Abstract:

L'Apparition récente du concept d'économie du contrat en jurisprudence permet de mettre au jour ses deux fonctions. D'une part, elle constitue une grille de lecture du contrat. Elle est en effet apparue comme une référence dans la détermination de la loi du contrat, qu'il s'agisse de son contenu obligatoire ou de son régime. Entre objectivisme et subjectivisme, la référence à l'économie du contrat marque une rationalisation de la volonté des parties. A leur intention réelle est substituée une intention normale telle qu'elle émanerait de contractants rationnels. En ce sens, l'économie du contrat est un parangon contractuel, dont la coloration économique est nette et apparaît également une référence pour en apprécier le sort, permettant la survie des contrats utiles et la disparition ou l'adaptation de ceux ne présentant pas ou plus d'intérêt. Une telle fonction n'est cependant admissible qu'à la condition de circonscrire plus étroitement la notion d'utilité. Au-delà de l'intérêt du contrat ou des parties, c'est finalement l'intérêt de l'opération contractuelle que tend à garantir la référence à l'économie du contrat
French judges use the concept of " économie du contrat " in two cases. First of all, the notion is useful to read the contract. Indeed, it's a reference to determine the contract law, i. E. The obligations it sets out but also the rules which apply to it. Between objectivism and subjectivism, the reference to the " economie du contrat " rationalizes the parties will. Their true intention is replaced with a normal intention so the " économie du contrat " is a contractual paragon. It's also used to make an economic assessment of the contract. Indeed, it allows to up hold useful contracts and to remove or adapt the others. It means it's necessary to define what a useful contract is. So, judges have to estimate if the purpose of the contractual operation can be reached. The " economie du contrat " is then a contractual standard

Abstract:

Les contrats basés sur les notions d'hypothèses/garanties constituent un paradigme expressif pour une conception modulaire et compositionnelle de spécification de programmes. Dans cette thèse, nous élaborons des fondements pour la mise en oeuvre de systèmes embarqués basée sur la notion de contrats. Nous proposons ainsi une algèbre de contrats basée sur deux concepts simples : les hypothèses et les garanties des composants sont définies par des filtres, les filtres sont caractérisés par une structure d'algèbre booléenne. Les choix effectués pour définir la structure des filtres permettent de définir une algèbre de Heyting sur l'ensemble des contrats. Un cadre de travail est ainsi défini, dans lequel les contrats sont utilisés pour vérifier la correction des hypothèses faites sur le contexte d'utilisation d'un composant, et pour fournir à l'environnement les garanties qui lui sont demandées. Nous illustrons cette présentation avec la spécification d'un moteur à quatre temps
Contract-based design is an expressive paradigm for a modular and compositional specification of programs. In this thesis, we elaborate new foundations for contract-based embedded system design by proposing a general-purpose algebra of assume/guarantee contracts based on two simple concepts: first, the assumption or guarantee of a component is defined as a filter and, second, filters enjoy the structure of a Boolean algebra. This yields a structure of contracts that is a Heyting algebra. In this framework, contracts are used to negotiate the correctness of assumptions made on the definition of a component at the point where it is used and provides guarantees to its environment. We put this algebra to work for the definition of a general purpose module system whose typing paradigm is based on the notion of contract. We illustrate this presentation with the specification of a simplified 4-stroke engine model

Abstract:

