Full textSection 21 of the New Code of Civil Procedure contains a theme running through the code. It states, with admirable brevity, that « it is within the fonction of the judge to conciliate the parties ». Put like this, the judge's role of conciliation is undoubtedly one of the key elements enabling the parties to come to an understanding of the role of the judge, of how this role has developed, and what its parameters are. A subject of such importance necessarily leads to a debate in which contradictory opinions are expressed. In the light of the criticisms and reserves which have been expressed about conciliation effected by judges, it is important to put it in its proper context, as part of the general role of every judge. It is also important to point out the underlying basis of this role, its raison d'être, and also to show that its use gives rise to positive reasons for hope. By going down this route, it is not sought to fully restore the image of the role of judicial conciliation in the same way a old malter, damaged by the passing of the years, would be restored. This role of judicial conciliation has not indeed been the victim of deterioration over the decades, but neither has it, is appears, been subject to proper examination. It is therefore appropriate to subject it to the spot-light of investigation that it deserves, and thus to put it in its true perspective

Full textMy comparative-legal thesis dedicated to conceptualisation of the model of interaction between ADR and civil court procedure.The first chapter devoted to description of history and contemporary status of ADR in Russia and France, as well as the key topic of my research: the conception of interaction of two regimes of disputes resolving and it's shapes. I offer conception of this interaction, which accepts mutual influence of two regimes of disputes resolving, and classify it's shapes to two groups: influence of ADR on a civil court procedure and influence of a civil court procedure on ADR. The second chapter devoted to the influence of ADR on civil court procedure: how ADR effects on the right of appealation to the court (1) (the range of using ADR and criterias of it's determination; mandatory and facultative ADR and it's effect on a right of appealation to the court; procedural effect of agreements of disputes resolving) and effect of ADR on implementation of the right to the court defense (2) (influence of using ADR on a period of limitation, a period of appellation to the court for the defense; procedural and evidential value of the overall ADR's acts). In the third chapter I examine the influence of civil court procedure on ADR: a shapes of using of the state court system mechanism for utilization of alternative dispute resolving (the state court functions of assistance and control), and the features of direct participation of judge and his administration in performing ADR-procedures (public alternative procedures)

Full textThis thesis studies the evolution of Quebec’s civil procedure between 1867 and 2016 through thedevelopment of certain principles now codified in the Code of Civil Procedure of 2016 and called«guiding». It is centred on five «guiding principles», namely : adversarial principle (audi alterampartem), proportionality, control of their case by the parties, control of the proceedings by thejudge, and conciliation. The analysis considers the emergence and growth of values, concepts andother manifestations revealing the presence or absence of those principles, the progressive orsporadic interest for them during this century and a half. It also takes into consideration the defininginfluence those principles may have had on the philosophy and practice of the civil procedure. Werethose principles already present in Quebec’s civil procedure, or in its spirit? Were they importedand how did they adapt to it? If they influenced some specific procedures, would parts of the Codeof civil procedure, related laws or elements be noticeably altered by their apparition or integration?If they have been present for some time, did they evolve or change? Would there be modificationsin the presence and definition of those principles at different times? With those questions andothers, this thesis wishes to shed light on some aspects of the construction and structure of the civilprocedure : progress, drawbacks, choices, new and potentially contradictory orientations, etc. It alsoaims to participate to a wider reflexion on the application of civil procedure in an evolvingenvironment. The discourse about civil procedure and those particular events is also taken intoconsideration, as the thesis attempts to measure the impact of those facts on the use of the civilprocedure in a judicial context. Implicitly, the analysis draws from concepts like evolution,borrowing, resistance and cultural change to underlay the presentation of information. The study ismade through the evaluation of changes in the nature and perception of the judicial function ofQuebec’s judges. It enhances changes made to the powers and duties of the judges, and explores thediscourse which emerges from or supports those changes, revealing of the orientations as well as therepresentations of the judicial function at different times. Through this, the guiding principles, thecivil procedure and the judicial function are presented as constructed, dynamic and evolvingelements.

