Abstract:
The article is devoted to the research of the problem of accurate definition and consolidation in the Code of Administrative Justice of Ukraine of the system and the content of certain principles of this type of justice, in particular competitiveness, dispositiveness, official clarification of the circumstances of the case, the rule of law and others. At the same time, special attention is paid to the peculiarities of implementation of the above principles in the consideration of court cases related to the provision of administrative services by the authorities. The essence of these features lies in certain restrictions on the principles of competitiveness and dispositiveness in order to balance the powers of the parties to the trial, which requires additional procedural guarantees and assistance to the plaintiff in the collection and extraction of evidence. In doing so, the court must preserve the impartiality and objectivity of the trial. In addition, the author emphasizes on the diversity of definitions of the content of the concept of the principle of administrative justice by scientists, and substantiates his definition of the concept of the principle of administrative justice and his vision of the list and content of the principles of administrative justice in the current Code of Administrative Justice of Ukraine. In particular, it is proposed to supplement the list of administrative justice principles with the principles of the greatest facilitation of access to court; the inevitability of the responsibility of the authorities for their misconduct, inaction or decision; non-interference of the court with the discretionary powers of the public authorities. The paper concludes that the rule of law must be stated in Art. 8 of the Constitution of Ukraine and the procedural codes, including Art. 6 of the Code of Administrative Judiciary of Ukraine, in the formulation of paragraph 41 of the report of the Venice Commission of April 4, 2014 №512 / 2009.

Abstract:
The paper analyzes the necessity of a fundamental reform of the Administrative Code of the Russian Federation with its division into two codes (a substantive part — the Code of Administrative Offences of the Russian Federation, and a procedural part — the Procedural Code of Administrative Offences of the Russian Federation). With regard to the problem of modernization of procedural administrative and tort legislation, the author questions the main directions, objectives and prerequisites of the third codification in this field and draws the conclusion that the fundamental reform of the Administrative Code of the Russian Federation with the division of it into two codes — material and procedural — is premature and, in fact, political decision not grounded by feasible research results. The author highlights that the Concept of the new Code of Administrative Offences of the Russian Federation approved at the meeting of the Government of the Russian Federation in June 2019 primarily deals with the issues of reforming mainly substantive administrative and tort legislation, while proposals for the improvement of procedural regulation of administrative responsibility are not covered in details. The Concept does not contain information concerning the fact that instead of the current Code of Administrative Offences of the Russian Federation two new codes — the Administrative Code of the Russian Federation (CAO) and the Procedural Code of Administrative Offences of the Russian Federation (PCAO) — will be adopted.The author focuses on the analysis of the draft of the PCAO published on the website of the Ministry of Justice of Russia. Primarily, the paper highlights such provisions that deserve an affirmative response. However, the author devotes the most significant part of the study to the analysis of the conceptual shortcomings of the PCAO of the Russian Federation. Without elimination of these shortcomings, it can hardly been concluded that a complete and qualitative procedural and legal mechanism for the implementation of justice in the field of administrative and tort relations is established in the courts of general jurisdiction.

In 2016, the French Parliament introduced a new chapter on mediation in the Code of Administrative Justice. To succeed, this reform needs to reverse repeated failures in this field. In view of the significant challenge of embedding administrative mediation in the French administrative justice system, the reform and its implementation were informed by empirical findings arising from a mediation pilot set up by the administrative court of Grenoble in Spring 2013. An empirical study of the pilot and of the experience of rolling out administrative mediation in France forms the core of this article and the context in which to revisit foundational questions about mediation and administrative justice. I argue that mediation is not illsuited to administrative law disputes, but that to be integrated in a system of administrative justice, mediation requires the negotiation of a dedicated environment triggering in turn the emergence of a pluralist administrative justice system.

