Abstract:
Dreyfus extends his argument against antirealism or “deflationary realism.” The deflationary realist holds that objects appear to be independent of us only relative to a particular set of practices, but in fact their existence is dependent on the practices that disclose them. Dreyfus argues instead for the coherence of a robust realism, according to which science can in principle give us access to the functional components of the universe as they are in themselves. To support the coherence of such a claim, Dreyfus draws a distinction between access practices and constitutive practice. Human artifacts and equipment are constituted by the practices for using them. But scientific practices, by decontextualizing objects from the way they are encountered in everyday life, are “contingent practices for identifying objects,” and thus give us access to the objects in a way that allows us to recontextualize and reinterpret them in theoretical terms.

Abstract:
Taking as a starting point the assumption that ambiguity is a constitutive condition of organizational practices in general, and, more specifically, practices of diversity, this chapter offers a framework for exploring the practices and perceptions of three forms of ambiguous diversity: strategic ambiguity, contradiction, and ambivalence. Through an illustration of the framework’s empirical applicability, we find that while ambiguity as such is neither inherently good nor bad, the various forms of ambiguity have different potentials for promoting diversity in organizational settings. In particular, expressions of ambivalence seem to be well suited for fostering new and more inclusive practices of diversity.

Abstract:
This chapter traces the tradition of critical theory in Europe in the way it has informed and framed legal thought. A key, and distinctive, element of this legal tradition is that it characteristically connects to the state as constitutive reference; in other words it understands the institution of law as that which organizes and mediates the relation of the state to civil society. The other constitutive reference is political economy, a reference that typically grounds this tradition of thinking about the law in the materiality of the practices of social production and reproduction. It is in these connections, of the institution of law to the domains of the state and of the political economy, that critical legal theory locates the function of law, and the emancipatory potentially it affords on the one hand, and the obstacles to emancipation it imposes, on the other.

Hernández, Gleider I. Sources and the Systematicity of International Law. Edited by Samantha Besson and Jean d’Aspremont. Oxford University Press, 2018. http://dx.doi.org/10.1093/law/9780198745365.003.0029.

Full text
Abstract:
This chapter illuminates the role that sources doctrine plays in construing international law as a system. It frames international law’s systemic qualities within the recursive relationship between sources doctrine and debates over international law’s systematicity. Sources doctrine reinforces and buttresses international law’s claim to constitute a legal system; and the legal system demands and requires that legal sources exist within it. International law’s systematicity and the doctrine of international legal sources exist in a mutually constitutive relationship, and cannot exist without one another. This recursive relationship privileges unity, coherence, and the existence of a unifying inner logic which transcends mere interstate relations and constitutes a legal structure. In this respect, the social practices of those officials who are part of the institutional workings of the system, and especially those with a law-applying function, are of heightened relevance in conceiving of international law as a system.

Abstract:
This chapter examines the cultural and social contexts in which honor killings occur. Honor killing is a social practice in which complex psychological, interpersonal, and social dynamics are unified and replicated over time. The chapter first illuminates the general features of social practices, then analyzes features critical for honor killing as a social practice, beginning with the salience of norms of honor and shame in what are called honor–shame communities. The chapter analyzes sharaf, an important general honor concept, and ‘ird or ‘ard, the conception of honor relating to sex and gender behaviors, and most important when concerns about honor offenses arise. The latter pertain to the chastity and obedience of females and male responsibilities as guardians of females and as enforcers of communal honor norms. The constitutive features of honor–shame communities are identified, and the interrelationship between collective social elements and individual identity and self-esteem are discussed.

Spinner-Halev, Jeff. Multiculturalism and its Critics. Edited by John S. Dryzek, Bonnie Honig, and Anne Phillips. Oxford University Press, 2009. http://dx.doi.org/10.1093/oxfordhb/9780199548439.003.0030.

Abstract:
This article examines multiculturalism, focusing on the so-called ethnocultural groups which are often ethnic and national cultural groups or intergenerational communities that have some shared practices and history that members believe are constitutive of the group. It explains that liberalist multiculturalists tend to view respect for cultural groups in instrumental terms while non-liberals often argue that cultures deserve respect because they are intrinsically valuable. It suggests that the non-liberal respect argument and the identity argument avoids some ambiguities involved in liberal multiculturalism since they do not argue for group-differentiated rights because of autonomy or self-respect.

Bickford, Tyler. Conclusion. Oxford University Press, 2017. http://dx.doi.org/10.1093/acprof:oso/9780190654146.003.0007.

Full text
Abstract:
The conclusion advocates for understanding music in terms of interpersonal relationships as much or more than as repertoires of texts with their own cultural meanings. Music should be considered in terms of Bourdieu’s concept of “social capital” in addition to “cultural capital” as it is normally conceived. Children’s in-school media use does not involve the intrusion of foreign consumer culture into education, but rather historically and culturally grounded traditions of peer-cultural solidarity provide a context into which entertainment media practices fit naturally. A seeming opposition between education and consumer culture is in fact a constitutive dialectic, which helps explain the politicization of children’s peer cultural practices in school. Consumer culture represents the extension of dynamics from school into the wider public sphere. The invasion of these practices into schools is only a natural return to original fields of conflict between children and adults.

Abstract:
In global politics, women’s bodies are policed, objectified, surveilled, and feared, with particular attention paid to both their met or unmet procreative potential. By illuminating and interrogating representations and narratives of maternity, this volume shows how practices of global politics shape and are shaped by the gendered norms and institutions that underpin motherhood. The guiding theoretical idea in this volume is that motherhood matters in global politics. However - as with so many political phenomena coded ‘female’ in the binary cognitive architectures of the West - the diverse ways in which performances and practices of motherhood are constituted by and are constitutive of other dimensions of political life they are frequently obscured or assumed to be of little interest to scholars, policy makers, and practitioners. Featuring innovative and diverse interrogations of the politics of motherhood as an institution, this collection shows that maternality is troubled, complicated, and heterogeneous in global politics and thus performances and practices of motherhood warrant closer and more sustained scrutiny.
