Full textBetween the tradition of the writing and that of the orality, the formal writing, in Abidjan, is a writing between two. It is located between two cultures that convey an official language to the status legitimated by the constitution and the local languages from four linguistic groups and which , althought not taught, are commonly practiced by the populations. In such a situation diglossia and contrary to practices in french, wich oral, in francophone Africa, highlight a ownership of the French language by the phenomenon of interference lexical, syntactic and additions or truncations, formal writing appears as a document properly written of points of view syntactic and lexical. However, as in any meeting, the contact of the languages affects the behaviour of language speakers. In the framework of the formal writing, speakers take support on the oral devices, better known and better controlled, to build their writing. This device, characterized by an ethic of otherness which makes the talk an art, is a source of strangeness because of its expulsionof standards of the administrative writing. This strangeness reveals an aesthetic discursive particular. Thus, expression of the linguistic identity, administrative writing is also to perceive as the place of interculturality and, the speaker, a boatman favouring the necessary link between people and cultures

Full textA major point in the evolution of the relations between the administration and citizens, the right of access to administrative records, recognized in the united states since 1966, was established in similar terms by the french law of july 17, 1978. Based mainly on an analysis of the american system and on a comparison with the french experience, this research intends to measure the importance and the degree of efficiency of the right of access to administrative records in a western democracy today. After analysing the foundation and origins of this right, it would be necessary to first present its general structure. The conditions which define its field of application, from the point of view of the parties and documents involved, give a first indication of the extent and the limits of openness. The elements of organization of the right give a second indication. To guarantee the efficiency of this new right, certain types of nonjudicial and judicial control are established, revealing in particular the originality of the french system as compared to the american model. In both countries, however, limits are designated to protect legimitate secrecy. Interests of the nation or those of third parties impose, in fact, a specific system of protection, constituting one of the first conditions of viability of the right of access. If the proper balance between openness and secrecy is found, the institution of the right of access to administrative records should mark a certain progress for both the administration and for democracy

Full textWith decentralisation, local and administrative collectivities hnow an important change in their way of acting with elected executives, tranferences of competences coming from the state. Those collectivities can't be supported by the anteriority of experience to face it. It's an apprenticeship for the actors of those local communities. Communication is an outstanding element of that process. In short, why do organizations for producing communication exist rather than nothing ? The concept of institutionalization gives an answer : it's a process (notion of perennialty); communication becomes an element of local institutions (as a bureaucratic activity), local communication tends to represent a social institution (a whole of beliefs in efficiency of ommunication associated with ways of behavior found in firms, state, political, local, communications). Institutionalization is based, on the one hand, on the integration of communication as an element of coherence for organizations, and on the other hand, on the fucntion of the intruments subject of legitimation. Communication is already a means to control permitting a symbolic order of various departements under the authority of executive,which activity is broadly monopolized by departements of communication. Besides, beliefs or representations moves with the times in society contribute to institute communication as a factor of legitimacy adapted to institutional and political local configurations. So, it represents a support in the time for a political local order accepted, with a communication that represents, in a permanent manner, local field on a plurality of supports. Finally, local communication is going to construct a professional field

Full textBy subordinating the audiovisual communication activity to the obtaining from an "independent authority, the csa (conseil superieur de l'audiovisuel) prior administrative permissions, the legislator is in contradiction with the system of freedom he claims to protect : "the audiovisual communication is free". Actually as a counterpart of the granting od authorisations, the private services of audiovisual communication are submitted to some obligations. Abiding by them is ensured by an elaborate system of administrative sanctions that tend to replace repressions. Thus, having predominently recourse to administrative repression is veryhelpful for regulating audiovisual communication but detrimental to freedom. This repression is enforced by an administrative authority and thus the persons sanctioned do not enjoy the same legal guarantees as those available in the case of penal repression
