The 8th International Symposium "Monitoring of Mediterranean Coastal Areas. Problems and Measurements Techniques" was organized by CNR-IBE in collaboration with FCS Foundation, and Natural History Museum of the Mediterranean and under the patronage of University of Florence, Accademia dei Geogofili, Tuscany Region and Livorno Province. It is the occasion in which scholars can illustrate and exchange their activities and innovative proposals, with common aims to promote actions to preserve coastal marine environment. Considering Symposium interdisciplinary nature, the Scientific Committee, underlining this holistic view of Nature, decided to celebrate Alexander von Humboldt; a nature scholar that proposed the organic and inorganic nature’s aspects as a single system. It represents a sign of continuity considering that in-presence Symposium could not be carried out due to the COVID-19 pandemic restrictions. Subjects are related to coastal topics: morphology; flora and fauna; energy production; management and integrated protection; geography and landscape, cultural heritage and environmental assets, legal and economic aspects.

Abstract:
Corporate participation within deep seabed mining raises unique challenges for international law. Commercial investment by private corporate actors in deep seabed mining is increasing. The deep seabed beyond national jurisdiction (the Area) comprises almost three-quarters of the entire surface area of the oceans, and it is home to an array of prized commodities including valuable metals and rare earth elements. These resources constitute the common heritage of mankind. Acting under the United Nations Convention on the Law of the Sea (UNCLOS), the International Seabed Authority (ISA) is responsible for regulating the Area for the benefit of humanity and granting mining contracts. Although mining activities in the Area remain at the exploration stage, in recent years, there has been a marked growth in investment by private corporate actors, and an increasing impetus towards exploitation. This increasing corporate activity presents challenges, including in relation to matters of common management, benefit sharing, marine environmental protection and investment protection. In part, these challenges stem from the often-contentious role of non-state actors, such as corporations, within the international legal system. A product of its history, the UNCLOS deep seabed regime is an unlikely hybrid of capitalist and communist values, embracing the role of private actors while enshrining principles of resource distribution. As technological advances begin to outstrip legal developments, this study advances the discourse by addressing the extent of any tension between corporate commercial activity in the Area and the achievement of the common heritage of mankind.

Abstract:
Ranganathan’s chapter observes that the construction of the oceans as a global commons has changed over time. Once asserted as an arena of freedoms, the oceans are now enclosed in large part within national and international jurisdictions. However, sovereign rights are accompanied by community obligations. The deep seabed and its mineral resources, in particular, are designated the common heritage of mankind. The chapter traces the evolution of this concept. Following a roughly chronological approach, it situates legal developments in political and economic context. Noting that the concept does not conform to a broad narrative of progress—a high-water mark reached in the 1980s was followed by a period of recession—the chapter evaluates whether the current framework offers an appropriate expression. It supplies the tools for a fine-grained analysis of the degree to which international law realizes this particular community obligation in principle and in practice.

The legal status of plant genetic resources has been subject to numerous international agreements and laws over the centuries. The “common heritage of mankind” approach enabled free access but proved unworkable because of conflicts over intellectual property rights. The Convention on Biological Diversity (1992) recognized sovereign rights of nations over genetic resources within their territory. The Trade Related Intellectual Property Rights Agreement under auspices of the World Trade Organization mandated intellectual property protection for plant varieties, but synchronizing such rights has proved problematic. Many developing countries have enacted sui generis regimes to comply with TRIPS requirements. The International Union for the Protection of New Varieties of Plants Convention provides models that have changed over time. With the advent of agricultural biotechnology and availability of intellectual property rights for plant components, patents relating to plant genetic resources have increased. As plant genetic resources are subject to many overlapping treaties, the regime governing them is becoming more complex, resulting in inconsistencies and disputes. While the rights of plant breeders and the private seed industry are well protected in formal agreements, the rights of farmers, who have nurtured diversity in plant genetic resources, developed varieties of crops with different traits, and contributed to exchange and conservation of plant genetic resources, are left to the discretion of nation-states. Farmers’ rights are mentioned in many international legal instruments, but no binding treaty or convention mandates protecting and promoting the rights of working farmers.
