Scolieri, Paul A. Ted Shawn. Oxford University Press, 2019. http://dx.doi.org/10.1093/oso/9780199331062.001.0001.

Full text
Abstract:
This book is the first critical biography of Ted Shawn (1891–1972), the self-proclaimed “Father of American Dance.” Based on extensive archival research, it offers an in-depth examination of Shawn’s pioneering role in the formation of Denishawn (the first American modern dance company and school), Ted Shawn and His Men Dancers (the first all-male dance company), and Jacob’s Pillow (the internationally renowned dance festival and school located in the Berkshire Hills of Massachusetts). For many years and with great frustration, Shawn attempted to tell the story of his life’s work in terms of its social and artistic value, but struggled, owing to the fact that he was homosexual, something known only within his inner circle of friends. Though Shawn remained closeted, he scrupulously archived his journals, correspondence, programs, photographs, and motion pictures of his dances, anticipating that the full significance of his life, writing, and dances would reveal itself in time. By exploring these materials alongside Shawn’s relationship with contemporary thinkers who were leading a radical movement to depathologize homosexuality, such as the British eugenicist Havelock Ellis, writer Lucien Price, and sexologist Alfred C. Kinsey, this book tells the untold story of how Shawn’s homosexuality informed his extensive body of writings and choreography and, by extension, the history of dance in America.

Abstract:
This chapter examines how NFL Films' engagements with aesthetic traditions, the discourses surrounding the company, and its selective incorporation of positive critical reception into its publicity materials separate the organization from other sports media outlets and, by extension, distinguish the National Football League (NFL) from competing sports organizations. Throughout its history, NFL Films has taken great pains to emphasize its distinction within sports media and in the broader contexts of art and media culture. The company places its productions in dialogue with established aesthetic traditions, reinforces its producers' status as legitimate artists, advertises the various accolades it has received, and distances itself from NFL's commercial motives. This chapter explains NFL Films' use of aesthetic traditions and discourses to craft its image and position the company as part of an artworld—a status that is remarkably rare in sports television and in sports media more generally. It also considers how NFL Films situates Ed and Steve Sabol as artistic visionaries who play central roles in reinforcing its efforts to claim status as a site that produces art.

Langford, Rosemary Teele. Company Directors’ Duties and Conflicts of Interest. Oxford University Press, 2019. http://dx.doi.org/10.1093/oso/9780198813668.001.0001.

Full text
Abstract:
This book contains the most detailed multi-jurisdictional analysis of directors’ conflicts available drawing together relevant case law, codes and statutory regulation from the law applying to directors of companies incorporated under the UK Companies Acts, with extensive reference to the law in Australia, Canada, Hong Kong and New Zealand. The book provides comprehensive analysis of the conflicts faced by directors and includes the important areas of conflicts of interest, conflicts of duties, unauthorised profits, corporate opportunities, multiple directorships, nominee directorships, and conflicts involving stakeholders’ interests. Difficult aspects of these topics are analysed with reference to the laws of a range of common law jurisdictions. The extensive multi-jurisdictional analysis allows solutions to be presented in relation to difficult legal issues and enables clarification of the legal approach. In addition to detailed coverage and analysis of general law duties, the specific statutory duties are outlined and analysed including those concerning related party transactions. The UK Corporate Governance Code, and Guidance on Board Effectiveness, issued by the FRC in July 2018 are covered extensively. The book provides detail on fiduciary theory, the reach of the term ‘director’, consequences of a breach, remedies, authorisation and the role of disclosure. It also contains a detailed table of key cases concerning corporate opportunities which includes the pertinent facts, whether there was a breach of directors’ duties, and a summary of the important factors in the decision made. The cases are featured in order from instances representing clear breach to those in which no breach was found. The book is significant in its thorough coverage of general law and statutory duties relating to conflicts, and its clarification of the scope and application of currently complex and uncertain duties. It provides clear guidance to academics, practitioners, directors and regulators in each of the jurisdictions on the regulation of conflicts of interest and the implementation of good regulatory practice. This is a key reference work on this important and dynamic area of company law which provides careful analysis of the law set in a practical context.

Chenoy, Shama Mitra, ed. Delhi in Transition, 1821 and Beyond. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780199477739.001.0001.

