Abstract:
Forensic populations in the United States are increasing, driven largely by a rise in individuals determined to be Incompetent to Stand Trial (IST). Across most states, including California, the number of mentally ill inmates awaiting competency restoration has increased dramatically in recent years. Traditionally, competency restoration has taken place in state hospitals, but incompetent inmates often experience a significant wait for state hospital beds because of the rising demand for beds in such facilities. The resulting waitlists, which range from days to months, have led to states being

Objective.Evidence is clear that the nation is experiencing an increasing number of incompetent to stand trial (IST) admissions to state hospitals. As a result, defendants in need of treatment can wait in jail for weeks for admission for restoration. This study was conducted to better understand this growing population and to inform hospital administration about the characteristics of IST admissions.Methods.The study was conducted at the Department of State Hospitals (DSH) facility in Napa (DSH-Napa), a 1200-bed primarily forensic inpatient psychiatric facility located in northern California.

Abstract:
This study investigated the effect of cognitive factors on competency to stand trial. Previous researchers have investigated how psychological variables --such as psychosis and intelligence--contribute to incompetency. Although several researchers have established that intelligence contributes to incompetency, very few have investigated the role of specific cognitive abilities within the realm of intelligence. This study investigated the performance of 55 defendants referred for competency restoration on neuropsychological measures. Specifically, competent defendants and incompetent defendants

Competency to stand trial cases constitute the largest percentage of forensic referrals for clinical psychologists. Furthermore, research suggests that the use of forensic measures facilitates the decisions of competency made by forensic examiners. This study investigated the construct validity of three competency measures: (a) the GCCT-MSH, (b) the MacCAT-CA, and (c) the ECST with 100 adult males incarcerated at the Tarrant County Jail in Fort Worth, TX. Construct validity was investigated via the use of a multitrait-multimethod research design for the three-prong conceptualization of the Dus

Abstract:
This study examines the quality of forensic assessments conducted by mental health professionals to determine competency to stand trial. Data were collected from 68 cases involving Rule 11 proceedings in the Superior Court of the State of Arizona for Pima County from 1986 through 1989. Two raters independently evaluated the court order forms and rated each report on recommended assessment and reporting procedures. Percent agreement and Cohen's Kappa results revealed moderate to excellent inter-rater reliability. These results suggested that competency to stand trial assessments lacked basic in
