Full textThis present work analyzes the importance of a communication strategy as part of the resolution of social conflicts in the mining industry. We used two cases of mining conflicts in Peru, the first one is the case of the AngloAmerican mining company with the Quellaveco project located in the department of Moquegua, which is a case of success and the second one is the case of Southern Copper Peru with the mining project Tía Maria, located in the department of Arequipa, which has not been resolved yet. For this, we focus on the importance of previous preparation and investigation of the negotiators, as well as the role of the state as a link between the extractive industry and the community. We also identify the external participants, evaluating the impact they have in the development of these negotiations. We bring under discussion, negotiation and communication where a key factor is the approach that is given to dialogue between the parties involved. In the development, we show how in the case of Quellaveco, the regional government headed by Governor Martin Vizcarra, assumed a very open position and became fully involved in the solution of the conflict by establishing a dialogue table with a participatory approach, being able to engage in collaborative negotiations with the community in order to get multiple beneficial agreements. Otherwise, Tía Maria is only using for the moment information tables in order to decrease the conflict without reaching agreement with the people who continue to oppose the project and increase the intensity of the conflict and its consequences.

Full textThe objective of this research work is to study the relationship between the new system that increases the working hours and the family conflicts. When changes in the work method were made in order to improve the production by increasing the working hours, some aspects and factors that directly have an effect on workers and their families were taken into account. We have researched concepts related to family, work and conflict, quality of working life, family conflicts, and the influence on production and the operations strategy in a company. By the qualitative research method, we have noticed that although the increase in the working hours allowed increasing the production, the analyzed data show that the relationships have been deteriorated considerably at home because there is no enough time to interact with the family. By the survey results and the fieldwork performed, we can infer that there is a strong entrepreneurial culture at Naviera Oriente (NAO) due to a clear identification with the organization, a high flexibility to change, a working autonomy (empowerment) and a clear perspective of continuous improvement based on creative and innovative ideas. However, there is a field in which the company should emphasize: the human and work relationships, so that an increase in production is not linked to the increase of the family conflicts at home nor the increase of working hours, since the worker´s ability tends to decrease and the worker cannot perform his duties properly. The in-depth interviews technique was used for interviews, whose characteristics were essential to guide the questions of the answers given. Qualitative data was obtained. Interviews were conducted to managers, employees and family members, whose answers were important to get high-quality information in order to establish and visualize the relationships between the abovementioned variables. Finally, this research is expected to be used as a reference so it applies to the river shipping activities to ensure production in the operations, implement good business strategies, and strengthen the human factor as an important element for each company, so there is a competitive advantage for organizational success.

Es el único encargado oficial de la protección de derechos de niños, niñas y adolescentes, además de regular y controlar la adopción en Chile, lo que lo convierte en una institución sumamente relevante para el país y la formación de niños y jóvenes. Full textThe present investigation develops the problem of mining social conflicts, dialogue meetings and Sustainable Development Projects in Peru. An analysis of the main theories of resource management is carried out, determining that cooperative action is a model of social management in the prevention of social conflicts. The main social conflicts and dialogue meetings in Peru allow us to conclude that these spaces serve for the fulfillment of commitments of the mining company and the demand for Sustainable Development Projects, also shows that the ability to generate harmonious relationships has been overcome between private enterprise, the State, communities and social organizations. Social conflicts in Minera Las Bambas S.A. they are complex because of the number of actors and scenarios. The interviews reflect that, social conflicts are an opportunity for change and the dialogue meetings do not contribute enough in the Sustainable Development Projects. Likewise, the experience in the District of Condoroma allows us to maintain that social conflicts can be prevented when working cooperatively in sustainable development and social management. Finally, the research proposes the creation of Councils for Sustainable Development and Social Management in Mining.

