Abstract:
The paper deals with Tax Procedure Code in the Czech Republic. The aim of this paper is to describe the Czech Tax Procedure Code and to present and evaluate its significant possible change. The basic principles of the Czech Tax Procedure Code are set out and the basic structure of the Tax Procedure Code is introduced. The study concludes that the tax procedure has been successfully codified in the Czech Republic. The adoption of Tax Procedure Code is a great achievement and the result of many years of work undertaken to preserve the autonomy of the tax procedure. Then the article is focused on the considered change of Tax Procedure Code related to the principle of tax self-assessment and tax additional self-assessment. It is further concluded that every tax in the broad sense should have a clearly stated model which is applicable for its assessment. Establishing the tax self-assessment and tax additional tax-assessment regime could make the examination stage of tax administration much clearer.

Abstract For more than two decades the family business enterprises of the first generation (generation of founders) are more and more dominating in the category of today’s small and medium–sized enterprises in the Czech Republic. The necessary legal background defining the legal relationships and rights of all participating persons was, however, limited to general provisions in the Commercial Code that has not solved many of the problems associated thereto. Only in 2012 the new Czech Civil Code, Act. No 89/2012 Coll., introduced the institute of family enterprise as completely new term in the Czech Civil law. The presented paper aims to analyse the key rules of this new legal regulation, focusing on significant aspects of the institute in the context of commercial law and family law, as well as, to highlight the potential weaknesses and gaps existing in the regulation.

Abstract:
This article is devoted to analysis of the pledge law regulation in the Civil Code of the Czech Republic. The Civil Code was adopted within a private law reform. The author addresses the fact of renouncing dualistic system of private law. The notion of pledge in Czech law is discussed. The article places special emphasis on the evaluation of the pledge agreement’s position in the pledge relationships together with correlation of the contract and law’s state in course of pledge agreement negotiation. Requirements to the form of contract and its content depending on a pledged assets are esteemed. The article also includes comment on the Czech law approach to the registration of the pledge titles and security interests. The articles of the newly adopted Civil Code are compared with prior legal regulation in the Czech Republic. The author focuses on characteristics of special types of pledge such as pledge of shares, securities, account of paperless securities’ owner, rights in action and special property. The procedure for levying execution is examined in the article in combination of analysis of the role of parties’ declaration of intent in a process of selection of assets disposal method. There are such methods as public sale and enforced sale. Both methods’ procedures are regulated by special laws. The article gives priority of claims in case of asset disposal which is stipulated by the Civil Code.

Abstract:
The evaluation of employees is currently one of the fundamental managerial tasks of each employer. The assessment of employees is used for documentation and recapitulation of the employee’s job performance, which is associated with particular tasks. This can be a very important tool for the management of an organisation and the method of evaluation of the performance of its own employees. The Czech Republic is facing some difficulties when recruiting policemen and policewomen. This is mainly due to the lengthy process of recruitment and examination, which takes place before the actual hiring. In addition, the candidates must pass tests in the field of mental endurance, physical fitness etc. There is a similar situation to be observed at the Ministry of Defence of the Czech Republic, where they want to recruit 8,000 personnel but do not have enough potential candidates. This will become a serious issue for the personnel department of the Czech Ministry of Defence, especially if President Donald Trump decides to reduce the number of US troops. The innovative element of this scientific article is that the whole issue is brought together with the various laws and regulations of the Civil Code of the Czech Republic, which is compared with the Labour Code and also applied to members of the armed security forces. The object of this article is to highlight the need and importance of effective evaluationof candidates in connection with various methods of employee evaluation in the context of the Czech Civil Code and Labour Code. Abstract:
On 2 January 2020, the Government of the Czech Republic submitted a bill to the Chamber of Deputies amending the Labor Code. The bill was sent to deputies as press 689/0 on 2 January 2020. The proposed amendment to the Labor Code was compiled by the Ministry of Labor and Social Aff airs of the Czech Republic, among other objectives, with the aim of achieving compliance with national legislation with EU regulations and case law. The proposed amendment to the Labor Code should explicitly regulate the conditions for the transfer of the employer's activities, and further specify the conditions for giving notice by an employee pursuant to Section 51a of the Labor Code when transferring rights and obligations from employment relationships. It is precisely in the issue of conditions for the transfer of the employer's activities that the current legal regulation has been repeatedly criticized due to insuffi cient use of EU legislation for the national legal regulation of the transfer of rights and obligations from labor relations.

