Abstract:
INTRODUCTION. International legal policy is a new object in international legal studies, although this phenomenon exists as long as the external relations of States. International legal policy is a rare case of research subject, which remains unexplored. International legal policy as a Concept of State's policy towards legal aspects of international relations was formed in the 80-s of last century. Earlier the questions and their particular aspects now embraced by international legal policy were divided between international lawyers and international relations researchers. However international legal policy is an integral system of State's approaches to international legal matters, therefore its punctual research is relevant only from comparative point of view. It would be interesting to compare States' positions on concrete issues or States' tactics at different stages of realization of international legal norms. This article concerns the question whether comparative studies of international legal policy can be integrated into existing fields of comparative foreign relations law or of comparative research of international law.MATERIALS AND METHODS. The article surveys theoretic questions primarily on the base of doctrinal sources. The retrospective analysis of the comparative method in international law is based on works published by Russian and foreign experts during the XX century. Particular attention is drawn upon works of founders of comparative research in international legal studies. The concept of foreign relations law in the scholarship and practice of the U.S. is researched on the base of national case law, which formulated the principle of executive exceptionalism in State foreign policy. Research work is realized with the use of analysis, synthesis, systematisation, as well as methods of historical and comparative method.RESEARCH RESULTS. The Article consistently reveals meaning and the content of international legal policy as one of the authors of the concept, French lawyer and diplomat G. de Lacharriere, presented it. The Article examines the history of foreign relations law in the U.S. and presents its doctrinal estimations from viewpoint of American constitutional law. The research work specifies different points of view on content of foreign relations law and approaches to its justification. Indeed international legal policy and foreign relations law can be compared as two types of State’s approach to its legal position on the international scene. There are six parameters for comparison: sources, functions, subjects of both concepts, questions on allocation of foreign powers in the State, on relationship between international and national law, on the role of national courts in interpretation and application of international norms. In consideration of “national interest” concept the attribution of international legal policy to international organisations or supranational association is judged as incorrect. The article examines the question of applicability of comparative method in the international law within the discourse among scholars on how differently modern States evaluate international legal norms. Analysis of the tendency to contrasting States’ approaches to the international law encompasses its development from notions “international law of transitional period”, “international legal systems”, to notions “national approach”, “legal style”, “legal culture”. Brief survey of comparative international law gives perspective on diversity of approaches to comparable aspects of the international law. Comparative studies of international legal policy could get consolidated among them.DISCUSSION AND CONCLUSIONS. At first sight the comparative method is hardly applicable to the international law. However the universality of the international law doesn’t exclude variety of approaches to it. The research into international legal policy determined by national interests of every State allows to systemize positions of a State into a single strategy. At the same time comparative method doesn’t only provide classical comparison of States’ positions by issues, but also offers to compare inner-workings of the international legal policy and shaping factors. Nowadays in the context of trends on diversification of international relations (fragmentation, regionalisation), growing popularity of the comparative method translated into comparative foreign relations law and comparative international law. However international legal policy doesn’t correspond with categorial apparatus of comparative foreign relations law. International legal policy is nor able to apply methodological tenets of comparative international law due to its multivalued content. Most likely comparative studies of international legal policy can become a new approach within comparative international law, which should be based on the principles of concreteness and consistency.

Abstract:
This review essay draws on a recently edited handbook by Esin Örücü and David Nelken to reflect on the methodological concerns and challenges of comparative law and sociolegal research. It argues that the contextualisation of laws should be regarded as the indispensable methodological characteristic of all comparative studies of law that aspire to transcend the understanding of law as a body of rules and doctrine. It further argues that although the cultural perspective facilitates contextualisation of the law, a cultural understanding is neither a precondition for undertaking comparative legal research nor necessarily the correct approach under all circumstances; for certain aspects of law and legal behaviour need not be conceptualised in cultural terms. The essay concludes by proposing that the combination of top-down and bottom-up approaches could provide a meta-methodological framework within which specific comparative techniques can be employed. Such a framework will enable comparatists and sociolegal researchers to account for how law interacts with, and simultaneously manifests itself at, the macro-, micro- and the intermediary meso-levels of society over time.

