation of rules and the exercise of the justice, as well as the meeting between the Western system and the local legal pluralism. In Senegal as in the other territories of the French West Africa, the legal and judicial evolution reveals the opposition between two trends: that of the assimilation and that of the adaptation. Within the framework of this confrontation, jurisdictions that are unknown in the mainland France are created in the colonies in order to remedy with the lack of staff and with the financial means of the jurisdictions. For these same reasons the collegiality remains very rare and the justice is often organized around only one judge who is in charge of the pursuit, the investigation and the judgement. The organisation of the native penal justice set up in 1903, practically meets with the will of keeping the native institutions. However, the desire of assimilation leads to achieve around it reforms which tend to weaken the native institutions

Full textThe Indigenat Code is a group of provisions which empowered colonial administration to punish summarily African subjects, as distinct from citizens, without recourse to any of the regular courts. For West French Africa, the first major legislation was that contained in the Decree of 30 September 1887. The local French Administration might have imposed penalties on individual offenders up to the maximum of 15 days imprisonment and a 100 francs fine. The list of the offences so punished included conscription, fiscal obligations and forced labour. Additionally, in situations of grave political crisis such as insurrection, the Governor of a local territory could impose communal fines and pronounce sentences of deportation or banishment. The indigenat was the most prominent way of coercion in the French West African Administration. It was the most effective means to realise French colonial objectives. From the very harsh nature of the legal provisions and also from a virtually uncontrolled use made of this power, several shades of excesses and abuses were denounced. The abolition of the regime came in the end as a result of both the armed and unarmed protests by the subject people ending the liberalising impact of the Second World War on French Colonial attitude

Full textEl presente artículo desarrolla los conceptos de medida cautelar y contracautela, a la luz de lo resuelto por el Tribunal Constitucional y lo establecido por nuestra doctrina, así como los alcances del primero como derecho fundamental y del segundo como requisito de ejecución. De la misma forma, se analiza los alcances de la incorporación del artículo 159° del Código Tributario, mediante Decreto Legislativo N° 1121, y su modificatoria a través de la Ley N° 30230. Finalmente, se propone una posible modificación al mencionado artículo, de conformidad con los fines recaudatorios del Estado y el derecho a la tutela jurisdiccional efectiva de los administrados.
