Abstract:

This Master thesis enhances an existing library search system with a new dynamic web interface and introduces the ability to perform remote searches by using Web Services. The remote search functionality also includes the ability to compress SOAP-messages, this functionality is optional. The system is implemented using the Microsoft.NET Framework with Visual Studio C#. A library needs to store information about articles and we have chosen to use a Sybase Adaptive Server Anywhere database.

The practical part of this thesis describes the architecture of our implementation and the design process.

The theoretical part is a comparative study between dynamically created web pages and static pages, SOAP-compression versus no compression, SOAP-optimization versus no optimisation and the use of Web Services locally versus local classes.

Abstract:
The purpose of this research study is to examine the present state of Insurance law in Cameroon with particular reference to motor insurance, bringing out the fact that with the exception of certain areas, there exist two systems of insurance law in Cameroon; one in the English-speaking part and the other in the French-speaking part. This work proposes that this distinction ought not to continue and advocates the unification of insurance laws. For reason of space not all the fundamental principles of insurance law and regulation will be attempted: hence some valuable material cannot be included in this thesis. Motor vehicle insurance was chosen for these reasons. First, it is the most common form of insurance in both English and French-speaking Cameroon. Second, it is, in practical terms, the most important type of liability insurance. It is therefore, of greatest interest and relevance to the Cameroonian public comprising insurance companies, policyholders, victims of accidents and the dependants of victims. This has led the state to intervene in regulating motor vehicle insurance a great deal more than in other branches of insurance. The approach adopted throughout is a comparative one, involving English, French and Cameroonian law. , In order to provide the reader with a background to the existence of the two legal systems in Cameroon, the introductory chapter traces the evolution of law with particular reference to the colonial era. The Reason for Government Regulation of certain aspects of insurance law in the countries involved is then examined (Chapter One). This intervention has been exercised through Government Control of Insurance Concerns (Chapter Two), Compulsory Motor and other Insurances (Chapter Three), the provision of a .Motor Insurance Fund (Chapter Four) and Regulation of Insurance Intermediaries (parts of Chapter Six). In the above areas where the government has intervened there now exists considerable uniformity in insurance law and practice throughout the Republic of Cameroon. However, there are still other aspects of the insurance transaction in which there are no uniform laws (see parts of Chapter Three dealing with the conceptual basis of liability and parts of Chapter Six dealing with Insurance Intermediaries and Disclosure. Further, see Chapters Five, Seven and Eight dealing with the Formation of the Insurance Contract, the Construction of the Insurance Contract and the Settlement Process respectively. Finally, this work concludes with proposals for reforming the present laws based on the material discussed, and in particular, a proposal for a Uniform Insurance Code for Cameroon.

Societies in general, and the developed ones in particular, are trying hard to control the use of the new educational means to re-educate adults in accordance with the high speed developments in all fields of life. In developing countries, there is still a tendency to identify adult education with literacy campaigns and other basic education programmes. Therefore, whatever the interest and whatever the country, adult education means education for life in its widest sense. Its main purpose is to give a chance to men and women to increase their actual activity in their societies, their responsibility towards them and their share of knowledge. The Egyptian society is facing the following problem: the necessity of reorganising educational programmes for adults in different specialisations with the aim of modernising their knowledge and giving them new skills to meet the continuous changes in the methods of production. To achieve this, we should review first what the advanced world is doing to know where exactly we are. The aim of this study is to throw light on the experiences of the advanced countries in the field of adult education with the purpose of benefiting from them and applying them in the Egyptian society after processing and assimilating them within the characteristics of the society. The task of this thesis is to compare the experiences and ideas of an advanced country, England, which has a very comprehensive "system" of adult education, with those of a developing country, Egypt, in the hope that the two countries can learn something from each other.

Abstract:
This study looks at the nutritional literacy of20 Greek and 20 British students who were about to complete higher secondary education. The meaning ofa balanced diet is discussed and a model is proposed according to which a balanced diet aims at the promotion ofthe overall health ofthe individual and not only the prevention of diseases. The various social psychological theories that have been used in surveys and health interventions are reviewed. Nutritional literacy is analysed with regard to four issues: understanding of health, understanding ofa balanced diet, ability to make informed food choices and ability to describe and comment on one's own dietary habits. For the exploration of these issues, an interview was selected as the research instrument because it is resilient and can focus on each subject's views. The schedule ofthe interview was developed through three series ofpilot interviews. The data collected were analysed qualitatively, but some statistical methods were also deployed. Students defined health positively, i.e. in terms ofgood health rather than the avoidance ofill health, and referred mainly to bodily health. They spoke about habits that we must adopt rather than about habits that we must avoid. Diet and exercise were the most often reported health-promoting habits. For most ofthe students, bodily growth and good looks were the aims ofa balanced diet. Some students reported the prevention of cardiovascular diseases through diet, but most ofthem ignored the links between the type ofdiet and cancers ofthe digestive tract. Some students interpreted nutritional information in a way that reflected their own strongly held views about the nature of a balanced diet. Students' views and their ability to plan a balanced diet were characterized by high accuracy but low comprehensiveness. Finally, students were rather selective in the description oftheir own diet. Most ofthem reported that they are more or less committed to a healthy diet. However, they did not identify this commitment as a precaution against ill health.

