The paper is devoted to the study of the relationship between the Russian constitutional history and Western legal traditions. The author argues the position according to which the constitutionalism has been a part of Russian legal history for centuries. On one view of Russian legal history, a written constitution remained an aspiration of the Russian people that was only partly realized in 1906. Marxist legal thought contemplated, or predicted, the “withering away of law” after a proletarian Revolution; adopting a constitution seemed counter-intuitive to this projected vector of history. It is generally accepted that the first European regional state was Italy (since 1948), and the second was Spain (since 1978). This article, however, proves that the first European regional state was the Kingdom of Yugoslavia (1921 - 1939). The Kingdom of Yugoslavia as a regional state was formed in imitation of the Union of South Africa (since 1909). The main proponents of the concept of Yugoslav regionalism were Bogumil Vosnjak, a Slovene, and Josip Smodlaka, a Croat from Dalmatia, both of them considered moderate nationalists. Abstract Spain according to the Constitution of 1978 is a unitary state, but its whole territory is divided into autonomous communities that have the widest rights from equivalent territorial units in other European countries. The Constitution restored the possibility of creating regional autonomies, which were abolished earlier during the Franco dictatorship. However, the basic law was adopted before the foundations of regional structures were fully developed, so norms concerning the issues of autonomy were dictated in a general way. Only later legal acts regulated the situation in detail, bu

The principle of equality is one of the fundamental principles of the modern Spanish legal order. Article 14 of the 1978 Constitution enshrines the equality of all citizens before the law and provides for a general prohibition on discrimination. The interpretation of Article 14 has given rise to a considerable body of case-law in the field of employment. While the Constitutional Court has perhaps been excessively reluctant to use the constitutional power to strike down legislation in this context, it has used Article 14 in a creative way to extend the role of human rights within the employment