Abstract:
Purpose. In 1999 the adoption of the General Administrative Code and Administrative Procedure Code in Georgia gave basis for creation of the new administrative law, since before the entry into force of the above-mentioned codes, Georgia had no tradition of the administrative law and, hence, no practice of the administrative justice. In Georgia being part of the Soviet Union, and in the Soviet Union overall, the administrative law did not exist with the understanding that is regulated by the modern administrative law. The communist doctrine of the administrative law radically differs from the modern administrative law because in those times the administrative legislation was mainly defining the citizens’ obligations before the administration, rather than ensuring citizens’ rights and protection of their interests. Methods. Therefore, the article discusses development stages of the administrative law, the path gone through by the administrative law starting from the formulation until present time, also the Soviet heritage and its influence on the development of the administrative law is discussed, along with the influence of the European reception and establishment within the Georgian legislation, the core factors are analyzed, which caused the necessity of the creation of new administrative law. Results. The significant part in the article is devoted to the discussion of the subject of administrative law and system of administrative law on the example of the Georgian administrative law. The core elements of the implementation of public administration are discussed, the notion of the administrative body, forms of activity of the administrative body and basic principles that are characteristic to the Georgian administrative law. Conclusions. In this regard, the important place is given to particularities of the administrative proceeding and judicial process in Georgia, namely, so called “prejudicial” rule of appealing within the administrative body, suspensive effect of the administrative appeal, principles of disposition and inquisition in the administrative process, as well as the institute of the amicus curiae is discussed, as a particularity of the Georgian administrative justice.

Abstract:
The article is devoted to the legal principles of taking administrative responsibility for disrespect for court. In the work the complex analysis of proceedings in cases of administrative offenses envisaged by Article 185-3 of the Code of Administrative Offenses is carried out. The problematic issues that arise in practice when considering cases of administrative offenses for disrespect for court are outlined. The article examines the individual decisions of national courts in cases of administrative offenses for disrespect for court. The Association Agreement with the European Union Ukraine has declared its agreement to strengthen cooperation in the field of justice, freedom and security in order to ensure the rule of law and respect for human rights and fundamental freedoms, strengthen the judiciary, enhance its efficiency, guarantee its independence and impartiality. Weaknesses of national legislation with respect to international standards of administration of justice are identified. Particular attention is paid to compliance with the principle of impartiality when imposing administrative penalties for disrespect for court. The relevant decisions of the European Court of Human Rights have been analyzed. Suggestions were made to remedy practical problems in order to bring administrative penalties for disrespect for court into conformity with the provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms and the practice of the European Court of Human Rights. It was concluded that it is necessary to determine the clear jurisdiction of the courts in the consideration of cases of administrative offenses disrespect for court with the introduction of appropriate changes or procedural codes, or the Code of Ukraine on Administrative Offenses. Key words: disrespect for court, administrative responsibility, impartiality, challenge (recusal) of a judge.

The paper is dedicated to the history of the Code of administrative judicial procedure of the Russian Federation and to main characteristics of this Code. The author deals with reasons of negative attitude to enacting of the Code, changes in this field as well as the efforts of the Supreme Court of the Russian Federation towards development of the Code and relevant judicial practice. The author makes attempt to emphasize the most significant characteristics of modern administrative justice reflected in the Code of administrative judicial procedure of the Russian Federation and to describe them briefly. The author’s conclusion relies on author’s previous comparative research works and analytic of the Supreme Court of the Russian Federation. The author also draw attention to some perspectives of development of the Code.

