Abstract:
The diploma thesis deals primarily with consumer protection in the capital market in the Czech Republic. It compares the situation in the capital market with conditions existing in the banking sector. It emphasizes the importance and possible consequences of upcoming pension reform in the Czech Republic in 2011. The first part of the thesis describes capital market structure and its functioning, analyses financial position of Czech households and contemplates the reasons that can lead to consumer protection in financial markets. The second part of the thesis deals with specific protective tools that are used in the Czech Republic to protect consumer. It analyses tools that are implemented to protect consumers' financial assets and tools associated with distribution of financial services and information requirements imposed on financial intermediaries. The thesis analyses the efficiency of selected important tools (such as investor compensation schemes or investment limits).

Abstract:
The thesis provides an overview of consumer protection in the financial markets in the Czech Republic. The focus is on the legislative system of client protection in commercial banking, which includes consumer credit, protecting consumer deposits and system of payments. Furthermore, this thesis deals with capital markets, focusing on consumer protection resulting from the implementation of MiFID in the legal system of the Czech Republic. The last segment of the financial markets defined in this thesis is the insurance industry. Each area of consumer protection is complemented by illustrations of current cases and includes an evaluation of the effectiveness of certain legal measures and revealing the weaknesses in each segment. Beyond the legislative framework are also described activities in the area of consumer protection by major institutions, in particular the activities of the Ministry of Finance of the Czech Republic, Czech Financial Arbitrator, Deposit Insurance Fund and the Guarantee Fund. To add to the comprehensiveness of the overview of consumer protection in the financial markets, additional protective measures were included (Institute of debt relief, distraint of debtor, protection of personal data of clients of financial institutions).

Abstract:
The performance of cash protection strategies implemented in the South African market are investigated in order to establish if investors are able to add value through the use of dynamic portfolio insurance methods. The analysis is performed, using monthly data, from January 1961 to August 2014 using six alternative methodologies including both a Fixed Rate and Rolling Average Stop-Loss approach, a Lock-In approach, a Constant Mix strategy, a Constant Proportion Portfolio Insurance ("CPPI") approach and an alternative CPPI approach using a Ratchet mechanism. The results indicate that the use of such cash protection strategies can markedly improve portfolio performance from a risk return perspective compared to a pure diversified investment strategy. Notably, the use of older, simpler trading strategies such as the Stop-Loss and Lock-In approaches at optimum threshold levels can still offer investors higher risk to reward benefits with less commitment required. These strategies, though, lack the flexibility observed with the more recently developed dynamic trading strategies in terms of providing for varying risk appetites.

Zimbabwe is a Southern African country which has witnessed frequent bank collapses in the last two decades. This has eroded consumer and business confidence in the banking sector due to the irreparable financial prejudice suffered by most sectoral consumers. The side effect of this lack of trust in the sector has been the hoarding and preference of cash in most, if not all transactions, as opposed to the use of plastic money. Between April 2015 and March 2016, it is estimated that between US$3 billion and US$7.4 billion was circulating outside the banking system in the informal sector thus exposing the depth of mistrust crippling the banking sector. Together with other factors beyond the scope of this study, it is submitted that this lack of trust and confidence in the sector has contributed to the current cash shortage which, according to Latham and Cohen, has left .a black hole in the financial system that's crushing the rest of the economy'.

Abstract:
Both developed and emerging markets have liberalised their stock markets by removing investment restrictions on equity capital inflows and outflows. The aim is to attract foreign investors and also to allow domestic investors to diversify internationally. However, existing literature shows that local investors overweight the domestic market (home bias), whilst foreign investors under or overweight foreign markets (foreign bias). Current studies have mainly investigated factors that determine home and foreign bias. The study uses comprehensive macro and micro level data to examine the implications of home and foreign bias on three research questions. The first empirical study investigates the impact of home and foreign bias on cost of capital. We mainly use five measures to proxy for cost of capital. We find compelling evidence supporting the hypothesis, those countries that exhibit higher home bias, experience higher cost of capital. Similarly, consistent with theory, we find that countries that have higher foreign bias enjoy lower cost of capital. In the second empirical study, we examine the impact of home and foreign bias on stock market development. Economic reasoning suggests, that countries that have home bias should have lower level of stock market development, while the countries where foreign equity portfolio investors invest more, should be associated with higher development. Our findings, based on rigorous analysis, confirm that prevalence of higher degree of home bias impedes stock market development. Likewise, higher foreign bias in equity portfolio allocations has significant positive implications for the development level of domestic stock market. Finally, in our third empirical research, we examine whether varying degrees of home and foreign bias have any impact on country level investor protection standards. We report two findings. First, we find strong evidence that supports the hypothesis that home bias leads to weak investor protection. Second, consistent with theory, countries that experience higher foreign bias, tend to have better investor protection. The findings suggest that provision of encouraging optimal international portfolio allocations to increase risk sharing, could be a crucial policy measure for governments. Policy makers in emerging countries can improve macroeconomic fundamentals and good governance to attract and retain foreign investors.

