Abstract:
The Durban Conference in 2011 brought international attention to the question of the descendants of victims of slavery and colonialism were entitled to reparations. Shortly after the Durban Conference several cases were filed in the USA by amongst other The Herero People Reparation Corporation claiming reparations from the German State for the Genocide on the Herero-people in 1904-07. These types of cases raise a host of complex questions – amongst others the question of when a historical injustice is too old to be subject for reparations. But as this paper explores the answer to this question depends not only on law but also the dominating politics of history, political will, and historical consciousness. A fact that might also have some influence on the Danish debate on reparations for slavery in the former Danish West-Indies.

Abstract:
The object of this article is to examine the impact of the Marshall Plan (ERP) on the strategy of reparations from Germany that was pursued by the British government in the postwar era. In order to put this into some kind of context it will first be necessary to provide a brief survey of the mechanism of reparations and then of the rationale behind the system of financial assistance afforded by the USA to Western Europe known as Marshall Aid (its title derived from the US Secretary of State, George Marshall, who pioneered the scheme). The idea of extracting some form of compensation from Germany, to be apportioned among the victors, came to be debated in Whitehall during hostilities, but little attempt was made to coordinate plans among the Allies until the conference at Yalta in February 1945. No consensus could be attained there among the participants (the UK, the USA and the USSR). Stalin lodged a claim for $10 billion of reparations in ten years, which entailed that the Soviet Union would be allocated half of all payments from Germany. The lack of assent from the Western powers led to a new body, the Allied Reparations Commission (ARC), being convened in Moscow, which also failed to reach a conclusion. Reparations were then settled at the Potsdam Conference between the same three powers in July–August 1945.

Abstract:
This article examines the negotiations that led to the incorporation of reparations provisions into the legal framework of the International Criminal Court (icc). Building upon a review of the travaux préparatoires and interviews, it traces the actors and main debates during the lead-up to the Rome Conference and the drafting of the Rules of Procedure and Evidence, explaining how and why reparations were included into the Rome Statute. In doing so, the article shows how the reparations mandate was produced at the intersection of a set of different agendas and actors. From this account, it identifies a number of key themes that were at the centre of the negotiations and often galvanised contestations among delegations or with ngos. The article concludes with a fresh perspective on the origin of victim reparations in the Rome Statute and its relevance for understanding many of today’s debates around reparations in international criminal justice.

Ce travail explore l'impact des réparations sur les groupes en se concentrant sur la question du temps. Les distinctions opérées par Paul Ricœur entre temps objectif, temps raconté et temps perçu permettent de circonscrire avec précision le champ d'action des réparations : elles sont des vecteurs de reconnaissance caractérisés par leur pouvoir de reformulation du passé. Pour démontrer cela, l'étude s'appuie sur le cas des réparations allemandes à Israël et à la Claims Conference de 1950 à 1990. Ce cas est interprété dans le but de comprendre ce qui a motivé ces gestes, et aussi en vue de justifier le principe des réparations en général : il adopte une méthode herméneutique critique. Les réparations allemandes sont d'abord liées aux théories de la reconnaissance. Les revendications des victimes sont interprétées comme une lutte pour la reconnaissance, les réactions des offenseurs comme un parcours vers la reconnaissance de responsabilité. Le fonctionnement de la reconnaissance est ensuite précisé par une étude des formes qu'elle revêt au fil du temps. Les années 1950 sont celles de la justice civile, c'est-à-dire des réparations monétaires. Ce mode de reconnaissance se caractérise par une façon elliptique de raconter les événements. Dans les années 1960, la justice pénale prend le relais et propose un récit plus concret du passé à travers les témoignages et les verdicts. Dans les années 1970 et 1980, ce sont les gestes symboliques, de nature essentiellement narrative, qui prédominent. This thesis explores the impact reparations have on groups by focusing on the question of time. It applies Paul Ricoeur's distinctions made between objective, narrated and perceived time. Thus it can show that reparations function as the primary vehicle for recognition due to their rephrasing power. Though they cannot undo the irreparable, they are capable to change the narrative about the past. The case study chosen to prove this point are the German reparations to Israel and to the Claims Conference from 1950 to 1990. The method applied is critical hermeneutics, so the case is not only interpreted in order to understand the motivations for these very reparations but also to justify the principal of reparations in general. The German reparations are first related to the theories of recognition. The claims of the victims are identified as a struggle for recognition, while the reactions of the perpetrators are described as a journey towards the recognition of responsibility. Then the functioning of recognition is specified through a detailed study of the different forms that reparations have taken over time. The 1950s were the years of civil justice, i.e. of monetary reparations. This form of recognition was characterized by an elliptic way of telling the events. In the 1960s, criminal justice took the place, and made a more specific narration of the past possible thanks to the testimonies and verdicts. In the 1970s and 1980s, symbolic acts, essentially narrative, predominated. To sum up, each form of recognition constitutes its distinct mode of telling the past and modifies as a consequence the perception of time. This power to reformulate is an answer to the irreparable

