It explains the important role notaries played in the market, describes the types of loans available to borrowers and lenders, stresses the importance of the life cycle in explaining the recourse to indebtedness, and ends with a discussion of the difficulties lenders had in assessing creditworthiness.

Abstract:
This chapter shows that there were two conceivable ways that banks could have engaged in lending. First, they could have entered the mortgage market as lenders but not relied on a notary to do anything except draw up the loan contracts. At the other extreme, banks might not have competed at all with notaries; rather, their short-term commercial loans might have complemented the notaries' business in arranging mortgages. The chapter examines both possibilities, along with more realistic alternatives between the two extremes, including one in which notaries tried to compete with banks. Notaries, however, were not driven out of business by banks. Many notaries were in fact tempted to take money on deposit and start making short-term loans, at least until the 1880s, when the government enforced prohibitions on the practice.

This chapter focuses on the French Revolution's impact on credit markets and the long-term implications for lending. It begins with the revolution's fundamental institutional reforms, which shaped credit markets for the rest of the nineteenth century. The chapter analyzes the effect of the reforms and the consequences of the revolutionary inflation—this entails looking at how borrowers and lenders reacted, both in the short and long run. It also involves examining shifts in their demand for notaries' services, whether to draw up contracts if clients were illiterate, or to secure loans with collateral. Finally, the chapter examines the difficulty that borrowers and lenders had in the peer-to-peer matching markets where only a few loans were made each month.

This chapter talks about how in the long buildup to the 1780s, the economy had been growing, along with the population, literacy rates, and inequality. At the same time, the volume of private lending had soared, particularly in cities, and more so in Paris than anywhere else. But lending in 1780 was not simply a city affair, for loans were made throughout France. In fact, in 1780, eighty percent of borrowers still got their loans in communities of fewer than five thousand inhabitants. The volume of new debt was centralized in cities, even though loans themselves were still dispersed across small towns and villages. In short, the credit market was diverse, and it was changing, in ways that affected the types of loan contracts that lenders and borrowers chose and the services that notaries provided.

This chapter turns to the Ottoman victims of Catholic corsairs and pirates who were carried off to Malta and Livorno to be sold as slaves and/or held for ransom. It focuses on the Ottoman magistrates (kadis) who, as judge-notaries, as captives, and as official mouthpieces of the Ottoman state, were involved in every stage of the ransom slavery industry in the eastern Mediterranean. From the late sixteenth century to the early eighteenth century, a number of Ottoman judges could always be found imprisoned in Maltese dungeons, where their legal expertise proved critical for preparing surety agreements and ransom contracts acceptable in courts throughout the Ottoman Mediterranean. The phenomenon of the kadis of Malta reflects the essential paradox of the seventeenth-century Ottoman Mediterranean: the inverse relationship between Ottoman maritime security and the importance of Ottoman law as an almost universally acceptable legal lingua franca from Istanbul to Malta.

Given the difficulties encountered when they tried to investigate and possibly prosecute Carlo Calà for the forgery, the Catholic authorities moved Giovanni’s case from Naples to Rome. This chapter takes us inside the Roman censorship apparatus. It focuses on Stefano Gradi, tasked by the Congregation of the Index to examine the sources on Giovanni. Gradi believed that all historical sources needed to be authenticated by means of solid documentary and historical analysis, and that the sources related to Giovanni did not pass muster. Carlo Calà, by contrast, believed that as long as the sources were stored in official archives and authenticated by public notaries, no further proof of their authenticity was needed. The debate between Calà and Gradi has profound implications for our own society and for the way we think about truth and authenticity in the process of governing people (through information) and the past (through historical records).

Little attention has been given to the economic activities of European private investors in the Western African trade. To partly fill this void in the literature, this chapter examines the private investment of the entrepreneurs and businessmen of the Dutch Republic in the ‘Guinea of Cape Verde’ between c.1590 and 1674. It analyses the entrepreneurs financing the insurances of ships and cargos for the Guinea of Cape Verde. The chapter also studies the Republic's businessmen operating in the long-distance circuits between the ‘Guinea of Cape Verde’, Europe and the Americas. In addition, it determines the commercial agents of the Republic's merchants and looks at their agency in the Guinea of Cape Verde's trade.
