Full textProfessional, or the increasing use of adhesion contracts (“take it or leave it agreements”), all are factors that can lead to the contractor’s vulnerability. The risk is, for the so-called “strong” party, to abuse its position in order to force the other party into a strongly unbalanced agreement, mainly in its own benefit. Since such a reprehensible behavior occurs during the contract formation, the weakened party should be able to find protection through the use of the defects of consent theory. However, this theory has proven inadequate to effectively protect abused contractors today. A major explanation is due to the fact that this theory remains unchanged since 1804. Based on an individualistic conception of the contract, conditions of admission of each defects of consent, such as error, abuse and fraud, are too restrictive. However, the more contractual inequalities exist, the more they will turn into abuse. Therefore, this is why such a theory should be restored in order to protect contractors. It is through the notion of “dol” (willful misrepresentation or fraudulent concealment) that we propose to do so. This choice is not a coincidence. It is justified by the fact that “dol” is a tort, even before being a defect of consent. Specifically, it is the manifestation of pre-contractual disloyalty. Its recognition as a fact altering willpower will generate two negative effects. The first is linked to the fact that “dol” appears to be a complex notion and a source of contradiction in substantive law. The second is not permitting to properly penalize the dishonesty perpetrated during the contract formation due to a too narrow scope of the “dol”, the latter being understood as an induced error. Giving it back its real nature of a civil tort defecting the contract and undermining the pre-contractual good faith, our work aims at finding a remedy to these two shortcomings

Full textSocially speaking, the sense of existence is bound in a challenge to live life as faisant oeuvre within the possibilities that the world offers, formed by ones community’s recognition. What one often refers to as “to live”. The human desire to be and to exist, from an ontological perspective, is drawn from the power to endure and from the emotional challenge out of which the possibility of « one’s presence » emerges within the lived present. Lives are taken within a double movement, that of an autonomous organ, and that of a being taken by world order : this imbrication between the lives in « Life » allows to construct an idea of oneself and of the world. A double anthropological implication is drawn from this formative and vital dynamic : a way to understand one self, and the encounter with the world. This formative relation embraces two livable conditions : how do I live life and how do I recount for living life. Taking into consideration that the unfolding of speech takes place in this very double perspective of “reclaiming”, the challenge of this study leans on the elaboration of an investigation process of speech allowing to explore the way in which the being is formed with the world from ones own condition and existence. The ethnographic approach lead within asquat, occupied by the Sorins collective (a group of migrants in an « illegal » situation), shaped the hermeneutic interpretation of speech within this work, which sheds light on the way in which a Subject faces the « unlivable » world imposed on him, regarding his political status, as well as the network through which he apprehends the « situation » of life and faces the world

Full textThis research aims at understanding the contribution of professional narrative accounts in preparing future ergonomists for their profession. It follows the recent introduction of a training program piloted by teachers in a university training center during which ergonomists gave students narrative accounts about their professional practice. The study of the effects of these narratives indicates that their educational purpose does not prejudge how the student will use them in a learning perspective. Some narratives were much more captivating, were better remembered, and produced much more targeted effects of ergonomics training than others by a majority of the students. All the narratives are not equivalent. Several favorable learning conditions were identified, among them the development of the professional’s explanation of the educational purpose of the narrative account, using dynamic visuals, giving real applications of how the accounts could be useful for students, involving the addressees of narratives and the development of the number of problem situations discussed during professional narratives and their resolutions. These results highlight the crucial role of the trainer and professional contributors, and provide food for thought regarding the design of training programs and the conditions of production, narration and utilization of accounts by the students and the participating professionals. We also note an influence of the student’s own cultural background, goals and mobiles in the process of operating accounts. We argue the principle of a double contribution {narrative-subject} whose some coupling properties promote a productive use of narratives.Finally, several professional guides use narratives in the context of university education are developed. They address several audiences. First, anyone wishing to be guided in developing an account of his experience. In addition, anyone wishing to engage professionals to share their experience in a training context.Keywords: professional training, professional narratives, ergonomics, teaching situation, conditions and learning process, episodic knowledge

