Full textThis dissertation addresses a classical topic of constitutional theory; the structural principles of the contemporary state. Although this topic has been primarily studied in terms of the principle of separation of powers, this research argues that there is a duty of collaboration that must exist between the different branches and organs of the state in order to achieve their tasks. This duty is expressly provided for by the Colombian constitution. Despite this, there is a lack of clarity on its meaning and scope. To fill this void, this dissertation provides a theoretical framework, conducts a historical review, undertakes a comparative study, analyzes existing interpretations and proposes an interpretation of a harmonious collaboration mandate for the Colombian constitutional system. In conclusion, such a mandate implies a principle of constitutional status, which is of an institutional and structural nature, that becomes indispensable for the development of a constitution with transformative and aspirational aims, such as that of Colombia.

Full textThe legal disputes around the multiculturalism and around the ethnic justice are at the heartof the legal and philosophic debates. In this matter Colombia today and its current ethnicconflicts are particularly significant of these debates. This country is ruled through the 1991Constitution as a multiethnic and multicultural State. Indigenous peoples have been alsorecognized as well and the rights tied to their cultural difference have been registered in thisnormative text. In this political and legal context, the Constitutional court of the countryplayed a fundamental role in the interpretation and the definition of these new rights. As faras the analysis of the jurisprudence and what we call here paradigm of the interculturaljustice are concerned, we shall rely on the distinction made by the philosopher Nancy Fraserabout the social justice as a redistribution and a recognition. This distinction will thus lead theanalysis which we develop about that subject, and will at the same time help us tryto complement in the studies concerning this population. This framework of interpretationof the autochthonous question will authorize us to highlight the limits of the recognition of thecultural diversity when it comes to the economic question, the general interest or the statereason. It will also allow us to estimate the consistency of the paradigm of the interculturaljustice and its implicit philosophy. This approach of the judge’s decision involves that weconsider that the jurisprudence can contain a strong bitof political philosophy, or in otherwords, that the jurisprudence contains one or several implicit philosophies. We are thusparticularly interested here in highlighting this implicit philosophy

Full textDenna rapport beskriver processen av ett examensarbete som behandlar solenergi, implementerat i Colombia. Projektet innebar en installation av en självcirkulerande solvärmeanläggning, och även kunskapsutbyte om förnybar energi. Ett av de två huvudmålen var att installera en fungerande solvärmeanläggning i byn Timbio utanför staden Popayán i sydvästra Colombia. Syftet var att använda gratis energi från solen och visa människor hur man kan använda energin på ett inte alltför komplicerat eller dyrt sätt. Det andra huvudmålet var att hålla workshops om förnybar energi i allmänhet och solenergi i synnerhet. Förberedelserna började i oktober 2010 genom konkretisering av projektet, stipendieansökningar och skapandet av nödvändiga kontakter; i Colombia och Sverige. Efterforskningar och korrespondens fortsatte under 2011 samtidigt som finansiering till projektet söktes från företag och fonder. Installationen tog ungefär tre månader och färdigställdes i april 2012. Projektet begränsades av tillgänglig tid och ekonomiska resurser. Projektet blev framgångsrikt; en fungerande solvärmeanläggning och lyckade workshops. Målet att väcka intresse för förnybar energi uppfylldes, även målet att visa hur solenergi kan användas på ett praktiskt och användbart sätt.