Le référé-liberté fondamentale est une procédure entièrement nouvelle introduite en droit du contentieux administratif par la loi n° 2000-597 du 30 juin 2000. Il apparaît, d’une part, que la procédure de l’article L. 521-2 du code de justice administrative est conçue pour combattre des situations qui, par leur gravité, présentent un caractère exceptionnel. D’autre part, cette voie de droit déroge au droit commun du procès administratif en vue d’offrir à la victime supposée d’une atteinte une protection particulièrement étendue de ses libertés fondamentales. Dans une logique d’amparo ordinaire latino-américain, le référé-liberté garantit ainsi aux justiciables une protection juridictionnelle rapide et efficace de leurs libertés dans les situations exceptionnelles où celles-ci se trouvent gravement mises en cause par les actes et agissements de la puissance publique
The « référé-liberté fondamentale » is a brand-new proceedings, introduced in litigation administrative law, by law 2000-597 of June, the 30th 2000. On one hand, this proceedings of the article L. 521-2 of the administrative justice code has been made up to struggle serious situations, considered as exceptional. Indeed, law requires that a serious and illegal damage turns out to be a fundamental liberties’ outrage, and so needs a very quick action from the judge to stop it. On the other hand, this law line derogates from the common law of the administrative process in order to give the presumed victim of this outrage a quite wide protection of her fundamental freedoms. Following the ordinary latino-american amparo logic, the « référé-liberté » offers the applicants a quick and efficient jurisdictional protection of their freedoms in exceptional situations, when they are seriously menaced by the public authority’s acts and deeds

Cette étude consiste à démontrer que les procédures administratives d’urgence ont entraîné une modification de la conception du rôle du juge administratif : d’une part, par rapport aux libertés fondamentales dont le juge administratif a dû déterminer et encadrer la notion ; d’autre part, par rapport à l’autorité administrative vis-à-vis de laquelle le juge administratif a retiré un pouvoir accru qui lui donne la vigueur d’un juge administrateur. Cette étude est présenté en deux parties on s’attacher, dans une première partie, à montrer comment les procédures d’urgence, mises à sa disposition par la loi du 30 juin 2000, permettent au juge administratif de faire cesser les atteintes aux libertés fondamentales. Dans une deuxième partie, on tentera de mettre en lumière l’évolution du rôle du juge administratif dans ses relations avec l’administration. Les procédures d’urgence ont conduit à l’élargissement de ses pouvoirs, ce qui a entraîné un renforcement de l’autorité du juge administratif par rapport l’administration
This study is aims to demonstrate that the administrative procedures of urgency has led to a redefinition of the role of administrative judge: first, in relation to the fundamental libertie whose the administrative judge had a duty to determine this concept. Secondly, in relation to administrative authority vis-à-vis which the administrative judge withdrew an increased power that gives it the force of a administration judge. This study is presented in two parts: in the first part, we show how the urgency procedures provided by the law N° 2000-597 of 30 June 2000, allows the administrative judge to stop violations of fundamental liberties. In The second part we attempt to highlight the changing role of the administrative judge in its relations with the administration. The urgency procedures have led to the expansion of its powers, which led to a strengthening of the authority of the administrative judge against the administration

« Alors la preuve vous l’abandonnez aux jurés. Et où chercheront ils la preuve du discernement ? Dans l’âme du coupable reconnu : elle est fermée à leurs yeux. Quoi de plus arbitraire, quoi de moins raisonnable. Je demande que cet article soit écarté ». C’est ainsi que Dominique Joseph Garat, député de la Constituante, s’était exclamé devant la représentation nationale pour affirmer son opposition concernant l’idée d’une irresponsabilité du mineur fondée sur le discernement. Cette insurrection ne sera pas la seule, bien au contraire. En effet, la question de l’enfance délinquante n’a cessé de revenir dans le débat public, et même très récemment avec l’ordonnance n°2019-950 du 11 septembre 2019 portant partie législative du code de la justice pénale des mineurs. Le législateur, la jurisprudence et la doctrine se sont toujours efforcés depuis le début de l’époque contemporaine de construire un régime juridique propre à l’enfant, se fondant notamment sur les notions de « âge » et de « discernement ». Toutefois, la préoccupation de la société quant à sa responsabilité civile et pénale n’est pas récente : le statut juridique de l’enfant a fait l’objet, tout au long de l’histoire, d’aménagements spécifiques et différents de celui du majeur. Du droit romain à l’ordonnance de 1945, en passant notamment par le droit canonique et de l’Ancien Régime, l’évolution de la responsabilité de celui dont la raison n'est pas encore pleinement développée apparaît certes intéressante mais surtout indispensable dans la compréhension de l’esprit des règles qui lui sont aujourd’hui applicables. En ce sens, la présente thèse traitera pleinement et chronologiquement de cette évolution

