Abstract:
ABSTRACTWhat is the nature of legal rules, and how do we discern whether they can be harmonized? My thesis seeks to answer these questions through a comparative analysis of civil law and common law jurisdiction rules in transnational cases. I develop a methodology for comparing legal rules that defines rules by their history, epistemology and cultural context. I seek to discover the legal traditions' essential components linked to their jurisdiction rules. I hypothesize that rules rooted to incompatible essential components are likely not capable of harmonization. Legal communities deeply

The practice of domestic courts continues to present challenges for understanding the relationship between international law and municipal law. Whereas constitutions increasingly contain more or less similar provisions on international law, the subsequent use of international law by domestic courts varies from traditional doctrinal approaches. This divergence by domestic courts is attributable to the fact that domestic and international courts/tribunals are engaged in exchanging ideas and formulating similar decisions on diverse substantive law issues out of a sense of common judicial identity

Transnational security threats are among the most pressing and complicated problems facing both governmental and non-governmental actors in today's world. Human trafficking is one example of contemporary transnational security threat that is relatively less studied compared to other transnational security threats. Because transnational security threats such as human trafficking exist above and outside the boundaries of state control, it may be supposed that a greater degree of supranationalism in the policy responses to them would yield better results in combatting these modern-day ills. Treaties and international organizations work together to create a global environment that protects the rights of a person and actively promotes the well-being of society. Therefore, it takes more than just international legal instruments to guarantee women's rights as human rights. This dissertation is an exploration of the ways in which contemporary practices of pluralism are challenging, and being shaped by, concepts of state sovereignty. I explore two very different contexts; the relationship between First Nations and Settlers on that part of Turtle Island sometimes called Canada, and the relationship between the European Union and its Member-States. In both contexts, I explore how political, legal, and economic practices are generating forms of social order that depart to varying degrees from the total, exclusive authority associated with sovereignty. Abstract:
My thesis is an analysis of my own translation of a chapter from Dominik Nagl's legal history 'Grenzfälle,' which addresses questions of citizenship and nationality in the context of the German colonies in Africa and the South Pacific. My analysis focuses primarily on strategies that I used in an effort to preserve the strangeness of a linguistic context that is, in many ways, "foreign" to twenty first-century North Americans while also striving to avoid reproducing the violence embedded in language that is historically laden with extreme power disparities.
