This chapter discusses consumer laws that protect—but in practice may hurt—low-income people, involving such matters as debt collection, consumer reporting, and lending. People with low income, people of color, and women face many legal, practical, and structural inequalities in commercial markets. In particular, minimum wage jobs do not lift full-time workers out of poverty, and many low-income people, vulnerable to predatory practices that exploit their financial instability, become trapped by debt. The U.S. Constitution does not specifically address many of these problems. The Equal Protection Clause in part protects against companies that refuse to do business because of a person’s race or gender; the Due Process Clauses provide some protection against companies that deploy judicially-sanctioned procedures to deprive a person of property without notice or an opportunity to raise objections; and the Eighth Amendment bars cruel and unusual punishment—and jailing a person who is too poor to pay a debt, which can include an unpaid court fee, should certainly be seen as cruel and unusual punishment. Congress has enacted various laws to protect consumers from unfair and arbitrary treatment. Attention in this chapter is given to debt collection, consumer reporting, access to credit, and limits on garnishment. In addition, the chapter discusses the fringe economy, including the dangers that payday, auto title, and online lending present, as well as private loans used to finance higher education. The chapter also touches on tax collection by the federal government.

These assumptions are comparable to those used in the previous chapters for consumers and production with decreasing returns to scale. The chapter starts by formulating constant returns to scale production by way of production sets with arbitrary numbers of inputs and outputs. It then addresses the profit maximization problem of a constant returns to scale firm. That problem does not always have a solution. More accurately, if some feasible activity yields a strictly positive profit at some given prices, then it suffices to consider an arbitrarily large multiple of that activity vector to get a feasible activity that yields an arbitrarily large profit at the same prices. We pass judgment on the value of scientific results. For example, we may feel that the periodic table of elements is of greater significance than the understanding that hydrogen is lighter than oxygen. For one thing, the latter fact may be deduced from an understanding of the periodic table. In this way, we may ascribe a measure of quality to an idea. The quality of an idea is subjective, and cannot be assigned an absolute value. However, it is possible to give a partial ordering and claim that idea A is of higher, lower, or equal worth in relation to idea B. The judgment of the relative importance of ideas is made routinely, for example, by an instructor in delivering a lecture or writing a book. The assignment of value occurs implicitly in the selection of topics and their relative emphasis. Once we admit a preference ordering among ideas, we may also assign an arbitrary numerical scale to them. This practice is standard in the field of economics, where a preference ordering among goods suggests a measure of utility. Since each consumer has individual tastes and needs, the resulting utility function varies from one person to another even for the same basket of goods. Further, the preferences are subjective and relative, rather than absolute. As a result, the level of utility can be based only on a conceptual scale. The basic measure of utility is an arbitrary unit called a util. In a similar way, we may assign a quality metric in terms of a granular unit of a qual. A person may assign a particular set of quals to a portfolio of ideas based on his own tastes and predilictions. A second person may offer a completely different set of quality values. This conception of an individual ordering of ideas is consistent with the view of difficulty and creativity as relative rather than absolute parameters. To pursue this line of reasoning, we may also speak of the combined quality of two or more ideas. The value of a set of ideas may be greater than, equal to, or less than the sum of the individual values.

With the exponential growth of the Internet and e-commerce, the need for secure transactions has become a necessity for both consumer and business. Even though there have been advances in security technology, one aspect remains constant: passwords still play a central role in system security. The difficulty with passwords is that all too often they are the easiest security mechanism to defeat. Kevin Mitnick, notably the most recognized computer hacker, made the following statement concerning humans and their passwords: …the human side of computer security is easily exploited and constantly overlooked. Companies spend millions of dollars on firewalls, encryption and secure access devices, and it’s money wasted, because none of these measures addresses the weakest link in the security chain. (Poulsen, 2000) Without secure passwords, e-commerce sites invite online criminals to attempt fraudulent schemes that mimic the goods and services that legitimate e-commerce merchants offer. With increasing numbers of users on an increasing array of e-commerce sites, often requiring the use of passwords, users often choose to reuse the same simplistic password, and do so on multiple sites (Campbell, Calvert, &amp; Boswell, 2003). For most computerized systems, passwords are the first line of defense against hackers or intruders (Horowitz, 2001). There have been numerous published articles that have created guidelines on how to create better or safer passwords with the following recommendations: 1. passwords should be memorized and not written down; 2. passwords should be an eight- or nine-character word or phrase, and end users should randomly add 3. passwords should contain a mixture of letters (both upper- and lowercase), numbers, and punctuation characters; and 4. passwords should never be words that can be commonly found in a dictionary. But if an individual adheres to security experts’ suggestions about password authentication, it usually involves a trade-off. If a password is easy to create and remember, it is most likely that it is easy