Every year thousands of college graduates seek employment. In preparing for a career, many students turn to the Office of Career Services for assistance since it is a resource that they can use in their job searches as they navigate through an increasingly tight job market. Despite the obvious importance of Career Services in higher education, not enough is known about how these offices work and how they utilize the various resources available to them in assisting graduates to find employment. The core purpose of the present study is to fill this gap in the literature. This qualitative case study compared the activities of the Office of Career Services at two institutions of higher education (St. Peter and St. Thomas will be the names used throughout this dissertation). While both institutions are Jesuit, they differ in a number of ways that allowed meaningful comparisons about how the staff members in the Office of Career Services responded to the needs of undergraduate students in their employment searches. Data were collected through open-ended, semi-structured interviews of critical members of the staffs of both institutions. The interviews focused on how staff members provide services to their students and alumni as well as to the employers of these alumni. The study attempted to understand the formal and informal processes used by the Office of Career Services at these two universities as a measure of the institutions' organizational culture (Tierney, 1988). In addition, the study examined how the staff of the Office of Career Services develop and maintain connections to the academic community and to local and national businesses. The results of the study indicate that the Career Services staff members at these two universities informed students early in their academic careers of the services afforded them in preparing for their job searches. Both offices are focused on their students, but believe they are under-utilized by the students. St. Peter's has an advantage with employment opportunities for students due to its location. St. Thomas has a stronger relationship with the institution's academic community. The implications of these results for career services in general were discussed.

Abstract:
As one of the most distinctive characteristics of English insurance law, the duty of utmost good faith is essentially stated in sections 17-20 of the Marine Insurance Act 1906. According to the statutory rules, both of the insurance parties must observe utmost good faith before the conclusion of an insurance contract. After one century of its application, both the judiciary and academics expressed their concerns in terms of its legislative defects and complexity in practice. Some developments have been made in recent judicial decisions and in statutory reform, e.g. the English Consumer Insurance (Disclosure and Representations) Act 2012, and Recommendations, Statutes and Explanations on the Amendments of Chinese Maritime Code of the People’s Republic of China. Therefore, debatable issues and law reform programs in both English and Chinese law are considered in the main body of this thesis. The examination is essentially based upon, (1) the materiality test of the concealed/misrepresented circumstances which can empower the injured party to rescind the insurance abinitio; (2) the duration of utmost good faith and specific issues; (3) the protective measures related to innocent misconduct; (4) the legal status of good faith and its application to fraudulent behaviour; and (5) whether the classic English utmost good faith doctrine can be extended to Chinese law. Therefore, the main objective of this thesis is to provide a comprehensive study of the current status and developments of the duty of utmost good faith in both English and Chinese law, which is of fundamental importance, not only at the negotiation stage, but also throughout the performance and at the claiming stage of an insurance contract. After identifying and analysing these crucial issues, this thesis concludes with some possible solutions.

Abstract:
Since the introduction of activity-based costing (ABC), researchers have identified situations where its implementation is deemed appropriate. Furthermore, a framework for implementation has been recommended. Additionally, it is suggested that the likelihood of installation failure increases when accounting staff sponsor the implementation of ABC, but Cotton (1994) did not find evidence to support this prediction. This indicates that the body of knowledge concerning the successful implementation process of ABC is incomplete. Consequently, two case studies on organisations that implemented ABC, Norwich Union Health Insurance (NZ) Limited (Norwich) and Nelson Marlborough Health Services Limited (NMH), were conducted to expand the existing body of knowledge of the implementation of ABC. The behavioural issues relating to individuals' reactions to the implementation ofABC were also examined. A number of anomalies between the existing body of knowledge and these practical examples of the implementation of ABC were found. In both cases, the decisions made prior to implementation and the installation processes used at these firms deviated from those recommended. Additionally, a number of previously unspecified symptoms indicating that a firm's costing system required alteration were identified. Similarly, additional reasons for implementing ABC were detected. Furthermore, the recommended methods for minimising individuals' reactions to change did not appear to be effective at NMH. Despite the lack of generalisability and other limitations of this research, the body of knowledge concerning the implementation of ABC has been expanded and areas for further research have been recommended.