A mudança Constitucional colombiana do ano 1991 comtemplou o direito aos grupos étnicos de ter uma educação diferenciada. Diante da implementação da política etnoeducativa, estabeleceu-se a parceria do governo junto aos grupos indígenas e afrocolombianos, visando a participação das organizações de base nesse processo. A política de etnoeducação inserida no processo nomeado de comunidades negras que surge a partir da Lei 70/93, viabiliza reformas operadas no sistema educativo. Essas reformas nas políticas públicas estão associadas com mudanças direcionadas à implantação das políticas neoliberais no país, cuja gênese está nas tendências globalizantes do Capital. Neste estudo a análise se centrará nas possibilidades de reprodução da cultura afrodescendente no processo da implementação da política etnoeducativa. A cultura aqui é entendida como prática, a qual se inscreve junto a outras esferas da vida social. Parte-se do pressuposto que na implementação da política etnoeducativa em comunidades afrodescendentes, reproduzem-se padrões da educação tradicional, sem maior compromisso com as reivindicações feitas por estas populações. O trabalho tem como objetivo; analisar as contradições entre os conteúdos da política de etnoeducação e a concretização da mesma nas práticas locais. Assim, se identificará como se vem executando o processo de implementação da etnoeducação, através da análise das práticas pedagógicas realizadas nas comunidades. Para tanto, parte-se da experiência do Colégio Etnoeducativo Técnico Agricola de Puerto Saija. Esta pesquisa teve como sujeitos de estudo as populações afrodescendentes que habitam nas comunidades de Guapi e Timbiquí no Litoral do Pacífico Caucano. Foram utilizadas as seguintes técnicas: entrevistas semi-estruturadas dirigidas aos membros das organizações de base; observação participante das reuniões e atividades etnoeducativas encaminhadas pelas organizações e pelas instituições governamentais; conversações informais com pessoas dessas comunidades: professores, alunos, administradores da educação e revisão da documentação produzida pelo governo para o atendimento da política etnoeducativa. As categorias de análise utilizadas foram: Etnoeducação, Estado, Afrodescendência e Participação. Os resultados da pesquisa apontam as contradições entre o discurso referido à etnoeducação contido nas leis e sua implementação nas práticas locais. Considerou-se que o papel das organizações de base neste processo esteve submetido aos direcionamentos do governo, pois na verdade, ele só visava legitimar a sua intervenção através do consenso construído com as comunidades. Neste contexto, conclui-se que as relações estabelecidas entre o governo e as organizações de base para a implementação da etnoeducação evidenciam a luta entre dois projetos: um que representa os anseios dos afrodescendentes e o outro, que comporta os direcionamentos de um governo comprometido com o neoliberalismo. Este último tem se sobreposto ao primeiro. Assim, tem delegado a realização de atividades próprias de governo às organizações de base. Finalmente, conclui-se que a política etnoeducativa definida e implementada para as comunidades afrodescendentes vem se constituindo numa prática de legitimação dos interesses dominantes.

Full textThis thesis offers an account of how the Colombian Army recovered from a series of humiliating defeats inflicted upon it by illegal armed groups led by the Revolutionary Armed Forces of Colombia (FARC) in the 1990s. It explains how a combination of internally generated, bottom-up and top-down organizational innovations, U.S. security assistance, and dynamic management from President Alvaro Uribe and a civilianized Ministry of Defense was able to restore Colombian Army morale, and to restructure and reorganize the military into an offensive force able to gain battlefield dominance and restore government authority over a greater part of the national territory.

Full textThis paper aims to investigate from a historiographical perspective in light of Bourdieu's field theory and social representations of Abric configuration processes, boom and saturation of industrial engineering as "field" to learn discipline in Colombia between 1950 and 2000 from the qualitative analysis of interviews with teachers and documents of industrial engineering programs from three of the best universities in the country : Universidad Nacional de Colombia in Medellin, Universidad Industrial de Santander in Bucaramanga and Universidad from Los Andes in Bogota. With the settlement of capitalism and strengthening industry generated after the development model implementation around 1950 that started mass production and determined the need for new rationalization work forms, such as, to permit description of trades measuring time and motion of worker, the precise establishment of cost operation and the establishment of work standards and production incentives. Consequently, there was an untimely business boom in Colombia motivated the social division of labor and the demand for education in industrial engineering soared to become saturated, the process of diversification and stratification marked the development of both the discipline and its training camp. All this leads to consider the possibility of new discourses to rethinking from new productions models such as equitable economy or eco-economy
El presente trabajo pretende indagar desde una perspectiva historiográfica a la luz de la teoría de campos de Bourdieu y de las representaciones sociales de Abric los procesos de configuración, auge y saturación de la ingeniería industrial como “campo” de saber disciplinar en Colombia entre los años 1950 y 2000 a partir del análisis cualitativo de las entrevistas realizadas a los profesores y de los documentos de los programas de ingeniería industrial de tres de las universidades más importantes del país: La Universidad Nacional de Colombia en Medellín, la Universidad Industrial de Santander en Bucaramanga y la Universidad Los Andes en Bogotá. Con el asentamiento del capitalismo y el fortalecimiento industrial generados luego de la implantación del modelo de desarrollo alrededor de 1950 que dió inicio a la producción en masa y determinó la necesidad de adoptar nuevas formas de racionalización del trabajo, tales que permitieran la descripción de oficios, la medición de tiempos y movimientos del trabajador, el establecimiento preciso del costo de cada operación y el establecimiento de estándares de trabajo e incentivos de producción. Se produjo un intempestivo auge empresarial en Colombia que motivó la división social del trabajo y la demanda por educación en ingeniería industrial se disparó hasta llegar a saturarse, los procesos de diversificación y estratificación marcaron el desenvolvimiento tanto de la disciplina como de su campo de formación. Todo lo anterior conlleva a pensar en la posibilidad de repensar nuevos discursos para la disciplina a partir de nuevos modelos de producción, como la economía equitable y solidaria o la eco-economía