Le premier chapitre montre l'interdépendance sur le marché locatif entre le formalisme procédural (FP) et les réseaux sociaux locaux. Tandis que le FP augmente le coût de résolution des conflits juridiques entre propriétaires et locataires, les réseaux sociaux présentent l'avantage de pouvoir régler un conflit sans la justice. Le FP permet de rendre plus intéressant aux yeux du propriétaire les individus appartenant à un réseau social. Le deuxième chapitre explique l'importance du soleil sur la demande de régulation du marché locatif. Les pays d'Europe du sud très ensoleillés sont attractifs de par leur douceur de vie. Cette immigration potentielle augmente la tension sur le marché locatif. Pour la réduire, les individus d'Europe du sud développent une complémentarité entre capital social local et régulation. Cette stratégie explique un équilibre méditerranéen où le capital social local et le FP sont élevés. A contrario, l'absence d'attractivité des pays faiblement ensoleillés explique un équilibre anglo-saxon et scandinave aux caractéristiques opposées. Le troisième chapitre explique le soutien pour la régulation du marché du travail par la présence de régulations sur le marché locatif. Lorsque ce dernier est très régulé, les propriétaires sélectionnent les locataires selon leur capacité à payer le loyer. Protéger les contrats à durée indéterminée oblige les entreprises à sélectionner les travailleurs et permet alors aux propriétaires de mieux estimer le risque individuel de licenciement. Nous construisons un modèle où les individus sans emploi demandent plus de régulations et de protections en dépit de l’augmentation du chômage et de la part des contrats temporaires
The first contribution studies the complementarities between the strength of social networks and the stringency of procedural formalism. While procedural formalism increases the cost of legal dispute resolution between landlords and tenants, social networks allow conflicts to be solved without recourse to justice. Procedural formalism is thus a way to provide a market advantage to local individuals embedded in dense local social networks at the expense of nonlocal agents without access to such networks.The second contribution deals with the importance of the sun on the demand for regulation in the rental market. Southern European countries with good climate amenities are attractive by their mildness of life. This potential immigration increases the pressure on the rental market. To reduce it, individuals in Southern Europe develop complementarities between social capital and local regulations. This strategy explains a Mediterranean equilibrium characterized by high levels of local social capital and procedural formalism. Conversely, the lack of attractiveness of countries with low climate amenities leads to an Anglo-Saxon and Scandinavian equilibrium with opposite features.The third contribution explains the support for labor market regulation by the presence of regulations on the rental market. When the rental market is very regulated, landlords screen applicants with regard to their ability to pay the rent. Protecting regular jobs offers a second-best technology to sort workers, thereby increasing the rental market size. We provide a model where non-employed workers demand protected jobs despite unemployment and the share of short-term jobs increase

Abstract:
The thesis deals with the issue of excessive debt of households. In the first part the analysis of development of indebtedness of households was made and it was found out, that consumer loans are the most risky. Consumer loans are associated with the highest ratio of defaulting loans and are the leading cause of bankruptcies of individuals in the Czech Republic. The following chapter analyzes institutional environment of credit market and detects current weaknesses. These weaknesses consist in insufficient oversight of nonbank provider of consumer loans, absence of upper limit of annual percentage rate for consumer credit and credit availability to risk groups of households. Another cause of overindebtedness of households is insufficient financial literacy in Czech Republic. The reduced consumption has been identified as the most significant impact of overindebtedness of households. It is caused by transferring funds from households with a higher propensity to consume to households with a lower propensity to consume. Lower household consumption leads also to lower government revenue collected through the value added tax. Another economic impact we can see for example in increasing poverty of households, increasing criminality, higher government spending on health care or potential political radicalization. The thesis results are proposals of legislative measures that would mitigate the economic impact of overindebtedness of households. These measures lie primarily in the regulation of consumer credit market and greater consumer protection. The specific options are an extension of supervision by the Czech National Bank on nonbank providers of consumer loans, determining the upper limit of annual percentage rate, more thorough application of the legal obligation to examine the ability of borrowers to repay loans. Another option is to reduce the limit of 30 % of paid-up commitments in insolvency law.

