AbstractThe progressive automation of management and production processes is increasingly affecting the way contracts are handled. Although for contract automation more concepts are currently being discussed than actually applied, the outlines of what will be possible in the future have become apparent. They raise the questions of what challenges contract handling will have to cope with in the future and whether the concept of contract lifecycle management (CLM) provides a suitable framework for this task. To give answers to these questions, the present article analyses the impact of the pull-effects of new forms of business and the push-effects of technology on the function, content, representation and usage of contracts. The results indicate that these developments entail major changes in the way contracts are handled and that the CLM concept will only be able to address them with considerable adjustments.

Abstract:
Intellectual contracts based on blockchain technology improve the efficiency of supply management of an automobile enterprise by optimizing the transactional costs of supply logistics. The present research featured KAMAZ PTC. The goal was to develop an interaction mechanism for all participants of an intellectual contract in supply activities. The article includes a review of Russian and foreign publications about intellectual contracts in various business spheres, supply management efficiency, optimization of transactional costs, and blockchain technology. The study made it possible to build an interaction mechanism of the parties involved in a blockchain intellectual contract. It also revealed a pattern of changes introduced to the intellectual contract at different stages of interaction between the initiator and suppliers. The authors also highlighted the difference between smart contract and intellectual contract. An intellectual contract appears as a logical development of a smart contract and allows the sides to change the terms. The party interaction mechanism can improve the supply efficiency as it optimizes the magnitude of transactional costs.

Abstract:
The objective of the research is to identify the inefficiencies in contract management practice in the SNRTP sub-projects and also the sources of these inefficiencies will try to find the probable solutions. To study the inefficiencies in contract management practice in SNRTP rural road projects, the checklist was prepared and data regarding the contract management were obtained with the project stakeholders. The data were collected using questionnaires, analysed using SPSS software, MS Excel and presented using the graph, table, and charts.The findings of the study showed that there are significant inefficiencies in contract management practice in the SNRTP project. It has been found that the majority of the respondents i.e. 79 percent of the experts interviewed opined that there are inefficiencies in the contract management practices in the rural road under SNRTP sub-projects, and only 21 percent think that the process is efficient from questionnaire survey. This has been statistically verified through descriptive statistics. The reason behind the inefficiencies in Contract Management Practice is mainly due to a lack of qualifications, knowledge, skills & experience of the contract management team, lack of cooperation & proper communication between project team member, lack of monitoring & evaluation in time, lack of timely meetings, slow decisions making, and improper planning & poor site management during the construction work. To overcome those inefficiencies some suggestions have been recommended as appointing the team member with proper qualifications, knowledge, skills & experience in the contract management. Proper communication & cooperation between team member, frequent inspection, monitoring and evaluation, completion of work within intended completion time, proper record keeping & timely issue management, and timely decision making from all stakeholders as required in construction work during the project implementation phase.

The author develops a model incorporating variables that previous studies have hypothesized as determinants of labor contract duration, then empirically tests the model using a data set containing bargaining pair—specific, industry-specific, and union-specific variables on 373 contracts signed over the period 1977–87. Three findings, all consistent with the model, are that the rate of wage change in a contract is positively related to the contract's duration; contracts containing cost-of-living adjustments (COLAs) tend to be considerably longer in duration than contracts without COLAs; and over the period studied, there was a substantial increase in average contract duration, even with controls for many economic factors.

Aim. The presented study aims to develop and describe a contract management system for FMCG chain retailing companies in the context of the digital transformation of the economy.Tasks. The authors examine the specific aspects of developing a contract management system for chain retailing companies; develop a classification of contracts by sector of activity and outline the landscape of the contract management process; create and describe a system for managing contracts.Methods. The methodological basis of this study includes conceptual representations of the contract management system, which make it possible to apply a systems approach, generalization, grouping, methods of formal system representation, and socio-economic experimentation.Results. The study examines the specific aspects of developing a contract management system for chain retailing companies in the context of the digital transformation of the economy, describing the major types of contracts used by these companies. The contracts are classified by sector of activity, and the landscape of the contract management process is outlined. Its individual units correspond to the Deming cycle and represent a cyclically repeating decision-making process.Conclusions. As a result, a contract management system for chain retailing companies is proposed, and the relationship between the management subsystem and the system of requirements for the architecture of business services in the field of contract management is determined. It is shown that successful implementation of an efficient contract management system requires preliminary work to identify requirements for the architecture of business services. Taking into account these requirements in the modeling of architectural solutions and integrating them into the business architecture will ensure high-quality contract management through the optimization of the company’s resources and highly efficient regulation of the relationship between the stakeholders and counterparties of chain retailing companies.

To respond to financial compound risk of farmers, two multiplicative derivative contracts, called respectively revenue futures contract and revenue put option, are proposed. The paper presents the theoretical management strategy of such a contract under the constraint that price and crop yield futures contracts are quoted. A financial intermediary can thus develop a risk-free management strategy to build a revenue futures contract. This paper opens perspectives on risk management for farmers, on completeness of markets and on new financial intermediation.

This paper investigates the ability of a combined buy-back (BB) and revenue sharing (RS) contract to improve the efficiency of a supply chain involving a risk-neutral supplier and a risk-averse retailer facing stochastic demand. We show that the combined contract can coordinate the supply chain under mild conditions. Further, the effects of risk aversion and contract parameters on the agents’ decision-making are analyzed when the retailer’s risk aversion is modeled by the conditional value-at-risk (CVaR) criterion. In contrast to individual BB and RS contracts, the combined contract is able to mitigate the effect of risk-aversion and allow the supplier to obtain higher expected profit. Moreover, situations exist where the combined contract can coordinate the supply chain when neither the BB nor the RS contract can coordinate it. Numerical experiments conducted further confirm the analytical results derived.