Full textWhile studying the distinction between the preparation and the execution of a contract, a reflection on a new alternative to the contract of instantaneous performance imposed itself: an adjustable circumstance-based contract. Devoted to a timeless model of contract, contract law has built itself on a pipe dream. Indeed, the negation of time’s infiltration in a contract led the boundaries between preparation and execution to crack apart. In front of this situation the expectations for clarification with the reform were numerous. However, the 2016 reform of contract law, although systematising the scattered provisions of case law, did not drew the needed conclusions by sanctioning the possible incompleteness of a contract in its preparation. Still ignoring time’s impact in time-based contracts, the 2016 reform has worsened the splitting of concepts and prevented the evolution of common right. Thus the author focused on embracing the whole of contractual reality and developing alongside the swap contract: the adjustable circumstance-based contract. Contract law has indeed been confronted to types of contract that struggled to integrate duration but which, in the need to happen alongside a unique swap model, distorted its concepts. This is why the offer of an adjustable circumstance-based contract would be able to reconcile, in contract law, the contract culture of swap and the contract culture of cooperation which arise in duration

Full textThis thesis is based on a selection of published work written between 1980 and 1992. The unpublished introduction examines recent developments in british labour historiography and presents a critical study of such notions as 'class' and 'identity' in their national and regional dimensions. The emphasis is laid on the multiple identities of any human group and it is suggested to consider political analysis in a long-term historical perspective. The selected works are then presented under five headings : (1) a study of a few themes over long periods (modes of unionisation, working class autonomy, skill and training, divisions and positioning within the working class) ; (2) a critical study of the representatioins of labour and of the 'labour aristocracy' in the 19th c. ; (3) a study of how english political culture operates today ; (4) a study of the decline and restructuring of trade unions today, and recent changes in training bearing on occupational culture ; (5) a study of some of the above themes in a local perspective : that of liverpool. These studies together are an interpretation of the decline and the specificity of english 'labourism' as a 20th-century expression of one aspect of a 'working class consciousness' in the making since the industrial revolution

Full textThe tool of reallotment, according to the Real Property Formation Act, is to achieve an improvement of the property stock. In 5:4-8 FBL there are several conditions, protecting individual interests, that must be performed before the reallotment can be carried through against a property owner's will. One of these terms is the value depreciation condition, which regulates the permitted resizing, hindering regulations that would carry out a far too greatinconvenience. Furthermore, the condition stipulates that a property cannot undergo a regulation that makes it less suited for its purpose, and that its grading value may not increase or decrease substantially. This bachelor’s thesis aims to analyze the value depreciation condition’s relevance and applicability today, as well as the origin of the law. The thesis has been answered through literature and case studies, and the results show that the practice of the law differs from the initial idea. Instead of using the tool of reallotment when reparcelling, which was the original idea, it is used in cases of forced reallotment and smaller reallotment measures. The case studyshowed that the purpose, which the property is suited for, is affected by burdensome easements or such regulating measures that carries danger, and therefore makes it less suited for that purpose. Concerning size changes, a 12 respective 25 percent change isn’t considered to be a significant depreciation of the grading value. Furthermore, the value depreciation condition has made it possible for compensation in money, which today is the most common form of compensation when regulating a property. The result shows that the law is still highly relevant, since property owners still must be protected against significant changes in the grading value, and such changes that makes it less suited for its purpose. Finally, it has been established that the Real Property Formation Act is important for societal development and in achieving the best possible property subdivision. It would be interesting to further study cases from the cadastral authority, and the COVID-19 pandemic’s impact on the Swedish supply of raw products and how it could be secured in the future through efficient legislation.