Abstract:
The article examines the main directions of improving the methodology of comparative history of law in the context of comparative legal science. It is proved that the comparative historical approach includes a basic comparative historical method, and taking about the principles of interdisciplinary, it can integrate the methodological capabilities of those tools that are used in other areas of scientific knowledge. It is found that the comparative historical method integrates the existing ways, methods and techniques of comparative knowledge of all forms of reflection of historical and legal reality. It is revealed that the use of a comparative historical approach and method in the area of comparative history of law allows us to learn the general, special and unique in the historical and legal development of diverse manifestations and forms of reflection of historical and legal reality in relation to various "non-legal" phenomena. It is proved that such knowledge is based on the integration of subject knowledge and the plurality of their understanding. It is found that the comparative-historical approach can attract the possibilities of methodological approaches used in the Humanities and social Sciences and adapted to the knowledge of legal reality (anthropological, humanistic, civilization). In the comparative history of law area, they «aim» at the scientific study of historical and legal reality, and the comparative-historical approach integrates the acquired knowledge for the purpose of comparative research of the historical and legal development of its manifestations and forms of reflection. It is established that the comparative-historical approach not only integrates this knowledge, but also "processes" it in the comparative perspective of knowledge. It is proved that it becomes possible to receive and accumulate substantive knowledge about the historical dynamics of human and civil rights and freedoms, the legal status of various sectors of the population in any spatial geographical scope with the variety of their forms reflect, subject to the identification of common and different", "equal and opposite"; it becomes possible to clarify the common and different», «equal and opposite to the historical development of "human right" in different societies. It is proved that the comparative historical approach based on the recognition of the equivalence of the "legal values" of all civilizations and the fact that any civilization can not be considered as an ideal model, searches for and integrates the common and different", "identical and opposite", "common and different", "confrontational-dangerous", "sensational, explosive", that caused in history the non-perception and rejection of the "legal values" of other civilizations. AbstractComparative Legal Research (CLR) is a valuable tool for legal research because it expands the history of community experience. Understanding basic knowledge in different systems fills the knowledge gap. However, the principles of globalization and universal human rights require a greater role for systematic CLR. This article analyzes the role of comparative legal research in contemporary legal education. The discussion is based on the idea that it is useful to distinguish between the education of lawyers and the conduct of comparative legal research. Comparative law is a successful field of study that has ignited a growing interest in academic and legal education in recent decades. It is proposed to pay more attention to the comparative pedagogy of legal research in today's world, where law students must be prepared to function in a global context. While comparative academic research, the goal is to foster a deep cultural understanding of foreign law, but in legal education, the goal is to learn the spirit as an advocate. This article provides an overview of the key conceptual tools to tackle the problem of the comparative methodology by introducing the logical argument to help the researcher to filter his approach. A literature review method will adopt for this article.

In their contribution in this issue Mattias Derlén and Johan Lindholm use social network analysis to show that the European Court of Justice is a precedent-driven constitutional court that is comparable to the US Supreme Court with regard to the citation of precedents. The article and its use of network analysis as a method provoked a lively debate on the editorial board of theGerman Law Journalabout comparative law theory and methods generally and the place of empirical (including network) analyses in the comparative law discipline. For this reason, the editorial board commissioned this “special section” of contributions dedicated broadly to approaches to comparative law. In his essay in this section, for example, Jens Frankenreiter offers a detailed assessment of Derlén's and Lindholm's analysis. In this piece, we take a broader perspective and look at the utility and the limits of network analysis for legal scholarship generally.