La présente recherche porte sur les rapports entre droit pénal des mineurs et justice restaurative dans le cadre d’une approche comparative entre la France et la Belgique. Au-delà de la révélation de similitudes et de différences entre les deux pays dans ces domaines, la recherche aborde également les difficultés présentées par la France et la Belgique dans l’acceptation de la justice restaurative en droit pénal des mineurs et de son développement au sein des institutions judiciaires. Par l’étude des raisons qui ont conduit la France à manquer le tournant restauratif et de celles ayant permis, en Belgique, l’implantation de la justice restaurative dans le droit pénal des mineurs, des points d’ancrage sont relevés de nature à permettre son épanouissement dans l’ordonnance du 2 février 1945. Une expérimentation dans un service éducatif de réparation pénale a été menée avec le souci de prendre en compte des problématiques intéressant le service lui-même (logiques actuarielles, prudentielles, financières, idéologies professionnelles, craintes diverses). L’analyse des pratiques souligne que les services de réparation pénale, inscrits dans une rationalité managériale du traitement du phénomène criminel juvénile, sont limités dans la mise en œuvre des démarches de justice restaurative. Il s’avère également que quelques prises en compte du mineur et des modalités de l’exécution de la mesure envisagée par les éducateurs facilitent (approche psycho-criminologique du passage à l’acte inscrit dans une dimension psycho-socio-éducative de la réparation) ou bien inhibent (approche criminologique de l’acte inscrit dans une dimension rétributive de la réparation) des programmes de justice restaurative. Pour autant, quand bien même la pratique facilite une telle expérimentation, lorsque les éducateurs disposent de mission de « réparation-directe » notamment, des obstacles d’ordre idéologique s’observent au niveau de l’accueil, du démarchage et de la participation de la victime. Il demeure cependant essentiel de souligner que, par la présentation des principes et des promesses de la Justice restaurative aux éducateurs rencontrés, les écueils identifiés tombent, principalement quant à la présence de la victime lors de la mise en œuvre de la réparation pénale directe. Une telle évolution des postures professionnelles augure d’une intégration harmonieuse prochaine des démarches de justice restaurative en droit pénal des mineurs
This research focuses on the juvenile criminal law and restorative justice in a comparative approach between France and Belgium. Beyond revealing the similarities and differences of these countries in these fields, the research also carters to the difficulties encountered by France and Belgium in the acceptance of restorative justice in juvenile criminal law and its development in the judicial institutions. By studying the reasons that led France to miss the “turning” of restorative justice and those enabled, in Belgium enabled, the implementation of restorative justice in the criminal law for minors, anchor points have been identified for its development in the order of 2 February 1945. Subsequently, an experiment in youth justice service on the reparation measures was led considering difficulties which concern the service itself (actuarial logic, supervisory, financial, professional ideologies and fears). Our analysis of practices in the youth justice services on the reparation measures, reveals that the experimentation of restorative justice is limited by a managerial rationality treatment of juvenile criminal phenomenon. Also, some of the minor approaches and their implementation in the measure facilitate (psycho-criminological approach to acting out part and a psycho-socio-educational dimension in reparation) or inhibit (criminological approach to act itself and a retributive dimension in reparation) restorative justice programs. However, even if the practice facilitates experimentation and that educators apply “direct reparation”, ideological barriers remain in dealing with victims. However, it remains essential to underline that, thanks to the presentation of the principles and promises of restorative justice educators met, the identified pitfalls fall, mainly with the presence of the victim during the implementation of “direct reparation”. Such a development professional postures omen a harmonious integration of next restorative justice approaches in juvenile criminal law

Abstract:
This chapter examines the politics of reparation in France, Germany, and Italy. The reparation issue was not settled at the Paris Peace Conference. Woodrow Wilson resisted the most extensive demands of the European allies, but recompense for civilian damages, which he sanctioned, was bound to be enormous. Furthermore, Britain won the principle that separation allowances and pensions for veterans or dependents must also be shouldered by Germany. To forestall divisive arguments, it was agreed that a Reparations Commission would determine the total damages and levy a final bill by May 1, 1921. The chapter discusses issues relating to reparation, taxes, and the German heavy industry. It also considers how with French Prime Minister Aristide Briand and German Chancellor Joseph Wirth sought support on the basis of a reformist or moderate position and found themselves stalemated, suggesting that both men were hostage to each other's moderation on reparations.