Full textThis research studies the romance on the end of the twentieth century in Colombia between 1990 and 2005 in a panoramic orientation. The analysis is approached from the point of view of writing and is made through the analysis of some novels of the period from the concepts of world, author and fragment. This research, also, is focused on the novels Rosario Tijeras by Jorge Franco, Entre fantamas by Fernando Vallejo and Pavana del angel by Roberto Burgos Cantor. On this way, the study presents three chapters; the introduction presents the purpose of the research and its explanation. The first chapter works with the concept of worldliness in the romance Rosario Tijeras by Jorge Franco, in a direct dialogue with the novel Después de todo by Piedad Bonnett and El anarquista jubilado by Roberto Rubiano. The second chapter attempts to define the concept of author and how it is configured in Entre fantasmas by Fernando Vallejo, for that purpose, it is brought into dialogue with Memorias de un hidalgo disoluto by Héctor Abad Faciolince, Amirbar by Alvaro Mutis, Érase una vez el amor pero tuve que matarlo by Efraim Medina Reyes and Vida feliz de un joven llamado Esteban by Santiago Gamboa. The third chapter discusses how the fragment is presented in Pavana del ángel by Roberto Burgos Cantor, a novel that is part of the literary tradition of Colombia and in particular, the Colombian Caribbean. This novel is set in relation to the novel Opio en las nubes by Rafael Chaparro Madiedo and also relates to the romance Los cuadernos de N., by Nicolás Suescún. The conclusion tries to define the way this research was developed.

¿Cuál debería ser el valor razonable de la acción de Almacenes Éxito? ¿Qué tan sobreestimado o subestimado es el valor observado de la acción de dicha compañía respecto del valor estimado? Para dar respuesta a los anteriores interrogantes se recurrirán a metodologías de valoración de empresas. Naturalmente, la siguiente pregunta a responder es ¿cuál de estas metodologías es la más apropiada para valorar las acciones de la empresa? ¿Podría el modelo del valor presente ajustado servir para tal fin? Al respecto, cabe destacar que dicho modelo se aplica en aquellos casos en los cuáles no existe una estructura de capital objetivo. Este no es precisamente el caso de la compañía a valorar. ¿Podría aplicarse el método de opciones reales? En cuanto a este método, cabe resaltar que bajo dicho modelo se asimilan las opciones de inversión al ejercicio de una opción. Sin embargo, dada la información que se dispone de la compañía, difícilmente podría utilizarse. ¿Serviría el modelo de descuento de dividendos para tales efectos? Dicho modelo es utilizado, por lo general, en la valorización de instituciones financieras, rubro al cual no pertenece Almacenes Éxito. Descartadas estas tres metodologías, restarían dos opciones: el método de flujos de caja descontados y el de múltiplos o comparables. El primero de ellos estima el valor de la empresa descontando a valor presente los flujos de caja estimados. Para ello, parte por depurar la Utilidad Neta de los Estados de Resultados proyectados adicionando y sustrayendo aquellos ingresos y gastos que no representan flujos reales de efectivo para luego adicionarle o restarle las inversiones en reposición, las inversiones en capital físico y los aumentos o disminuciones de capital de trabajo y el valor terminal de la compañía. Los flujos resultantes de estos cálculos, se descuentan a valor presente utilizando la tasa promedio ponderado de capital (WACC, por sus siglas en inglés). Respecto del método de múltiplos o comparables, se requiere identificar compañías pertenecientes a la misma industria y con características similares a las de la compañía objeto de valoración con el fin de calcular. Con base a datos financieros de estas compañías se calculan ciertos drivers de la industria, los cuales se aplicarán posteriormente a ciertos datos financieros de Almacenes Éxito para estimar el valor de la acción de la misma. Si bien las dos metodologías mencionadas anteriormente pueden poseer ciertas deficiencias, como ocurre con todas las metodologías, son las más apropiadas para determinar un valor razonable del valor que se desea estimar. Obviamente, para realizar la valorización de cualquier empresa se requiere comprender el contexto macroeconómico en el que esta se desarrolla, la industria donde esta opera y disponer de información financiera y no financiera que permita entender su giro, su desempeño financiero, sus expectativas a futuro, entre otros aspectos. Esperamos que la información que suministraremos a continuación sea de utilidad para el lector para dar respuesta a las interrogantes inicialmente planteadas.

