Full textThe contract of adhesion has been the subject of doctrinal debate for long time and usually arises during the signing of contracts. In such conditions one party will be in a position of inferiority compared to the other contracting party. This imbalance will usually be in favor of the first party who prepared the contract. As for the second party who will not be in the position of negotiating, they will merely adhere to a pre-established contract without having the possibility to discuss the terms. In this context, the law of the parties’ sometimes causes inequalities and certain abuses. The new reform of French Civil code law dated 10 Feb. 2016, marks an evolution; Hence, the importance of a reflection on the concept of the contract of adhesion in French and Kuwaiti law. The comparative approach allows us to grasp the points of convergence and divergence that exist between these statutes in regard to both the legal system of the contract of adhesion and the level of protection. This brings us to question whether the Kuwaiti law can be improved by embracing the French law

Full textFrench law, Moldavian law and Community law concerning the right consumer share, if not a source, at least, a certain idea of consumer protection against unfair terms. The comparison with the French and with the system of the European Union, put, for example, in evidence the desirability of adopting a mechanism to combat unfair terms in contracts concluded with consumers. Lack of direct negotiation, contradiction with the requirement of good faith and the significant imbalance, pillars of the protective system, allow the judge to appreciate unfair terms flexibly in all three systems, with the effect of guaranteeing the effectiveness of consumer protection as a socially vulnerable part of the contract. The comparison with the system in force in France, in particular, highlights in the same time the limits of the Moldovan system. In Moldova, the difficulties arise from inside, we see the same mistakes of the past when, for example, public powers encouraged consumers, especially the poor to overconsumption. The concept of sustainable consumption should also be applied in this area. Otherwise, social dysfunctions appear inevitable. In France, however, the problems are coming from the outside. The needs of the single European market sometimes have the effect of reducing the protection offered by the national legal order. The maximum harmonization of the legislation of the European Union places the national legislator in a difficult position in relation to the expectations of the consumerist movement. This might actually be, incidentally, in the field of unfair terms and, in the near future
Dreptul francez, moldav şi comunitar cu privire la dreptul de consum împărtăşesc, dacă nu o sursă, cel puţin, o anumită idee de protecţie a consumatorului împotriva clauzelor abuzive. Comparaţia cu sistemul francez şi cu cel al Uniunii Europene, pune, spre exemplu, în evidenţă oportunitatea adoptării unui mecanism de luptă împotriva clauzelor abuzive în contractele încheiate cu consumatorii. Criterille de lipsa negocierii directe, contradicţia cu cerinţade bună credinţă şi de dezechilibru semnificativ, piloni ai sistemului de protecţie, permit judecătorului de a aprecia clauzele abuzive cu flexibilitate, în toate cele trei sisteme, cu efectul de a garanta eficienţa de protecţie a consumatorului ca parte defavorizată a contractului.Comparaţia cu sistemul în vigoare din Franţa, în mod special, evidenţiază în aceleaşi timp limitele sistemului moldovenesc. În Moldova, dificultăţile provin din interior, vom vedea aceleaşi greşeli din trecut cînd, de exemplu, puterile publice încurajau consumatorii, în special cei săraci -la supraconsum. Conceptul de consum durabil trebuie de asemenea să se aplice în acest domeniu. În caz contrar, disfuncţii sociale apar inevitabil. În Franţa, cu toate acestea, problemele vin din exterior. Nevoile unei pieţi europene unice au uneori ca efect de a reduce protecţia oferită de ordinea juridică naţională. Mecanismul de maximă armonizare a legislaţiei Uniunii Europene plasează legiuitorul naţional într-o poziţie dificilă în raport cu aşteptările mişcării consumeriste. Acest fapt ar putea fi, de altfel, şi în materia clauzelor abuzive, într-un viitor apropriat