Felipe Hernández Lorca Department: E053 Information and Documentation Programme: 05302 Techniques and methods in information and documentation Objectives Define the role of the Press in a democracy as well as the legitimacy of the media in exercising control over the actions of the Government and other institutions. Describe the conflicts at both the personal and institutional level between the Press and certain members of the Felipe González administration in addition to other top officials in the Spanish Socialist Party (PSOE) during four consecutive terms in power (1982-1993). Define and detail the concept of counter-power with respect to the press and its limits, including the functions of journalism, its social value and the freedom of expression as one of the highest values enshrined in the Spanish Constitution of 1978. Demonstrate that the arrogance of the Socialist leaders, resulting from having won successive elections by absolute majority, led to a steamroller approach in relations with opposition groups and social partners and was indeed one of the causes of the belligerent attitude of the Press towards authorities. Methodology The methodology applied is in line with the content analysis approach to bits of information or opinion published in the press, which together give rise to a conclusion. The sample of information used has been obtained in a random yet significant manner and then sorted by themes (or conflicts in the case of this study) that account for the facts and opinions expressed by various social partners, opinion leaders or those directly involved in the events. The methodology is therefore based on extracting all pertinent information from documents from various sources (using a specific and relevant bibliography and academic studies) with a particular focus on the main newspapers published in Madrid during the period under study: ABC, Diario16 and El País. Editorials are particularly relevant in this study, for in this section newspapers express their views on the events that are of interest to and also feed public opinion. Columns, opinion pieces penned by prominent and influential figures, are also of special interest here. Conclusions Following the censorship of the news media that occurred during the Franco Dictatorship, the Press was acutely aware of the role it needed to play in the young Spanish democracy: unabashed defence, without censorship or self-censorship, of the freedom of expression. The phase of successive Socialist governments (1982-1993) provides an adequate testing ground for Press-Power relations and ultimately gives us a perfect example of the tensions that should not occur in a democratic system. The drive to politically control information was mainly justified as an attempt to prevent media criticism from negatively affecting electoral support. The Socialist government promoted regulatory control of the Press and gag laws, such as reforms to the Penal Code to include penalties of professional disqualification. Furthermore, the government tried to create a group of favourable media by awarding top positions within the “Prensa del Movimiento” . It was not only the Press, but also “within the Press”, where the debate on the Socialist government's leadership arose and in which the opinions and criticisms of authors of highly diverse political, social and academic backgrounds converged

Full textFootball is the most popular sport in the world, and its agents work as models for a great number of people. Despite it has an enormous educational potential, this game has become in many ways a space for breaking the rules and validating cheating and corruption in order to get better results and economic benefit. An important part of these behaviors occur in the field, and coaches are frequently protagonists for their relevance as leaders. Then, this research has as main objective to describe and discuss the moral reasoning and moral judgment processes of eight youth football coaches when presented with the Sport Conflicts Instrument, which was build for this work. The main results confirm there is a prevalence of preconventional reasoning, in which breaking the rules is justified or reasoned in a cost-benefit way, especially for strategic foul commission, cunning attitude and to a lesser extent, tricking the referee. The research proposes a need to rethink the role of football coaches and sports psychologists in the moral education of children and teens, expressly adopting a vision of moral principles in the resolution of conflicts.

Full textResistance to mining is not new and nonetheless, resource extraction has been expanding materially and geographically during the last 50 years, reaching new frontiers, moving bigger quantities of soil and water and impacting more communities. The resistances that are emerging are becoming more relevant in shaping the commodity frontier and are an important factor in the political economy of mineral expansion. Thus, it has become crucial to understand why is resistance to mining emerging and how is it evolving. Bringing attention to uranium, the often forgotten source of nuclear power, this thesis studies the industrial dynamics of uranium mining, its impacts and health implications, and the resistance at the uranium mining frontier in Africa. Namibia and Niger, the main producers of uranium in Africa, stand at the forefront of what was a global uranium rush partially slowed down by the Tepco-Fukushima accident. This thesis proposes three enabling factors that help to explain the emergence and intensity of resistance by local communities to uranium mining: the ecology and geography of the resource; the degree and type of political and economic marginalisation of the community; and crucially, the creation of extra-local alliances that connect and integrate local concerns with broader social movements and global demands. I show how these three attributes play out differently in five Namibian communities that have been, or stand to be, affected by uranium mining, and explain how local ecologies of resistance shape, or fail to shape, the global uranium frontier. The cases presented deal with Low Level Radiation caused by uranium mining affecting workers' health and those of people living in nearby communities. With people impacted claiming causal links that are still not scientifically sustained, the burden of proof is left to the communities. Through extra-local contacts local grassroots organisations in Niger and Namibia are engaging with scientists to produce new knowledge to learn how to protect themselves from the impacts and confront the manufactured uncertainty and other information produced by the mining companies. Locally driven, this ‘Activism Mobilizing Science’ process gives activists visibility and legitimacy to become new political actors and form part of an ‘extended peer review’ community (in Post Normal science language). A second objective of this thesis aims at uncovering how resistance to mining has evolved. Whilst strikes, protest and demands linked to labour issues have dominated mining conflicts through history, we have seen how in the last two decades communities living in the surrounding areas of mining projects are increasingly opposing them on environmental grounds and objecting their lack of representation and participation in decisions concerning their development path. These groups are innovatively combining local narratives and alternatives with global discourses on rights (to clean water, to take decisions, indigenous rights) and environmental justice. Cross-scalar alliances have allowed local groups to increase their knowledge about the projects, give them visibility and comprehend and act against their weak position in the global commodity chain. These alliances have also contributed to the emergence of a diverse set of resistance strategies such as legal court cases, activist-scientist collaborations or "consultas" at community level to reject mining projects. The response of the state and the mining companies to resistance is also explored. The thesis concludes that whilst the resource and geography of a mining project are key determinants in a socio-environmental conflict, the community’s strive for participation and recognition drive the connection and integration of local concerns with broader political demands and the control or production of new knowledge, key paths in the formation and success of resistance movements to mining.

