Full textThe impressive evolution of international relations during the recent years has reinforced the NGOs' role on the international scene, along with states and intergovernmental organizations. However, neither International Relations nor International Law are able to offer a definition and a clear description of their legal status. Despite the lack of legal personality, NGOs have asserted themselves as original actors in the international field. This study outlines the process of their contribution to international humanitarian law and to international law of human rights ; it discusses the impact of their participation on the international legal order. Due to their great power of proposal and their recognized legal expertise on the occasion of the training of the international law, NGOs are now major contributors to international fora, through contributions to international control and judicial procedures, and ability to mobilize public opinions. This increasing influence on international relations and law do not, yet, affect the normative power of states and intergovernmental organizations

Full textBased on the acknowlegement of mutual interests, the project for a new international economic order is an attempt at establishing a new type of relationships hitherto lying on the balance of power and the logic of conflicting interests. The hypothesis is that this claim to put forward new international cybernetics has been resisted by the ruling powers because it went against the current world system whose state of crisis helps indeed to hide geographical, political and technological basic redeployment. The demonstration, which falls into three parts, follows a machiavelian approach. The first part shows how the ideology of the world governing classes, whose paradigm of reference is transnationality, imposes a type of outward development weakening all the partners; such is the global logic which is challenged by the nieo project. The second part expounds the contents of the nieo which, through the various perceptions of the protagonists - upheaval for some, offer of cooperation for others - make up a doctine of socio-economic nationalism whose ambition is to reconcile economic growth and provision of the essential needs of the populations. The mythical dimension of the nieo project can be viewed, in terms of ethno-psychiatry, as a phenomenon of compensation and sublimation, and also as a counter-utopian project. The third part highlights the process of destruction of the nieo; first the noxiousness of the project and its "semi-socialist" character are exposed through doctrinal criticism and utopias that take over part of its contents, then the third-world states are intrinsically unable to sustain the overall dynamic of the nieo project. Eventually, the third world countries are brought into line by the geographical and geostrategical requirements of the two superpowers and are considerably weakened by the policies of multinational firms. The nieo project is wrecked by the logic of transnational capitalism

Full textThe Western Balkans (WB) were torn apart after 1989 due to wars, which were particularly cruel and problematic in Bosnia and Herzegovina, in Kosovo and in Albania. Western powers, and especially NATO and EU, could not anymore turn a blind eye. These conflicts indeed confronted European countries to war in a neighbouring state which could lead to destabilization of the region and to more migrants coming from the WB. This is the reason why NATO and UE have since been deeply involved in peace building and state building missions throughout the region. They started with implementing security and defense policies, then turned to enlargement policy. These organisations’ actions, as well as the efforts done by the WB, led to the end of the war and, to a certain extent, to a stabilization of these countries which is however not fully achieved. WB State security is indeed still a major objective. The threat lies nowadays in the non consolidaton of state institutions and democracy.Our thesis is aiming at analyzing the stabilization of the WB since the fall of the Berlin wall. It will focus on studying and confronting a complex set of actors, goals, means and processes in order to have a better understanding of the evolution of the stabilization of the region. In order to analyze this complex process, we are using a model based on the concept of « security communities » (SC) developed by Deutsch and al., at the end of the 1950’s. However, for the need of our study, we will « reconceptualize » this concept using several variables selected in europeanisation and democratisation studies which the authors could not have predicted at the time they elaborated their concept of « security communities ».Therefore, the concept of SC, « reconceptualised », helps answering our research problem : why and how has a SC including countries from the instable region of the Western Balkans been built on the European continent, around NATO and the EU, since the fall of the Berlin wall ?Our research hypothesis consists in the combination of two elements to explain the building of a SC: on one side, an exogenous pressure from regional organizations imposing concrete changes in terms of democracy and securitization and, on the other side, the acceptance of these demands from both the elites and the population of the concerned countries. In other terms, the more legitimized and implemented the pressure from these regional organizations is, the more probable is the creation of a SC.The dependent variable that we analyze is the building of a pluralistic European SC which includes the Western Balkans. The means for building this security community correlate with our independent variables which are endogenous and exogenous and have been selected in security, democratisation and europeanisation studies. On one side, exogenous variables stand on the role of external actors and factors (NATO and the EU) leading to the stabilization of the WB, and therefore to their contribution to the building of an European security community including the Western Balkans (ESCWB). On the other side, there is a range of endogenous variables being the role of internal actors and factors (elites and populations of the WB) in the shaping of ESCWB. We will show that both internal and external levels are in constant interaction.Our study results based on primary and secondary sources as well as semi-directed interviews and using the « process-tracing » method highlight two distinct periods regarding the building of the ESCWB: before and after the year 2000. Thereby between the fall of the Berlin wall and the year 2000, there is almost a complete lack of the necessary conditions to build a SC and therefore the ESCWB merely exists in an embryonic form. Full textThis study aims to show the diversity of the European community participation within the framework of international organizations. It is also important to evaluate the intensity of European community participation throught the study of how it exercises its competences within international organizations. As a matter of fact, a divergence may exist between the formal status the Community has in those organizations and the effective exercise of its competences by the European community. First, it is necessary to qualify the different status of the European community within the framework of international organizations, as observer, as "full participant" and as member. Despite its evolution and development, the international legal condition of the Community remains heterogeneous. Indeed, it non only depends on the scope of the Community's competences but also on the rules of the international organizations themselves without considering political aspects, which in fact play a decisive role. Second, the following questions are studied. Are pragmatic arrangements sufficient to ensure unitary representation of the Community and the Member states in the international sphere? Or is it necessary to codify the exercise of the competences of the European community and the Member states from the negociation process up to the process of implementation?
