Full textGlobalization is pre-positioned by the universalization of the competitive model that is legitimized by the triumph of the liberal paradigm. Competition triggers the elaboration of an International system which does tend towards the globalization of rules, values, objectives, while pretending the integration of the peripheral regions of the world. Considering that the unification of the International system is based on means able to support the mobility and the interpenetration, the world economic model promotes membership to a legal, political and economical common order. This leads to an evolution towards a global competition order. The standardisation of law is established according to a process wich accelerates the alignment of the International actors on the configuration of state model. The transformation starts with the influence of competion on the blast of foreign envelop of the state, on the reform of its interior territorial organisation and its intervention, also with a paradigm change of the internal legal orders. On the other hand, the empirical researches reveals some contradictions on the globalisation of the legal and institutional order of competition and the unexpected effects on the development processes. The Western models introduction into the south countries and prompting them to adapt themselves to the Competition model do bring to the reconstruction of the dependence idea without leading necessarily to development

Full textSome stories send a chill down one’s spine! An old man appears at an attorney’s office claiming the identity of glory of Napoleon Bonaparte’s Empire: the colonel Chabert. However, Chabert is dead; the living declared his death after the register of vital statistics based, in turn, on testimonies. With his claim, the old man opposes acknowledged truth and his own reality, throwing doubt upon evident facts. In the silence of the night, the faint contours of the glorious colonel emerge from the story narrated by this ghost asking for recognition but he will learn that identity is not something that springs up upon demand but must be built up. Yet he made a good start by bringing in his mutilated body and his story. He could have followed the only possible way of taking Chabert off the list of the glorious dead by accepting a settlement where he could continue being the colonel provided he erases parts of his history. The old man’s identity is given neither by the novel which created him nor by law, that law responsible for his death, as the only answers to be found in both law and literature are acknowledged facts which always remain questionable. An individual’s identity is embedded in the story of a culture and the game consists in always making adjustments within the meeting point of all designating discourses. One of these is that of law: it sets the criteria allowing existence itself and from which individualization can occur. So we can say law and Balzac’s «Human Comedy» merge together into a new common space in wich seizing stories are narrated and where the construction of individual identity takes place. This singular relationship between law and literature sheds a new light upon them, thus making them subjects to be studied from an anthropological point of view

Full textThe birth and the development of the railroads in France are understood at the same time by the continuation of the movement of centralization of the territory operated by the State, and the expansion without precedent of the capitalist economy, which saw emergence, as from the XIXth century, of the mode of the concessions and the intervention of the public power. With the explosion of the exchanges and ways, a political control of these flows appeared. As from IIIrd Republic, the role of the State evolving on social matters, the rail was gradually led to become a public line of business. Nationalization operated in 1937, by creating the National company of the railroads, and the passage, in 1983, of the statute of company of mixed economy to that of industrial and commercial public corporation, seems to reinforce this tendency. But the behaviour of company adopted by the SNCF, in particular starting from the reform of 1971, leads to a difficult conciliation between requirements which appear increasingly contradictory. In this direction, the influence of European integration was decisive being the questioning of the monopoly of the SNCF, the opening to the competition of the rail networks and the appareance of a new railway regulation. In this configuration, the maintenance of the railway public service seems to depend on the will of the regional councils, within the framework of railway regionalization, and the financial support of the State for the money-losing lines which continue to answer an general interest. These are theses movements that this thesis intends to analyze