Thus, Dominique Joseph Garat, deputy of the Constituent Assembly, exclaimed in front of the national representation to affirm his opposition concerning the idea of a miner's irresponsibility based on discernment. This insurrection will not be the only one, on the contrary. Indeed, the issue of child delinquency has continued to return to public debate, and even very recently with Ordinance No. 2019-950 of 11 September 2019 on the legislative part of the Code of Juvenile Criminal Justice. The legislator, the jurisprudence and the doctrine have always endeavored since the beginning of the contemporary era to construct a legal regime peculiar to the child, basing himself particularly on the notions of “age” and “discernment”. However, the company's concern with its civil and criminal liability is not recent: the legal status of the child has been the subject, throughout history, of specific adjustments and different from that of the major. From Roman law to the 1945 ordinance, passing in particular by canon law and the Ancien Régime, the evolution of the responsibility of the one whose reason is not yet fully developed appears certainly interesting but especially indispensable in the understanding of the spirit of the rules that are applicable today.In this sense, this thesis will deal fully and chronologically with this evolution

Les institutions judiciaires camerounaises compétentes en matière de faillite et de liquidation judiciaire sont d'inspiration française. Leur évolution et leur structures sont toutefois différentes. L'économie camerounaise a été bâtie par le colonisateur et de ce fait, mise au service de l'économie métropolitaine. Les institutions judiciaires chargées de réguler la vie des entreprises n'ont jamais rempli leur mission en raison des carences matérielles et humaines, et aussi à cause du cadre juridique inadéquat des entités commeerciales. Le droit des société camerounais a évolué au gré des orientations politiques, puis des investisseurs étrangers. En dépit des réformes en cours sur l'organisation des procédures de règlement et de liquidation judiciaires, les moyens judiciaires restent inadaptés et peu fiables au regard de l'évolution constatée en France depuis 1807. Cette situation fragilise le rôle des juges, malgré la solidité et la cohérence apparente des textes nouveaux. Il existe un décalage entre les objectifs économiques envisagés et le désir de garantir la sécurité juridique et judiciaire des activités commerciales. Les limites structurelles et fonctionnelles de l'appareil judiciaire camerounais rendent nécéssaire et indispensable, la réforme du système judiciaire tout entier et son adaptation à l'environnement culturel et économique des sociétés commerciales. L'harmonisation économique commande nécéssairement l'harmonisation judiciaire.

Abstract:
La période allant de 1887 aux indépendances (1960) permet d’aborder la question de la justice en Afrique occidentale française en mettant en évidence la transformation des règles et de l’exercice de la justice, ainsi que la rencontre entre le système occidental et le pluralisme juridique local. Au Sénégal, comme dans les autres territoires de l’Afrique occidentale française, l’évolution juridique et judiciaire révèle l’opposition de deux tendances : celle de l’assimilation et celle de l’adaptation. Dans le cadre de cette confrontation, des juridictions non connues en métropole sont créées dans les colonies afin de remédier à l’insuffisance de personnel et des moyens financiers des juridictions. Pour ces mêmes raisons, la collégialité demeure très rare et la justice est souvent organisée autour d’un seul juge qui prend en charge la poursuite, l’instruction et le jugement. L’organisation de la justice pénale indigène, mise en place en 1903, répond avec pragmatisme à la volonté de maintenir les institutions indigènes. Toutefois, le désir d’assimilation conduit à y réaliser des réformes qui tendent à affaiblir les institutions indigènes
The period going from 1887 to the independences (1960) allows us to approach the question of the justice in French West Africa by highlighting the transformation of rules and the exercise of the justice, as well as the meeting between the Western system and the local legal pluralism. In Senegal as in the other territories of the French West Africa, the legal and judicial evolution reveals the opposition between two trends: that of the assimilation and that of the adaptation. Within the framework of this confrontation, jurisdictions that are unknown in the mainland France are created in the colonies in order to remedy with the lack of staff and with the financial means of the jurisdictions. For these same reasons the collegiality remains very rare and the justice is often organized around only one judge who is in charge of the pursuit, the investigation and the judgement. The organisation of the native penal justice set up in 1903, practically meets with the will of keeping the native institutions. However, the desire of assimilation leads to achieve around it reforms which tend to weaken the native institutions