The work is dedicated to the protection of consumer rights on the property market. The graduation thesis consists of three parts. The first part is the theoretical basis of the issues to be analysed: concept of "consumer", protection of consumer rights. The practical part of the study is focused on violations of the rights of consumers on the real estate market and trends in this field. The last part of the work is advisory, because it describes recommendations for consumers who want to buy real estate. The main purpose of this paper is to analyse violations of consumer rights when purchasing real estate. The central hypothesis is the following statement: violations of consumer rights are due to large gaps in the Czech legislation. The graduation thesis is intended for a wide range of readers interested in the real estate market, as well as for those who have an intention to buy real estate.

Šiame darbe pateikiama mokslinės literatūros apžvalga ir OMXB Plataus vartojimo prekių gamintojų finansinių rodiklių palyginamoji analizė 2007 – 2009 metų laikotarpiu. Finasiniai rodikliai suskirstyti į keturias grupes: pelningumo, mokumo, turto apyvartumo ir kapitalo rinkos. Palyginamosios analizės tikslas – nustatyti ir palyginti faktinius įmonių rodiklius tarpusavyje ir su ūkio šaka, nustatyti įmones, kurios vykdė pelningą veiklą, neturėjo mokumo problemų, o turtas buvo valdomas efektyviai. Nustatyta rinkos kaina leidžia išsirinkti geriausias investavimo galimybes šiame sektoriuje. Palyginus įmones pagal visas rodiklių grupes buvo nustatytos geriausios visų sektorių įmonės. Darbe pavaizduota atskirų įmonių ir vidų sektorių rodiklių dinamika nagrinėjamu laikotarpiu. Naudoti metodai – mokslinės literatūros apžvalga, lyginamoji analizė.
This paper presents an overview of the scientific literature and OMXB Consumer Staples comparative analysis of financial indicators during the period of 2007 - 2009. Financial indicators were grouped into four categories: profitability, solvency, asset turnover and markets indicators. . Goal of this comparative analysis - identify and compare actual performance between firms and sectors of the economy, identify companies that are engaged in gainful activity, have none of solvency problem, and assets have been managed effectively. To choose the best investment opportunities in this sector there have been market indicators identified and compared. The analysis shows the best – doing companies and reflects the situation of the whole sector in general. Using techniques - literature review and comparative analysis.

Abstract:
Financial intermediation due to misselling harms consumers. The work concerns to regulation of financial intermediaries and relation between financial intermediary and his or her client. The main objective is to analyze how the regulatory of commissions impact financial intermediation. The paper analyzes the current form of legal status of financial intermediation in the European Union and the Czech Republic and results in analyzing the impacts of regulatory proposals that was discussed in Chamber of Deputies Parliament of the Czech Republic. It concludes that if the proposals were accepted, it will not improve the quality of consumer protection, but even can cause damage to the client. The current legislative base moreover provides sufficient resources to prosecuting financial intermediation, which does not respect the client's interest. For analyzing the relation between financial intermediary and his or her client is developed theoretical model based on theory of games.

This thesis is focused on consumer protection in the European Union with a special emphasis on online shopping. The first section defines the term 'consumer protection', its development, institutional support, instruments and financing. Also, this part describes the digital market of the European Union, hindrances to the growth of online shopping as well as strategies which are created in order to form a digital single market in the European Union. The second section focuses on protection of personal data, alternative dispute resolutions, current legislation regarding consumers rights on internet and new proposals from the European Commission. The new proposals dominate the second part of this thesis and are discussed with an expert. A survey has been conducted to find out more about the Czech experience with problem solving when shopping online. Moreover, this thesis does not leave out court orders from the European Union´s Court of Justice which have led to the uniform application and interpretation of the consumer protection in the European Union.