Les disciples de Frédéric Le Play (1806-1882) ont cherché, par la constitution d’écoles, àperpétuer l’oeuvre de leur maître. En matière juridique, ils tentent de refonder le droit sur l’espritsocial. Celui-ci, frontalement opposé à l’esprit classique des juristes, fait d’abstraction etd’idéalité, doit permettre de réinsuffler le social dans le droit, saturé par l’idéologie des Lumières.Cet objectif passe notamment par une réflexion méthodologique sur la science juridique, quidoit allier le classique procédé déductif à l’induction des sciences sociales. Une fois le droit assissur la neutralité du fait social, il peut enfin être assaini de l’idéologie rousseauiste qui l’imprègneet, somme toute, dépolitisé. Les leplaysiens en retrouvent in fine le fondement dans la tradition,mélange d’immanence et d’historicité. Les disciples de Le Play, qui entendent promouvoir desréformes en vue de l’avènement d’une société traditionnelle vectrice de paix sociale, utilisentalors les sources formelles du droit. The followers of Frederic Le Play (1806-1882) sought by the establishment of schools, toperpetuate the work of their master. They indeed tried to reestablish social spirit as the true basisof legal science. The latter, frontally opposed to the classical spirit of Jurists, made of abstractionand ideality, must allow life to penetrate the field of legal science, saturated with the ideology ofthe Enlightenment. To achieve this objective, they develop a methodological reflection on legalscience, which must combine the classic deductive process to the induction of Social Sciences.Once seated on the neutrality of the social fact, legal science can finally be cleansed ofRousseau’s ideology and be, after all, depoliticized. The leplaysiens ultimately found the truebasis of law in tradition, defined as a mixture of immanence and historicity. The disciples of LePlay, who intend to promote reforms to the advent of a traditional society vector of social peace,then use formal sources of law. The latter appear truly manipulated : the followers of theengineer use indeed to suit their needs, both custom, jurisprudence and law to achieve theirreforms. It appears from this study that they have mostly influenced the Third Republiclegislation in a methodological and intellectual way

Abstract:
Although social policy was once perceived to be solely within the purview of the nation state, there has been a move toward a more European social policy. The European Court of Justice for the European Communities (‘Court of Justice’ or ‘Court’) determines the scope of European law and how it affects national welfare states. The court’s decisions will affect not only the national law of the member states with regard to social policy but also the direction of European social policy as it expands. However, the ECJ does not choose the policy areas in which it makes its decisions, but instead reacts to the preliminary references that are sent by the national courts of the Member States. These preliminary references from the Member States will set the Court’s agenda. Preliminary references are unevenly distributed across the Member States of the EU, and some Member States’ preliminary references are concentrated in particular policy areas. The jurisprudence of the Court, and consequently the social policy of the EU, could be steered by this uneven distribution. This thesis will answer the threshold question of why scholars of social policy should care about the Court of Justice, with a legal analysis of some key themes in the Court’s decisions in the area of social policy. It will then employ a mixed methods research design to explain the variation in rates of social policy preliminary references from the EU-15. First, a Time Series Cross-Section (TSCS) model will be used to test a series of hypotheses generated from the literature, and three novel hypotheses, in a dataset of social policy preliminary references from the EU-15 from 1996 to 2009. Next, a Qualitative Comparative Analysis (QCA) (Ragin 2000) will group the variables that were found to be significant into sets of conditions, or ‘causal pathways,’ that lead to higher and lower rates of social policy preliminary references. Finally, two qualitative case studies will be conducted, in the UK and France. Analysis of documentary evidence and 25 expert interviews in the two member states and at the Court of Justice will further explain and illuminate the differing usage of preliminary reference process. The analysis of the mixed methods is integrated in the final stage. Implications for the direction of EU law related to social policy and the future development of European social policy will be considered in the concluding chapter.

This study examines why Japan and Switzerland have chosen to keep the vocabulary of Article 9 and neutrality, respectively, and to reinterpret their definitions to suit their needs (policy reinterpretation), instead of simply abandoning the original policy and replacing it with a new, more suitably worded policy that clarifies the changing policy position of the government (policy abandonment). By analyzing the legal history of the overseas capabilities of the Japanese Self-Defense Forces and the Swiss Armed Forces, as well as the actions and influences of the government, political parties, and the public, this study finds the following trends. First, the government tends to refrain from policy abandonment either due to perceived public opposition or benefits in international negotiations. Second, party resistance is not an significantly influential factor in the choice of policy abandonment over policy reinterpretation. Finally, public opinion is influential, but self-contradictory; often supporting the change in policy (increased overseas capabilities of armed forces) but opposing the concept of policy abandonment due to high attachment to the respective policies of Article 9 and neutrality.