Full textSince the signing of Peace Accords between the FARC-EP guerrilla and the government of Juan Manuel Santos in 2016, Colombia has embarked on a new attempt to resolve the armed conflict, taking into account the specificities of historically minorized ethnic groups, who have been both actors or victims of violence within the conflict. The "ethnic chapter" integrated into the recent Peace Accords reflects several decades of social mobilization, where victim movements intersected with Indigenous and Afro-Colombian movements in the fight for human rights and for the decentering of peace rights from marginalized territories. It is also part of ongoing peace-building policies amidst the armed conflict and efforts to manage ethnic diversity in a postcolonial context that Colombia has adopted since the end of the twentieth century. Prior to these Peace Accords, Decree-Laws 4633 and 4635 of 2011 had already outlined the rights of victims to justice, truth, reparations, and the non-repetition of violence, through an "ethnic differential approach" aimed at Indigenous, Black, Afro-Colombian, Raizales and Palenqueras peoples and territories. Situated at the crossroads between two governance models – conceptualized as Transitional Justice and Multiculturalism – policies for collective reparation to ethnically differentiated victims of the Colombian armed conflict challenge traditional citizenship categories of belonging on multiple levels. How is the recognition of ethnic communities as collective subjects of rights may be translated into the formulation and application of collective reparations for peripheral communities and territories historically constructed as ethnic? How does the transition towards peace through reparations for conflict victims prompt a rethinking of the relationship between Indigenous and Afro-Colombian peoples and the State? To what extent does the restoration of their rights violated during the armed conflict contribute to a redefinition of differentiated ethnic and victim-based citizenship? To answer these questions, this thesis adopts a socio-anthropological fieldwork approach comparing two reparative processes conducted within two ethnic communities recognized as collective victims of the armed conflict by the 2011 Victims and Land Restitution Law: a group of displaced people organized as a Nasa resguardo in the Andes of Cauca and a Black Community Council encompassing eleven Black communities in the Pacific coast of Cauca. Combining archivist research to trace the mobilization of ethnic organizations in shaping post-conflict policies that take them into account with a field work conducted from 2017 to 2020 within three transitional institutions established by the Victims' Law and with the two collective political subjects entitled to reparation, this study aims to better understand the interethnic power dynamics at play in the formulation and implementation of reparation policies for ethnic communities recognized as victims. The comparative analysis of transitional public policies directed at historically ethnicized territories and communities provides insight into the mecanisms of integration and empowerment for ethnic authorities under new transitional institutions, which ensure an increasing presence of the State in its peripheries and the ethnic differential approach that brings into question the exercise of power
Desde la firma de los Acuerdos de Paz entre la guerrilla de las FARC-EP y el gobierno de Juan Manuel Santos en 2016, el Estado colombiano ha emprendido un nuevo intento de resolución del conflicto armado que toma en cuenta las especificidades de grupos étnicos históricamente puestos en minoría, bien sean actores o víctimas de la violencia cometida en el marco del conflicto. El "capítulo étnico" incorporado en los recientes Acuerdos de Paz responde a varias décadas de movilización social en las que se han unido movimientos de víctimas, movimientos indígenas y movimientos afrocolombianos para reivindicar el respeto de los derechos humanos y su descolonización epistémica desde los territorios marginados. También se inscribe en la continuación de las políticas de construcción de paz en medio del conflicto armado y de manejo de la diversidad étnica en un contexto poscolonial, adoptadas desde finales del siglo XX en Colombia. Anteriormente a los Acuerdos de Paz, los Decretos-Leyes 4633 y 4635 de 2011 establecieron un marco para los derechos de las víctimas a la justicia, la verdad, la reparación y la no repetición de la violencia, basado en un "enfoque diferencial étnico" dirigido a los pueblos y comunidades indígenas, negras, afrocolombianas, raizales y palenqueras. En la encrucijada entre dos modelos de gobernanza conceptualizados como justicia transicional y multiculturalismo, las políticas de reparación a víctimas del conflicto armado colombiano dirigidas a pueblos étnicamente diferenciados cuestionan las categorías sociales y jurídicas de pertenencia en varios niveles. ¿Cómo se traduce el reconocimiento de las comunidades étnicas como sujetos colectivos de derecho en la formulación y aplicación de reparaciones colectivas a comunidades y territorios periféricos históricamente construidos como étnicos? ¿De qué manera el contexto de transición a la paz a través de la reparación a las víctimas del conflicto nos lleva a repensar la relación de los pueblos indígenas y afrocolombianos con el Estado? ¿En qué medida el restablecimiento de sus derechos, vulnerados durante el conflicto armado, contribuye a una redefinición de la ciudadanía diferencial étnica y de víctimas? Para responder a estas preguntas, esta tesis adopta un enfoque socio-antropológico de trabajo de campo para comparar dos procesos de reparación llevados a cabo en el seno de dos comunidades étnicas reconocidas como víctimas colectivas del conflicto armado por la Ley de Víctimas y Restitución de Tierras de 2011: un grupo de desplazados constituido como resguardo nasa en los Andes caucanos y un consejo comunitario conformado por once comunidades negras en el Pacífico caucano. Combinando un trabajo de archivo que rastrea la movilización de las organizaciones étnicas en la construcción de políticas para el posconflicto que las tengan en cuenta, con una investigación de campo realizada entre 2017 y 2020 en el seno de tres instituciones transicionales creadas por la Ley de Víctimas y con los dos sujetos colectivos de derecho a la reparación, este estudio pretende comprender mejor las relaciones de poder interétnicas en juego en la formulación y aplicación de las políticas de reparación para las víctimas miembros de comunidades étnicas. El análisis comparado de las políticas públicas transicionales dirigidas a territorios y comunidades históricamente etnicizadas permite captar las lógicas de integración y autonomía de las autoridades étnicas por parte de las nuevas instituciones transicionales, garantes del despliegue del Estado en sus periferias y del enfoque diferencial étnico idóneo para cuestionar el ejercicio del poder