O atual arcabouço normativo de proteção do investidor no mercado de capitais brasileiro teve suas linhas mestras cravadas pela reforma bancária introduzida pelas Leis 4.595, de 31 de dezembro de 1964, e 4.728, de 14 de julho de 1965, pela criação de um regulador especializado em mercado de capitais pela Lei 6.385, de 07 de dezembro de 1976, e pela reforma da legislação das sociedades anônimas introduzida pela Lei 6.404, de 15 de dezembro de 1976. Desde 1976, o arcabouço normativo de proteção do investidor no mercado de capitais brasileiro vem sendo desenvolvido a partir dessas linhas mestras iniciais, incorporando as lições aprendidas com as turbulências e euforias vividas pela economia nacional. Esse arcabouço normativo que aí está desde 1976 foi inspirado por contribuições do direito federal norte-americano, as quais foram conscientemente captadas no Brasil pelo legislador e pela comunidade jurídica nacional. Difundiram-se internacionalmente dos EUA para o Brasil os preceitos da proteção do investidor no mercado de capitais calcados na existência de um órgão regulador do mercado de capitais, na divulgação de informações relevantes para decisões de investimento (disclosure), na regulação funcional dos agentes do mercado de capitais e na vedação de fraudes com valores mobiliários.
The current normative framework for the protection of investors in the Brazilian capital market had its main lines placed by the banking reform introduced by the Laws 4.595, as of December 31, 1964, and 4.728, as of July 14, 1965, by the institution of one regulatory body specialized in the capital market by the Law 6.385, as of December 07, 1976, and by the reform in the legislation on companies introduced by the Law 6.404, as of December 15, 1976. Since 1976, the normative framework for the protection of investors in the Brazilian capital market has been developed based on such original main lines and incorporating the lessons learned with the turbulences and euphoria lived by the national economy. This current normative framework in place since 1976 has been inspired by the contributions of the federal US law and such contributions have been consciously captured in Brazil by the legislator and the national legal community. The following precepts of the protection of investors in the capital market have diffused from the US to Brazil, namely, the existence of one regulatory body in charge of capital markets, the disclosure of information relevant to investment decisions, the functional regulation of the agents of the capital markets and the prohibition of frauds with securities.