Abstract:
The thesis is split into two parts. The first part examines the principle of insurable interest in property insurance as a test which distinguishes insurance contracts from wagering. Throughout the study, the principle of insurable interest will be explored and analyzed under English and Canadian Laws as models of the common law, on the one hand, and Saudi Law which is based upon Islamic Law, i.e. Sharia, on the other. The second part deals with the Saudi conception of insurance contracts. Insurance contracts have been rejected by Sharia on the ground that they contain elements of Riba, (usury) Gharar, (uncertainty) and Maysir (gambling). Muslim scholars believe that where one of those elements is found in an insurance contract, it will be vitiated by virtue of Sharia principles. The principal object of this study is not only to make a critical study of the common law approach to insurable interest but to suggest a model of insurance that complies with the general principles of Sharia. The thesis consists of eight chapters. The first chapter provides a brief outline of the requirement of insurable interest under the common law models and Saudi law. It will outline the objectives, significance, methodology, scope and the structure of the thesis. The second chapter will be devoted to a historical examination of the contract of insurance together with the requirement of insurable interest. The third chapter will consider the nature of the requirement of insurable interest and the principle of indemnity. The fourth chapter will discuss the consequences of lack of insurable interest. The fifth chapter outlines the conception of contract in Saudi law and outlines the importance and the influence of Islamic law upon Saudi law. It also explores the elements of Riba, usury Maysir, gambling and Gharar, uncertainty. The sixth chapter will discuss the distinction between what Muslim scholars call 'commercial insurance', the original form of insurance that is understood by the common law and which is forbidden under Sharia, and 'co-operative insurance,' which, it will be argued is acceptable to Sharia. The seventh chapter will propose an alternative form of insurance that accommodates Sharia, i.e. 'solidary insurance.' The final chapter, eight, will evaluate the outcomes and will compare and contrast the contract of insurance in its original form, co-operative insurance and the suggested form of insurance, so-called 'solidary insurance.'

Abstract:
This thesis considers age discrimination in financial services, focusing on a comparative analysis between Italy, Austria and United Kingdom. It does this by first examining Directive 2000/78/EC which is the first and the only European legislation existing on age discrimination in the employment field. Additionally, relevant case law is analysed to create a theoretical framework. By this approach, it is possible to see that, although equality is a fundamental principle of European law, both direct and indirect age discrimination can be justified. Therefore, this analysis focuses on Article 6 of the Directive as it allows the Member States to objectively justify age discrimination for the benefit of public economic interests. This conflict between economic interest and equality is evident also in the financial services field, where a European legislation does not exist yet. In this way, in each country, the assessment of risk is strongly linked to domestic law and financial stability. The study focuses on the implication of age justifications on the economy and its relation to population ageing.

"Death is inevitable. A funeral, in one form or another, regardless of culture or religion, is inevitable. Obtaining insurance cover for a funeral is usually easy, generally affordable, and most importantly: based on an inevitability. It is therefore not surprising that funeral insurance is a considerable portion of Life Insurance business in South Africa. Countless South Africans ensure that, even if they have no other insurance policies in place, they have, at the very least, funeral cover for themselves or their loved ones. In terms of the Insurance Act 18 of 2017, there are a total of nine classes of Life Insurance Business, namely: Risk, Fund Risk, Credit Life, Funeral, Life Annuities, Individual Investment, Fund Investment, Income Drawdown and Reinsurance. Funeral cover can be underwritten under either the Risk class or the Funeral class of Life Insurance Business. The classes of Life Insurance Business have various prudential and market conduct standards that need to be adhered to. Although some of these standards are constant throughout the various classes, there are some standards that differ. The mini-dissertation explores these differences, as well as what effect these differences would have on the public. In essence, the author discusses the two classes in which funeral insurance can be underwritten, the various standards that are applicable to the two classes, as well as whether or not the choice of class would ultimately affect the policyholder, and if so, if said effect is to the policyholder’s detriment."

In the UK and Saudi Arabia, it is necessary for the contracting parties in insurance contracts to comply with the requirement of the doctrine of utmost good faith. In recent years, the doctrine of utmost good faith and the mutual duties of the contracting parties have developed in different ways in each jurisdiction. Both jurisdictions provide consumer protection in insurance markets by Consumer Insurance (Disclosure and Representation) Act 2012 in the UK and Insurance Consumer Protection Principles 2014 in Saudi Arabia. However, there are many differences between the conduct of each jurisdiction since the coming into force of the Insurance Act 2015 in the UK, which revolutionised the insurance law in several key areas. This thesis particularly aims to critically analyse the reform of the doctrine of utmost good faith and looks at how the current reform impacts on the interpretation of this doctrine between the UK and Saudi jurisdictions. This study critically analyses the insureds’ pre-contractual duties for consumers and businesses in the UK with a comparison to Saudi law.

