Full textThe thesis will consider the new evolution of maritime law, which today, in many aspects, follows air law. It will become clear that both systems face the same difficulties. In particular, the multiplication of international conventions has weakened the aim of uniformity by admitting different regimes of the carriers' liability. Once the causes of conflicts of jurisdiction have been identified, the thesis will analyze how the conventions attempt to solve those conflicts. The use of forum shopping by the parties and the use of forum non conveniens by the courts, reveals that present international solutions are not satisfactory. The practice in maritime law is to consider a conflict prior to its existence and to permit jurisdiction as well as arbitration clauses. While the former clauses are forbidden in air law, arbitration clauses, although accepted in various international air conventions, have never been used until recently in air law, and only in respect of the financing of major projects.
It is therefore possible to believe today, that the maritime approach can and will be followed in respect of conflicts of carriage of goods by air, thus proving that maritime law does still influence the evolution of air law.

Full textIn view of the increasing on the usage of electronic media as a means to facilitate the trade of goods and services beyond the State borders, the purpose of this study is to identify the challenges arising from the clash between the practices in the cyberspace and the contemporary law, showing in a critically way the solutions unveiled by international society. The international law issues, that are already conflictual before the traditional international trade, become even more subjective in particular virtual environment, dematerialized and deterritorialized. Such characteristics and peculiarities reflects in the identification of jurisdiction and applicable law, in the solutions to prevent the cybercrime and in the alternative dispute resolutions as well as other subjects that were likely to be addressed in this study. Therefore this study intends to examine the solutions developed so far in order to regularize and/or standardize the actions in the electronically international trade, presenting rules and case law implemented or in developing in the area.

Full textIn order to study the paradoxical phenomenon of the rise of party autonomy in parallel with the multiplication of mandatory norms in contemporary private international law, the concept of permissive rule is particularly apposite. It accounts for all instances where the law-making body grants a beneficiary the possibility to do or not to do something; be it the judge when he is authorized to stay the proceedings in case of related actions, or the parties when they are authorized to choose the law applicable to an international contract.A study of the positive law shows that permissive rules are numerous in both Choice of laws and Jurisdiction and that they operate under distinct logics depending on whether they grant a possibility to a judge or to the parties. In the latter case, the issue at stake is no longer whether a right is granted by the legal rule, but rather whether a right is conceded in the choice of the legal rule. This specificity, together with the proliferation of permissive rules in private international law, warrants that their relevancy be tested.In this context, the assumption that permissive norms would adequately serve the purpose of foreseeability of solutions, which forms the basis for their adoption, must be questioned. This critical assessment leads to the proposal that permissive norms should, in the future, play only a residual role in private international law, either as a way to reach consensus or as a stopgap in the absence of a sufficiently foreseeable connecting factor

Full textInternationality is a central concept of private international law, which has however never been clearly defined. The construction of Europe and the several phenomena of despatialization brought about by globalization have made it even more difficult to grasp by introducing a differentiation between European and truly international situations and by partially calling into question the spatial localization of certain legal situations, qualified as transnational or even anational. The definitional difficulties that have always affected the notion of internationality are today gaining in visibility and importance as a result of the increase in the number of international situations. In this context, we first propose certain solutions to the most common problems of apprehension of internationality, as well as the adoption of a functional approach to the concept, which makes it possible to define its contours with satisfactory precision. Secondly, starting from the observation that the existence of internationality triggers the application of the rules of private international law, which lead to a legal regime that is often different and more favorable than that reserved for internal situations by domestic law, it is shown that this difference in treatment resulting from internationality is not always justified, in that it is not driven by the needs specific to internationality. Similarly, the appropriateness of establishing a legal regime specific to European situations as compared with truly international situations is partly questioned. With regard to the influence of European regionalization and despatialization on the regime of international situations, we finally partially question the appropriateness of the establishment by EU-law of a different legal regime for European situations and truly international situations, on the one hand, and conclude that the current methods of private international law are adequate to regulate transnational situations, on the other hand