On 28 January 2020, three living individuals of the Leisler’s bat, Nyctalus leisleri, were found in a shed in Malaucène, southern France (44°11’34”N, 05°07’26”E). Two of these bats had bands with the inscription CESON.ORG used in the Czech Republic since 2019. The whole ring code was detected in one case (CZ03313), in a female captured and banded in a bat-box near Bečov nad Teplou, western Bohemia, Czech Republic (50°05’27”N, 12°51’38”E) on 9 September 2019, 878 km away from Malaucène. This is the first case of a long distance migration in the population of Nyctalus leisleri of the Czech Republic. This observation also gives a direct evidence of a flight during the maximum 141 days in late summer or autumn from the central or northeastern Europe to the southwestern parts of the continent.

Abstract:
This contribution is focused on the trend to demand various declaration of taxable persons via specific forms issued based only on the wide and vague authorisation of the Ministry of Finance of the Czech Republic. The aim of this paper is to familiarise readers with the relevant Czech regulation and case law of the Czech Constitutional Court and to provide conclusions evaluating this case law and legislation. The beginning of this paper is devoted to respective provisions of the Tax Procedure Code, Charter of Fundamental Rights and Freedoms, Act on VAT and Act on Transactions evidence. Then, the part dealing with the development of the Constitutional Court approach evaluating the practice of the tax administration follows. Finally, the author provides his conclusions estimating future development in this issue. Scientific methods used in this paper are analysis, induction, deduction and description. The aim of the contribution is therefore the evaluation how the recent case law will affect the current legislation and what steps should be made by the Czech Parliament.

Abstract:
How do business ethics and CSR form part of pharmaceutical business in the Czech Republic and Hungary? The question was analyzed through empirical studies where surveys were the main tool. The research investigated business ethics, CSR, ethical code, ethical involvement of employees as factors that might be important to achieve ethical behaviour in the pharmaceutical industry. Results showed that, with 69.4% response rate, that Czech and Hungarian original companies are more towards ethical behaviour and the employees know more about the organization they work for. The data were compared with parametric statistical analysis based on Mann-Whitney U calculator.

The topic of my master thesis is the comparison of Czech and Slovak labour law. The goal of the paperwork is to compare structure and of content Czech and Slovak labour code, describe the most significant differences in chosen parts and analyse rights and obligations of employees and employers in both countries. At first the basic concept of labour law, his functions and position in legal system are defined. It continues with description of the history of labour law with focus on development of legislation after separation of the Czechoslovak Republic. Thesis analyses main three instituts of Czech and Slovak labour code: commencement of an employment relationship, his termination including financial and others entitlement of employees and agreements of work performed outside an employment relationship. The conclusion containts the partial summaries with emphasis on the biggest differences and evaluation of the hypotesis given at the beginning of the work.

The diploma thesis deals with an analysis of a concept of a value on the basis of the selected literature. It tries to point out a connection of ethical theories with a practical human behaviour. It has been structured from an explanation of key concepts as ethics, morality, manners; it examines a word of the value and fundamental philosophical theories which are associated with values. In detail it analyses the values in terms of so called philosophy of the material and formal subjectivism. It focuses on representatives of the phenomenology - Max Scheler, Nikolai Hartmann and Dietrich von Hildebrand. It specifies approaches to the values as well as in terms of a human personality, especially from a perspective of the analytical psychology. The thesis shows an importance of the values in the practical application - in the professional ethics of social work, where ethical codes provide an orientation for employees. Caritas Czech Republic was chosen as a model organization. That is also why a theological perspective on the values has been mentioned and basic values and principles of the Code of Caritas Czech Republic as well. This study should be a stimulus for a further exploration of the concept of the value and its significance for human beings. It considers the values to be a fundamental motivation that will lead mankind to a good behaviour (virtues) in the future.

This work deals with professional ethical reflection and analysis of the code of ethics of social workers to join in the broader context of the social work profession and human rights principles. The introduction deals with disabilities, the basic concepts of ethics and social work with regard to the specifics of the social work profession and the requirements of professional social worker. Based on professional ethical reflection theoretical work also analyzes the document Code of Ethics of Social Workers of the Czech Republic in comparison with the International Social Work Code of Ethics and the Code of Charity Czech Republic with an emphasis on the interpretation of the principles of human rights and social justice. At the end of the work in relation to analysis tries to summarize the importance of criticism and also updated the Code of Conduct, including an indication of other possible paths to explore this issue.