Full textThe thesis finds its main purpose in the study of the recent evolution of French and Romanian civil law of liability during the pre-contractual period. We favored a comparative approach between national rights, in the light of European laws. During the pre-contractual period, the parties are free to negotiate as they please, as long as they do not cause damage to their partner. A bond is created between the parties and it can only be broken in accordance with the principle of good faith. We noted that the basis of liability is fairly controversial and varies from one legal system to another. Indeed, the civil liability is balances between legal security, private autonomy and freedom of contract. In summary, the pre-contractual phase has experienced profound transformations in its evolution. At the time of European harmonization, or even globalization, French and Romanian law undergo modifications in order to clarify the most complicated rules, in particular those relating to pre- contractual civil liability

Full textThe economic development of the gem sector is based on the understanding of the gem- stones colors and the identification of their source. This thesis work is focused on two Be- bearing silicates of gem-quality : euclase and beryl. Euclase is an overlooked seldom stone, recognized for its interest to gem and mineral collectors. Beryl is a well-known and wides- pread gem, used in jewellery. These two gemstones present various special colors, as pink euclase and blue-lagoon beryl, which are studied in this thesis. The coloration of gems is mainly due to transition elements, as iron and manganese, and depending on the redox conditions during their formation. The use of a multi-technical spectroscopic approach (OAS, RPE, XANES, EXAFS) combined with ab-initio calculations allows to get new data about the optical phenomenon at the origin of gem colors. The spectroscopic study of pink, blue, colorless and zoned euclases shows the relation between the color and the oxidation state of Fe and Mn during the formation of these gems, inducing specific redox conditions for the hydrothermal fluids. The blue color of aquamarines has been identified, but is still a controversial issue. The use of polarization in spectroscopy (OAS and EXAFS) gives new reflection elements about the nature of intervalence charge transfer Fe2+?Fe3+ in beryls

Full textDuring the year 2020, one of the first lawsuits in three-dimensional property formation came. This led to reactions among those who work with property development. After a consulting firm conducted a seminar on the case, it emerged that those who work with property development were not satisfied with the first paragraph in Chapter 3. 1a§, second paragraph of the Property Development Act, also called the financing condition. They felt that a change in the financing condition was needed or that the financing condition should be removed completely. This leads to the purpose of this study: to examine how the examination / handling of the financing condition has been carried out to get an idea of how the condition has been handled until now. The study will also go deeper into why the business surveyors who work with property formation think that the condition requires a change. In this study, a questionnaire survey, interviews and a study of administrative acts were conducted to answer the study's questions. The results show that the administrative documents are difficult to read with regard to how the financing condition has been handled or how deep an examination at a procedure goes. From the surveys and interviews, there has been a better result which shows that the trial has been partly deficient but also that there are several situations where the surveyor considers that the condition is met without having tried the condition. The survey and the interviews have shown similar results as the seminar, that is, those who work with property development believe that the financing condition needs a change. The conclusion is that the examination / handling of the financing condition has not been entirely in accordance with the bill, but that a change has taken place and that the examination is more similar to the proposition today. At the same time, we see that the financing condition has probably been met in many of the procedures that have been carried out, regardless of whether a detailed examination has been carried out or not. The conclusion regarding the business surveyors' opinion that the financing condition needs a change is that those whom proposition wanted to prevent have not been a problem and that there are other problems with three-dimensional property that are formed before the facility is built. So a change in the condition somehow they consider important.

Full textPre-contractual liability is derived from the transfer of the duty of the contracting parties to act in good faith from the contract performance phase to the contract formation phase. This transfer was carried out in Colombia by legislative action through the 1971 Commerce Code and in France, by jurisprudence. Nevertheless, the repressive nature of liability during contract formation is still interpreted as simply a reminiscence of delictual liability, at best, and as a marginal sanction for contractual liability, at worst. The goal of this study in comparative law is to find a criterion that confers autonomy and specificity to pre-contractual liability. Therefore, careful analysis by the author led to the discovery that those who insist on denying the existence of pre-contractual liability by linking it to delictual liability have based their argument on a chronological perspective taken from the old notion of contract, i.e., the time of execution. Furthermore, in their view, the absence of a contract justifies the application of the non-contractual liability regime. However, a comparison of the Colombian and French systems on this matter shows the fragility of the argument when faced with the large number of victims of defects of consent who, day after day, prefer indemnification of damages instead of a ruling of nullity of contract. This fragility is much more evident when judges order the indemnification of damages in well-formed contracts, due not to faults related to failure to meet any of the obligations that are derived from them, but to faults originating in the contract formation phase. In essence, finding common ground and discrepancies between the Colombian and French law systems regarding the contract formation phase and comparing them with the mutations of the good faith regime seem to actually contribute to consolidating pre-contractual liability as an autonomous institution