Likewise in all the national documents of reference to the production of the Title in Degree in Social Work there is gathered the importance of the resolution of problems as essential competition in the professional profile of the workers and the social workers, as well as of the mediation as area of intervention and own function of the Social Work. The present doctoral thesis analyzes if the importance granted in the academic and professional national area to the constructive management of conflicts in the professional practice of Social Work, has formative response in the Plans of Study of the Spanish universities. Especially, distinguishes itself the incident that the above mentioned formation has in the student body of the Faculty of Social Work of the Complutense University of Madrid in the perception, personal styles of confrontation and knowledge on the conflict, on the basis of the concept of professional competence as the set of knowledge , know-how and knowledge to be. For it there has been carried out a methodological mixed design, where across the technology of the survey, focus group, interviews in depth and analysis of content has been investigated concerning the object of study.

Full textThe purpose of this research work is to identify, analyze and determine if the breach of social obligations committed by mining companies could have influenced the activation of social conflicts around their operations and seek a formula for legal solution that could make efficient the fulfillment of the commitments of the company with the community. For these purposes, the reports of social conflicts prepared by the Ombudsman's Office from January 2013 to December 2017 were reviewed and analyzed. In this work it was evidenced that the breach of obligations and social commitments of mining companies with the communities and populations located within the area of their influence have represented during the past five years a considerable percentage of the total causes that led to social conflicts in Peru in that period, a significant number that requires special attention by the Government. Thus it was verified that the origin of some of these conflicts is due to the non-fulfillment of the obligations and social commitments assumed by the mine owners with said populations and communities due to the fact of being contained either in contracts, agreements or in minutes derived from tables of dialogue product of negotiations conventionally accepted by the parties that sign it. For the aforementioned reasons, an alternative legal solution is proposed that may contribute to the resolution of said social conflicts, through the institutional strengthening of the General Office of Social Management of the Ministry of Energy and Mines and an effective financial mechanism that may allow the enforceability and compliance with the obligations and social commitments assumed by the mine owners.

Full textNon Euro-descendant ethnic groups in Peru have little access to the media. In news programs, Afro-descendant and Andean and Amazonian indigenous peoples tend to be stigmatized. This paper employs critical discourse analysis tools to analyze how processes of representation are developed in Peruvian television through a news discourse that constructs a stereotyped image of indigenous peoples in order to justify the takeover of indigenous ancestral territory. I examine how the repetition of colonial stereotypes in news interviews in contemporary media still designates indigenous people as inferior and as an obstacle to progress based on a primary exporter model. I focus on the representation of indigenous Amazonian peoples in Peruvian televised news discourse during the Amazon conflict of Bagua in 2009.