The thesis named "People with no religious affiliation as workers of diaconia - Current situation in Catholic and Protestant traditions" deals with stances of chosen Churches and diaconal organizations towards the employment of workers who are not members of any Church or not religiously defined. At the beginning the thesis deals with a definition of basic terms and their Biblical origins, then the thesis shortly describes important milestones in history of diaconia with closer look at the implementers. The main part of the thesis presents specific attitudes of the Roman Catholic Church, Evangelical Church of Czech Brethren and their diaconial organizations to cooperating with non denominational people and their employment. This part also presents these attitudes in the light of documents of Second Vatican Council. A chapter about spirituality and religiosity of the present time brings up a topic of the current situation in the field of employment of non denominational people in chosen church organization and fields which may appear problematic. The Plurality of Persons Regarding Ownership - General Issues Resumé The aim of this diploma thesis is to analyze some of the issues concerning the plurality of persons regarding ownership which have been brought by the Act of the Czech Republic No. 89/2012 Sb. Civil Code ('the Civil Code 2012'), which has come into effect on 1 January 2014. The thesis is divided into five chapters. The first chapter is devoted to the sources which were the main inspiration for the authors of the Civil Code 2012. The main sources were the Civil Code of Austria (Allgemeines Bürgerliches Gesetzbuch) and the bill of Civil Code proposed by the Czechoslovak government in 1937. The chapter emphasizes the fact that it is necessary to take these sources into consideration when analyzing legal regulation contained in the Civil Code 2012. The truth of this statement is proved throughout the whole text of the thesis since many references concerning these sources are made. The following chapter describes two legal forms of co-ownership that exist in the Czech legal system: common ownership and co-ownership in which shares of co-owners do not exist (e.g. community property). This chapter provides an overview of the legal framework of set-off in the Czech Republic both outside and within the context of insolvency. In the Czech Republic, set-off rights are regulated exclusively by statutory law. General regulations on set-off arrangements are laid down in Sections 1982–1991 of the Czech Civil Code. Other laws relevant to set-off are the Business Corporations Act, the Capital Markets Act, the Financial Collateral Act, and the Act on Insolvency. The chapter first examines set-off between solvent parties, taking into account general regulations, specific regulations under the Business Corporations Act, contractual set-off involving multiple parties, and special regulatory regimes governing set-off in the Czech Republic. It then considers set-off between insolvent parties before concluding with an analysis of set-off issues arising in the cross-border context.

"All in all, the CISG has met with resounding acceptance around the globe. Today, the CISG counts 67 Contracting States among its members, covering more than 70 per cent of global trade and production of goods; of the 50 leading exporters and importers in world merchandise, over 60 per cent are Contracting States to the CISG. Of those large industrial nations that are not yet Contracting States to the CISG, notably the UK, Japan and Korea, both internal and external pressure to ratify is rising. Currently, approximately 1,300 court and arbitral decisions decided under the CISG have been handed down from 32 judicial instances, and more than 6,500 academic publica-tions exist in 24 languages. This is in addition to the numerous conferences and other forms of academic discourse dealing with the Convention, most notably the CISG Advisory Council, a global body of CISG and international sales law experts that meets on a regular basis to discuss the significant developments in the field of international sales law and aims at promoting the uniform interpretation of the CISG. Perhaps the most tangible success of the CISG can be seen in the number of domestic sales laws that have used it as a model. Notably, many Scandinavian countries have used the CISG as the background for the modification of their domestic sales laws, as did Germany in its 2002 Schuldrechtsreform (Revision of the Law of Obligations) and The Netherlands in drafting the Law of Obligations in the Wetboek (Civil Code). Furthermore, many of the former Socialist states in Eastern Europe, including Estonia, the Czech Republic and Croatia, are also basing the re-development of their private and domestic sales and com-mercial laws on CISG concepts. Completing the CISG’s global impact is the reform of the Chinese private law. The New Code of Obligations of China has adopted many legal concepts and institutions promulgated in the CISG and the drafters have confirmed using the CISG as a source of inspiration in this regard. In addition, not only domestic sales laws, but also, increasingly, regional and inter-national principles are availing themselves of CISG principles to guide their drafting. The general approach of the Principles for International Commercial Contracts drafted by UNIDROIT (the UNIDROIT Principles) and the Principles of European Contract Law, which are intended to pave the way for a European or an international law of contract, can be traced back to the CISG. The same is true of the European Directive on Consumer Sales, which mirrors the concepts of conformity and non-conformity set out in the CISG. Furthermore, the OHADA, a union of 16 African states, has adopted a common sales law, which follows the CISG almost to the letter. Efforts at unification of the law are often met with the criticism that the unique peculiarities and historical variety of local laws are thereby ‘bulldozed’ by an all-consuming ‘international’ law. This is not the intention of the CISG. It certainly aims to provide a certain, uniform and consistent basis for defining the scope and obligations of international sales contracts for those states that have declared their intention to be bound by it. The Czech Republic National Radiation Protection Institute (SURO) provides technical support to the Czech Republic State Office for Nuclear Safety, providing safety analysis and reviewing of the technical documentations for Nuclear Power Plants (NPPs). For this reason, several computational models created in SURO were prepared using different codes as tools to simulate and investigate the design base and beyond design base accidents scenarios. This paper focuses on the creation of SCALE and PARCS neutronic models for a proper analysis of the VVER-440 reactor analysis. In particular, SCALE models of the VVER-440 fuel assemblies have been created in order to produce collapsed and homogenized cross sections necessary for the study with PARCS of the whole VVER-440 reactor core. The sensitivity study of the suitable energy threshold to be adopted for the preparation with SCALE of collapsed two energy-group homogenized cross sections is also discussed. Finally, the results obtained with PARCS core model are compared with those reported in the VVER-440 Final Safety Report.