Il n’est pas évident d’identifier le « petit professionnel » dans le droit des contrats actuel. Qu’il s’agisse du droit commun des contrats ou des droits spéciaux, aucun n’a réellement vocation à appréhender de manière spécifique cet acteur économique. Pourtant, si le droit positif ne porte pas un regard attentif à ce contractant, son éclosion au sein des relations juridiques n’est pas contestée et le droit européen, au travers des projets mis en œuvre, se positionne comme témoin de cette émergence. C’est pourquoi, il est proposé d’étudier les manifestations du « petit professionnel », d’une part, aux côtés des notions déjà connues de consommateur, de non-professionnel et de professionnel, puis d’autre part, des notions voisines de commerçant et d’entreprise. De nombreux domaines sont touchés par l’avènement du « petit professionnel » notamment le droit des contrats, le droit de la concurrence, ou encore le droit de la consommation. Aussi, l’objectif est de mettre en évidence le manque d’attention dont il fait l’objet. Dans le cadre de ses relations contractuelles, le « petit professionnel » est considéré bien souvent comme un professionnel quelconque malgré son statut particulier. Le propos est donc également de réfléchir à une adaptation des règles auxquelles il est soumis. Le contenu de ses droits et devoirs doit être analysé avec rigueur afin de les comprendre et de les rendre plus appropriés
The « small professional » is not so well identified in current contract law. Whether it concerns general laws of contract or special contract laws, neither really have a vocation to specifically appreciate this economic stakeholder. However, if positive law is not attentive to this contracting party, its emergence at the heart of legal relations is not disputed, and as pointed out in European law, it places itself as witness to this outcome. In consequence, it is proposed to study the expression of the « small professional », on the one hand, through the already-known notions of consumer, non-professional and professional, and on the other hand, through related notions of trader and business company. Many areas are affected by the advent of the « small professional » including contract law, competition law and consumer law. The aim is therefore to emphasize the lack of attention to this party. La thèse propose de retracer l’histoire de l’utilisation et de l’encadrement des informations relatives à la qualité nutritionnelle des produits alimentaires circulant sur les marchés. Elle s’inscrit ainsi dans le cadre de la sociologie économique en s’intéressant plus particulièrement et dans une perspective historique à l’émergence de dispositifs visant à « équiper » le choix nutritionnel des consommateurs. Parmi ces dispositifs, l’étiquetage nutritionnel et les allégations nutritionnelles et de santé, correspondant, pour le premier, à la manifestation scripturale et réglementaire de la qualité nutritionnelle des produits agroalimentaires et, pour les secondes, à son utilisation marketing, sont au cœur de l’étude. Après avoir retracé les débuts de l’utilisation marketing de la dimension santé des aliments, à travers l’exemple des campagnes publicitaires de la fin du dix-neuvième siècle de la marque américaine d’avoine pour le petit déjeuner Quaker Oats, la thèse se concentre sur l’évolution des règlements encadrant à la fois étiquetage et marketing nutritionnels. Elle prend ainsi comme point de départ l’Amérique des années quarante pour arriver finalement à la situation européenne actuelle et opère donc un déplacement à la fois chronologique et géographique entre l’Amérique et l’Europe, en passant par l’Angleterre. Ce déplacement permet de mesurer les difficultés propres à la mesure nutritionnelle des aliments, à son expression et à sa mobilisation dans le cadre de stratégies aussi bien privées que publiques qui visent à orienter, persuader et équiper les individus dans leurs choix de vie et de consommation. L’étude montre en outre qu’au niveau européen, les notions de santé et de bonne alimentation, au-delà des avancées et controverses scientifiques en la matière, ont aussi des déclinaisons différentes selon les pays et les secteurs d’activités. Ainsi, en matière de réglementation des informations nutritionnelles marchandes, les pays du Nord tels que le Royaume-Uni ou les pays Nordiques ont depuis une vingtaine d’années au moins, intégré cette réglementation dans le cadre de politiques de santé publique plus globales, contrairement aux pays du Sud comme la France ou l’Italie. Ces différences se retrouvent ainsi au niveau européen, comme en témoigne le règlement européen n°1169/2011, voté en 2011. Ce règlement, bien qu’ayant rendu l’étiquetage nutritionnel obligatoire, est marqué par des incohérences et des faiblesses qui reflètent bien les difficultés propres à la « capture » des caractéristiques nutritionnelles des produits et à leur « mise en boîte »
The question of the display of nutritional information on food products has been largely dealt with from an Anglo-Saxon perspective, especially in the United States; this study aims to examine the problem from a European perspective. Drawing upon the theoretical framework of economic sociology, this dissertation focuses on the social and historical factors surrounding the emergence of apparatus that aim to « equip » consumers’ nutritional choices. Among these devices, nutritional labeling and health and nutrition claims are central to the study. The former is the scriptural and regulatory description of nutritional quality and the latter, the expression of this quality in a marketing context. After an in depth consideration of early examples of the use of nutrition based rhetoric in marketing through the example of the Quaker Oats brand's advertising campaigns of the late nineteenth century, the dissertation studies the evolution of the rules and regulations on labeling and nutritional marketing. Mapping this historical trajectory means drawing a line from the United States in the 40s to the current situation in the European Union. This analysis thus operates a chronological and geographical movement from America to Europe via the United Kingdom. This movement sheds light on the specific difficulties attached to the nutritional measuring of food products, to its expression and to its use in private and public strategies aimed at guiding, persuading and equipping individuals faced with lifestyle and consumption choices. The study also shows how inside the European Union, the definition of notions such as good health and proper alimentation, as well as being informed by scientific knowledge and controversies, is also subjected to both geographical and socio-professional variations. For example, Northern European countries such as the United Kingdom or Scandinavia have been integrating the question of the regulation of nutritional information on food products into public health policies unlike southern countries such as France or Italy. These differences have an effect on European food labeling policy, as in the case of the European regulation n°1169/2011, voted in 2011. Although it does make nutrition labels compulsory on a majority of products, this ruling bares incoherencies and flaws that deeply reflect the problems linked to the “capturing” and “boxing” of food products' nutritional characteristics

