Abstrak – Tujuan pada penelitian ini adalah untuk mengetahui pengaruh konflik peran ganda terhadap kinerja dengan dimoderasi stress kerja pada perawat RSUP Sanglah Denpasar. Teknik pengambilan sampel dalam penelitian ini yakni non-probability sampling dengan Purposive Sampling. Untuk menguji pengaruh moderasi dari stress kerja data dianalisis dengan menggunakan MRA (ModeratedRegression Analysis). Hasil analisis data menunjukkan bahwa stress kerja memoderasi hubungan antara peran ganda pada variabel Work-Family Conflictsebesar (-)0,026 dan Family-Work Conlict sebesar (-)0,025 terhadap kinerja perawat. Akhirnya RSUP Sanglah Denpasar diharapkan dapat membuat kebijakan-kebijakan yang dapat memfasilitasi kebutuhan perawat wanita seperti waktu kerja yang fleksibel untuk jenis pekerjaan tertentu, terdapat jadwal kerja alternatif dan kebijakan ijin keluarga.

Abstract:
The article examines the processes of forming stage identity models in the artistic space of cinema that possesses a modeling function, the ability to create new identity types, to influence the formation of a personality and change social relations. A screen art work both reflects the inner identity changes and offers the culture subjects some plausible behavior models for self-identifying in everyday life. By analyzing a number of ilms the author singles out four stages of identity development and deines their main characteristics. The structure and process of identity formation are treated as the result of interaction with culture. The configuration of identity depends on the prevalent cultural system. The notions "Culture 1" and "Culture 2" are revised and such concepts as "product culture" and "conlict culture" are introduced.

Abstract Dalam penelitian ini untuk mengetahui pengaruh work family conflict terhadap kinerja karyawan wanita di the sanchaya bintan. Jenis penelitian ini digolongkan kepada penelitian kuantitatif dengan metode asosiatif kausal. Populasi dalam penelitian ini adalah seluruh karyawan wanita yang berkerja di the sanchaya bintan sebanyak 54 orang dengan teknik pengambilan sampel jenuh. Pengumpulan data dilakukan menggunakan kuesioner (angket) dengan skala likert yang telah teruji validitas dan reliabilitasnya. Selanjutnya data dianalisis melalui analisis deskripsi dan uji regresi linier sederhana dengan bantuan Program Komputer SPSS versi 20.00. Hasil penelitian menunjukan bahwa: 1) Work Family Conlict di The Sanchaya berada pada kategori Cukup dengan persentase 46,30%, 2) Kinerja karyawan wanita di The Sanchaya Bintan berada pada kategori cukup dengan persentase 66.67% . Selanjutnya diperoleh nilai R Square sebesar 0,206 dengan taraf sig. 0,001 < 0,05, maka variabel Work Family Conflict dapat menjelaskan variabel Kinerja Karyawan Wanita sebesar 20.6% dan 79.4% dipengaruhi oleh faktor lain. Kata Kunci: Work Family Conflict, Kinerja Karyawan.

Abstract:
This paper raises the issue of the opinion of Garut Islamic scholars (ulama) about cash waqf and limited time (mu‘aqqat) of waqf, two issues of waqf are considered as the new problems of waqf for the Indonesian muslims as opposed to their view before. The findings of this study are as follows: 1) Garut Islamic scholars agree that the law of cash waqf is permitted becouse that cash waqf does not conlict with essence of waqf; 2) There are differences of opinion among Garut scholars relating the law of limited time of waqf. Some of them said that this waqf allowed becouse it does not conflict with the meaning and the esssence of waqf, even charitable opportunites for the community will be greater in the presence of limited waqf. Some other scholars consider that limited time of waqf have violated the essence of waqf to be timeless, forever. However, they still consider that there is virtue of this type of waqf, and still allowed conducted with a note its name is not waqf.

The result of this research indicated that: (1) the couses of Dayak, Melayu and Madura ethnics in Sebangki Villages, Landak District, West Kalimantan avoided from conlict are because of the competition of jobsorder are very little. The limitation of physical infrastructures building like: streets, electricity, and telephone or celularphone that can be used for social movement, relatively long distance between village to village and the most of existing government and education institution, as well as institutions of religious, politics, and the family function still are efectif to maintain threir daily social life; (2) social interactional models between Dayak,Melayu and Madura can be conducted through married system, economic activities, institutions: of adat Dayak Kanayatn, social/ education, religious, and politics; (3) the construction ofsocial capital between those etnics is very strong ; (4) the social engineering which conducted by government institution and the existing institutions of: adat, social/ education, religious, politics, and the family function in Sebangki villages are very high. The methods of social control within multicultural ethnics in Sebangki use persuasive and coersief techniques. This techniques may be appropriate because they can give positive responses for the whole people as well as motivate people to have more interactions and consequently tighten the social capital and social integration among ethnics in Sebangki.

