Abstract:
This chapter offers a systematic reading of Hegel’s comments about punishment in his philosophical system with careful attention to his Philosophy of Right. It argues that the conventional reading, which claims his theory of punishment is mostly confined to the section Abstract Right, raises interpretive difficulties. One problem is the inadequacy of punishment as described in Abstract Right to be a complete theory of punishment. A second problem is accounting for apparent inconsistencies between what Hegel says in Abstract Right versus comments stated elsewhere in the Philosophy of Right and larger system. The chapter argues that later sections like Ethical Life matter for our understanding Hegel’s penal theory and a systematic reading of his texts can help make best sense of this and the unified theory of punishment he defends. It concludes by reflecting on the implications this reading has for our understanding Hegel’s philosophy and its contemporary appeal.

By the end of the 1930s space (Raum) had become a common catchword in the writings of Carl Schmitt. This chapter argues that space was not merely a theme during this phase of his career, but was linked to a rhetorical strategy and mode of argumentation. Focusing on Land and Sea (1942) and “Nomos” of the Earth (1950), the first two sections show how Schmitt developed two contrasting modes of argumentation inextricably intertwined with his theory of space and the poetics of his writing. In the final section Agamben’s comments on Schmitt’s “topology” and the collaborative work A Thousand Plateaus by Deleuze and Guattari serve as case studies for recent reconfigurations of Schmitt’s spatial thought. The analysis of their appropriations of Schmitt points to major differences between his original perspective on space and these contemporary theories. Schmitt’s spatial theory is deeply rooted in the epistemology of the early twentieth century.

Abstract:
The historical evolution of ideas about the entrepreneur is a wide-ranging subject and one that can be organized in different ways — theorist by theorist, period by period, issue by issue and so forth. What follows is a compromise between these possibilities. This article starts with some very broad reflections about economic change over thousands of years and the connections between these changes and the economic thinking of the time. A recognizably ‘modern’ idea of the entrepreneur begins to emerge in the eighteenth century and part of this article is devoted to the role of entrepreneurship in classical and neoclassical economic theory. In the next five sections, the article looks at particular areas that have been associated with debates about the entrepreneurial role — uncertainty, innovation, economic efficiency, the theory of the firm, and economic development. A final section presents a brief summary and comments on the place of the entrepreneur in evolutionary models.

The book is organized into four major sections. The first explores the nature of psychiatric illness and the ways in which define it including clinical and psychometric perspectives. The second section examines problems in the reification of psychiatric diagnostic criteria, the problem of psychiatric epidemics and the nature and definition of individual symptoms. The third session explores the concept of epistemic iteration as a possible governing conceptual framework for the revision efforts for official psychiatric nosologies such as DSM and ICD and the problems of validation of psychiatric diagnoses. The final session explores how we might move from the descriptive to the etiologic in psychiatric diagnoses, the nature of progress in psychiatric research and the possible benefits of moving to a living document (or continuous improvement) model for psychiatric nosologic systems. The analysis is organized into three sections: his early years, the Weimar Years, and the Nazi years. In the first section, I trace Fraenkel’s upbringing in a secular household influenced by the so-called Jewish Enlightenment, or Haskalah; explore the origins of his life-long predilection for social democracy; and recount the intellectual effects of his military service in World War I. In the second section, I reconstruct Fraenkel’s education and socialization as a young lawyer and interpret Fraenkel’s most important Weimar-era writings. I explicate the roles they played in preparing the ground for the writing of The Dual State. In the third section, finally, I commence my analysis of Fraenkel’s Nazi-era thought and conduct up until his escape to freedom in 1938.

This commentary analyses Article 9.1.2 of the UNIDROIT Principles of International Commercial Contracts (PICC). According to Art 9.1.2, Section 9.1 of the PICC does not apply to transfers made under the special rules governing the transfers of instruments such as negotiable instruments, documents of title or financial instruments, or of rights in the course of transferring a business. This means that Section 9.1 of the PICC still applies with respect to such instruments or rights if they were assigned by way of a ‘normal’ assignment; that is, not under the special rules. However, the Official Comment makes clear that this is only valid if such transfer is allowed under the domestic law. The Official Comment mentions the bill of exchange as a negotiable instrument, the documents of title mentioned in the Official Comment are bills of lading or warehouse receipts — and the financial instruments are stocks and bonds.

This book has never been published before, although its contents have provided the basis for hundreds of papers, theses, and books on geostatistics. The chapters are based on the lectures of a summer course given by Georges Matheron in 1970; initially written in French, they were translated into English by Charles Huijbregts. They do not contain mathematical technicalities or practical case studies; instead, they present major topics like estimation variances, kriging systems, mining estimation, and intrinsic theory, all of which are established by simple proofs. The reader is invited to wonder about the physical meaning of the notions Matheron deals with. When Matheron wrote these lectures, he considered the theory of linear geostatistics complete; however, what was an ending for Matheron has been the starting point for most geostatisticians. Many discovered the book’s content indirectly, via the many borrowings one can find in several books; in such a situation, it is always instructive to come back to the original document, where the author's motivations, his physical intuitions, and his thoughts on the meaning of what he does are detailed. The decision to publish this book was motivated by the desire to introduce Matheron’s work to a larger audience. The book has remained faithful to the original notes while introducing a common structure for the chapters and sections, numbering equations sequentially within each chapter, numbering the figures (most of which were redrawn) sequentially, and adding captions. In addition, Matheron’s comments on the exercises, or suggestions for solutions, have been added.