Full textThe spoken word is one of the specificities of tribunal proceedings. Although litigants are very attached to this tradition, it is also a source of problems for practitioners. The oral nature of the dispute before the employment tribunal ensures greater simplicity and a more direct access of employees to the judge. Even if the spoken word should, in principle, guarantee the efficiency, speed and flexibility of the institution concerned, the latter is faced with a completely different reality, which tends to underline its inadequacies at the dawn of the third millennium. It is necessary to analyze and assess the real place of the spoken word in employment tribunal today, what it represents and its mechanisms so that a study could be conduced to decide whether it should or could continue, and, if so, to propose appropriate changes guaranteeing its future

Full textJanuary 1, 2016 marked the entry into force of the new Code of Civil Procedure, leading Québec’s civil justice system into the 21st century. This new Code is much more than a simple reform; rather, it encourages a wholly “new legal culture” by providing solutions adapted to the needs of its citizens. As such, to quote the Code itself, “appropriate technological means should be used whenever possible”, i.e. conforming to the principle of proportionality. This proposition may appear trivial upon first glance, but actually contains a fairly innovative reality: a well-established principle – that of procedural proportionality – now regulates a new area of activities – being information technologies. This thesis aims to identify all of the ramifications and implications of this application and will do so in two steps. First, we will begin by defining the legal concept of procedural proportionality, which has been relatively little studied until now. As to its origins, the concept of proportionality itself goes back millennia and, throughout time, has gained prominence in several fields of law: it is therefore the story of an ever-growing trend. That being said, it was only in the middle of the 20th century, against a backdrop of civil justice crises and under the influence of utilitarian theory, that proportionality was introduced as a matter of civil procedure (first in the United States, then in England, to finally percolate into other jurisdictions). In Québec, proportionality is today a guiding principle of procedure, which qualification has had a genuinely systemic effect. This gain is however not unanimous, as several other civil jurisdictions, France being the first, relegates proportionality to the rank of mere concept, theoretically located at the intersection of new managerial principles of civil procedure (such as quality, efficiency, celerity, etc.) In a second step, we will examine the practical technological effects of the principle of procedural proportionality. In our opinion, what we call “technological procedure” based on electronic transmission of documents and audiovisual technologies is insufficient in and by itself: it is only a mass of technical rules, without coherence or cohesion, much too mechanical. The principle of proportionality, applied to technologies, is therefore an interesting way to unify and humanise technological procedure. Concretely speaking, this means that a court should authorize, refuse or order the use of technologies according to an in concreto and in globo analysis of the interests at stake. For instance, in the case of a complex litigation, the use of Skype for the remote testimony of a main witness who lives next to the courthouse should be refused, since it is manifestly disproportional. In this manner, we are witnessing the emergence of a new sub-principle, what we call “technological proportionality” herein, which has its own definition, test and finalities. Furthermore, judges will henceforth have to assume a new role with respect to information technologies, notably by making technological choices and performing a form of “technology assessment”. In the end, such an approach, as it develops in Québec, offers a novel discussion on technology in civil procedure: neither proportionality (ancient, traditional, legal) nor technologies (futuristic, innovative, high-tech) are rejected; in fact, one cannot be dissociated from the other. The message of this thesis can therefore be summarised by three simple words: modernization in moderation

Full textLa thèse analyse en théorie du droit l’évolution de la procédure civile sous l’angle des enjeux de l’accès à la justice. Elle formule l’hypothèse d’un modèle de régulation sociale qui opère un renversement de la perspective moniste positiviste classique par l’intégration des modes extrajudiciaires de PRD. La thèse répond à la question de recherche suivante : Quels fondements théoriques à l’évolution de la procédure civile pour l’amélioration de l’accès à la justice ? D’un point de vue méthodologique, la thèse opte pour une démarche théorique et documentaire. Elle emprunte aux principales Écoles de théories du droit, en particulier à l’École sociologique. Le cadre théorique s’appuie alors sur les théories du pluralisme juridique, des systèmes et du réseau. Ces théories irriguent la thèse tout entière et servent de grille analytique aux deux parties principales de celle-ci. Dans la première partie, la thèse délimite et précise le concept d’accès à la justice. En trois chapitres, cette première partie s’attèle méthodiquement à déconstruire les acceptions dominantes institutionnelles et restrictives du concept. Elle aboutit à l’élaboration d’une définition innovante à valeur théorique et pratique de l’accès à la justice. Dans la seconde partie, l’analyse porte sur l’évolution des paradigmes de la procédure civile. En trois chapitres, elle pose une critique du système dominant de règlement des conflits en général et de la procédure civile en particulier qui reposent sur le droit selon les principes de hiérarchie des normes. La thèse déconstruit cette vision, puis propose une théorie générale supportant la légitimité des modes extrajudiciaires de PRD. Finalement, la recherche suggère une évolution de la procédure civile et soumet à cet effet un modèle de système de justice alternatif intégrant les modes extrajudiciaires de PRD. Le modèle de régulation proposé est non antinomique et complémentaire au modèle dominant. Le modèle de régulation sociale construit dans la thèse s’articule autour de trois paradigmes fondamentaux à savoir la décentralisation, la multipolarité et la complémentarité. La thèse constitue un compendium d’analyses et soumet un cadre de référence des paradigmes de base d’un système de justice renouvelé pour l’amélioration de l’accès à la justice.