Conflict resolution between between illegal parking attendant and the owner of the vehicle is throught conciliation and conflict resolution between UPT parking with illegal parking attendants thrught pursuing cooperation strategy Penelitian ini bertujuan untuk mendeskripsikan konflik pengelolaan parkir liar di Purus Padang. Pendekatan yang digunakan dalam penelitian ini adalah kualitatif dengan tipe deskriptif analisis. Pemilihan informan mengggunakan teknik purpossive sampling. Metode yang digunakan untuk pengumpulan data dilakukan dengan cara observasi berperan serta terbatas, wawancara mendalam (Indepth Interview) dan studi dokumen. Hasil penelitian menunjukkan bahwa munculnya parkir liar di Pantai Purus berawal semenjak jembatan penghubung dibangun pada tahun 2008 dan berkembang pada tahun 2013. Bentuk konflik yang terjadi dalam pengelolaan parkir liar adalah konflik antara petugas parkir liar dengan pemilik kendaraan, dimana pemilik kendaraan kehilangan barangnya disaat parkir, lalu konflik petugas parkir liar dengan UPT perparkiran dalam proses penertiban. Abstrack Women who are married and decide to keep working will add another role in their lives. Work-family conflict occurs when the roles and responsibilities between work and family are not balanced so that it will cause pressure and conflict that can disrupt the balance between work and one's person. This study aims to examine the effect of job demands (work overload, cognitive demand, and emotional demand), social support husband (emotional support, informational support, instrumental support, and support friendship) and factor demographic on work-family conflict of married bank employees. This study was conducted to 160 bank employees who are married and have children. The sampling technique used is non-probabililty sampling technique that is purposive sampling. The author uses Work-Family Conflict Scale (WFCS) measuring instruments developed by Carlson, Kacmar & Williams (2000), Questionnaire On The Experience And Assessment Of Work from Bakker, Brummelhuis, Prins & Heijden (2011) and husband's social support developed from Sarafino's (2011) social support theory. The validity of measuring equipment using confirmatory factor analysis technique (CFA) with the help of software Lisrel 8.70 and the data analysis using multiple regression analysis techniques with the help of software SPSS 22.0 The results of research using multiple regression analysis showed that all the free variables used significant effect against the work-family conflict with the proportion of variants of 55.4%, while the remaining 44.6% are influenced by variables other than research. Meanwhile, the results of the analysis of each variable separately variable indicates that work overload, cognitive demand and emotional demand significantly to work-family conflict in married employees. While the variables of emotional support, informational support, instrumental support, support friendship, working hours, number of children, and age of the last child not significant effect on work-family conflict of married bank employees. A conceituação clássica de acesso à justiça o iguala ao acesso ao Poder Judiciário. Todavia, o acesso à justiça encontra uma série de óbices à sua concretização, de ordem econômica, social, cultural e legal. Ao remoção dessas barreiras e também a nova demanda social por acesso à justiça reclamam a revisão deste conceito. Editlca-se, então, um novo conceito de acesso à justiça, onde o Estado e a Sociedade, em parceria, comprometem-se a resolver cont1itos por meio de diversos mecanismos de resolução de cont1itos e não exclusivamente pela via dos tribunais. O acesso à justiça passa a ser entendido como um conjunto de meios colocados à disposição da sociedade para a solução de litígios, que devem ser escolhidos por critérios de adequação, reservando-se a jurisdição à condição de ultima ratio desse sistema. Os meios alternativos de resolução de cont1itos, em especial os autocompositivos- conciliação e mediação-, além de ampliarem o acesso à justiça, levando à população a possibilidade de resolução de conflitos de modo rápido, desburocratizado, seguro e com baixo custo, podem revelar-se como o método mais indicado na solução de determinados conflitos. Deve-se disseminar e incentivar sua utilização. Recomenda-se, assim, o desenvolvimento de uma política pública que ofereça informação à população sobre esses temas e também possibilite a resolução de conflitos por meios autocompositivos, colocandose os tribunais em posição de retaguarda.
The old concept of access to Justice is as old as access to the courts. Nevertheless, access to Justice has many economic, social, cultural and legal obstacles to itself realization. Removing these obstacles, so the new social demand lor access to justice cal! for a review of the concept. Then built up a new concept o f access to Justice, where lhe State and Society, in partnership, undertake to resolve conllicts through various resolution mechanisms, and not exclusively through thc courts. Access to Justice is beginning to be understood as a set of ways for society to solve disputes, which must be chosen by criteria o f adequacy, reserving to Jurisdiction the condition of ultima ratio of that system. Alternative ways of resolving conflicts, especially the mutual agreement - conciliation and mediation - increase access to Justice, enabling people to resolve conllicts quickly, simple, safe and cheap, also may prove as best method to solve some contlicts. This use should be spread and encourage. lt is recommended, therefore, the development of a public policy that provides information to people about these issues and also enable the resolution of conllicts through mutual agreement, leaving the courts as a last alternative.