Full textIn 1865, Victor Duruy, Minister of State Education appointed by Napoleon III, puts in place an intermediate course between primary and secondary education. This “Special Secondary Education” was meant to provide the nation with intermediate executives for the industry, trade and agriculture. Consequently, this sector called up in its ranks specific teachers and, wishing this new training to be officially recognized, V. Duruy created three distinct agrégations. He also founded at Cluny a Teacher Training College or École normale in charge of training the new staff while giving the opportunity to external candidates to take this new examination. From 1881 onwards the Special Secondary Education underwent several reforms, until 1891 when it became Modern Education. The Teacher Training College closed down and the special agrégations were stopped. The last exam session took place in 1893. From 1866 to that date, 468 candidates will have passed the special agrégation. For a period which extends from 1866 to 1914, our research work suggests first of all getting to know this neglected teaching staff. Relying on the special agrégés’ personal files, we will first study their social, academic and geographical origins, then their personal routes both in their professional and private lives. The study will next attempt to follow these teachers in their everyday life in order to assess their standard of living. Finally, historiography having pointed out that the standard agrégés often showed contempt towards lower grade social groups, our task will be to highlight the place either in the University or in society the special agrégés held

Full textThe aim of our work is to study a meshfree method introduce recently in by S. Dumont, O. Goubet, T. Ha Duong and P. Villon for the numerical resolution of an elliptic boundary value problem. We are motivated by problems of surface evolution problem like Hele-Shaw flow where the speed of the moving interface is governed by the solution of an boundary value problem posed on the moving domain. In 3D-problems, the induced remeshing can be expensive. Moreover, the projection of the computed solution on the new mesh is a costly operation which may deteriorate the quality of the computed solution. Hence we seek to avoid this remeshing stage. Many techniques have been developed in that direction. One idea is to include our domain in a bounding box and solve an equivalent problem on this box. This is the case of the fictious domainmethod. This approach has been applied in for surface evolution problem for exemple. In case of cracks growth, an eXtended Finite Element Method has been also used in with satisfactory numerical result. The common feature of these methods is to increase the number of degree of freedom by adding either nodes, either dedicated basis functions

Full textIn this manuscript, we will expose the characterization and modelling of Single Wall Nanohorns (SWNH) and Nanotube Forests by analytical microscopy and the functionalization of SWNH for drug delivery applications. Firstly, we will introduce the microscopy and spectroscopy methods used for our experiments. We will then study the growth process of Single Wall Carbon Nanotubes (SWCNT) forests (within the framework of a collaboration with AIST, Japan). SWCH, their structure, modifications and filling properties will be analysed in details. An original method will be presented to study the porosity of inorganic material with EELS. Ab initio calculation will also be used to explore the effect of the defects present in the SWNH wall on the oxidation and filling process. We will study the potentialities of Single Wall Carbon nanohorns as Drug Delivery Systems and particularly as anticancer drug carriers