Full textThis anthropological study describes multiple activities initiated through the creation in (1982) and subsequent extension in (1999) of a wine-making project conducted in the high Andean altiplano with a group of farmers of the Department of Boyaca in Colombia. This region has undergone a historical process of deterritorialization. Nowadays, it is the home of a robust peasant population which heavily relies on numerous small properties known as minifundios and micro-minifundios, which are generally farmed by peasant households on hillsides. From this study, it is argued that the application of specialized information (based on specialized methods) to agriculture has been very limited in the region of our study. Therefore, this lack of specialized practices has contributed to the significant level of poverty these communities face, especially the rural dwellers. This is to say, agricultural practices represent a decisive factor for the use of natural resources and cultural development. In the particular case of vegetable and mineral exploitation, this study argues that the current practices have mostly been led by priests, politicians and military authorities. Thus, the need for a science-based approach entwined with cultural traditions of the local peasant communities encouraged the creation of this study called Proyecto vitivinícola del Valle del Sol y territorios afines, and carried out in above mentioned region. Full textThis doctoral dissertation adopts a spatial perspective to explore how gendered street interactions affect the experience of and access to Medellín’s urban public spaces. It is particularly concerned with comments men direct at women in public places (many of which are commonly understood to be “street harassment” and locally referred to as “street compliments”), mobilizing an intersectional approach to analyze how their use, contestation, and regulation are affected by entwined power structures related to gender, class, and race. I examine how these interactions perpetuate racial and class hierarchies rooted in colonial history by upholding gendered polarities that distinguish between “respectable” and “dishonourable” women, a distinction implicit to caste categories in place under colonial rule. I similarly examine the role these interactions play in upholding a corresponding masculine polarity between “protectors” and “aggressors.” The research is based on seven months of immersive ethnographic fieldwork, which included observations of public spaces and over 70 semi-structured interviews in addition to innovative methodologies such as mobile interviews and social cartography. It was conducted in 2018 and 2019, shortly after the signing of peace accords between the Colombian government and the FARC [The Revolutionary Armed Forces of Colombia] in 2016. Medellín was particularly affected by Colombia’s armed conflict but has recently rebranded as a modern and innovative city on the international stage. This context gives rise to one of the central lines of inquiry in my thesis, which looks at the ways in which both legal and illegal forces of order (Medellín’s municipal government and local paramilitary groups, respectively), alternately condemn or engage in the harassment of women in public spaces as a means to consolidate control over territories and uphold particular economic and social orders
Esta tesis doctoral adopta una perspectiva espacial para explorar cómo las interacciones generizadas en los espacios públicos afectan la estructura, el acceso y la percepción de estos espacios en la ciudad de Medellín. Focaliza particularmente los comentarios masculinos dirigidos hacia mujeres desconocidas en lugares públicos (que son ampliamente comprendidos como “acoso callejero” pero habitualmente llamados “piropos callejeros” a nivel local), adoptando un enfoque interseccional para examinar cómo su utilización, regulación y cuestionamiento son modulados por estructuras de poder interconectadas que están relacionadas con el género, la clase social, y la raza. Examina cómo estas interacciones participan de la reproducción de jerarquías de raza y de clase social arraigadas en la historia colonial a través del mantenimiento de polaridades de género que distinguen entre mujeres “respetables” y “deshonrosas,” una clasificación implícita en las categorías de casta vigentes en la época colonial. También indaga el papel de estas interacciones a la hora de mantener la correspondiente polaridad masculina entre hombres “protectores” y “agresores”. La investigación está basada en siete meses de trabajo de campo etnográfico e inmersivo que incluyó la observación de espacios públicos y más de 70 entrevistas semiestructuradas, además de metodologías innovadoras como entrevistas móviles y cartografía sensible. El trabajo de campo se realizó en 2018 y 2019, poco tiempo después de la firma de los acuerdos de paz entre el gobierno colombiano y el grupo FARC (Fuerzas armadas revolucionarias de Colombia) en 2016. Medellín se vio particularmente afectada por el conflicto armado pero recientemente ha logrado reinventarse como ciudad moderna e innovadora en la escena internacional. Full textThe increase in violence involving transnational organized crime syndicates in various parts of México in the twenty-first century is widely viewed as a challenge to security and stability. Some observers have drawn comparisons with the well documented conflict in Colombia in the 1980s and 1990s between the Colombian government and the Medellín and Cali cartels. Various factors, including the professionalization of the Colombian National Police, are viewed as a model for improving the effectiveness of law enforcement elsewhere. This thesis asks whether a Colombian law enforcement model can be codified, in terms of key attributes, to improve security and stability in México. To this end, I explore Colombia’s law enforcement strategy in the 1980s and 1990s and identify shifts in strategy that might also apply to the current struggle in México. At the same time, I identify aspects of the Colombian model that have little or no relevance to contemporary México. I argue that the Colombian model can do little to reduce or eliminate the production and transportation of illegal narcotics by México-based organized crime syndicates; however, a hybrid version of the Colombian model could help reduce the overall power of the cartels and enhance security and stability throughout México.