Abstract:
Commissioned by the English East India Company to write about contemporary nineteenth-century Delhi, Mirza Sangin Beg walked around the city to capture its highly fascinating urban and suburban extravaganza. Laced with epigraphy and fascinating anecdotes, the city as ‘lived experience’ has an overwhelming presence in his work, Sair-ul Manazil. Sair-ul Manazil dominates the historiography of eighteenth- and nineteenth-century compositions on Delhi in Persian and Urdu, and remains unparalleled in its architecture and detailed content. It deals with the habitations of people, bazars, professions and professionals, places of worship and revelry, and issues of contestation. Over fifty typologies of structures and several institutions that find resonance in the Persian and Ottoman Empires can also be gleaned from Sair-ul Manazil. Interestingly, Beg made no attempt to ‘monumentalize’ buildings; instead, he explored them as spaces reflective of the sociocultural milieu of the times. Delhi in Transition is the first comprehensive English translation of Beg’s work, which was originally published in Persian. It is the only translation to compare the four known versions of Sair-ul Manazil, including the original manuscript located in Berlin, which is being consulted for the first time. It has an exhaustive introduction and extensive notes, along with the use of varied styles in the book to indicate the multiple sources of the text, contextualize Beg’s work for the reader and engage him with the debate concerning the different variants of this unique and eclectic work.

Abstract:
In a culture dominated by discourses of “colorblindness” but still rife with structural racism, digital and social media have become a resource for Black Americans navigating a society that simultaneously perpetuates and obscures racial inequality. Though the Ferguson protests made such Black digital networks more broadly visible, these networks did not coalesce in that moment. They were built over the course of years through much less spectacular, though no less important, everyday use, including mundane social exchanges, humor, and fandom. This book explores these everyday practices and their relationship to larger social issues through an in-depth analysis of a network of Black American digital media users and content creators. These digital networks are used not only to cope with and challenge day-to-day experiences of racism, but also as an incubator for the discourses that have since exploded onto the national stage. This book tells the story of an influential subsection of these Black digital networks, including many Black amateur podcasts, the independent media company This Week in Blackness (TWiB!), and the network of Twitter users that has come to be known as “Black Twitter.” Grounded in her active participation in this network and close ethnographic collaboration with TWiB!, Sarah Florini argues that the multimedia, transplatform nature of this network makes it a flexible resource that can then be deployed for a variety of purposes—culturally inflected fan practices, community building, cultural critique, and citizen journalism. Florini argues that these digital media practices are an extension of historic traditions of Black cultural production and resistance.

Azzara, Christopher D., and Alden H. Snell, II. Assessment of Improvisation in Music. Oxford University Press, 2016. http://dx.doi.org/10.1093/oxfordhb/9780199935321.013.103.

Full text
Abstract:
This article provides an overview of research on assessment of improvisation in music and offers suggestions for increasing its centrality in music teaching and learning. With listening, improvising, reading, and composing as context for music teaching and learning, it covers historical and philosophical foundations for, and research on, creativity and improvisation. The article’s synthesis of the literature focuses on assessment of ability to interact, group, compare, and anticipate and predict music while improvising. Six elements (repertoire, vocabulary, intuition, reason, reflection, and exemplars) contribute to a holistic and comprehensive creative process that inspires spontaneous and meaningful music making. The article concludes with recommendations for replication and extension of research to provide insight for improvisation assessment.

Full text
Abstract:
This chapter challenges the common modern differentiation between religious poems and hymns, emphasizing the category of poetry that promoted piety in a range of forms. Isaac Watts was a pervasive influence. Multi-authored Congregationalist, Methodist, Baptist, Presbyterian, and Unitarian hymn collections are examined, together with the methods and choices of the main editors, including the Wesleys, Whitefield, Ash and Evans, George Burder, and Andrew Kippis. The publishing and editing of poetry by a range of writers, famous and obscure, is compared. Milton, Young, and Cowper were the favourite religious poets, but many little-known writers published volumes of religious poetry or contributed to the religious magazines, with some of their poems being published posthumously. Readers and writers made extensive use of hymns and poems in private and in company, reading them in silence and aloud, quoting them in their manuscript journals and letters, and interweaving them in their prose publications.

Abstract:
There are many methods of exchanging occluded or clogged percutaneous catheters. Typically, catheter exchange is simply performed over a guidewire. When debris occluding the lumen is compact, chronic, or extensive, such exchanges are difficult. Because salvaging an obstructed catheter, without risking loss of access, is difficult, multiple techniques to preserve organ access have been developed. This chapter describes a technique whereby a peel-away sheath is advanced over the catheter to re-establish organ access and facilitate catheter exchange. The placement of a coaxial peel-away sheath is useful for exchanging occluded enteric catheters, biliary drains, abscess drains, nephrostomies, and even selected vascular catheters.

