Full textThe concepts of "contracting authority" and "contracting entity" are the defining elements of the personal scope of the EU Directives on Public Sector and Utility Sector Procurement. The content of these concepts is determined according to a functional approach which raises a number of questions in relation to various notions of domestic law. A comparative study of three representative legal orders, namely French, German and English Law, illustrates these questions which revolve around two issues: the legal form of the purchasers and the nature of their dependency on the State. The first issue involves studying the extent to which the public or private nature of an entity as well as, more generally, the existence or lack of legal personality, have an impact on the implementation of the concepts of "contracting authority" and "contracting entity" in domestic law. Based on the relevant EU and national case law as well as on other specific national provisions, the second issue involves examining the extent to which the nature of an entity's activity and its different ties in particular financial, with the State justifies the application of the public procurement rules on such an entity

En esta investigación se fundamentan los aspectos jurídicos que deben sustentar la noción de funcionario público en Cuba, que han de servir de base al sistema de organización de los servidores públicos en el ámbito administrativo. Con ello se propugna contribuir al mejor funcionamiento de la Administración Pública y a elevar la calidad de la gestión pública. A tales efectos, se realizan precisiones teóricas que permitan delimitar, gnoseológicamente, la categoría funcionario público en el contorno jurídico nacional. De conformidad con los objetivos trazados, se dedica un primer capítulo al estudio de la función pública, como presupuesto para la noción de funcionario público, y se propone su concepción como técnica jurídica de ordenación de los medios personales al servicio de la Administración Pública. En un segundo capítulo se analizan aspectos de la evolución histórica y construcción doctrinal de la categoría funcionario público y se valoran los elementos teóricos sobre los que debe sostenerse su noción jurídica. Por último, se aborda, en un tercer capítulo, lo relativo a la evolución del sistema de función pública y de la concepción de funcionario público en el escenario cubano, su regulación actual y se proponen pautas para la implementación de la propuesta que se realiza

Full textSeeking unity between private and public contracts is ultimately intended to demonstrate the existence of a base, a law common to private and public contracts, at the stage of their conclusion. However, if the unity, in terms of private and public law, of the basic elements of the contract may prove to be imperfect, two concepts may bring cohesiveness to the legal phenomenon of the unity of contracts: the general concept of contract in its role as a founding principle of the phenomenon of unity enables a uniform definition for the contract to be sought, the expression of which is the concept of consent whereas the notions of object and cause reveal themselves to be main instruments of identification, ancillary to the phenomenon of the unity of contracts. Thus, if multiple contracts exist, there only exists one concept of the contract. If there are an infinite number of objects, causes and means of consent, there is only one concept of object, cause and consent. The unity of private contracts and public contracts is this: the reduction of a multiplicity of notions into one basic framework, the concept of the contract

Full textThe notion of “filiation” refers to the family relationship between a parent and a child, which place each on ein a family lineage and identify him from the members of his family. Because of its universality, it seemed appropriate to examine how two different legal systems, such as those of civil law and common law , understood it. Referring intuitively to a genetic link between parent and child, the notion of “filiation” could be, at first sight, reduced to a physical aspect. However, the law recognizes that it covers other realities like social and emotional ones. Thus, it reveals a more complex concept. In recent years, a tension appeared between genetic reality, which became available thanks to advances in science, and will, used to base alllegal fictions such as adoption, assisted reproduction and surrogacy. The law seeks to check and balancethese foundations with the child's welfare and public policy.The comparative study of French and English law also revealed a growing dissociation between the notion and its effects. Indeed, the effects can be assigned independently of the legal existence of the link. This dissociation has revealed a more precise one between the status, that is to say the initial link which isattached the effects, and the role, that is to say, the behavior which will receive all or part of the effects of filiation. Then, the effective exercise of this role can re-aggregate the effects of filiation. Thus, it is questioning the notion on its ability to account for changes in the family law

Full textPenal offense and then contractual fault, the strike became a constitutional right in France and Benin. This consecration comes in paragraph 7 of the Preamble of the French Constitution: "the right to strike is exercised within the framework of the laws that regulate it". Article 31 of the Beninese Constitution of 11 December 1990 states: "The State recognizes and guarantees the right to strike. Any worker may defend his interests, either individually or collectively or through trade union action, as provided by law. The right to strike shall be exercised in accordance with the conditions laid down by law ". As the formulas adopted by the French and Beninese constituents were almost similar, it was the legislator who had the task of clarifying the scope of beneficiaries. In common, apart from some variable legal limitations, the right to strike is found both in the public sector and in the private sector. The Beninese and French legislators have specified the conditions under which the right to strike can be exercised and the formalities or procedures to be respected before the strike begins. The French legislature imposed guarantees on the exercise of the right to strike by opting for the principle of the suspension of the employment contract of the striking employee and the maintenance of employment if the strike takes place under certain conditions. Only the gross negligence attributable to the employee makes it possible to terminate the employment contract. The Beninese legislature has not expressly enacted the same rules, leaving the case law to protect and guarantee the exercise of this constitutional right. The powers traditionally recognized by the employer are subject to scrutiny when disciplinary proceedings are instituted against strikers or in the event of a pay deduction for strike action. Protection is only in favor of a strike based on professional demands. In order to properly exercise the right to strike, strikers must inform the employer in advance of their claim so that they can respond to it and avoid the strike if possible. The right to strike must be exercised in the permanent search for compatibility with other constitutional freedoms (property rights, freedom of enterprise, freedom of labor, etc.). There are voluntary conflict prevention and resolution procedures in both countries. The exercise of the right to strike is subject to the invocation of a superior interest such as the general interest, but also sometimes to the obligation imposed on employees to observe a minimum service or even to respond to a requisition order. The system of requisitioning strikers differs in its implementation in Benin and French law. On the other hand, the obligation to observe a long notice as well as the multiplication of preliminary remedies is part of strategies to delay or make difficult the strike. In Beninese law, as in French law, certain grounds or methods of strike are prohibited. By way of indication, the requirement to call a strike by a representative trade union in the public sector constitutes a point of divergence between Beninese and French rights. On the other hand, in both countries, the "statute" of an employee's striker does not preclude the possibility that, in the event of an abnormal exercise of the right to strike, civil or criminal liability may be exercised