Full textEl presente trabajo tiene por objeto analizar el ordenamiento jurídico chileno respecto del régimen de copropiedad inmobiliaria que se aplica a condominios de viviendas sociales, identificando posibles falencias del mismo y planteando propuestas de soluciones que permitan perfeccionar la legislación aplicable a estos conjuntos habitacionales. Para ello, se partirá por estudiar los antecedentes legales e históricos vinculados a la Ley de Copropiedad Inmobiliaria y los condominios de viviendas sociales, buscando situar el tema desde un contexto que permita una comprensión amplia y acabada del mismo. Posteriormente, se analizará en detalle la regulación establecida de manera especial para los condominios de viviendas sociales en Chile y las instituciones asociadas a ello, identificando sus ventajas, problemáticas y dificultades de aplicación. Finalmente, se analizará estadística relativa a la situación de los condominios de viviendas sociales y el rol ejercido por municipalidades en las comunas con mayor cantidad de conjuntos de viviendas sociales bajo el régimen de copropiedad. Todo lo anterior permitirá plantear vías de perfeccionamiento para la Ley de Copropiedad Inmobiliaria, posibilitando una aplicación más efectiva de la misma.

Identifica y reconoce la relación entre comunicación y conflicto, de tal manera que se pueda mejorar la gestión en adelante. El estudio se concentra en el trabajo desarrollado en Cálidda, distribuidora de gas natural para Lima y Callao durante los años 2010 – 2012, desde la gerencia de relaciones externas, de la cual es parte la subgerencia de relaciones comunitarias. Profundiza en el análisis de tres aspectos importantes: el devenir histórico de las relaciones comunitarias, específicamente en el Perú, la relación entre conflicto y comunicación y Cálidda y su gestión de relaciones comunitarias. Explica cómo durante los últimos años se ha incrementado la demanda de las comunidades hacia las empresas, no sólo económica sino social y ambiental. Para comprenderlo es importante abordar la historia de las relaciones comunitarias, ya que así conoceremos la relevancia actual en la incorporación del modelo al sistema empresarial. El rol del empresariado en los últimos años se ha perfilado como el de un miembro más del tejido social. Ya no se le mira como un actor lejano, sino muy por el contrario, ha adquirido la condición de “vecino”, el mismo que debe respetar las reglas del “barrio”, ayudar a los otros y no crear problemas al resto. En este camino, casi forzoso, es que la comunidad viene adaptándose a un nuevo tipo de convivencia. El análisis sobre la relación empresa y comunidad a lo largo del tiempo, tanto en el Perú como en el mundo, específicamente en el caso de Cálidda, ayudará a entender cómo se encuentran conformadas las ciudades hoy en día, las pautas de convivencia para lograr una armonía entre empresa privada y las áreas de influencia, las estrategias que utiliza Cálidda para propiciar una buena relación en sus comunidades, a través del análisis de actores sociales y la creación de buenas prácticas de relaciones comunitarias, serán claves para el desarrollo del presente estudio. Desde este punto de vista, se trata de abordar a la comunicación social, no solo como herramienta sino como proceso, para entender cómo la gestión de una buena comunicación y los conflictos sociales ofrecen oportunidades de entendimiento entre distintos actores dentro de una situación problemática. Cómo es que la comunicación es abordada desde sus aportes en la formación y consolidación de relaciones positivas entre empresa y comunidad, en este caso en particular, entre la empresa Cálidda y sus zonas de influencia, específicamente en sus estrategias de intervención, discursos comunicacionales y sus enfoques para la creación de una estrategia de relaciones comunitarias sólida. No existen muchas investigaciones que hablen sobre cómo la comunicación social interviene para el mejoramiento de las relaciones o la creación de confianza, por ejemplo. Por tanto, la sistematización de la experiencia profesional de la autora de la presente investigación brindará algunos elementos para la identificación de estrategias que logren este fin. Por último, debido al crecimiento desordenado de la demanda, se debe hacer un esfuerzo por entender los procesos que se desarrollan en un área de relaciones comunitarias, ya que estas interactúan con diferentes actores y situaciones para cumplir su misión. Ningún caso de relacionamiento con la comunidad es igual a otro, y ninguno de ellos tiene un mismo resultado, por eso es necesario el análisis de la relación empresa y comunidad de una manera abierta, sin procedimientos que la delimiten sino con lineamientos que ayuden a entenderla. Es así como, las unidades de investigación consideradas pertenecientes a la población son las siguientes: áreas de influencia, Cálidda, gas natural para Lima y Callao, sector empresarial, comunicación, conflicto y, redes sociales.