Full textCamposol Colombia is one of the subsidiaries of the Camposol S.A group, which is positioning in the Colombian market with the harvest, production, and export of its flagship product: Hass avocado. The present strategic plan aims to generate the strategies to develop so that Camposol Colombia can become the largest producer-exporter of Hass Avocado in Colombia. The plan began with an analysis of the current situation of Camposol Colombia, to understand how the company is currently doing; then the vision, mission, values, and code of ethics of the company were developed. Additionally, it has been seen convenient to carry out the external evaluation, to know the environment of the company, with which opportunities were identified such as growth in demand, free trade agreements, and accesses for the output of the product, among others; however, threats that are intended to be minimized were also detected, such as deficiency in the infrastructure of the properties, periods without rain and the lack of technology. Likewise, an analysis of potential local and international competitors has been carried out. Next, a study of the internal evaluation of Camposol Colombia has been carried out, to capitalize on its strengths such as leadership, commercial management, cost management, financial support, technical personnel, and experience in the business. Likewise, its weaknesses have been identified as lack of knowledge of environmental regulations in Colombia, new to the sector, local qualified human resources, among others; to establish competitive advantages from the identification of their distinctive strengths. Then, the interests and long-term objectives of the company have been realized. Subsequently, the appropriate strategies were established that would help Camposol Colombia from its current situation to the objective that is expected in the future. It is important to highlight that such strategies have been generated through a study and analysis concerning the external and internal evaluation of the company; Which can be mentioned as an example: (a) invest in the purchase of land, to increase the production of the product; and (b) strategic alliances with suppliers in general, among others. Finally, the evaluation of the strategy has been carried out through the Balanced Scorecard, to capture and follow up on the interests and long-term objectives of Camposol Colombia, to make decisions and assertive actions that help to achieve what the company is proposing for the future.

Full textIn a competitive and a globalized world the market demands the highest standards of the products and services that the companies provide, this standards allow to guarantee a excelent quality of their products and services that the companies develop. All the regulations allow the organizations to have quality and warranty in their products and services however there are other companies that don’t have a Quality Management System(QMS) and offer products and services that compete in some way with certified companies. In order to determine the impact of a QMS in the level of quality of the products or services of organizations a investigation will be going the be develop whose main objective is to identify if the companies in the methalmechanic sector in Colombia with QMS have a higher quality levels compared to those without a QMS. To develop this investigation a survey was made in wich the nine quality factors are evaluated for the companies in the methalmecanic sector of Colombia that have a QMS or not and by this way determine the levels of compliance perceived by this companies. The methalmecanic sector in Colombia is compound with approximately 2.000 companies, the survey was sent to about 1500 companies, obtaining response of 143 of these. To develop the analysis a study of the methalmechanic sector and the factors that influence considering the quality management in Colombia and the analysis of the economic sector was realized. After the analysis of the investigation results it was concluded that the quality factors between the companies in the methalmecanic sector that have or not a QMS are not affected by the fact of having a certification in QMS. This result is possibly by the quality of the products that develop this sector must have high standards and service to guarantee the integrity of the consumer. Another reason is for the knowledge acquired by managers and directors in companies that were certified so they implement them in other companies that dont have a QMS and result as a improvement in the processes and procedures of quality. Despite the diferences in the quality factors for the companies with and without certification, is important that the companies that dont have qms continue to work for the certification in order to improve the competitiveness in the market not only for national level because is also important to a international level.