Abstract:
This was a descriptive study of 140 volunteer therapists in the Richmond, Virginia metropolitan area who identified themselves as either "brief" or "time-unlimited" in their practice of marital therapy. The sample, predominantly female and highly educated, had a mean age of 46.9 years.;For the purpose of this study, brief marital therapy was defined as eight or fewer therapeutic sessions within a 3-month period, and time-unlimited marital therapy was designated as therapy lasting longer than eight sessions or over 3 months. There were 60 self-identified brief marital therapists (BMTs) and 73 self-identified time-unlimited marital therapists (TUMTs). Subjects completed four instruments, including the "style" questionnaire, the active-directiveness subscale, and two instruments developed by the researcher. The specific variables under consideration were active-directiveness of the therapist, therapeutic goals, and duration of treatment.;Results revealed a high degree of similarity between BMTs and TUMTs regarding theoretical orientation, style, interventions, aim of therapy, and length and scheduling of sessions. Despite their similarities, therapists endorsed items consistent with their identification as either a BMT or TUMT. Thus BMTs, compared to TUMTs, were more active-directive, employed more limited, modest goals, and utilized fewer sessions. Therefore, it was concluded from the present findings that there was a significant difference between BMTs and TUMTs on the variables under scrutiny.

Abstract:

This thesis presents an implementation study on the handling of electronic identification in three public authorities in Sweden. Electronic identification is a complex but very topical policy domain, largely tied to the general policy aspirations of e-government development. Theories on policy action, logic of appropriateness, garbage cans, and the dialectics of institutions and technology are used. The result highlights that the policy process of electronic identification in the three studied authorities could not be adequately explained from a traditional policy-implementation dichotomy. The action imperative to develop e-services is very strong and explains why and how electronic identification has been developed within the three authorities. The three authorities have very different institutional capacity to implement e-services with electronic identification. The available technology on electronic identification is inscribed with certain logics of appropriateness, that doesn’t sit equally easy with the administrative logics of appropriateness in all three authorities.

Normalisation as defined by Wolfensberger informs British services for people with learning disabilities, probably without exception. It is an approach which instructs services to help service users acquire behaviours and characteristics which are as 'culturally normative as possible' (1972:28). The later interpretation by O'Brien (e.g. 1980), where he summarises and translates normalisation into the Five Service Accomplishments, has attempted to aid support staff in the task of translating operational policies built upon normalisation principles into practice. While many studies have attempted to assess the efficacy of this approach, it is difficult to establish their success, as their measurement criteria are usually based upon levels of competence and participation - values themselves derived from the normalisation approach. This study attempts to step outside this dilemma by using a comparative research method. Services in London are compared with services in Milan, Northern Italy, as while the latter also undertake to support people with learning disabilities using individual planning processes and on rare occasions residential services, the operational policies, training and overall framework for doing so are underpinned by a holistic, legislative model which views the family or its substitution as the key to service provision. Milanese services also advocate a framework which values interdependence between service users, and indeed considers the group living perspective of living in the community as essential for the development of self esteem. This is felt to be a pre-requisite for effective integration with the local community. British services, conversely, aim to encourage relationships between people with learning disabilities and non-disabled others as the most appropriate pathway to integration. This then acts as a valuable contrast with normalisation and enables the impact of Wolfensberger's approach to be considered in a unique way. The comparison is on three levels. Residential services - one in London and one in Milan - are studied using in-depth interviews with a total of 12 service users and 11 staff, as well as participant observation of daily life in each project. Individual planning processes, seen as the most direct way by which service ideology is implemented, is compared by interviewing 21 service users and their key-workers and 5 relatives, and sitting in on individual planning meetings. Staff training structures are also compared. In addition, operational policies for the residential services and the planning services, as well as relevant legislation from each country, is analysed in depth. The findings are discussed at each stage and comparisons made. Recommendations related to interpreting service principles are made for increasing good practice in certain aspects of the British services. The main suggestion is that consistent, legislated training for support staff in British services might contribute towards ameliorating current difficulties described by much of the contemporary research. The observation that the implementation of normalisation is by way of an approach rather than a model of service provision is highlighted.