Дисертація є одним із перших у вітчизняній юридичній науці комплексним загальнотеоретичним монографічним дослідженням, присвяченим галузевій юридичній компаративістиці, визначенню її статусу, її взаємодії з іншими юридичними та гуманітарними науками, а також визначенню її місця в системі юридичної освіти. Здійснено аналіз наукової літератури, присвяченої галузевій юридичній компаративістиці, насамперед, шляхом виявлення таких основних недоліків, як: невідповідність більшості робіт у сфері галузевої юридичної компаративістики предмету юридичної компаративістики та методології порівняльно-правових досліджень; відображення тільки у назві деяких публікацій порівняльно-правового спрямування дослідження, тоді як самих їх розроблено на основі краєзнавчого підходу, тощо). Розглянуто основні підходи до визначення статусу галузевої юридичної компаративістики в системі юридичної науки. Перший підхід передбачає визнання її статусу як самостійної юридичної науки з властивим їй предметом дослідження та методологічною базою. Другий підхід передбачає визнання галузевої юридичної компаративістики як метода пізнання. Третій підхід – це є найбільш об’єктивний підхід, який розкриває сутність галузевої юридичної компаративістики та визначає її статус як допоміжну юридичну дисципліну в рамках юридичної компаративістики. Відповідно до цього підходу галузева юридична компаративістика і юридична компаративістика мають як «загальне поле», у тому числі методологічного характеру, так і власні специфічні інтереси. Галузева юридична компаративістика є допоміжною науковою дисипліною у рамках юридичної компаративістики. Оскільни на формування предмета галузевої юридичної компаративістики здійснює вплив також предмет відповідної галузі права, можна стверджувати про «подвійне підпорядкування» її предмета. Обгрунтовано тричленну структуру галузевої юридичної компаративістики, до якої включено компоненти загальної теорії юридичної компаративістики, компоненти загальної теорії відповідної галузі права та компоненти особливої частини відповідної галузі права у залежності від об’єкта дослідження. Визначено роль галузевої юридичної компаративістики в системі юридичної освіти. Виокремлено основні підходи до викладання галузевих порівняльно-правових дисциплін: вибірковий інституційно-проблемний, системно-правовий та інституційно-галузевий підходи. Сформульовано рекомендації, урахування яких дозволить поліпшити якість викладання юридичної галузевої компаративістики.
Диссертация является одним из первых в отечественной юридической науке комплексным общетеоретическим монографическим исследованием, посвященным отраслевой юридической компаративистике, определению ее статуса и потенциала взаимодействия с другими юридическими и гуманитарными науками, а также определению ее места в системе юридического образования. Осуществлен анализ научной литературы, посвященной отраслевой юридической компаративистике, прежде всего, путем выявления таких основных недостатков, как: несоответствие большинства работ в сфере отраслевой юридической компаративистики предмету юридической компаративистики и методологии сравнительно-правовых исследований; отображение только в названии некоторых публикаций сравнительно- правового направления исследования, в то время как сами они разработаны на основе страноведческого подхода. Рассмотрены основные подходы к определению статуса отраслевой юридической компаративистики в системе юридической науки. Первый подход предполагает признание ее статуса как самостоятельной юридической науки с присущими ей предметом исследования и методологической базой. Второй подход предполагает признание отраслевой юридической компаративистики в качестве метода познания. Третий подход признает отраслевую юридическую компаративистику как вспомогательную юридическую дисциплину в рамках юридической компаративистики. Отмечено, что наиболее объективным подходом, который раскрывает сущность отраслевой юридической компаративистики, определяет ее статус, является подход, согласно которому отраслевая юридическая компаративистика и юридическая компаративистика имеют как «общее поле», в том числе методологического характера, так и собственные специфические интересы. Отраслевая юридическая компаративистика выступает в качестве вспомогательной научной дисиплины в рамках юридической компаративистики. Поскольку на формирование предмета отраслевой юридической компаративистики оказывает влияние также предмет соответствующей отрасли права, можно утверждать о «двойном подчинении» ее предмета. Обоснована трехчленная структура отраслевой юридической компаративистики, в которую включены компоненты общей теории юридической компаративистики, компоненты общей теории соответствующей отрасли права и компоненты особенной части соответствующей отрасли права в зависимости от объекта исследования. Определена роль отраслевой юридической компаративистики в системе юридического образования. Выделены основные подходы к преподаванию отраслевых сравнительно-правовых дисциплин: выборочный институционально-проблемный подход, когда для сравнительно-правового анализа берётся несколько стран и ограниченное число тем; системно- правовой подход воплощается в процессе реализации права в основных правовых системах; институционально-отраслевой подход, когда наряду с рассмотрением общих вопросов, посвященных закономерностям и тенденциям развития регулирования тех или иных правоотношений, своеобразия правовых систем современности дается сравнительно-правовое описание развития отраслей права. Сформулированы рекомендации, учет которых позволит улучшить качество преподавания юридической отраслевой компаративистики.
The thesis is one of the first complex general theoretical research in domestic legal science, which dedicated to the branch legal comparativistics, its status definition and to its potential cooperation with other legal and humanitarian sciences and the determination of its place in the system of legal education. The analisys of scientific literature dedicated to the branch legal comparativistics by identifying the major disadvantages such as: inconsistency of the majority of works in the field of branch legal comparativistics with a comparative law subject and methodology of comparative legal studies; displaying only in the name of some publications of comparative legal research direction, while they themselves are based on a regional geographic approach. The basic approaches to the determination of the status of branch comparative law in the system of jurisprudence are examined. The first approach involves the recognition of its status as an independent legal science with its inherent subject of research and methodological base. The second approach involves the recognition of branch comparative law as a method of cognition. The third approach recognizes the branch of comparative law as a supporting legal discipline within legal comparativistics. It was noted that the most objective approach that reveals the essence of branch legal comparativistics, which determines its status, is the approach that the branch legal comparativistics and comparative law has as «total field», including methodological, and their own specific interests. Branch comparative law acts as an auxiliary academic discipline within the framework of comparative law because on the formation of the subject of branch comparative law also affects the subject of the relevant branch of law, one can argue about the «dual subordination» of its subject. Substantiated the tripartite structure of branch comparative law, which includes the components of the general theory of comparative law, the components of the general theory of law and the relevant sector of the respective components of the particular branch of the law, depending on the object of study. The role of branch comparative law in the system of legal education is determinated. The basic approaches to the teaching branch comparably-legal disciplines are: selective institutional and problematic approach, when several countries are taken for comparative legal analysis and the limited number of themes; system-legal approach, embodied in the process of realization of the law to main legal systems; institutional and branch approach, when in addition to considering of general issues dealing with laws and regulatory trends in the development of these or other legal relations, legal identity of modern systems, given a comparatively legal description of the branches of law. Recommendations, taking into account which will improve the quality of teaching comparative law branch are given.

