Our aim is to investigate differential characteristics between gastric SRC and other non SRC carcinomas (nSRC). The present chapter focuses on the methodology underlying the ‘Common Core of European Administrative Laws’ project in general, and its first research output on public authorities’ liability in particular. This chapter explores the common and distinctive elements that emerge from the comparative analysis of legal systems, in terms of commonality and diversity in administrative law. It begins by outlining the main institutional features of the legal systems selected for the comparison, with an initial focus on the idea of a 'divide' between civil law and common law. The two important features of the legal systems examined in this book include judicial independence and judicial specialization. The chapter then discusses the procedural requirements at the heart of the factual analysis. This chapter compares the main strands in twentieth-century liberal thought: laissez-faire/libertarianism; social liberalism; pragmatic liberalism; and conservative liberalism/Ordo-liberalism. English-language accounts of the new liberalism have tended to neglect conservative liberalism/Ordo-liberalism in favour of social liberalism. This book seeks to remedy this neglect. Conservative liberals were as staunch opponents of laissez-faire as the social liberals and even more critical of pragmatic liberalism. They sought to anchor their thought about politics, economics, law, society, and culture around general principles and binding rules. Conservative liberals envisaged a morally disciplined population. For them, rules were enabling as well as constraining: character-building; consistent with intergenerational economic justice; and offering a sustainably prosperous and humane society in which individuals could flourish. Liberalism had to be safeguarded against self-destruction. The chapter examines conservative liberalism and Ordo-liberalism against the historical background of the first two transformational crises of liberalism, the 1770s to 1850s and 1918 to the 1950s, and raises the prospect of a third such crisis early in this new millennium. Conservative liberals were critics of the Enlightenment, without being counter-Enlightenment. They were deeply committed to aesthetic and intellectual values as the basis of human flourishing. The chapter also investigates the historical origins of the term Ordo-liberalism; the role of historical contingency; the significance of the ORDO Yearbook and Freiburg in certifying the ‘mainstream’; the role of German politicians in its memorialization; the role of the ‘strong state’; the misplaced hopes to which it led; and its effects on the reputation of this body of thought. The distinctive features of conservative liberalism are summarized.

In this brief chapter some reflections of a comparative nature between the Austrian legal order and some state systems of the German Empire are presented regarding the standards of judicial review adopted between 1890 and 1910. The comparison is based primarily on the research works of Angela Ferrari Zumbini and Lilly Weidemann, which, after a general introduction to the subject in the different legal orders, present a series of judgments issued by the administrative courts of last instance in that period. The questions in intellectual property (IP) law which most directly engage language fall into several types. ‘Language’ questions may concern particular signs or stretches of language examined for their registrability as a trademark, or disputed in relation to alleged infringement of literary copyright. Other kinds of words and phrases may also create difficulty, such as the words ‘distinctive’ or ‘generic’ which describe features of, and categorize, such signs or stretches of language. Such words and phrases establish a metalanguage that overlaps with frameworks in linguistics (e.g. ‘noun’, ‘consonant’) yet differs from such frameworks both in detail and purpose. Across all IP subject areas, a further kind of language, the field’s legal terms of art, defines the intangible subject matter, doctrines, and rationales of IP law, giving specialized legal meaning to otherwise general words and phrases whose meaning in law may nevertheless be contested. Such terms remain in concurrent use beyond law, with related but different meanings, and may therefore also be problematic when relied on in policy formation and in public debate about what IP is. ‘Language’ in these and other IP contexts is not, we argue, a single, unified topic. Rather, it consists of a number of very different kinds of language use, which raise different questions and call for varied forms of analysis. This chapter describes and illustrates those specialized kinds of language use. It also discusses prominent examples of research into them by legal scholars and linguists, and highlights further topics that may be amenable to linguistic investigation. In conclusion, we explain why specialist linguistic expertise is less important in such study of than interdisciplinary, legal and linguistic collaboration.