Abstract A weld overlay (WOL) following the general guidelines of ASME Code Case N-740-2 was successfully installed in March of 2018 on a dissimilar metal weld joining the super emergency feedwater1 piping to steam generator (SG) at the Dukovany nuclear power plant (NPP) in the Czech Republic. The repair was necessary due to stress corrosion cracking detected in the super emergency feedwater nozzle to safe-end dissimilar metal weld. This was the first WOL installed in the Czech Republic and represents a significant step towards further acceptance of this proven repair technology in Europe. The WOL repair approach was accepted by the Czech regulator, and two different inspection agencies, following successful mockup demonstrations, welding procedure qualification, nondestructive examination demonstrations and weld residual stress analyses. This paper describes the preparatory work as well as field deployment of WOLs in the Czech Republic.

The paper presents results of a sub-task of the STYLE project currently running within the 7th Framework EU programme by way of an overview of deterministic engineering assessment methods (EAM) used for evaluation of flawed nuclear plant components, as used in various European countries (Germany, France, UK, Netherlands, Czech Republic, Spain, Finland and Sweden). Within STYLE, several mock-up experiments are being performed on specimens containing structural features. Structural features being considered include (1) dissimilar metal welds, (2) repair welds, and (3) austenitic cladding on a ferritic pipe. The overview thus focuses on the evaluation of flaws contained within each of these three types of features. Information on the procedures and codes applied in the various countries are given: KTA standard, ASME Code in Germany; ZG Appendix of RCC-M, A16 Appendix of RCC-MRx, and App. 5.4–5.6 of RSE-M in France; R6 in the UK; BS7910, R6 in the Netherlands; VERLIFE, ASME Code in the Czech Republic; ASME Code in Spain; SSM Handbook, ASME Code in Finland; and SSM Handbook, ASME Code, ProSACC in Sweden. An overview and brief description of the different methods is included in the paper, highlighting the commonalities and differences among the various approaches.

The paper describes methods used for evaluation of pressurized thermal shock (PTS) at UJV Rez and selected results. The UJV Rez participated on the one hand in a number of international programs focused on development of PTS methodology, benchmark testing etc. On the other hand UJV has worked in several projects evaluating PTS for nuclear power plants in the Czech Republic and abroad. The introductory part of the paper also briefly mentions a development of PTS methodology in the world, its current status and trends. The core of the paper describes thermal hydraulic part of the PTS evaluation process, which usually contains system thermal hydraulic (TH) analysis and mixing calculation. Already at the system TH calculation level, a simple 2D model of reactor downcomer (DC) is used in UJV Rez analyses — as this approach enables the prediction of 2D temperature and velocity fields in DC and improves the prediction of natural circulation flow or its stagnation in individual loops. For the subsequent mixing calculation the Computational Fluid Dynamics (CFD) computer codes are used nowadays. Comparison of 2D temperature fields from 2D system TH analysis and CFD calculation shows surprisingly good agreement for most cases. The paper shows such comparison for several representative cases and takes a more detailed look into one of them.