This work was developed under a internship in the Master of Marketing, given by the Catholic University of Porto, and is based on the analysis of the services provided by AXA Portugal - Companhia de Seguros SA, in particular by the Endowment Department . The quality of services and their management is an increasingly important issue for companies, that requires our full attention. Thus, this paper provides a description and study of the services offered by AXA, including different features and moments of truth present in the companies. At the same time, we make an analysis of the Asset Management Complaints Department, in order to detect the different faults that exist in the provision of services of the same. This study follows upon an LLM thesis in which the writer submitted that South African marine insurance law should be allowed to develop by way of a codification process which co-ordinates research of the principles of Roman-Dutch law . Abandonment is defined as a special remedy available to the assured under a marine insurance policy in in special circumstances. It is related to the indemnity principle and subrogation and , operates as a method of transferring real rights. The reasons for the research are examined and the historical-comparative method is proposed as the appropriate rearch method. An historical review of the origins and early history of indemnity insurance is undertaken . It reveals that abandonment is an original institution of marine insurance which has been imported into to the legal systems of the countries of western Europe and England . After recounting the historical developments in customary and statute law pertaining to abandonment spanning the period from the birth of marine insurance to the end of the eighteenth century, the principles of abandonment currently applicable in Dutch, German, French, English and American law are analyzed and compared in order to determine what the basic rules of abandonment are. In this process certain common principles of abandonment are identified and arranged into a set of basic rules. The theoretical implications of abandonment and its relationship with the indemnity principle and subrogation are considered in order to arrive at some conclusions with regard to the origins of abandonment, its functions as a servant of the indemnity principle and its links with economic loss as a species of indemnifiable loss. It is concluded that the purpose of abandonment is to compensate for a loss which is wholly or partially economic in nature. Abandonment as a means of transferring real rights without formal delivery of the abandoned things is discussed against criticism by others that abandonment does not have the effect of transferring real rights in South African law. The development of abandonment principles in South Africa after 1652 is investigated against the background of the original customary law which applied in Europe, the local ordonnances which were promulgated in the towns of Holland between 1563 and 1744, the writings of the most important Roman-Dutch authors and developments in South African statute and case law. This allows the basic principles of abandonment in the law of the countries used for comparison and arrived at by the historical-comparative method to be compared to the principles of abandonment in the Roman-Dutch law of the seventeenth and eighteenth centuries and to current South African law. It is concluded that, whilst there are unimportant differences, the South African common law recognizes the same basic rules of abandonment as the classic Roman-Dutch law, recent Dutch law and current German, French, English and American law. In the- discussion of South African case law it is pointed out with reference to Roman- butch, English, French and Dutch authorities that an injustice has been done in the case of the 'Morning Star' . Three general recommendations are made with regard to the future development of South African law, namely that total loss should be recognized as a separate category of loss, that it is unnecessary to import the concept of a constructive total loss into South African law, and that the insurer should be allowed to decline receiving transfer of ownership of the abandoned ship or goods. The principles of abandonment are also stated on three different bases, allowing the South African legislature to choose its own model, namely: those which apply in South African law as the inherited Roman-Dutch principles; those which apply in English law, firstly as they applied prior to codification in 1906 and secondly as they now apply under the Marine Insurance Act 1906; and lastly those which the writer recommends should be taken up in a proposed South African marine insurance act . Case law is stated as at 31 December 1995. In the case of English law the wealth of material has made it necesary for the author to use his own discretion on the question whether any particular case or work was worthy of a mention .

The Owner''s Control Insurance Program has been operating in other countries for years in view of such advantages as the comprehensive insurance plans, the integrity of the risk management plan, the unity of the claim management as well as the reduction of the premium. At present, Taiwan Power Company, Ltd. and Department of Rapid Transit Systems, Taipei City Government are the only two governmental units, who have sound experiences in adopting this arrangement due to the concerns of the big size of the work. As to other companies like Taiwan High Speed Rail Corp., Mass Rapid Transit Bureau, Kaohsiung City, Chinese Petroleum Corp., Taiwan, and China Steel Corp. they also have more or less experience. However, in consideration of the size and the complication of the engineering works and the difficulties of the reinsurance arrangement nowadays, the Owner''s Control insurance Programs are getting popular. Nevertheless, most of the insurance policy structures applied in the domestic market are based on the European formats, which are largely different from the ones applied in the U.S. market. Furthermore, there are lots of engineering insurance clauses involved. Without deliberate inspections, if these clauses originally suitable for the U.S. market are used on the existing policy structures, it might result many disputes. Therefore, this research mainly compares the difference of the Owner''s Control Insurance Program applied between our country and U.S. At the same time, it also proposes some research findings in respect of the line of business to be purchased, the design of the insurance clauses, the coverage of the insureds and claim issues. All of them might provide the principals, the large-scale contractors, the project participants and the insurers, whether they intend or have adopted The Owner''s Control Insurance Program, with some practical suggestions.

In recent years, Taiwanese consumers accustomed to using credit cards to pay personal consumption. The banks want to attract the consumers to own their credit card and use it to pay for travel fares when going abroad for travelling or business, they often offer the credit card comprehensive travel insurance for their cardholders, spouse or her(his) unmarried children under twenty-five years of age. It means when the cardholder pays for total air tickets or eighty percent of the travel fares, the credit card issuing bank will offers credit card comprehensive travel insurance to its consumers. The credit card comprehensive travel insurance programs are often different with the types of credit card. This paper will focus on the three types of credit card comprehensive travel insurance: travel accident insurance, travel inconvenient insurance and global purchase protection insurance, and make comparative study on the differences of insurance programs among the top 17 card issuing banks in Taiwan. This study found that the amounts of credit card comprehensive travel insurance protection programs from different banks are not the same. Even though the different banks insure the same insurance company, the protection and the insurance provisions are also different.