Previous research finds some evidence that analysts affiliated with equity underwriters issue more optimistic earnings growth forecasts and optimistic recommendations of client stock than unaffiliated analysts. Unfortunately, these studies are unable to discriminate between three competing hypotheses for the apparent optimism. Under the bribery hypothesis, underwriting clients, with the promise of underwriting fees, coax analysts to compromise their objectivity. The execution-related conflict of hypothesis postulates that the investment banks employing analysts who are more bullish on a particular stock are better able to execute the deal, and so the banks pressure their analysts to be bullish in order to enhance their execution ability. Finally, the selection bias hypothesis postulates that analysts are objective, but because of the enhanced execution ability, banks with more optimistic analysts are more likely to get selected as underwriters. We test these hypotheses in a previously unexplored setting, namely M&A activities. Depending on whether an analyst is affiliated with the target or the acquirer and whether the analyst report is about the target or the acquirer, the hypotheses predict analyst optimism in some cases and pessimism in other. Therefore, examining the issue of analyst bias in the M&A context allows us to shed some light on alternative explanations for the impact of analyst affiliation on the properties of analyst forecasts and recommendations.

Abstract:
This Sierra Leone Conflict arose from the society’s failure to institutionalize the requisite post-conventional organizing principle for collective will formation and for conflict resolution. In this post-traditional society - one artificially constructed from diverse political and cultural groups, without a shared ethos – only mutual (communicative) understanding can resolve differences and ensure solidarity. A lack of mutual understanding overburdens the adaptive capacity of the society, creating crises tendencies. Repression only intensified these tendencies, ensuring their eventual catastrophic explosion, 11 years civil conflict. State hindrances to social (communicative) interaction rendered the society incapable of realizing the requisite post conventional moral learning i.e. the social intelligence or problem-solving equipment required to resolve conflict, decolonize itself, neutralize normative power, shed dogmatic consciousness, change oppressive conventions, and influential customs. Thus, the study promotes civic virtues of post conventional morality (justice, truthfulness, moral rightness) as the key for liberating the society from its crisis-inducing colonial organizing principle. As the basis of sociology, the discipline the remains focused on society-wide problems, the theory of social evolution is adopted here to reconstruct the crisis in Sierra Leone’s constitutional democratic development. The study uses the rational reconstructive method to explicate problematic validity claims of norms, policy decisions, or the social order. The social order was rendered crisis-ridden because the reasons - the axis around which mutual understanding revolve - adduced for it cannot admit of consensus. The emerging social disintegration exemplifies use of deficient logic in social interaction, one below the requisite categorical moral cognitive consciousness. For this research, colonization is not necessarily externally induced, but forms of understanding in the political, legal, social, and educational interactions. The key point of the study is this: today Sierra Leone achieves solidarity, and decolonize from its conventional organizing principle, only if the state, economy, and civil society can find their limit in the socio-cultural domain.

