Abstract:
This chapter examines the role of natural resources such as water, hydrocarbons, and diamonds in international armed conflicts within the framework of international law, as well as the legal regulation of the jus ad bellum aspects of the issue. After outlining some of the international rules relevant to the relationship between natural resources and conflicts, the chapter considers the rules pertaining to the jus ad bellum and assesses the interstate aspects of resource conflicts, paying particular attention to the legal framework for the use of force in international relations. It then looks at the role of sovereignty in the allocation of natural resources among states, the interaction between jus ad bellum and jus in bello with respect to the exploitation of natural resources in occupied territories, , and the effect on transactions in natural resources of the duty of non-recognition of unlawful territorial situations. Finally, it describes the initiatives of the United Nations in addressing the issue of natural resources and their relation to interstate conflicts.

Abstract:
This chapter examines principles and rules on environmental protection in two critical situations: non-international armed conflicts and post-conflict peacebuilding. What kind of environmental obligations apply in bello between a government and rebels? In what sense are parties to the conflict accountable for environmental devastation? May states be liable also for injurious consequences of acts not explicitly prohibited under international law? How can their obligations be enforced? Furthermore, issues of post-conflict peacebuilding are discussed to explore whether specific principles and rules of jus post bellum are relevant for the protection of the natural environment. While certain aspects of the protection of the environment in relation to armed conflicts appear to be still unclear, some recommendations are developed in support of efforts currently undertaken in the International Law Commission.

Abstract:
Armed conflicts pose a threat to the natural environment, such as when hazardous substances are released as a result of attacks on industrial sites, or when biological, chemical, and nuclear weapons are used by the combatants. The international effort to protect better the natural environment from the ill-effects of armed conflict occurred in three phases: during the Vietnam War, during the Gulf War of 1990–91, and the adoption of the International Committee of the Red Cross’s Guidelines for Military Manuals and Instructions on the Protection of the Environment in Times of Armed Conflict. This chapter discusses the existing legal protection for the natural environment during armed conflict, first by considering the specific and general rules of international humanitarian law (IHL). It then examines some of the gaps and deficiencies in the law and presents possible remedies to strengthen the legal protection provided by IHL for the environment. It also focuses on multilateral environmental agreements that are applicable and not applicable during armed conflict, as well as multilateral agreements that are silent on the matter.

Abstract:
Foreign intervention in ethnic conflicts has received significant attention in the last 20 years. Scholars have initially considered the sources for these interventions through instrumental and affective factors, though a better classification involves grouping these motives between domestic and international factors. The former category assumes that a third state’s internal politics best explain motives of intervention, and that domestic groups within the state have the greatest impact on foreign policy decision making. Theories based on domestic explanations assume that domestic politics greatly matter in the formulation of states’ decisions to intervene or not in ethnic conflicts elsewhere. As for the external explanations, scholars share a common assertion that the international environment is the central determinant explaining third state intervention. These explanations focus on the impact of institutions and international norms on the international relations of ethnic conflicts. In addition to these approaches, this area of research still contains many issues left unaddressed, such as how interference from outside might affect an ethnic conflict, and what forms of analysis might be used to study foreign interventions. Scholars have applied both quantitative and qualitative techniques, and the diaspora literature stands out for relying almost exclusively on case studies and on very notable cases. Otherwise, the rest of the work in this field follows the current standards by using a mixture of case studies and quantitative analyses depending on the questions in play.

Chapter 4 examines Russian and Chinese responses to the two major contemporary regional conflicts in Eurasia and the Middle East that are reshaping the international security environment and involving wide regional and global participation: Ukraine (2014–16), and Syria (2011–16). The cases of Ukraine and Syria demonstrate the capacity for Russia and China to serve as a counterbalancing influence to the United States and its allies in decisively influencing regional conflict situations challenging the norms and values of the liberal democratic order. Russia’s resurgence, China’s rise, and the burgeoning Sino–Russian strategic partnership suggest that the two countries possess the capacity to exert significant influence in provoking, managing, and resolving conflict situations not only in bordering areas, but on the wider global stage.

Contamination from remnants of conflict is a legacy of many armed conflicts, threatening the environment and human security. Addressing these hazards, reopening access to resources and livelihoods and re-establishing basic security, mine action is a critical activity in the transition from conflict to peace. Yet, clearance of remnants on land may also lead to environmental damage. Furthermore, residual risks remain after clearance and states and mine action organizations may face liability in case of accidents. This chapter examines the negative environmental impact of remnants of conflict and discusses the normative framework and good practice aimed to ensure that clearance does not further harm the environment. It is also demonstrated how mine action illustrates and is relevant to a holistic jus post bellum framework. This chapter finally scrutinizes the different challenges related to addressing liability for environmental degradation and damage to individuals from remnants of conflict and from their removal.

Since 2011, states and civil society have sought to draw attention to the health and environmental risks from the toxic remnants of war; a process that has led to the International Law Commission proposing a draft principle that obliges states to help minimize their risks to the environment following conflicts. In addition to raising awareness of the impact and legacy of conflict pollution, the process has helped to reverse the historical decoupling of explosive remnants of war from other physical and toxic war remnants. Itself a product of the humanitarian advocacy framing promoted by the civil society-led campaign against anti-personnel landmines. The new draft principle on the toxic and hazardous remnants of war, which is one of several proposed to help address and remedy environmental damage following conflicts, could eventually help fill a gap in how the international community responds to pollution caused or exacerbated by armed conflict.

The discipline of geography is built around four key concepts—environment, place, space, and scale—that form a matrix for exploring and appreciating many aspects of contemporary society. The environment is the ultimate source of human sustenance; people have created places to realize that potential; and a spatial structure—nodes, routes, surfaces and bounded territories—has been erected within which human interactions are organised.The relationships between human societies and their environments—now very much changed from their pre-human “natural” state—involve competition for and conflicts over resources, of increasing intensity. Resolution of all but the smallest scale of those conflicts requires a body that is independent of the actors involved and can ensure that agreements are reached and then implemented. Such a body is the state, a territorially bounded apparatus that, through the operation of territoriality strategies, can ensure conflict resolution among its citizenry and thereby resolve environmental problems.Many of those problems—the most severe being global climate change resulting from anthropomorphically induced global warming—are not contained, and cannot be contained, within an individual state’s territory, however. Tackling them requires inter-state co-operation, at a global scale, but the absence of a super-national body with the power to require actions by individual states is a major constraint to problem resolution.