Asthma ist eine Erkrankung die das komplette Immunsystems involviert, ein System so komplex, dass es sich nur unzureichend in-vitro studieren lässt. Daher haben sich Mausmodelle als ein unverzichtbares Werkzeug in der präklinischen Asthmaforschung etabliert. Da es sich weiterhin bei Asthma um eine Erkrankung handelt, die durch eine schnelle Änderung der Symptome gekennzeichnet ist, wäre longitudinale vorzugsweise nicht-invasive Bildgebung, insbesondere bei der Entwicklung und Bewertung neuer Therapiekonzepte von großem Interesse. Nachteilig hingegen ist, dass die Darstellung der Mauslunge in der Praxis auf Grund der Größe des Organs und, im Falle einer in vivo Bildgebung, durch die Bewegung des Brustkorbes sich als äußerst schwierig herausstellt. Die Vielzahl der Luft-Gewebe-Grenzflächen erzeugt starke Streuung in der optischen Bildgebung, der große Hohlraum der Lunge verursacht Suszeptibilitätsartefakte bei der MRT und die Rippen erschweren eine Ultraschallbildgebung. Aus diesen Gründen besteht ein großer Bedarf an neuen Bildgebungsverfahren, um die durch Asthma verursachten anatomischen, funktionalen und molekularen Veränderungen darstellen zu können. Um die Schwierigkeiten in der Lungenbildgebung bei Mäusen zu umgehen, habe ich mich auf drei wesentliche Bildgebungsstrategien fokussiert: A) anatomische Bildgebung durch “inline free propagation phase contrast computed tomography”, B) direkte Messung der Lungenfunktion durch “low dose planar cinematic x-ray imaging” und C) funktionale Bildgebung mit Hilfe der „near infrared fluorescence imaging“ in Kombination mit Antikörpern, die mit einem Fluoreszenzfarbstoff markiert wurden, oder “smart probes”, die in Gegenwart von Entzündungen aktiviert werden. Durch die Anwendung von “phase contrast computed tomography” für die anatomische Bildgebung war ich in der Lage morphologische Veränderung des Lungengewebes zu quantifizieren, indem ich lokal das Verhältnis zwischen Weichgewebe und Luft, das Zusammenziehen der Luftwege sowie das Anschwellen der Bronchialwände im asthmatischen Lungengewebe ausgewertet habe. Diese Parameter erlaubten es zwischen Mäusen von Asthmamodellen unterschiedlicher Schweregrade, therapierten und gesunden Mäusen zu unterscheiden. Zusätzlich ermöglichte diese Technik die Darstellung intra-tracheal applizierter Bariumsulfat markierter Makrophagen im Lungengewebe. Dies stellt meines Wissens die erste Kombination einer funktionalisierten Kontrastierung und hochauflösender Lungenbildgebung mittels CT unter in vivo ähnlichen Bedingungen dar. Um diese Ergebnisse mit dem Grad der asthmabedingten Kurzatmigkeit zu korrelieren, habe ich eine einfache und verlässige Methode entwickelt die es, basierend auf 2D Röntgen-videos niedriger Röntgendosis (~6,5mGy) erlaubt, in narkotisierten Mäusen die Lungenfunktion zu bewerten. Mit Hilfe dieser neuen Methode gelang es mir charakteristische Unterschiede in der Lungenfunktion von asthmatischen, therapierten und gesunden Mäusen in vivo über die Zeit nachzuweisen, und diese Resultate mit den Ergebnissen von CT und Histologie zu korrelieren. Das Verfahren wird derzeit von mir für die Anwendung an frei beweglichen und nicht narkotisierten Mäusen weiterentwickelt. Dies sollte zu einer deutlichen Stressreduktion für die Maus bei der Untersuchung führen und somit, vor allem in Asthma, im Gegensatz zu etablierten Verfahren wie Plethysmographie, die Erhebung validerer Messdaten erlauben. Mit Hilfe von „near infrared fluorescence imaging“ konnten wir in vivo und longitudinal erfolgreich verschiedene durch Asthma ausgelöste molekulare Veränderungen in der Mauslunge verfolgen. Erstens erlaubte die Verwendung einer neuen Polyglyzerol Probe mit dendritischer Struktur (MN2012) die spezifisch an Selektine bindet, die Darstellung der durch Asthma verursachten Entzündung der Lunge. Im Zuge dessen konnten wir nachweisen, dass sich MN2012 zur Darstellung von Enzymkinetiken bei Entzündungsreaktionen durch eine schnellere Kinetik und höher Spezifität als kommerziell erhältliche Proben auszeichnet. Zweitens haben wir gezeigt, dass in Kombination mit einem Fluoreszenz markiertem Antikörper gegen SiglecF, einem Antigen das hauptsächlich auf Eosinophilen exprimiert ist, Eosinophilie in asthmatischen Mäusen verfolgt und der Effekt einer Dexamethason Behandlung ebenso dargestellt werden kann. Drittens konnten wir den Verbleib inhalierter fluoreszierender Nanopartikel in der Lunge der Maus in vivo untersuchen und dabei nachweisen, dass diese hauptsächlich von endogenen Makrophagen im Lungengewebe aufgenommen werden. Alle diese Techniken wurden gegeneinander und mittels histologischer Analyse und Fluoreszenzmikroskopie korreliert und validiert. Zusammenfassend bilden die in meiner Dissertation entwickelten Lungenbildgebungsstrategien für Asthmamausmodelle eine Bildgebungsplattform, um sowohl spezifische Effekte in asthmatischen Mäusen unterschiedlichen Schweregrades als auch die Auswirkungen neuer Therapien abzubilden und im Detail zu untersuchen.

Abstract:

Die vier Beiträge der vorliegenden Dissertationsschrift untersuchen das Entscheidungsverhalten von Landwirten in unterschiedlichen Entscheidungssituationen. Das übergeordnete Ziel ist es, die Präferenzstruktur und Zahlungsbereitschaft von Landwirten in den untersuchten Entscheidungssituationen zu analysieren, um so die Informationsgrundlage als Entscheidungsbasis für Politiker und Berater sowie der Landwirte selbst zu erweitern. Hierzu findet die Methode der Discrete Choice Experimente in allen vier Beiträgen Anwendung. Im Einzelnen werden in den Beiträgen folgende Forschungsfragen untersucht: Der erste Beitrag prüft welche Faktoren die Entscheidung von Landwirten beeinflussen, den Preis für ihr Erntegut ex ante abzusichern. Im zweiten Beitrag werden die Präferenzen von Landwirten für das Eingehen einer Kooperation unter expliziter Berücksichtigung von nicht-monetären Faktoren analysiert. Der dritte Beitrag geht der Frage nach, welche Rolle die finanzielle Flexibilität in Investitionsentscheidungen von Landwirten spielt. Wie Anbauverträge für Biogas-Zuckerrüben aus Sicht der anbauenden Landwirte ausgestaltet sein müssen, wird im vierten Beitrag geklärt.