As the steady development of insurance industries and the strengthening of people's awareness of the importance of the insurance, life insurance attracts more and more people's attention since it holds a direct relationship with the interest of the main parties concerned in the insurant contracts and it impacts the healthy and orderly development of the whole insurance industry. The subject discusses some inappropriate parts of the regulations concerned with the insurance beneficiary and the insurance beneficial right from the viewpoint of the insurance laws across the Taiwan Strait. According to the discussion and analysis, suggestions to the legislation perfection will be proposed at the completion of the academic study for the reference of stipulating regulations, resolving disputes in practice, and/or conducting academic research. There are five chapters in this study. Chapter I: Introduction. The research motives, research purpose, research scope and limitation, and expected results are stated in this chapter. Chapter II: Discuss the right of the insurance beneficiary .The analyses of its legal status are debated from the points of the legal source, the character of the right, and comparing with inheritance. Chapter Ⅲ:Discuss the qualification of the beneficiary and state if the beneficiary should have the insurable interest, and discuss the designation and the change of the beneficiary, and the content, the character, exertion and the forfeit of the insurance beneficial right. Portfolio Insurance strategy has long been an important issue for investment. Fund managers, on one hand, wish to have a portfolio insurance strategy to protect from downside risk of investment when the market is unfavorable. On the other hand, they hope to the strategy can preserve potential profits when the market is favorable. In this study, we argue that transaction costs are a non-trivial factor in influencing the performance of portfolio insurance strategies. Transaction costs should not only include explicit costs such as brokerage fee and transaction tax, but also include implicit costs such as bid-ask spread. We will consider how rebalancing frequency affects the performance of various portfolio strategies, in order for determining optimal rebalancing frequency. The study provides practitioners with optimal portfolio insurance strategy with transaction cost minimized. Earlier studies on portfolio insurance mostly focus on reducing replicating errors, but not paying too much attention to increasing transaction costs in rebalance adjustments. The main purpose of the study is to derive optimal portfolio insurance strategy with minimum transaction costs and replicating errors. We apply Monte Carlo simulation to historically simulate Taiwan Weighted Stock Index to compare the performance of a variety of portfolio insurance strategies. The strategies of consideration are protective puts (PP), synthetic put option (SPO), constant proportion portfolio insurance (CPPI), constant mix (CM), and time-invariant portfolio protection (TIPP). In this study, it is found that the optimal portfolio insurance strategy which rebalancing frequency were different in different markets. Based on the result, each portfolio insurance strategy with different market trend has different best adjustment frequency and parameter. It is found that synthetic put option has the best performance in bull market and time-invariant portfolio insurance strategy has a better diversification effect.

Since 2000, the global financial storm has hit the major countries and influenced the consumption and the investment behavior, and the global unemployment rates have thereupon soared. For nearly three decades, the unemployment rate in Taiwan has been comparatively low. Influenced by the recent international economy and the change of industrial structure, the unemployment rate in Taiwan soared until 2003, when the Employment Insurance Act provided. The German Welfare Model has been a pioneer in Welfare Policy, and serves as a great role model for Taiwan. Since 2004, the unemployment in Germany has decreased significantly due to the Hartz reforms, the Unemployment Benefit І, and the Unemployment Benefit II. The Hartz reforms have also kept the unemployment benefit system and employment promotion, public service organization working even more closely. By examining the unemployment insurance system of Taiwan and Germany, the paper tries to show the possibilities and future directions for Taiwan.

With the wave of merging intensifying in financial service sector, the current stalemate was broken so that the banking and insurance industries were forced to transform from traditional institution toward a more efficient procedure and technology provider. The competitors within banking and insurance industries would have more chances to cooperate and thrive in global economy as a result. The insurance and commercial banks across the Strait have continuously strengthened their collaborations in recent years; they acted vigorously in broadening the realm of insurance service, offering integrated financial service and meeting the social needs. However, the differences in policy and financial institution across the Strait have led to diverse structures in development context, financial product, mode of cooperation and the attitude toward financial supervisory during the integration process between banking and insurance. Issues such as the selling for financial product, the norm for cooperation, the supervision for laws and decrees and the customer interests require joint endeavors from both of the banking and insurance authorities, constructing a health environment for development. The collaboration between the Cathay Life Insurance and China Eastern Airline in Mainland has moved a remarkable first step in our country. Further challenge would be how to utilize the experiences gaining from different sectors and integrate them into a suitable marketing mode in order to explore new business opportunities. Finally, we proposed our recommendations to Taiwan and China government and cross-Strait arrangement as the references to Bancassurance operation.

In this study, the salesman of insurance brokerage is used as the object to investigate the satisfaction related issues for the services provided by the insurance company. The satisfaction opinions of insurance brokerage salesman for the services provided by insurance company were collected by questionnaire. The quantitative analysis is carried out by mean difference t test and logistic regression model. The results show that salesmen of insurance brokerage think that, among all the service items provided by insurance company, reward activity needs to be improved for the first prioroty, proposal spreadsheet is the most helpful, the satisfaction for the promotion staff of insurance company is the highest. For the application frequency, proposal spreadsheet is the highest and followed by internet platform. The results of regression analysis show that the longer the marketing time of salesmen of insurance brokerage, the higher the application frequency for the service provided by insurance company, also for satisfaction. In addition, the application frequency for the service provided by insurance company is lower as the age of the salesmen of insurance brokerage increased.

