Full textThe surviving spous still remains a second-class successor while his position of "hors-rank" heir is more and more established in popular conscience and in experienced professionals as well (notaries, sociologists). The traditionnal rules of succession rights, family patrimony preservation, consanguinity, wich formerly justified such lowering of status, are now outdated. They gave way to the real basis of order of succession in a married couple: affection. Naturally a refractory feeling, this changing state, most certainly, cannot compose a simple and uniform element of estimation for jurist whose objectivity may be them in danger. Nowadays, the whirl of affections frightens more than it never did. Nevertheless, legislator will not avoid a debate of value because of the strength of pressure. The aims of our step were then to reveal the insufficiency of successional laws for the surviving spouse and the inefficacy of the presently existing palliatives of this aborted vocation (marriage settlement, change in matrimonial system, donation inter husband/wife), which palliatives, even if necessary, are not the cure for troubles endured par the surviving spouse continuing the couple. We are proposing to the surviving spouse a very true successional vocation, according to his social condition, most of the time, an unemployed or under-employed widow, only getting low incomes and made socially dependent. It is all done with the subsidies she was formerly, compassionately given and that we still intend to give her, trough maintening which, even if a paiseworthy way, is more connected, out of its function, with an alimony right than with a real right of succession. No comfort share, then, but a real successional tendency, for a real heir that we wish to become a heir having a rightto part of an inherintance in acurdance with most foreing legislations including those close to our juridical tradition

Full textThe law dated December 3rd, 2001 realized, undoubtedly, a major step forward in the protection of the surviving spouse since it recognizes for him a legal vocation in property and it allows himself, the rest of his life, to remain in the matrimonial home. Nevertheless, this protection turns out to be insufficient for the one to which the law closes the option for the legal usufruct : the survivor left with at least one child stemming from a previous union. The introduction of this distinction in the article757 of the civil Code does not, indeed, allow to guarantee for the widows and widowers, stemming in particular from blended families, the preservation of their previous conditions of existence, it, especially as the right life annuity in the accommodation cannot accrue with the legal quarter in property. Where from thenecessity for the future deceased to anticipate the consequences of his disappearance. The property right of the family offers, in this respect, a whole outfit of legal instruments which the legislator of June 23rd, 2006 came to enrich, in particular by new liberalities-divisions and the gradual (and residual) liberalities. However, it will be called on to the most classic stemming tools, for some, of the right of the matrimonial systems with the marital advantages, for the others, the right of the liberalities with the contractual institution between spouses. The marital way in front of, as far as possible, to constitute the main part of the protection of the survivor. Finally, it will be considered as good practice to complete these measures of conjugal foresight by the life insurance and the civil society of management of portfolio of securities

Full textThe surviving spouse has very often been considered a poor relation in matters of inheritance. Generally defined, in French-speaking African countries, as the non-divorced spouse and against whom there is no final judgment of separation, his rights have undergone significant development. The laws of these countries were strongly inspired by the texts of France, the former colonizing power, mainly from the civil Code of 1804 and subsequent reforms.Originally, these rights, characterized by their heterogeneity, have, on the one hand, coexisted among themselves, under the influence of heterogeneous traditional institutions, generating unequal rights, based in particular on the privileges of masculinity and primogeniture. This coexistence was achieved, on the other hand, with the exogenous laws, in this case French law and Muslim law, which contributed to the general establishment of legal pluralism and specific inheritance pluralism, in a context shared between opposition and coordination of existing rules.Today, the homogeneous nature of these rights is affirmed throughout the territory of each of the countries under review. These rights are therefore granted by law, just as they can be by will, subject to compliance with the prohibitions relating to the marriage contract, and the reservation of reserved heirs. In addition to this consecration which above all highlights the inheritance vocation of the surviving spouse, these rights are nevertheless abused. Consequently, they first call for protection based more on devolution rules favorable to the tightening of the family nucleus around the matrimonial home. Also, on the strength of the community and linguistic space in which they operate, it would be interesting and appropriate to consider the harmonization of the rights of the surviving spouse in French-speaking African countries

Full textThe patrimonial status of the surviving spouse has always been exposed to a legislative “dépeçage”, entailing characterization and articulation difficulties, which had to be confronted to current evolutions known in private international law and substantive law. However, neither the implementation of EU Regulations (no.650/2012 on inheritance and no.2016/1103 on matrimonial property), nor the favour for the surviving spouse have eradicated the difficulties affecting his or her patrimonial status in private international law. Hence the interest, as a first step, to apply the techniques of qualification, substitution or adaptation in an attempt to overcome these difficulties on a case by case basis; then, as a second step, to pursue the reunification of the surviving spouse’s patrimonial status under only one legislation. Two ways would enable to reach or, at least, enhance the achievement of such a legislative unity. The first solution, involving the modification of the content of the relevant connection categories, either by merging them or by extending one of them, has been eliminated. However, the second one, based on the modification of matrimonial connection after death, either by judicial substitution, as now recognized by the EU regulation no.2016/1103, or through inter partes agreement, as already recognized under French law, has been upheld