There are two NPPs operated in the Czech Republic: NPP Dukovany of WWER 440/213 type and NPP Temelin of WWER 1000/320 type. Four units of NPP Dukovany have started their operation during 1985 – 1987, two units of NPP Temelin have been put into operation during 2002 – 2003. Pressurised-thermal shock evaluation, i.e. assessment of resistance of reactor pressure vessel (RPV) against fast fracture, was for both NPPs performed during the plant operation. For NPP Dukovany the PTS evaluation started in 1996 and the project was completed in 2004. For NPP Temelin the PTS project was conducted during 2001 – 2004. At the beginning of the project for NPP Dukovany the PTS evaluation was performed according to the IAEA “Guidelines on PTS Analysis for WWER NPP” [1]. At later phases of this project and for the whole project of NPP Temelin, the appropriate PTS evaluations were performed according to the IAEA PTS Guidelines, Revision 1 [2] and the “Unified Procedure VERLIFE” [3]. The PTS analyses consisted of two main parts: 1) Thermal hydraulic (TH) analyses: The system TH analyses were performed mainly with using the RELAP5 computer code. Reactor coolant system, secondary circuit, and emergency core cooling system were modelled in a very detailed way according to the actual NPP configuration, signals specific to the NPP were built into the models and operator actions were taken into account for some PTS transients. For relevant cases, the behaviour of media in such components as hermetic confinement (NPP Dukovany), containment (NPP Temelin), sumps and ECCS coolers, was investigated by MELCOR or RELAP5 code with primary objective — to determine the exact temperature of water from safety injection system. The detailed TH mixing analyses were performed for all non-symmetric cases using CATHARE (with 2-D model of reactor downcomer) or REMIX/NEWMIX codes. 2) Structural Analyses: All computations were focused on circumferential welds in the beltline zone. The overall approach to the analyses (for the final stages of the projects) was as follows: Temperature and stress fields were computed by finite element method (FEM) on RPV model with crack included in the mesh. SYSTUS FEM code was used for this purpose, with elastic-plastic modelling of material properties. After performing the stress analysis, the energy release rate G was calculated using the postprocessor of SYSTUS code. Finally, the stress intensity factors KI were computed based on values of G. The defects were finally postulated as semielliptical underclad cracks, both axial and circumferential, with aspect ratios a/c = 0.3 and 0.7 and with the depth 1/10 of the wall thickness. Maximum allowable critical temperature of brittleness Tka was determined by comparison of KI and [KIC]3 (the allowable value of stress intensity factor) curves. Some examples of results are presented in the paper.

This paper presents the application of the modified ATHLET code to the dynamic behavior analysis of a supercritical water cooled system. A small scale fuel assembly under the “evaporator” condition of the HPLWR core design concept, with a supercritical water cooled experiment loop, is about to be tested in the LVR-15 research reactor of the Nuclear Research Institute in Rez in Czech Republic. With the purpose to analyze the safety characteristic and prepare for the licensing of the test loop, some design based accidents like loss of coolant due to break of coolant supply lines and trip of the primary pump are simulated in this paper. All the results achieved indicate that the modified ATHLET code has good feasibility in simulation of supercritical water cooled systems.

The contribution provides information about the development of a system for visualization of NPP severe accident progress. This visualization is under development in cooperation of UJV Rez, a.s. and Czech Technical University in Prague. The project is supported by the Technology Agency of the Czech Republic and is planned to be solved from 2015 to 2017. The visualization uses results of an analytical code MELCOR for evaluation of the NPP severe accident progress. The visualization firstly reads MELCOR results, transforms them to a suitable format for quick processing and provides graphical screens with reactor components that could demonstrate the progress of the evaluated severe accident. The visualization can even provide parallel presentation of more different scenarios of the severe accident. The system is planned to be used for training of NPP staff to handle severe accidents. In the first year of the project solution (2015), the software for MELCOR data transformation, next for providing information about transformed data were developed. In the following year (2016), software for creation of graphical screens with reactor components and software for severe accident progress presentation is creating. In the final year of the project (2017), thorough testing is going to be carried out, and the applicability of the visualization for a practical use during a NPP staff training is going to be verified.

Since the Fukushima nuclear disaster in 2011, much attention has been paid to investigation of severe accidents (SA) progression in spent fuel pools (SFP) of various types of nuclear power plants (NPP). In Czech Republic, 4 VVER-440 and 2 VVER-1000 types of reactors (at the Dukovany and Temelin NPPs, respectively) are currently under operation. In order to enhance their safety, especially with respect to station black-out (SBO) events, numerical analyses have been carried out evaluating the risks associated with accidents occurring also in the SFP. The present paper deals with analyses of 2 postulated scenarios (loss of cooling and loss of coolant) and is mainly focused on the input deck preparation for the integral, lumped parameter (LP) code for SA analyses — MELCOR 1.8.6. Emphasis is put on description of correct implementation of the complex geometry of the SFP, consisting of 3 distinct pools separated by concrete walls (lined with steel plates) in which fuel assemblies (FA) are stored in an absorber grid (rack). In the description of the prepared numerical model, light is shed on the encountered modeling issues, and corresponding hints and solutions are proposed in order to provide guidance for preparing adequate models for various types of SFP designs. Finally, some of the most characteristic results are presented for both postulated scenarios.