This chapter considers the history of comparative law. The birth of comparative law as a discipline can be traced back to the year 1900, when the Congrès International de Droit Comparé in Paris raised it above the level of singular, disparate, albeit remarkable studies and treatises to a collective, concerted venture guided by theories, methods, and projects. Before 1900 there was little interest in systematic legal comparison. Comparative law was marked, in the Western comparative community, by a significant inferiority syndrome. Comparatists felt neither adequately recognized by their academic peers nor sufficiently represented in the law school curriculum. Today, the (changing) reality of curricular marginality and comparative law’s growing popularity appears to nourish the hope for the well-deserved invitation to the field of the legal sciences.

AbstractThis chapter contains the meso component (Qualitative Comparative Analysis, QCA). It discusses the QCA research model, the QCA methodology, and the analysis of the QCA results.QCA is used to analyse both quantitative and qualitative data, thus enabling causal inferences. However, QCA is not a statistical technique that focuses on the likelihood of the relations among variables. Instead, it is a method based on Boolean logic, rooted in set theory, and founded on the notions of sufficiency, the necessity of conditions, and conjunctural causation.QCA results indicate, among others, that for high competitiveness, high EPI suffices if Concordats with the Vatican are low and if the Roman Catholic and Orthodox population is low. No State Religion positively affects competitiveness. Having Concordats with the Vatican negatively influences competitiveness. Additionally, factors like German, English, and Scandinavian legal origin help to increase competitiveness.Oppositely, QCA results for high corruption indicate that Concordats in combination with Roman Catholic religion adherence increase corruption. Orthodox religion has a similar negative effect. Most countries with high corruption are of French legal origin and have high Concordats. This trend is robust.Colombia and Switzerland (the two extreme cases) exhibited several consistent QCA results. The other two cases (Cuba and Uruguay) only revealed one or two consistent outcomes.