This study aims at discussing the corresponding responses of life insurance corporations to the Operational Risk Management Mechanism deriving from policy administrative managers, operational procedures and system after the policy after-sales service turned into digital-oriented. This research was conducted by interviewing 13 companies and 30 professionals including current policy administrative directors, senior case officer as well as information department directors of domestic financial and non-financial holding companies as well as foreign life insurance corporations. According to the interview, in terms of policy administrative works, the settlement efficiency would not only be improved but also serve as the first line of defense of operational risk management after the auditing conditions (including life insurance penalty cases and must-improve items required after financial inspections) were recognized as automatic check. Furthermore, it’s beneficial for improving the control effectiveness by managing the policy after-service cases according to the source, in written and digital forms. With respect to case penetration in digital platforms, the number of investment link (Unit Link) policies significantly outweighs that of traditional policies which ensures policy administrative personnel’s reliance on system and at the same time undertaking multiple inspections. While the man-made transaction omissions occur from time to time due to compliance with red tapes issued by competent authorities, unappeasable or poor functional development of core system and digital platform systems of policy and even failure to upgrade operational procedures in timely manner. In addition, the system abnormality inspection depend mostly on emergency measures instead of inspections in advance; and there are concerns on failing to examine user permissions exploits of digital services in timely manner. This research provides several suggestions based on the findings: firstly, the calculation ratios and standards should be recognized as one performance assessment index after they are expressly stated; secondly, company should introduce new technologies to strengthen digital identity authentication and establish outsourced digital service provider evaluation information. All of which are expected to be the references for life insurance industry’s planning of operational risk management mechanism of digital service.

With the rapid improvement of economy in the two sides across the Taiwan Strait, the environment of insurance and finance is changing quickly. Meanwhile, the diversification in society, merchandise, information, and charge all contribute to the reduction of the gap between cities and countryside, the high population density in cities, the establishment of hi-tech industries, and the trend of density in the high-price facilities, factory buildings,and equipments. As the potential risk is rising, it will result in more demand in the insurance. An insurance broker in the whole insurance market stands for the benefit of his customers, concludes an agreement, provides the service between his customers and insurance companies and earns commission. Owing to the difficulties in the insurance business and the complex in the insurance contracts, insurance brokers play an important role in the insurance market. A professional insurance broker recommends exquisite goods to his customers and takes the responsibility of after-sales service. Consumers get what they need with the most reasonable price and service through the arrangement of the insurance brokers. Also through the constructive competition among the insurance brokers, it will bring high quality service and guarantee to all the customers. After the entering of the insurance brokers between the two sides across the Taiwan Strait, we will face more difficulties, opportunities, and challenges in the process of globalization and liberalization. In order to respond the insurance system timely, we must propose reformation plans and concrete proposals in the aspect of the insurance system between the two sides across the Taiwan Strait. We hope that we can do good to the insurance system between the two sides across the Taiwan Strait. After entering the globalization market, in order to get the insurance moving into the liberalization, the government should take the responsibility supervising and leading the insurance brokers into internationalization. We hope the government examines the defect of insurance system from all aspects, directs the ways to improve the professional level among the insurance brokers, strengthens the added value to both the insurance fields and the customers, enhances the international competency, and promotes the international cooperation. We also hope that we can increase the complementary advantages among the insurance brokers between the two sides across the Taiwan Strait, integrate resources, collect specialties, upgrade levels, raise the service efficiency, and catch up with the whole world. Taiwan in the past always takes a conservative attitude toward the market in China. It results in the information lack about the market in China. Nowadays, in the trend of finance liberalization and internationalization, Taiwan opens up the investment of the market in China. Owing to the opacity of information, Taiwan’s insurance companies still cost lots to set up a branch office or get the sales license. Therefore, in my study, I would like to discuss how to operate an insurance company in the market in China, and provide some market information to the same trade.