Governing Law in the Absence of Choice in Contractual Relations in the Czech Republic and in the United States (Private international law in a comparative perspective) English Summary: The subject of the thesis is the main differences in Private International Law (or Conflict of Laws in the Unites States) in the area of contractual relations in the absence of a choice of law. The introduction explains the methodology of the work, as it does not strive to provide an exhaustive list of contract types - since this would be ill-advised considering the differences in Czech and American contract law - but rather provide the reader with a general characterization of the different approaches to the subject matter. The introduction also explains the legal certainty principle (typical for Civil Law countries) and the principle of equity (typical for Common Law countries), and describes how the consideration of these will enhance the reader's understanding of the thesis' topics. The first chapter is concerned with the relevant sources of law in the Czech Republic and in the United States. The most important legislation applicable in the Czech Republic is the Czech Private International Law Act, the Rome Convention and the Rome I Regulation. Esta dissertação, de carácter exploratório e descritivo, insere-se no âmbito do estudo das representações sociais do luso-tropicalismo. As variáveis analisadas foram a perceção de discriminação e a perceção de conflito numa amostra de 207 colaboradores portugueses do terceiro setor. Os questionários foram autoadministrados. Os resultados demonstram que são percecionadas como fontes de conflito, a ideologia e o estauto social, mas os valores médios de resposta não se afastam muito dos restantes fatores, i. e., a etnicidade e a identidade atribuída. Comparando os resultados da perceção de discriminação com os resultados da sua aceitação, estes demonstram que os participantes se pronunciam com mais intensidade quanto à condenação de actos discriminatórios, do que à perceção da presença dos mesmos nas relações laborais entre portugueses e estrangeiros. Também podemos observar que a hostilidade é mais percecionada, quanto mais percecionado for o Estatuto Social, a Etnicidade e a Identidade Atribuída. No entanto, quanto à aceitação de discriminação face à perceção de conflitos, não foram evidenciados resultados significativos. Por fim, analisando as diferenças entre os sexos, as mulheres assumem resultados mais elevados na perceção dos fatores da etnicidade e da ideologia. Na discussão, os resultados deste estudo foram confrontados com outros realizados no mesmo âmbito e examinados tendo o contexto laboral e social. Através deste estudo conseguiu-se dar continuidade ao aprimoramento das escalas, e adicionalmente foi analisada a diferença entre sexos relativamente a ambas as escalas.
This research, with exploratory and descriptive character, falls within the scope of luso-tropicalim social representations’. The variables analyzed were the discrimination perception and the sources of conflict perception in a sample of 207 portuguese workers of the third sector. The questionnaires were self-administered. The results show that ideology and social status are perceived as sources of conflict, but average responses values do not differ much from other factors, i. e., ethnicity and attributed identity. Comparing discrimination perception results with the results of their acceptance, it demonstrates that participants answers with greater intensity in the condemnation of discriminatory acts, than in the perception of his presence between Portuguese and foreign working relations. We can also observe that hostility is more perceived, the more perceived Social Status, the Ethnicity and Attributed Identity are. Discrimination acceptance against conflict perception, were not shown significant results. Finally, analyzing the differences between sexes, women take higher results in the of ethnicity and ideology perception factors. In the discussion, the results of this study were compared with others conducted in the same field and examined with the labor and social context. Through this study we were able to continue the improvement of both scales and additionally it was analyzed differences between sexes.

Abstract:
This paper discuses a new topology optimization method using frame elements for the design of mechanical structures at the conceptual design phase. The optimal configurations are determined by maximizing multiple eigen-frequencies in order to obtain the most stable structures for dynamic problems. The optimization problem is formulated using frame elements having ellipsoidal cross-sections, as the simplest case. Construction of the optimization procedure is based on CONLIN and the complementary strain energy concept. Finally, several examples are presented to confirm that the proposed method is useful for the topology optimization method discussed here.

Abstract:
The BOSS Quattro system (developed by Samtech s.a.) is an open architecture allowing to run various optimisation engines including gradient based methods (SQP, GCMMA, Conlin, MDAQ, ...), DOE and Response Surfaces, and Genetic Algorithms. This system has been used and various optimisation strategies compared for the resolution of non linear optimisation problems including crash worthiness and airbags opening simulation. Thanks to BOSS Quattro open architecture, using neutral or specific drivers so to read information from models, software like MADIMO, Pam Crash, LS-Dyna, but also NASTRAN, SAMCEF and Abaqus can been used in order to model the non linear behaviour of the optimised vehicles. One or several models were used and computation distributed by BOSS parallel architecture on network of workstations. Direct parallel mode can be used, or the tasks distributed on the network through a Task Manager like for example LSF. As a first example, the optimisation of a stiffened box is performed using one (dynamic) then two models (static but elasto-plastic/dynamic). The external software used are NASTRAN and ABAQUS. A second example deals with the optimisation of a Golf crash model using MADIMO to represent a sequence of events including opening of air bags. Mixed optimisation is performed using as design variables : the time to open a given airbag (continuous) or the type of wheel configuration (pure discrete variable). Constraints are related to safety of the passenger (sternum invasion, various criteria related to accelerations).