AbstractThis paper will discuss the characteristics of the court system and proceedings in the Nordic countries. The analysis is based on the idea of Nordic legal systems as a group bound both by historical similarities between them and by advanced legal cooperation between different legal actors. First, the main features of socio-legal developments, legal theory and legal practices characterising Nordic legal systems are discussed. Then, ideas, methods and results of cooperation in the field of law are described. ‘Nordicness’ within legal and judicial institutions is highlighted with three examples. The first example concerns popular participation, especially the importance of lay judges. The second example concerns the relationship between the legislator and the judiciary and the non-existence of constitutional courts. Finally, the third example discusses the many modes of conflict resolution typical in the Nordic countries.

Functionalist study and cultural immersion give social dimension to the comparison. In the context of multicultural society and march of globalization, CLR has attained great scope and potentiality. Abstract:
The Soviet legal system did not assume any division of law into private and public constituents since communist ideology did not recognise anything private as such. The end of the communist experiment and Russia’s transition to democracy, a state governed by the rule of law, a social market economy and respect for human rights logically led to the need to revive private law and its further development, and therefore the idea of dividing law into private law and public law became relevant in legal doctrine. The article contains a brief comparative analysis of Russian and French legal theories in terms of the concerned problem. The methods used are comparative law, legal hermeneutics, the formal legal method and certain elements of cultural and historical analysis. Despite the conventionality of the public-private law dichotomy, its theory is based upon the actual legal reality of the Romano-German family of legal systems; this theory is not just an abstract theorisation, but is feasible. Unlike the French theory, Russian jurisprudence applies an approach suggested by S.S. Alexeev, who points to the conceptual rather than classification-based nature of the dichotomy in the first place, stressing that private law expresses the most important essence of law as a whole and the new trend in its develop ment is to include human rights. Based on this analysis, it is concluded that human rights are the common part that unites public and private law, and therefore their unity is inseparable: prejudice to human rights, as the experience of building communism in Russia (and in other communist countries) showed, inevitably leads first to the destruction of private law, and then to the transformation of public law into a pseudo-legal system.

The issue of intellectual property is inevitable for an engineering design course today. Traditionally, it would be discussed separately from the technical or the legal perspective. But they are two sides of the same coin. In the course of comparative analysis of patent dispute, the case method was used to treat the issue involved from both perspectives at the same time. Patent disputes are mainly concerned with the issue of patentability or infringement, and normally both involved. For analysis of a dispute, it is normally required to compare the elements of the invented object with either the prior arts or the alleged infringement, depending on the cases. For such legal analysis one can instead take design methods such as TRIZ (an acronym in Russian standing for “theory of inventive problem solving”) and SCAMPER (an acronym standing for “substitute, combine, adapt, magnify or minify, put to other uses, eliminate or elaborate, and rearrangement or reverse”) to check the design concepts or the inventive principles behind the objects, so that the students can learn the innovation methods and the legal procedure at the same time. In this paper pedagogical experience with concrete examples was demonstrated.

The outbreak and the rapid spread of global COVID-19 pandemic have put significant strains on the institutions. The need to adapt to “new normal” and contain the rapid spread of disease, while maintaining a functional society, resulted with introduction of numerous new legal mechanisms and adaptation of the existing ones. However, it seems that one area of law remains on the fringes: the regulation of wills. Even before the start of the pandemic many authors often pointed to the fact that the current legal framework does not follow modern technological developments, but no significant attempts were made to overhaul the inheritance law. Also, once the pandemic started in its full, there were no references to introduction of extraordinary mechanisms or new legal solutions to overcome the potential difficulties in forming wills. Comparative analysis yielded no better results: although some countries (such as Austria) recently completely overhauled their regulation of inheritance law, it seems that no attempts were made to introduce new types of wills or new methods of drafting wills into their regulations. Furthermore, following the spread of the pandemic, increasing number of potential testators find themselves unable to use traditional methods of drafting wills as they, or the authorized persons tasked with assistance and creation of wills, remain isolated from one another due to various reasons (lock-downs, isolation in case of experiencing symptoms, etc.). Having in mind these circumstances, it is necessary to ascertain whether there is a genuine need to introduce new types of wills into existing legal framework, or to adapt the current legal framework by facilitating the communication between citizens and the institutions. Also, it is necessary to analyze whether the interpretation of the existing legal framework enables the introduction of certain facilitating mechanisms. In order to reach these goals and clarify the possibilities within the current legal framework, interpretative and comparative method are used.