Abstract:
Le système colonial français reposait sur la distinction fondamentale entre sujets indigènes et citoyens français. Le code de l'indigénat -encore appelé régime de l'indigénat ou indigénat- s'appuyait sur cette différenciation. Il fut introduit au Sénégal par le décret du 30 septembre 1887 puis étendu à toute l'AOF. Elaboré en marge du régime judiciaire, l'indigénat permettait aux administrateurs coloniaux de réprimer d'une peine de 15 jours de prison et/ou d'une amende de cent francs toute une gamme d'infractions spéciales aux sujets indigènes telles que le «manque de respect envers un représentant de l'autorité française » ou le « non-paiement des impôts et non-accomplissement du travail obligatoire ». En outre, une procédure exceptionnelle donnait aux gouverneurs la possibilité d'interner pour une durée de dix ans tout individu suspecté de menacer la sûreté de l'Etat colonial. Le code de l'indigénat joua un rôle coercitif majeur et contribua largement à l'insertion des sociétés colonisées dans l'économie de marché. En l'absence de contre-pouvoir judiciaire régulier, de nombreux abus d'autorité furent dénoncés au cours des vingt premières années. La concurrence de la justice indigène et l'évolution de la politique coloniale rendirent des ajustements nécessaires. Des réformes furent donc exigées mais les administrateurs, dont l'efficacité dépendait étroitement de ces pouvoirs répressifs, continuèrent d'appliquer le régime avec sévérité, notamment dans les périodes de crise. The Indigenat Code is a group of provisions which empowered colonial administration to punish summarily African subjects, as distinct from citizens, without recourse to any of the regular courts. For West French Africa, the first major legislation was that contained in the Decree of 30 September 1887. The local French Administration might have imposed penalties on individual offenders up to the maximum of 15 days imprisonment and a 100 francs fine. The list of the offences so punished included conscription, fiscal obligations and forced labour. Additionally, in situations of grave political crisis such as insurrection, the Governor of a local territory could impose communal fines and pronounce sentences of deportation or banishment. The indigenat was the most prominent way of coercion in the French West African Administration. It was the most effective means to realise French colonial objectives. From the very harsh nature of the legal provisions and also from a virtually uncontrolled use made of this power, several shades of excesses and abuses were denounced. The abolition of the regime came in the end as a result of both the armed and unarmed protests by the subject people ending the liberalising impact of the Second World War on French Colonial attitude

Depuis que Motulsky lui a consacré une réflexion décisive, le concept d'office du juge est couramment utilisé en doctrine.Toutefois, la juridiction administrative n'a eu recours à cette notion et ne l'a utilisée dans ses décisions que depuis quelques années. Nous retrouvons désormais régulièrement la notion d'office du juge dans le cadre des porcédures de référé. En effet, le contentieux administratif a connu une profonde réforme de ses procédures de référé avec la loi n°2000-597 du 30 juin 2000 relative au référé devant les juridictions administratives. D'anciennes procédures, comme le sursis à exécution devenu le référé-suspension, ou le référé-conservatoire, ont été modernisées ; et en parallèle le législateur a créé une nouvelle procédure - le référé-liberté - appelée à jouer un rôle de premier plan dans la protection des libertés fondamentales. D'autres procédures de référé ont également bénéficié de cette réforme pour connaître une certaine modernisation comme ce fut notamment le cas pour le référé-provision. La rénovation des procédures de référé d'urgence a ainsi marqué le point de départ d'une évolution de l'office du juge administratif des référés et le recours à la notion d'office du juge des référés a permis de justifier son intervention. Cette mutation de l'office du juge des référrés a tout de même préservé une certaine continuité jurisprudentielle. L'office du juge administratif des référés conditionne tous les aspects des procédures de référé. en effet, cette notion intéresse à la fois les conditions d'intervention du juge des référés et les mesures qu'il ordonne, mais également la façon dont sont contrôlées ses ordonnances.