With the emergency of low birth rate and elderly society, insurance becomes more important for risk and financial planning. Due to the intensive competitions in Taiwan insurance industry, how to maintain and upgrade the relationships with current customers therefore become crucial. In the insurance literature, most researches explore the strategies of increasing purchasing quantity and customer retention from the perspectives of product, price, place and service quality. This research differs from the previous is focus on the cross analysis of three levels and four stages of relationship marketing. Three levels are financial, social and structural connections and four stages are attraction, establishment, maintenance and upgrading. By a comparative case study, this research tries to explore how companies maximize the performance by relationship marketing from the perspective of different patterns of insurance company. The cases include three kinds of patterns, including brand companies, insurance brokers and insurance agencies (cross case). Each case will choose three companies to interview. By a cross-case study analysis, this research tries to uncover the differences of relationship marketing strategies from the perspective of different patterns of insurance company. The findings suggest that the most common strategy for attracting potential customers is by pricing. Regarding social connection, it depends on the resources of the company, the insurance companies target at all segmentations, however, only niche markets are targeted by insurance brokers and agencies. Finally, in the stage of structural connection, the opportunities and challenges are relatively complicated because what customers want is multi-dimension service; this means that customization is necessary to offer total solution and one stop shopping service. In addition, in the stages of relationship development, the findings suggest that in the attracting stages, due to the enough resources, insurance companies can exert national advertising to build up the mind share of customers. Relatively, the insurance brokers and agencies with fewer resources adopt professional services to attractive potential customers. By effective interactions, customers will transfer their trust from the sales person to the brand. In the stages of establishment and maintenance, all companies adopt the same strategies using activities, advertising, professional services and customer management system to maintain the relationship with customers. Finally, in the stage of upgrading, due to the enough resources, insurance have more resources to feedback customers, however, all the companies use the coupons of department stores, the reason could be attributing to brand image management. For customers, they are also happy to receive such kind of feedback. Finally, in the cross analysis between three levels and four stages, the finding suggest that social connection is the most important of all, because insurance is a kind of service, people plays an important role. As a result, profession and attitude can be delivered by financial planning and care. Finally, the record of customer transactions can be managed by customer relationship management system. By the combination of people, profession, attitude and system, the highest condition of marketing-“let sales become surplus” could be achieved.

The domestic aging population ratio in Taiwan has been on the rise in recent years, and with the concomitant birthrate decline, traditional concepts of raising a family and then being cared for by them in retirement are on the decline as well. This means that for the elderly they are faced with social problems arising from their lives and long term care. As aging of population and the birthrate falls precipitously over time in Taiwan, there has also arisen issues relating to the large number of elderly requiring care and long-term care services. Currently Taiwan’s long-term eldercare network is incomplete, and is unable to provide the elderly with continuous and comprehensive eldercare services. With the ever growing demands for long term eldercare and the common public growing understanding of eldercare concepts, insurance companies are faced with a large market demand and have been assiduously introducing and promoting a variety of long-term care insurance offerings, and given the variety of such long-term care insurance products, the underwriting of such long-term care insurance becomes all the more important. Since our domestic long-term care insurance studies have only begun to explore long-term care policy underwriting, this study will investigate long-term care insurance, in the hope of making a contribution to long-term care insurance underwriting efforts. This study includes the following aspects: 1.Introducing the domestic long-term care insurance system and the status quo of commercial long-term care insurance and underwriting systems. 2.Study of international long-term care insurance systems and elucidating risk factors for common geriatric disorders and diseases among the elderly. 3.Discussing international long-term care insurance underwriting experiences and their contribution to the long-term care insurance underwriting system. 4.Discuss future development trends in commercial long-term care insurance. 5.Conclude by considering case analyses of commercial long-term care insurance underwriting.

Based on the insurance law in Taiwan, the payment for the insurance policy to the individual beneficiary is not taxed nor is the death benefit included in the estate of the deceased. Furthermore, there is no stringing definition of insurance enforced in the island. It has been shown that one can incorporate a unit-linked insurance policy to blend investment and estate planning easily together. Equally interesting, the tax deduction with respect to the insurance investment has not been raised for more than two decades. An obvious lacking of fairness in terms of tax treatment has aroused the attention of the Insurance Bureau. The thesis compiles tax information from U.S.A., G7 countries and OECD in terms of insurance definition, deduction, death benefit, bonus, surrender value, and endowment payment. The purpose of the research is to provide a reference point where a possible reformulation of the insurance related tax is in progress.

The Taiwan Life insurance also launched an activity insurance service in 2012, which different from the traditional paper book process, using table computer to help clients to insure and make a change of contract, payout and other business (the description of the Mobile Services. Let the insurance professional become the company’s action counter to help the customer convenience right away, a wide variety of service channels, but also to effectively enhance the efficiency of the company’s internal work and reduce the cost, the real enterprise sustainable business and good business community responsibility. In this study, the protection of Mobile Services by C insurance company was used as a test image, with the use of random way to develop the paper, get 471 valid questions, with SPSS software for the effective problem of the system analysis, and with Syrian, Piersen analysis, Reliability analysis, Variation analysis (ANOVA) and regression analysis. To explore the impact of customer convenience, perceived risk, service quality, customer engagement, experience value on the satisfaction of the customer, satisfaction with the implications of the business, the impact of the business image on behavior and the impact of business images on the line of influence. esearch results found: (1) there is a positive relationship between the quality of the service and the value of the experience and the satisfaction of the customer, it shows that C insurance company provides the experience and feeling of the quality and experience of the physical insurance service, and can also effectively enhance the satisfaction of the customer. (2) The positive relationship between the satisfaction of the customer and the intention of the bank shows that the customer is more satisfied with the active insurance service provided by the C insurance company, which can effectively enhance the intention of the re-use. (3) The image of the enterprise has a positive relationship with the intention, which shows that the good corporate image of the C insurance company will influence the wishes of the customer experience and insurance service.