Guins, Raiford. Atari Design. Bloomsbury Publishing Plc, 2020. http://dx.doi.org/10.5040/9781474284561.

Full text
Abstract:
Drawing from deep archival research and extensive interviews, Atari Design is a rich, historical study of how Atari’s industrial and graphic designers contributed to the development of the coin-op cabinet. Innovative game design played a key role in the growth of Atari – from Pong to Asteroids and beyond – but fun, challenging, and exciting game play was not unique to the famous Silicon Valley company. What set it apart from its competitors was innovation in cabinet design. Atari did not just make games, it designed products for environments. With “tasteful packaging”, Atari exceeded traditional locations like bars, amusement parks, and arcades, developing the look and feel of their game cabinets for new locations such as fast food restaurants, department stores, country clubs, university unions, and airports, making game-play a ubiquitous social and cultural experience. By actively shaping the interaction between user and machine, overcoming styling limitations and generating a distinct corporate identity, Atari designed products that impacted the everyday visual and material culture of the late 20th century. Design was never an afterthought at Atari.

Stemplowska, Zofia. Should Coercive Neurointerventions Target the Victims of Wrongdoing? Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198758617.003.0019.

Full text
Abstract:
This chapter argues that victims of serious wrongdoing probably enjoy immunity from coercive interventions (CNIs) designed to induce them to comply with their duties towards the wrongdoers. More precisely, it suggests that even if they cannot appeal to the fact that CNIs undermine their autonomy in order to block their use against them, they have a separate strategy open to them: they can appeal to the fact that the use of CNIs against them can be seen as an extension of the original wrong done to them, and the worse the wrongdoing of which one is the victim, the more immunity one is likely to enjoy from CNIs, and the threat of their use. Thus, importantly, the victims of serious wrongdoing probably enjoy the immunity even if, as the author argues, it cannot be grounded simply in the fact that CNIs would violate their autonomy. The author then outlines how it can be grounded in the need to limit the original wrongdoing.

Strangleman, Tim. Voices of Guinness. Oxford University Press, 2019. http://dx.doi.org/10.1093/oso/9780190645090.001.0001.

Full text
Abstract:
At the Guinness brewery established at Park Royal in West London in the mid-1930s, workers enjoyed a well-paid job for life, one where they could enjoy free meals in silver-service canteens and restaurants. During their breaks, they could explore acres of parkland planted with hundreds of trees and thousands of shrubs. After work, they could play over thirty sports or join one of the theater groups or dozens of other clubs. On retirement, they received a company pension from a scheme to which they had never contributed a penny. They worked in buildings designed by an internationally renowned architect whose task was to create a building that would last “a century or two.” Voices of Guinness tells the story of the brewery from its planning to its 2005 closure, showing how the history of one plant reveals a much wider picture of changing attitudes to work and organizations in contemporary society. Voices of Guinness draws on extensive oral history interviews with staff and management as well as archive and photographic sources to explore the experience and meaning of work, the ultimate loss of employment, and deindustrialization for Guinness workers. It will be crucial reading for anyone interested in work history, contemporary organizations, and industrial loss.

Full text
Abstract:
Depression affects 9–13% of pregnant women and 12–16% of postpartum women. Rates vary depending on whether depressive symptoms or DSM diagnoses of depression are considered. Risk factors of perinatal depression include socioeconomic status, social support, personality style, personal and family history of depression, and hormonal changes. The Edinburgh Postnatal Depression Scale (EPDS) is a self-report instrument commonly used to assess for perinatal depression. The treatment of perinatal depression with antidepressant medication is controversial. Most guidelines recommend psychotherapy for mild to moderate depression and medication for moderate to severe depression. Established psychotherapies include interpersonal psychotherapy and cognitive behavioral therapy, as well as alternative therapies such as infant massage in the postpartum. Although extensive research on perinatal depression has been conducted over the past two decades, future research could include designing prospective, methodologically sound studies with larger samples to compare treatment modalities, teratogenicity associated with pharmacotherapy, and prevalence of perinatal depression in various cultures.