Two main concepts of group-buying are “gathering of needs” and “discount by quantity”. It means that consumers with the same buying needs gather as a group, with the advantage of purchasing in large quantities, to negotiate the price with the seller or ask for a discount. With the retail price became cheaper and the business increasing a win-win situation is created. When we apply group-buying to the Internet dimension, we called it online group-buying. Besides the above mentioned characteristics , it is also convenient, fast, and unconstrained by space and time. Mobile group-buying is a kind of online group-buying with following features: location designed, time defined (start and end), number of participants limited (highest and lowest), product designed and high discount. It makes group-buying more flexible and precise. However, no matter which way consumers choose to purchase, they will have to be cautious and take their time to find a buying group meeting their needs, and are also under the risks of receiving not as expected products, long waiting time, or failed to gather enough participants. Furthermore, if businesses create a group sale without precise marketing survey, they may fail due to the wrong strategies. Mobile group-buying can actively match the needs of moving buyers and sellers in order to form a group-buying subject while providing suggestions on group sale conditions to businesses to ensure profit. When the seller eventually decides to process the sale, the system will inform the buyers to complete the purchase. In order to accomplish this service, we set up the conditions of dynamic group-buying and the methods of forming the target. The condition of dynamic group-buying includes a proper location, list of suggestive products, number of participants (highest and lowest), start/end time, and price. The formation of a group-buying target is when the system recognizes a gathering of certain amount of consumers with the same interests the system seeks a compatible seller and offers the suggestions according to the purchasing conditions and evaluation of risks. If the seller accepts the suggestions and the dynamic group-buying is set up, the system notifies the consumers about the realization of the purchase and asks them to go to the store to purchase the products. This research enhances mobile group-buying, mobility and dynamic capacity. As the list of buying interests moves with the consumers, the system finds matches sellers buyers and so the purchase is successfully completed. Moreover, the seller’s store will be near the location of the buyers, therefore greatly reducing the waiting time for the product. The buyers also choose their own products instead of going to a group-buying platform looking for a group purchase which may not correspond to their needs. Consumer autonomy is assured, which facilitates “planned” group-buying and reduces the possibility of impulsive purchases. For the sellers, the system helps to attract customers, by giving advice on group-buying and evaluating the risks. It decreases the expenses of promotion and of marketing investigation and precisely captures the buyers’ needs. The main purpose of this research is to build the system mentioned above, the formation of targets and the institution of conditions of dynamic group-buying in mobile environments. Therefore, the content of the study includes: problem definition of the formulation of a dynamic group-buying condition and target, ways to formulating dynamic group-buying conditions, ways to formulating dynamic group-buying targets, the mechanism of choosing the best group-buying store(s), the simulated system environment , and constructed evaluation mode. We also evaluate the efficiency from the dimensions of the system, consumers and the sellers. The results of the research show a high rate of the sellers’ acceptance to the suggestions made by the system, and after the acceptance, the completion of the group-buying. For the buyers, it has an excellent results of the average waiting time of under 30 minutes, the distance to the store less than 6 km, and a 30% off discounts on average.

Several factors that may affect the surface nodule size of a polymeric membrane were under investigation. The increase of polymer concentration and molecular weight was found to increase the surface nodule size. The increase of casting temperature also resulted in an increase in nodule size. These results supported that the radius of gyration and the collision frequency of polymer chains were the key factors affecting the nodule size. However, when the radius of gyration was reduced by the use of a poor solvent or by pre-adding nonsolvent in the casting solution, the surface nodule size increased. It suggested that there existed other factors affecting the nodule size on membrane surface besides the gyration radius and the collision frequency of polymer chains. In this study, we found in most cases that the surface nodule size decreased along with the surface tension difference between casting solution and coagulant. To demonstrate the effect of surface tension, we examined the nodule size inside the membranes where the nodule formation was not affected by the interfacial tension. Opposite to what was observed on the surface, the nodule size increased with the sovation power of the solvent. This result suggested that it was the interfacial tension that overpowered the gyration radius in affecting surface nodule size. In addition, the effect of surfactant additives on the surface and cross-section nodule structure of membranes was also studied. The size increased with surfactant additive in casting solution content increased, and casting solution viscosity also increased. The AFM microscopic studies showed that membrane surface roughness increased with nodule size increased. The membrane surface nodule size distribution is well rounded at high temperature than that in lower. With this information from Kinetic and thermodynamic study, can know that light transmission rate increased, the size of nodule increased excepted polymer molecular weight and concentration part.