Hence, the Courts apply the law of the forum automatically and do not apply their own conflit of rules. Definition is not precise enough to be used accurately. Therefore we propose to define concept of Overriding mandatory provisions focuses on the « Public Interest », which is derived from article 9, paragraph 1 of the regulation on the law applicable to the contractual obligations. In the following lines, we wonder about the mandatory implantation of these rules at the intrenational level. Full textFrench private international law holds as usual the dissociation between choice of law and judicial jurisdiction. This independence between the two sets of rules is set up as a principle by both majority doctrine and law. According to this principle, any form of correlation is and must be refuted, whether it occurs at the time of implementation of the conflict rules or the time of their formulation. In other words, three hypotheses are thus denounced: that of the direct applicability of the lex fori as such, but also those of the jurisdiction of the forum legis and the parallelism of the conflict rules, which lead to an indirect applicability of the lex fori. However, according to this study, contracts and torts private international law shows that such a principle does not exist and that it is not necessarily appropriate. Indeed, both the mechanism of overriding mandatory provisions and freedom of choice of law give rise to a direct applicability of the lex fori. Moreover, the refutation of indirect correlation modes is inappropriate. On the one hand, the jurisdiction of forum legis makes it possible to guarantee the effectiveness of overriding mandatory provisions, insofar as no other remedy is sufficient. On the other hand, the specialisation of contracts and torts private international law and the influence of European Union law on this discipline generate rules of judicial jurisdiction rules and applicable law that present a certain parallelism that is not only accidental. The thesis thus invites us to question certain classic dogmas of private international law of obligations

Full textThe liberal influence in Family Law and the rise of individualist ideology have led to a multiplication of conjugal life forms and considerably increased the diversity of laws and methods applicable to couples in International Private Law. To analyse couples under International Private Law leads us to rethink the International Private Law of the Couple. Deconstructing this subject brings to light the current non-adaptation of the classic conflict of laws method and the insufficiency of the recognition approach. In fact, current International Private Law as it pertains to couples neither guarantees the international recognition of theconjugal bond nor ensures a coherent legal treatment of legal problems faced by international couples. It is therefore necessary to examine a possible methodological evolution of thesubject. This study aims to demonstrate that it is possible to adapt the classic conflict of lawsmethod by taking into account the objectives of the recognition approach whilst founding iton the lex auctoritas rule. This would not only bring better coherence to International Private Law of the Couple but it would also assure a real legal stability for international conjugal relationships

Emphasis is placed on matters of a commercial nature. Furthermore, a discussion of the Hague Convention on Choice of Court Agreements provides insight on the Convention’s purpose and its possible influence on and implications for jurisdictional rules found in the private international law of the IBSA countries should they become members to the Convention.

Full textLegal judgements against unsuccessful defendants are handed down around the world on a daily basis, but their enforcement can become a complicated matter when the enforcement of the judgement must occur outside the territorial boundaries of the state from which it emanates. The purpose of this paper is to determine the enforceability of judgements of the European courts whereby the jurisdiction of the court was determined in terms of Brussels I. This paper begins with an in-depth discussion of the principles of recognition and enforcement of foreign judgements and the purpose it serves within the context of private international law. The second chapter discusses recognition and enforcement of foreign judgements in South Africa. The requirements and the criteria necessary to fulfil such requirements will be discussed under this heading. The third chapter considers the various grounds of jurisdiction available to the plaintiff in approaching a court of a European Union State. Each ground will be followed by a discussion on the enforceability of a judgement, founded on such a ground of jurisdiction, in terms of the South African principles of recognition and enforcements of foreign judgements and whether the requirements discussed in the preceding chapter have been met. Chapter 4 provides concluding remarks relating to the matters discussed in the body of this paper.

Full textThis essay seeks to look at the role of express submission to jurisdictjon under the Brussels I Regulation,lthe Brussels I (recast) Regulation2 and the Hague Convention on Choice of Court Agreements.3 The express submission to jurisdiction under the three instruments mentioned in the previous sentence refers to the situation in which parties to an international commercial contract include in their contract a court of their choice to govern any disputes that may arise between them. This designated court may or may not be situated in a country that is a member of the three instruments mentioned above. The purpose of this thesis is to determine what will occur when the court chosen is from a country that is not a member of either of the three instruments mentioned. We will first look at express submission and the role it plays in determining which court has jurisdiction. This section on express submission will provide the definition of express submission in the context of a contract which incorporates a choice-of-forum agreement between the parties who are engaged in an international commercial transaction. The thesis will view the role of submission in a common-law and civil-law country in light of express submission by contract. Finally, a distinction will be made between an exclusive and non-exclusive jurisdiction clause. A brief discussion ofthe Brussels Convention4 (The Convention) will be provided in order to present the fact that the Convention only applies when a choice-of-forum agreement in a contract has assoned thejurisdiction to a court of a country which is a member of the Convention. The Convention would not apply when a choice-of-forum agreement in a contract has assigned jurisdiction to the court of a country which is not a member to the Convention. ln order to determine whether the position has changed since the enactment of the Brussels I Regulation (Regulation) with regard to choice-of-forum agreements that designate jurisdiction to the court of a country in a nonmember state of the Regulation, provisions relating to express submission clauses will be discussed. A further discussion will be provided to ascertain whether the enactment of the Council Regulation (EC) No 4412001 of 22 December 2000 on jurisdiction and the recognition and enforcement ofjudgments in civil and commercial matters.