Abstract:
Almost five years have passed since the first successful edition of this work and for various reasons it was time for a new edition. Much relevant case law and legal literature have since been published which requires treatment. Furthermore, several hard and soft laws relevant to the book have undergone important changes, making a new edition necessary: the enactment of the new Chinese Civil Code, the French Civil Code following extensive reforms in 2016, the UNIDROIT Principles now apply as amended in 2016, and the INCOTERMS 2020 replace the former INCOTERMS 2010. Praise for the 1st edition: »an indispensable and compact reference guide that provides an ideal platform for scholars, practitioners (in-house counsel, legal advisors and advocates) and students internationally. The reviewer is temtped to extend this list to include commercial parties such as the importers and exporters as the writing is clear, concise and direct, contract clauses and practitioner tips sections are provided, and finally because the book provides illustrations to which they can relate.« Navin G. Cai, Congyan. The Rise of China and International Law. Oxford University Press, 2019. http://dx.doi.org/10.1093/oso/9780190073602.001.0001.

Full text
Abstract:
The rise of China represents a far-reaching process of international relations in the twentieth century, which should bring about extensive but uncertain ramifications. How China interacts with international legal order—namely, how China takes advantage of international law to facilitate and justify its rise and whether and how international law is relied upon to engage a rising China—has been inviting growing debates among academics and policy circles. A couple of recently eye-catching events, for instance, China-Philippines South China Sea (SCS) arbitration and the China-U.S. trade war, have intensified unease in international society. This book for the first time provides a systematic and critical elaboration on interplay between a rising China and international law. It focuses on several crucial issues, including: Is international law relevant to the rise of China? How has China adjusted its international legal policies as China’s state identity changes over time, especially as it rises as a new great power? What methodologies does China adopt to comply with international law, in particular, to achieve its new legal strategy of norm entrepreneurship? What is the typology of China’s engagement with international organizations? How does China organize its domestic institutions to engage international law to enhance its rise? How does China use international law at the national level (Chinese courts) and the international level (lawfare in international dispute settlement)? And finally, how should “Chinese exceptionalism” be understood? This book adds important literature on emerging comparative international law.

Abstract:
The point of departure of this book is the fundamental observation that actual conversations tend to consist of loosely connected, compact, and meaningful chunks built on a noun phrase, rather than fully fledged sentences. Therefore, after the treatment of elementary matters such as the Turkish alphabet and pronunciation in part I, the main points of part II are the structure of noun phrases and their function in nominal, existential, and verbal sentences, while part III presents their adjuncts and modifiers. The verbal system is extensively discussed in part IV, and in part V on sentence structure the grammatical phenomena presented so far are wrapped up. The first five parts of the book, taken together, provide for all-round operational knowledge of Turkish on a basic level. Part VI deals with the ways in which complex words are constructed, and constitutes a bridge to the advanced matter treated in parts VII and VIII. These latter parts deal with advanced topics such as relative clauses, subordination, embedded clauses, clausal complements, and the finer points of the verbal system. An important advantage of this book is its revealing new content: the section on syllable structure explains how loanwords adapt to Turkish; other topics include: the use of pronouns in invectives; verbal objects classified in terms of case marking; extensive treatment of the optative (highly relevant in day-to-day conversation); recursion and lexicalization in compounds; stacking of passives; the Başı-Bozuk and Focus-Locus constructions; relativization on possessive, dative, locative, and ablative objects, instrumentals and adverbial adjuncts; pseudo-relative clauses; typology of clausal complements; periphrastic constructions and double negation.

Abstract:
The subject of this chapter is the relationship between the Tuscan cities and the families belonging to the middle ranks of the lay aristocracy, from the late tenth until the early twelfth century. Taking the case-study of Florence as a starting point, a comparison with other cities of the Tuscan March in the same period (Lucca, Pisa, Arezzo, Pistoia, and Siena) will be sketched, to see that during the eleventh century we can find a similar situation in different contexts. In fact almost everywhere the ‘mid-level’ aristocracy held extensive and dispersed landholdings, many castles and private churches in the countryside, but important urban and suburban holdings as well. They established political, social, and economic connections with the primary wielders of regional power (the marquis, the counts, the bishops and other important ecclesiastical institutions) and gravitated on the cities, taking part to urban politics and probably living there some periods during the year. The situation in Florence, however, rapidly changed during the protracted crisis of the Tuscan March at the end of the eleventh and in the early twelfth centuries, when the rural aristocracy confronted a major crisis: many lineages rapidly fragmented, the splintered branches concentrated on building compact rural lordships, and they turned their backs on Florence, without playing a role in the emerging comune. But, in the same context of the decline of the March, in other Tuscan cities the separation between rural and urban aristocracies did not take place, or at least seems to have been not so stark and dramatic. Paying attention to the strength of several factors (power of the bishops, economic attraction, connections with powerful counts families etc.), different situations will be compared to reflect about the political behaviour of rural aristocracies and their degree of integration in the urban elites during the so-called ‘consular period’.