It makes the assumption of a model of social regulation which operates a reversal of the classic positivist monistic perspective by the integration of the extrajudicial modes of PRD. The thesis responds to the following research question: what theoretical foundations to the evolution of civil procedure for the improvement of access to justice? From a methodological point of view, the thesis opts for a theoretical and documentary approach. It borrows from the main schools of theories of law, in particular the sociological school. The theoretical framework is then based on theories of legal pluralism, the systems and the network. These theories irrigate the whole thesis and serve as the two main parts of the analytic grid. In the first part, the thesis focuses on the accuracy of the concept of access to justice. In three chapters, this first part is working methodically to deconstruct the dominant meanings institutional and narrowing of the concept. It leads to the development of an innovative theoretical definition and practical access to justice. In the second part, the analysis focuses on the evolution of the paradigms of the civil procedure. In three chapters, it poses a critique of System dominant rules of conflict in general and civil procedure in particular which are based on the law according to the principles of hierarchy of norms. The thesis deconstructed this vision, and then proposes a general theory supporting the legitimacy of the extrajudicial modes of PRD. Finally, the research suggests an evolution of civil procedure and submits to this effect an alternative justice system model not oxymoronic, but complementary to the dominant model integrating extrajudicial modes of PRD. The social regulation model built and submit in the thesis revolves around three paradigms fundamental namely decentralisation, multipolarity and complementarity. The thesis is a compendium of analyses and submits a frame of reference of the paradigms of a justice system for the improvement of access to justice.

It became subject to harmonisation in Europe under the Directive 2008/52/EC of the European Parliament and of the Council of 21 May 2008 on certain aspects of mediation in civil and commercial matters. In this context, the objective of the thesis is to analyse the functions performed by mediation as well as the limitations to mediate from the viewpoint of civil procedure law, contract law and intellectual property law and to present some proposals to optimise mediation to intellectual property law. Full textRegulation of competition is dualistic in France and Canada. On one side, public authority frame the market and impose sanction, if appropriate, to the practices contrary to existing legislation, and, on other side, the victims injured by antitrust practices, that is consumers and company, may bring a private procecussion based on the liability to obtain a compensation for the antitrust injury. They are respectively of public action and private action, also referred to as public enforcement and private enforcement of competition law. However, in the European Union, and particularly in France, the antitrust harm has no effective remedy. Indeed, in France, consumers had not, until the adoption of the collective redress, procedural means to access the judge of compensation. In addition, the French civil law proves too rigid to allow compensation for something as complex as the competitive harm. For its thinking about it, the French legislator has often turned to the Canadian and Quebec models to reform its bicentenary civil law. Indeed, the Quebec civil law is particularly flexible in disputes related to competition law. In addition, the Canadian Competition Act provides a right to compensation adapted to the constraints of the victims of anticompetitive practices. The author has sought to understand how the Canadian private enforcement mechanism works to assess whether this model, through the Quebec civil law, could inspire a reform of French civil law model adopted by the legislature in particular during the introduction of collective redress. The analysis is primarily civil law to allow a reading of private action that departs from conventional stereotypes of the American experience in this field. The ultimate goal of this comparison is to make effective use of the private businesses and consumers in French and Canadian rights following an injury resulting from a violation of anti-competitive practices