1 Abstract This work deals with the performance of supervision over the financial market and the entities operating in the financial market. Part of the work is devoted to consumer protection in the financial market and compensation systems. Because of the fact that the Czech Republic became a member of the European Union in 2004, this work includes also legislation of regulation and supervision of this level, as this treatment significantly predetermines Czech adjustment. Following questions were examined as an example of protecting the interests of clients of supervised entities: - whether there are any tools to protect the client's interests at the level of supervised entities, - what kind of role the supervisory authority has or may have in relation between a supervised entity and its client, - how are the client's financial interests protected in the event of failure of the supervised entity and whether this protection is de lege lata sufficient. The theoretical part of the work briefly describes the institute of supervision, its assorting and forms. The aim of this thesis is to analyze the warning systems used against dangerous or unsafe products, as well as to analyze the knowledge and attitudes of consumer protection against unsafe products. The work deals with the analysis of the RAPEX and RASSF alert systems in 2009. Market research was conducted assessing the knowledge of respondents regarding dangerous products. In the final section, there is a proposal for improving these systems, as well as an economic evaluation. An analysis of the market research I conducted indicates that respondents are interested in a product?s security when they are deciding whether or not to purchase it, they know where to find this information (Internet, TV), they mostly do not understand the safety warning systems used in the EU, and they rarely seek the support of surveillance institutions. Disturbing finding was the behavior of respondents in the case of having dangerous goods (many of them stop using the product). For this reason I propose to change consumer behavior to improve the situation. I would like to achieve the change in behavior through information campaigns on television, where they would show the correct behavior and the benefits that arise from the correct behavior, such as reducing and preventing the occurrence of dangerous products on the market. The campaign would be in harmony with the aims of consumer policy for the period 2011-2014, where the safety of products and services, health, life and personal property security of consumers are fundamental priorities.

This research examines the execution conditions of organic vegetable by the Farmers Market, Consumer Protection Committee in order to understand consumers source of trust of organic vegetables and their particiaption in the leisure behavior in consumers’ protection committee’s market. Employing semi-structural interview of qualitative research as method, the personnel in the Consumer Protection Committee, organic farmers, and consumers were interviews as research objects. From the research findings, it is discovered that the conditions of the implementation of Farmers Market by the Consumer Protection Committee can be divided into two aspects. First, there is the fast testing of pesticide for organic vegetables, organic farmers’ certification, and cultivation environment management by the Consumer Protection Committee, and second, the selection and management of organic vegetables by organic farmers. The consumers’ source of trust for organic vegetables is mainly visual inspection – seeing is believing of the Consumer Protection Committee’s management mechanism, and the understanding in person regarding farmers’ method of growing organic vegetables in order to recognize the difference between growing regular vegetables and organic vegetables to create their trust. Consumers’ behavior of going to consumer protection markets on a long-term basis with high frequency will arouse their interests in the people, events, and objects in their processes of participating in consumer protection markets. Likewise, they will regard participating consumer protection markets as leisure behaviors, from which they want to understand the related knowledge and the environment for organic farmers to grow organic vegetables. With such, they will build up their reliability. Therefore, the more the consumers are involved in consumer protection markets, the more frequently they will participate in the market activities, building up higher trust in organic vegetables.

Protection of retail investors by providing the minimal guarantee in case of investment firm's inability to return securities or money to investors became an essencial instrument in order to restart the economy, particularly in times of economic recession. Given the transboundary nature of investments a single European legislation is not only appropriate, but also practically necessary measure to restore investors' confidence in investment firms and to increase the competitiveness of markets in financial services within the European continent. Legal Status of the Financial Arbiter in Comparison with Selected Regulatory and Control Institutions in the Czech Republic and EU The topic of my thesis is legal status of the Financial arbiter in the Czech Republic. It represent a specific institution for out-of-court settlement of financial disputes between providers of some financial services and their clients. The Financial arbiter does not substitute the role of courts; instead it operates alongside the judicial system and offers to the clients of financial institutions swift and free of charge alternative to the legal proceedings, which emphasizes reconciliation. In the opening chapter of this thesis I looked into the theoretical concept of this institution and characterized it as an administrative authority sui generis. In order to obtain better understanding of the institutional status of the Financial arbiter, I further compared the Financial arbiter with similar institutions in the Czech Republic and the EU.