Full textMany problems encountered in industry are concerned with interface evolutions, where contact, friction and adhesion are fundamental topics. This PhD thesis contributes to the development of a model involving adhesion and friction and allowing the healing of the adhesive bonds when the bodies are again pushed closer together after their separation. This model is called model of healing adhesion. In this work the applications concern specifically the contact glass/rubber. The formation of the the adhesion neck, jump-on and jump-off phenomena and the formation and the propagation of the Schallamach waves are investigated. A modelling of the adhesive contact is thus proposed, based on thermodynamic considerations and surface interactions concepts. In addition to the possible healing of the adhesives bonds, the originality of the model is that healing process and damage process are both related to the rate of the solicitation at the interface. According to the applications, the approch allows to consider two potential sources of dissipation. One is called surface dissipation and linked to the behaviour of the interface. The second is called bulk dissipation and linked to the behaviour of the bodies. The dynamic formulation is done within the framework of the non-smooth mechanic. Implementations of appropriate numerical methods and simulations are done in LMGC90 (Montpellier - Marseille). The model is tested with Benchmark and validated with the simulation of a glass/rubber experiment

Full textThe objective of this work is to consider changes in formulation or process of the geltrusion technology developed by Batscap to increase the reliability of supercapacitors by limiting self-discharge. The technology is based on the simultaneous extrusion of polymers (PVDF, PVDF-HFP), solvent (propylene carbonate) and fillers (activated carbon, carbon black). The mixture carried out in a twin-screw extrusion is then filmed and laminated on the aluminium collector. Therefore, it was important to understand the interactions between the different components of the electrode, and especially to study the miscibility of the ternary system polymer/polymer/solvent and also the adsorption of solvent on fillers. This approach has allowed a better understanding of the phenomena involved through a characterization of the complex, in its current form at different stages of the process. Then, changes in formulations were considered. In particular, the effect of the structure and molecular weight of the polymers on adhesion was studied. In all cases, it was envisaged to test the possibilities offered by the use of a different solvent (dimethyl sulfoxide). The latter being a better solvent for the PVDF, is also easier to remove than propylene carbonate. Finally, from the rheological data of the mixture, a mechanical modeling, using the multimodal Maxwell model, was conducted in the lamination step taking into account of the viscoelastic behavior of the gel. All these studies allow us to conclude on the relevant changes in the formulation and process conditions

Full textThe objective of this thesis is to establish a principle of contractual justice, especially in Egyptian law, thus benefiting from French and English experiences in this regard. In terms of precision, we deal with situations of dependence where contracts are formed, from the outset, unbalanced. The idea for this thesis was implemented due to the French reform of contract law in 2016. The latter has been devoted to article 1143 of the Civil Code a new vice of consent: the vice of abuse of dependence related to the duress. In this perspective, we had the idea of comparing this new vice with the fourth vice; in the Egyptian law known as the vice of exploitation, which mainly deals with abuses of the moral weakness of the parties. In order to present an unprecedented comparative experience, we decided to integrate the English law in our field of research. The originality of this subject also appears in the fact of simultaneously treating dependence and contractual equilibrium. However, the subject of this thesis encounters several difficulties which concerns not only dependence, but also contractual justice. First of all, concerning the dependence: its concept has so far been unclear. The dependence is surrounded by several other notions which only hide it instead of clarifying it such as the state of necessity, the vulnerability, the state of need, the state of weakness, the constraint, the subordination, the ignorance, and the inexperience. In addition, dependence, mainly in French law, was known at the outset to special law, that is to say in criminal, consumer or competition law. It had no precise concept in contract law. We note in the end that dependence is a subjective state of moral weakness, but which must also widen to encompass adhesion or standard contracts and contracts including unfair terms. This perspective would provide real protection for weaker parties.As far as contractual balance is concerned, in addition to its conceptual imprecision, it encounters a more serious difficulty. This is contrary to the traditional and usual logic of autonomy of will known in the three legal systems. That is to say that the contract is correctly formed from the moment the parties grant their consents, even if the contract itself is unequal or unbalanced from the formation.However, the contract is properly formed unless proven otherwise. This gives a vision of the legal philosophy adopted: this is a corrective philosophy and not a preventive one. The legal sanction for unbalanced contracts is a posteriori and not a priori sanction. That is to say, the law establishes contractual balance through contractual imbalance.In our view, the contractual context in general must be strengthened by a legal principle competing with that of autonomy of will. This principle is the contractual justice. The latter would counterbalance the contractual relations usually governed by the principle of the autonomy of the will. It would make it possible to control the justice of contracts a priori.This solution might seem to some "utopian". It is, on the contrary, a very practical solution because balance in contractual relations is a supreme end which will help to decrease the cases of unbalanced contracts or the cases of contracts vitiated by the abuse of dependence