Full textThe oil industry in Colombia is essential for the development of economic activities in the country. The sector is an integral part of the country's development plan and national progress. In the current situation, the oil industry has been growing in terms of exploration and production, the industry is the leader activity that attracts foreign and domestic investment, job creation and large multinational companies. The oil and gas sector grew at constant prices of 2005, up 17 percent from 2010 to 2011. However, it is the sector with the most challenging social, environmental, and regulatory enforcement to maintain equity between the use of natural resources and economic progress of the country through a comprehensive strategic approach. The strategic approach presented in this paper seeks to follow the entire strategic process to establish a strategic plan to 2032 for the oil industry in Colombia that allowing the Ministry of Mines and Energy, Colombian Petroleum Association and other organizations, public and private to have a comprehensive proposal to establish the current situation throughout a methodology to develop a strategic approach for 2032. Finally, the strategic approach is supported in the implementation of a balanced scorecard as a central to evaluate of the oil sector strategy in Colombia.

The oil and gas exploration and production industry normally has three major actors, the first one being the governments, who dictate the 'game' rules and provide the framework for attracting investors to this sector. The second one consists of operators, large companies and joint ventures between experienced operators and investment funds who are seeking attractive returns on investments, and the third actor is service companies who provide all services required to extract oil and gas from the subsurface and send them to refineries. The oil and gas service market moves according to international oil prices. High prices mean more exploration, which in turn mean more investment and opportunities for service companies. After more than five marvelous years of a boom in oil prices, a contraction is severely affecting the oil and gas industry. An option for international or multinational oil and gas service companies is to diversify their geographic areas of influence and expand their presence in countries where oil and gas investors are moving resources, especially in countries where oil and gas represent a significant percentage of its Gross Domestic Product (GDP) and government rules are more flexible, which increases the possibility to maximize returns. The purpose of this paper is to understand if it is possible to introduce a specific service from a Chinese oil and gas service company in Colombia under the current economic situation: hydraulic fracturing services for unconventional resources. By using data from previous studies that estimate the unconventional resources potential in Colombia, current and potential customers, service and price benchmarking, some market positioning strategies as well a risk mitigation plan that could reduce exposure, it will be possible to ascertain whether it applies to this new service or not, and if possible, to determine what barriers could this company face to obtain its goal.

A partir de la década de los noventa, Colombia empieza un largo camino hacia la liberalización de la economía y la búsqueda por atraer Inversión Extrajera Directa, como fórmula para el crecimiento económico. Sin embargo, sólo hasta comienzos de 2007 se ven materializados avances más concretos, tras un trabajo de planificación en conjunto del Estado, entidades públicas y el Consejo Nacional de Política Económica y Social (CONPES), se definen un nuevo marco de acción para hacer del país una economía atractiva al capital foráneo. Como resultado, se efectúan modificaciones a la legislación colombiana, una reforma regulatoria y una financiera. De manera simultánea se refleja un significativo aumento de las inversiones en Colombia, convirtiendo a Chile, el lugar de procedencia de gran parte de estos capitales, quienes con el ingreso del retail, modelo de grandes tiendas, desarrollan una línea de negocio, en el que la población colombiana tiene adicional a la venta de bienes, la tarjeta de crédito para adquirirlos.
From 1990's, Colombia started a long road into economical liberalization and search to attract Foreign Direct Investment, as a method for economical growth. Nevertheless, only beginning 2007 we see materialized a more concrete progress, after a planning carried out by the State, public entities and the Social and Economical National Politics Council (CONPES), a new action framework is defined in order to promote the country as an economy attractive for foreign capital. Full textThis thesis is dedicated to the study of war crimes, and under this category of International Criminal Law, seeks to confirm the terms of its enactment into the Colombian law. In this sense, it aims to establish the role of cooperation and complementarity of the International Criminal Court (ICC). Chapter I develops remote and recent history of the notion of war crimes. The historical study establishes the legal dimension and emphasis of the concept of war crimes as a special category of International Criminal Law. Chapter II examins the nature and scope of the elements of war crimes under the Rome Statute, the jurisprudence of the ICC, and the doctrinal discussions concerning their binding character. The research defines the material, mental, and contextual elements of war crimes. In doing so it develops the current typology of armed conflict with special reference to the existence, nature, and characteristics of the Colombian armed conflict in the way of the jurisprudence and doctrine. An analysis of international criminal responsibility of the individual is offerred in chapter III by identifying its governing principles. In addition to including an analysis of the forms of participation in war crimes, the chapter also presents the theories of international criminal responsibility applied by the ad hoc tribunals, the ICC, and the Colombian criminal jurisdiction. The jurisdiction to prosecute and punish war crimes in Colombia is closely studied in chapter IV. This chapter includes the limits of the internal jurisdiction and is closed by the modalities of cooperation and complementarity of the ICC, inspired by the developments of the cooperation itself in the matter. a The findings are a synthesis of concepts and facts substantiated through research, which serves as a starting point to a number of suggestions and proposals for strengthening democratic institutions in Colombia in their efforts to prevent, prosecute and punishing war crimes that deeply offend human dignity.