for others to guess or a hacker to crack. Eventually, any password can be cracked. Password crackers use a variety of methods and tools that can include guessing, dictionary lists, or brute force attacks. Dictionary lists are created by using an automated program that includes a text file of words that are common in a dictionary. The program repeatedly attempts to log on to the target system, using a different word from the text file on each attempt. A brute force attack is a variation of the dictionary attacks, but it is designed to determine passwords that may not be included in the text file. In a brute force attack, the attacker uses an automated program that generates hashes or encrypted values for all possible passwords and compares them to the values in the password file (Conklin, White, Cothren, Williams, &amp; Davis, 2004). Unfortunately, many of the deficiencies of password authentication systems arise from the limitations of human cognitive ability (Pond, Podd, Bunnell, &amp; Henderson, 2000). The requirements to remember long and complicated passwords are contrary to a well-known property of human memory. First, the capacity of human memory in its capacity to remember a sequence of items is temporally limited, with a short-term capacity of around seven items plus or minus two (Kanaley, 2001). Second, when humans remember a sequence of items, those items cannot be drawn from an arbitrary and unfamiliar range, but must be familiar “chunks” such as words or familiar symbols. Third, the human memory thrives on redundancy. "The activity center accounts were debited with all indirect charges (wages and sundries). They were credited with the sums appor­ tioned to each type of production. THE IMPORTANCE OF DEPRECIATION At Saint-Gobain, depreciation methods barely evolved be­ tween 1830 and 1872. From that date, the Directors paid new attention to the problem.13 There were essentially two reasons for this: on the one hand, the Directors recognized the necessity of investing more and more in machinery, and, on the other hand, they were bound to respect their “no long-term debts" policy. The Company had to preserve the sums of money that were essential for its growth, but it was quite impossible to say this bluntly to shareholders who were numerous and not well aware of manage­ ment matters. Until then, the Company made a distinction be­ tween ordinary depreciation, “calculated according to steady rules", and extraordinary depreciation, “determined by the Board of Directors according to the profit and rectifying the slow progress of the ordinary depreciation as regards the value of some items”. Further on, the record shows the directors' concern that "the only drawback of the system is its arbitrary aspect; the share­ holders argue that to accuse the Board of Directors of deciding the dividend according to their desires and not to the year's profits.” At this time, there was no radical changes of the depreciation method. There is just evidence of greater scrutiny in valuing the assets, and more concern for keeping the shareholders acquainted with the management of the Company and the problems manage­ ment faced. "All in all, the CISG has met with resounding acceptance around the globe. Today, the CISG counts 67 Contracting States among its members, covering more than 70 per cent of global trade and production of goods; of the 50 leading exporters and importers in world merchandise, over 60 per cent are Contracting States to the CISG. Of those large industrial nations that are not yet Contracting States to the CISG, notably the UK, Japan and Korea, both internal and external pressure to ratify is rising. Currently, approximately 1,300 court and arbitral decisions decided under the CISG have been handed down from 32 judicial instances, and more than 6,500 academic publica-tions exist in 24 languages. This is in addition to the numerous conferences and other forms of academic discourse dealing with the Convention, most notably the CISG Advisory Council, a global body of CISG and international sales law experts that meets on a regular basis to discuss the significant developments in the field of international sales law and aims at promoting the uniform interpretation of the CISG. Perhaps the most tangible success of the CISG can be seen in the number of domestic sales laws that have used it as a model. Notably, many Scandinavian countries have used the CISG as the background for the modification of their domestic sales laws, as did Germany in its 2002 Schuldrechtsreform (Revision of the Law of Obligations) and The Netherlands in drafting the Law of Obligations in the Wetboek (Civil Code). Furthermore, many of the former Socialist states in Eastern Europe, including Estonia, the Czech Republic and Croatia, are also basing the re-development of their private and domestic sales and com-mercial laws on CISG concepts. Completing the CISG’s global impact is the reform of the Chinese private law. The New Code of Obligations of China has adopted many legal concepts and institutions promulgated in the CISG and the drafters have confirmed using the CISG as a source of inspiration in this regard. In addition, not only domestic sales laws, but also, increasingly, regional and inter-national principles are availing themselves of CISG principles to guide their drafting. The general approach of the Principles for International Commercial Contracts drafted by UNIDROIT (the UNIDROIT Principles) and the Principles of European Contract Law, which are intended to pave the way for a European or an international law of contract, can be traced back to the CISG. The same is true of the European Directive on Consumer Sales, which mirrors the concepts of conformity and non-conformity set out in the CISG. Furthermore, the OHADA, a union of 16 African states, has adopted a common sales law, which follows the CISG almost to the letter. Efforts at unification of the law are often met with the criticism that the unique peculiarities and historical variety of local laws are thereby ‘bulldozed’ by an all-consuming ‘international’ law. This is not the intention of the CISG. It certainly aims to provide a certain, uniform and consistent basis for defining the scope and obligations of international sales contracts for those states that have declared their intention to be bound by it.