This legislative activity is the harmonization of the legislation of the Republic of Serbia with the acquis communautaire in the process of joining this significant European association. The paper examines and analyzes the notion of European society, the way of its establishment, management and termination, as well as other important issues that are necessary for a comprehensive overview of the legal position and role of this society in our legal system. The research uses primarily a normative method by analyzing legal solutions relating to the European society, as well as a comparative method by which the solutions contained in our law are compared with the solutions from the Council Regulation (EC) on the Statute of the European societies. At the end of the work, an appropriate conclusion was given indicating the significant benefits that such a legal form of a business (stock) society could bring to our economy.

The relevance of the topic is that the continuous and rapid increase in the role and volume of information in human life leads to the need to develop ways of protecting private information as a subject of personal property and personal value. Privacy is a natural human right and is enshrined in the European Convention on the Protection of Human Rights and Basic Freedoms, as well as in the Constitution of the Russian Federation. The regulation of the right to privacy is enshrined in the Russian Civil and Criminal Codes, which provide for legal liability for violations of this right. However, with regulations in place, the human element remains and often leads to leaks of private information, which destroys the personal value of the right. The article examines the concept of the right to privacy, its importance in the information society and human life, and the ways in which it can be protected. The aim of the study is to identify ways of protecting and complementing the right to privacy in the information society. The comparative legal analysis method allowed us to identify the mechanisms for the legal protection of the right to privacy. The case-analysis method enabled us to analyse Yandex’s data breach situation, while the content analysis method allowed us to make recommendations for protecting personal data. Main conclusions: the right to privacy as a personal value in the information society has not been sufficiently addressed in the scientific literature; self-protection as well as raising human legal awareness of information technology can be used as mechanisms to protect privacy.

Nowdays intellectual capital has become one of most important resources which provide sustainable competitive advantage for a company. Despite it, intellectual capital in companies in Latvia is lim-ited. Previous studies, conducted by the authors, showed that one of the factors that influence intel-lectual capital in companies is legal protection of intellectual capital. The purpose of the study is to analyse the concept of intellectual capital in legislation in order to clarify the understanding of the concept of intellectual capital. The following qualitative and quantitative research methods have been used: logical and comparative analysis, the deductive method, the statistical method, the empir-ical method and the induction method. The current study results show that an additional factor, which influences the intellectual capital development in companies in Latvia, is lack of uniform ap-proach to the concept of intellectual capital in legislation.

When carrying out the research, the following scientific methods of cognition were used: the method of comparative analysis, which made it possible to identify the advantages and disadvantages of the distant form of education in the context of the coronavirus pandemic; the method of quantitative analysis, allowed the authors of the article to better orient themselves in the general pile of facts, as well as to model the existing social processes in the field of education and society as a whole during the coronavirus pandemic; the use of the systemic method in the study of the subject of research made it possible to single out the determining factors influencing the reproduction of social experience in order to streamline and stabilize the spiritual and moral foundations, communication processes as the most important condition for the socialization of the individual; the formal legal method was used in the study of various legal documents; content analysis was used to study a set of statements on a specific topic.

Abstract:
This project aimed to research the effectiveness of Australian age discrimination laws. While demographic ageing necessitates extending working lives, few question the effectiveness of Australian age discrimination laws in supporting this ambition. This project drew on mixed methods and comparative UK experiences to offer empirical and theoretical insights into Australian age discrimination law. It sought to create a normative model for legal reform in Australia, to inform public policy and debate and improve responses to demographic ageing, providing economic, health and social benefits.
