Abstract:
The article presents the study of the nature and structure of compromise (mixed or hybrid) theories of punishment justification. It explores the foundational elements of retributivism and consequentialism upon which these theories are based, as well as their respective advantages and disadvantages. Despite their varying forms, compromise theories share two essential components: the “general justifying aim” of punishment (e.g., crime prevention, reform, retribution, etc.) and restrictive means (e.g., prohibiting the punishment of the innocent, preventing excessive punishment of the guilty).