Full textIn questa tesi si analizzano, in termini generali, alcune operazioni discorsive che articolano il discorso dei Diritti Umani in Colombia e le rappresentazioni che da questo emergono. L’obiettivo principale è descrivere l'interazione discorsiva e gli attori del discorso dei diritti umani in Colombia, specificatamente coloro che partecipano allo scambio epistolare tra la Rete Italiana di Solidarietà ed il Governo colombiano dal 2002 al 2006. Si tratta pertanto di una ricerca qualitativa ed interdisciplinare che si iscrive negli Studi Critici del Discorso concretamente nella prospettiva sociocognitiva del discorso che a sua volta riprende anche concetti teorico-metodologici della pragmatica e della socio-semantica delle quali si utilizzano le categorie di analisi proposte in alcuni dei suoi campi. In definitiva: “Cosa si dice sui diritti umani in questa interazione?” e “Come si fa questo?” Sono le domande generali alle quali intendo rispondere nello sviluppo della tesi dottorale.

Full textEl Programa Nuevos Territorios de Paz- NTP- (2010-2016), surge a partir de las experiencias obtenidas de los programas de Desarrollo y Paz, que por más de 15 años fueron desarrollados en distintas zonas de Colombia afectadas por el conflicto armado. El objetivo de esta investigación se centrará en analizar los arreglos institucionales para la articulación de actores regionales y nacionales en la implementación del programa NTP en la región del Bajo Magdalena. La metodología fue de tipo cualitativo- deductivo. Las fuentes utilizadas fueron de tipo primario, a través de 14 entrevistas a los coordinadores y asesores de instituciones y organizaciones que implementaron el programa y secundarias, por medio del análisis de documentos oficiales y normativa. La unidad de análisis se basó en los distintos arreglos institucionales que permitieron generar coordinación y articulación entre los actores y el objeto de estudio fueron las organizaciones implementadoras y el gobierno nacional. De los resultados obtenidos, se evidencia que, para analizar los arreglos institucionales, es necesario estudiar los acuerdos formales e informales desde una mirada política y técnica. De esta forma se comprenden las estrategias y modelos propuestos por parte de los actores, para dar respuesta a los problemas públicos. Se identifica el modelo de articulación denominado por Barreto (2009) como triángulo de diálogo y cooperación estrategia de articulación del programa NTP, además de los elementos formales que soportan dicho modelo, como el modelo de contratación y los protocolos de actuación. Igualmente, esta investigación identifico a través de niveles de articulación: comunicación, colaboración, coordinación, cooperación y convergencia, los recursos formales e informales utilizados para implementar los recursos del programa, se evidenció que gran parte de las acciones de articulación estuvieron enfocados en comunicar y cooperar para cumplir con los objetivos de los contratos firmados entre los socios y el gobierno nacional. En cuanto a las conclusiones se observa que las fortalezas del proceso de articulación están relacionadas con el conocimiento previo del territorio, la construcción de una visión territorial como elemento articulador de acciones, el posicionamiento de la región en la agenda de desarrollo y paz del país y el fortalecimiento de la participación ciudadana, a través de la creación y fortalecimiento de espacios de seguimiento y control a las acciones públicas. En cuando a las dificultades, se identifica la poca participación de los gobiernos locales, lo que significó la no continuidad de algunos procesos iniciados por el programa en la región, y el modelo de contratación del programa tan rígido que exige el cumplimiento de marcos lógicos y actividades específicas, por lo que articular recursos significaba en muchas oportunidades inconveniente para los socios estratégicos del programa.

Full textThe Colombian judicial review system is characterized by its wealth of methods of control. On the one hand, it has a concentrated control that reduces the democratic objection, comparatively speaking, because of the aperture to participation in its procedure and its impact both on the abstract protection of fundamental rights and on the control of respect for the checks and balances system. On the other hand, there is a diffuse control that, despite having entered into force at the same time as the concentrated control, has not been at the center of Colombian legal thought. In effect, its doctrinal and jurisprudential treatment has been scarce and superficial in the training of lawyers and judges. This is explained by a strongly exegetical law culture in which the idea of the non-application of rules was seen as a direct affront. Thus, fears were raised about the use of this mechanism that remain presently, despite the transformation of the concept of law as a result of the constitution of 1991. Indeed, the diffuse and concentrated controls were not conceived in a coordinated way, delimiting the function of each. In fact, the provisions that establish them tend to grant a very broad scope to both of them. Finally, this study proposes a concept of diffuse control that must interact harmoniously with concentrated control to restrain abstract and concrete unconstitutionalities. This thesis then ultimately analyzes the role diffuse control has had in (and should have in) the Colombian system of judicial review through various methodologies of the social sciences