Abstract Wolfiporia cocos is an edibles fungi, it has long been used as traditional Chinese herb with curing incontinence, edema, sputum, palpitations and sleeplessness. Pharmacology studies have proven that its anti-tumor, anti-emetic, ant-inflammation, anti- nephritis, diabetes. The potential markets for W.cocos as neutraceutial and pharmaceutical products will stimulate the research for methods of its cultivation. The results indicated that in shake flask fermentation at 26ºC, 100rpm, a 5% olive oil addition in the medium is the best among different concentrations for the mycelium growth, while the 4% olive favors the exo-polysaccharide formation. In fermentor studies, the 7 liter bubble column fermentor (BCF) with 2 vvm aeration is the best for exo-polysaccharide production, and has a concentration of 0.39mg/ml in 7 days,as compared to 0.23mg/ml by 5 liter stirred tank fermentor(STF) at 2 vvm . At 1 vvm, the polysaccharide is 0.17 mg/ml and 0.21 mg/ml for BCF and STF, respectively.Lower aeration rate resulted in poor polysaccharide production which is caused by the aggregation of the mycelium which accumulated at the bottom of fermentor, and interfered the air supply. The fermentation condition affect the molecular weight (MW) of the polysaccharides greatly. MW distribution of polysaccharides, as determined by GPC, from STF 1vvm, BCF 2vvm, and BCF 0.5vvm, were in the rang of 103~108Da, and during the 7 days fermentation, the MW changed from one single distribution in early stage into two MW distribution in the late stage. STF 2vvm and BCF 0.5 vvm was in the range of 103~109Da, while the MW was unchanged throught the cultivation period.

Full textThe main focus of this thesis is to investigate pre-contractual liability as it pertains to Quebec and International law. More specifically, it will examine how breaches in negotiations are dealt with when there are no existing pre-contracts. In order to determine the parameters involved, the nature of the liability will be determined. Since it has not been coded within Quebec law and is not specified in any major international documents, liability is considered within the framework of one of two main systems, either contractual or extra-contractua1. This is not simply a theoretical issue since it directly influences prescription and private International law. In Quebec, doctrine and jurisprudence have associated pre-contractual liability with the extra-contractual framework, thus following the c1assic model of fault, injury and causality. The nature of the liability remains unclear under International law due to the diversity among members comprising the committees that elaborate norms. However, all agree that there is a fundamental concept underlying pre-contractual liability: that of good faith. It remains central to the notion of fault and dictates the ethics involved in negotiations. In addition to the nature of the liability, we will also discuss how it is brought into play. The notion of good faith implies that negotiating partners have certain duties with regard to each other that they must respect. These duties have been developed through jurisprudence and each case must be evaluated separately. Quebec courts rarely sanction breaches in negotiations because they relate to the basic concept of freedom of contract. It is this notion of freedom that prevents Common law countries from accepting the concepts of good faith and pre-contractual liability, even though they sanction faulty behaviour during negotiations through various mechanisms. The damages that can be sought vary. In Quebec and France, damages for losses and projected losses are awarded, although damages for projected losses are rarely awarded under International law. In conclusion, pre-contractual liability is emerging and developing as an entity even though court claims to this effect remain infrequent.

Candida albicans (C. albicans) is an opportunistic pathogenic fungus and one of the most commonly isolated human pathogens. Especially in immunocompromised patients, it can lead to lethal candidiasis. It is believed that filamentous growth is involved in virulence. Researchers have developed the avirulent cph1/cph1 efg1/efg1 C. albicans, which is unable to form filaments. In recent years, the abuse of antibiotics and the emerging of resistance to existing antifungal drugs have made the treatment of fungal infection more and more difficult. To search for a new drug with higher efficiency and less toxicity, I have screened and isolated the virulence genes of C. albicans with the technique of suppression subtractive hybridization in the hope of unveiling suitable new targets for drug development. Two sets of suppression substrate hybridization were performed. One subtracted mutant RNA from wild type RNA (WT-Mut). The other subtracted wild-type RNA from mutant RNA (Mut-WT). Genes in the WT-Mut group are expressed only in the wild type C. albicans or expressed at a higher level in wild-type than in mutant strain. Virulence genes could be in this group. 32 islated cDNA fragments were subjected for sequence analysis. Among them, 18 were EFG1 DNA fragments. Since EFG1 gene was included in the WT-Mut group as expected, this performance of this technique is reliable. It demonstrated that this suppression subtractive hybridization can indicate not only whether certain genes are expressed or not but also the difference in the expression level. In the remaining 14 clones, grouped into 12 different genes, some have been reported to be associated in morphology or virulence: Serine/threonine kinase is involved in filamentous growth; squalene epoxidase (CAERG1) is in the pathway of synthesis of cell membrane; hxt6 gene for galactose/glucose transporter is responsible for the metabolism of energy.