Abstract:
In the first part of the article, a development for the concepts of provisional remedies and real or personal property bond and covering loss and damage, is proposed, under the Constitutional Court and our national doctrine view; as well as the scope of the first as a fundamental right, and second as a condition of execution. On the following part of the paper, the inclusion and the subsequent amendments to the article 159° of Tax Code is exposed, also its scopes and reasons. Finally, a possible modification of the article, that respect state´s raising goals and due process citizens’ right, is proposed.
El presente artículo desarrolla los conceptos de medida cautelar y contracautela, a la luz de lo resuelto por el Tribunal Constitucional y lo establecido por nuestra doctrina, así como los alcances del primero como derecho fundamental y del segundo como requisito de ejecución. De la misma forma, se analiza los alcances de la incorporación del artículo 159° del Código Tributario, mediante Decreto Legislativo N° 1121, y su modificatoria a través de la Ley N° 30230. Finalmente, se propone una posible modificación al mencionado artículo, de conformidad con los fines recaudatorios del Estado y el derecho a la tutela jurisdiccional efectiva de los administrados.

Alternative solutions have come to the fore in recent years. In our country, the new Ombudsman Institution is; Upon the operation and complaint of the administration, it is responsible for examining and conducting all kinds of actions and operations of the administration and its attitudes and behaviors within the understanding of justice based on human rights, in terms of compliance with law and equity, and to make recommendations to the administration. Therefore, it offers alternative solutions for these issues. In the first part, general information about the functioning of the Ombudsman Institution and the application standards will be given. In observing the decisions of the institution, reference is made to international conventions for examination. Because of this reason, in the second part, the decisions given by the ombudsman institutions will be evaluated for compliance with international conventions and the constitution. Recommendations made by the Agency also help to increase the total quality of public institutions. The decisions of the Ombudsman institution should be made in accordance with the international conventions and the constitution. Because without reference to human rights, there will be problems in terms of binding decisions. Therefore, facilitator methods should be followed in terms of application criteria.

Korea Electric Power Industry Code (KEPIC) has been developed on the basis of referring to the prevailing U.S. codes and standards which had been applied to the electric power facilities in Korea. KEPIC has been applied to the construction of Ulchin Nuclear Units 5&6 since 1997 as per the endorsement of Ministry of Science and Technology, and is being completely applied to the construction of Shin-Kori and Shin-Wolsung Nuclear Power Plants (NPPs) in Korea and of Barakah NPPs in UAE. Although the technical requirements of KEPIC related to design and inspections for pressure vessels have been developed on the basis of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code (BPVC), Korea Electric Association (KEA) that is KEPIC maintenance organization is trying to find and improve unreasonable requirements based on the acquired experiences for the continuous construction and operation of NPPs. In the administrative requirements, KEPIC, unlike ASME, adopted not only mechanical field but also electrical field related to NPPs. Furthermore, the qualifying system for services such as Nondestructive Examination, Heat Treatment, Design and Equipment Qualification Organization was adopted to improve safety and reliability for NPPs. In the technical and administrative requirements, KEA has been performing betterment studies such as ‘integration of welding coordinator in welding quality system of KEPIC’, ‘induction of Korean national standards (KS) materials equivalent to ASME/ASTM materials into KEPIC-MH codes’. The result of study for development of Steel-plate Concrete (SC) structure and modularization technique for NPPs has been adopted to 2010 edition of KEPIC-SNG.