Making music is one of the most demanding tasks for the human central nervous system. It involves the precise execution of very fast and, in many instances, extremely complex physical movements that must be coordinated with continuous auditory feedback. Practice is required to develop these skills and carry out these complex tasks. This article discusses the neurobiological foundations of planning, motor learning, and practice. The first section introduces essential general information for musical readers concerning the organization of cortical, subcortical, and cerebellar motor systems in the brain. The second section addresses the brain processes during acquisition of skilled movements in music making and demonstrates the dynamics of neuronal networks. The third section reports new findings on practice strategies and performance quality. The fourth section presents the causes of degradation of skilled movements in professional musicians. The article concludes with some comments concerning the significance of results of brain research in order to improve practice habits and performance in musicians.

Freedom of expression and freedom of association are guaranteed by section 2 of the Charter of Rights and Freedoms. These freedoms are closely related, conceptually and philosophically, but evolved in different directions under the Charter. Whereas section 2(b)’s guarantee of expressive freedom generated a rich jurisprudence across diverse issues, section 2(d)’s attention focused on associational freedom in the context of labour union activities. The authors draw on a pocket of section 2(b) case law on picketing and other labour-related expressive activities to bring these guarantees into comparison. In doing so, they comment on the Supreme Court of Canada’s interpretation of each guarantee, including the constitutionalization of key aspects of labour relations under section 2(d). In addition, the authors critique the Court’s jurisprudence, emphasizing the central importance of protecting protest and dissent activities under both guarantees.

The book examines the extent to which States in the Pacific region have put in place legislative and administrative measures designed to promote and protect the rights of minorities and indigenous peoples within their State. The book starts by identifying and classifying the various States in the region, and commenting on general trends that are visible across the region. This analysis includes Australia, New Zealand, and the Pacific Island Countries in the geographic boundaries of Micronesia, Melanesia, and Polynesia. The region is assessed against human rights standards, and the extent to which State practice conforms to international standards. There are five chapters in the book. The opening chapter conducts a tour d'horizon of the Pacific, identifying the states, delivering a history of the development of the region, comments on theories concerning the original migration of peoples, narrates colonial expeditions and enterprises, and assesses the emergence of independent government and institutions. The record of engagement with international human rights law is examined, in particular the States' ratification of human rights covenants. The attempt to implement a regional human rights mechanism for the Pacific is described with the merits of such a project debated. The subsequent four chapters are case-studies, designed to expose in detail, the extent to which indigenous and minority rights are implemented in the Pacific. Four states were chosen as representative of the challenges that face these groups in the region: Australia, New Zealand, Fiji, and Papua New Guinea. Each chapter is broken-down into four sections, according to the structure of the book series engaging with the history, identification of indigenous and minority groups, the rights of indigenous and minority groups, and the legal and other remedies available.

This chapter examines the duty to consult doctrine, which is a particularly significant doctrine under Canada’s section 35 Aboriginal rights clause that is triggered hundreds of thousands of times a year. Since a series of cases in 2004, this doctrine has taken a particular proactive form in which the honour of the Crown leads to government duties of consultation when government decisions potentially impact on Aboriginal or treaty rights. This chapter explains the purposes and origins of this duty, considers its relationship to developing international norms on consultation and FPIC (free, prior, and informed consent), and considers a number of controversies that have emerged on the scope of its application. The chapter also examines the complex relationships of the duty to consult to administrative law contexts before turning to some final comments on potential future directions for the duty.

This chapter focuses on indigenous peoples, but will also seek to address the other significant minorities in contemporary New Zealand. The chapter proceeds as follows. Section 3.1 articulates the relevant history in order to understand the contemporary issues facing protection of indigenous and minority rights in the state. Section 3.2 identifies the groups that come within the purview of the definition of ‘minority and indigenous peoples’ and the range of needs these communities face. Section 3.3 portrays the range of ‘rights’ that currently exist in New Zealand law, drawing from the Constitution, special regimes as created through statutes, interpretation of case-law, and crucially the Treaty of Waitangi and its interpretation by the statutory body, the Waitangi Tribunal. Section 3.4 concentrates on the remedies available in New Zealand to tackle violations of the rights of indigenous peoples and minorities. It assesses the institutional framework for rights, and reassesses the remedies needed to arrive at a regime respectful of the rights of minorities and indigenous peoples. The concluding section offers a brief comment on the future protection of indigenous peoples and minorities in New Zealand.

This chapter examines disability discrimination law under the Equality Act 2010. It focuses on disability discrimination, with disability being treated as a separate protected characteristic. The chapter first considers the historical context and the possible conceptual approaches to the protection of disabled workers. It then addresses the definition of ‘disability’ in section 6 of the Equality Act. This is followed by an analysis of the employer’s duty to make reasonable adjustments in the workplace to accommodate disabled workers. Next, the ‘discrimination arising from disability’ concepts are discussed. Finally, the chapter presents some comments and observations on the current state of disability discrimination law in general, taking into account the recent introduction of the Equality Act and European developments.

This chapter discusses features of the extensively used attribution “art of listening” in contexts of therapy, partially New Age–like capacity building, sociology, and music. The second section comments on the relationship between music listening and music appreciation. The key assumption discussed is that understanding (described as a process of relating oneself to something or somebody) unfolds as activities that can be increased respectively between four poles: creating meaning, making music, generating emotion, and deepening reflection. Finally, the chapter returns to the question: Is listening to music an art—or not? Agreeing with Adam Heinrich Müller’s assumption that “the art of listening” stands for creating meaning autonomously, this question is answered in the affirmative.
