Abstract:

Abstract En raison de son caractère synallagmatique, le contrat de transport met à la charge de l’expéditeur ou du destinataire, selon le cas, l’obligation de payer le prix du déplacement des marchandises. Ainsi, en cas de refus de paiement du prix du transport le transporteur a le droit de retenir les marchandises transportées jusqu’à complet paiement de sa créance. Mais malgré que le droit de rétention du transporteur ait été érigé au rang de sûreté, c’est parfois avec peine que son exercice par le transporteur débouche sur un paiement spontané du débiteur du prix du transport. La réalisation de la sûreté n’étant pas en principe possible, le désintéressement du transporteur ne peut être assuré que grâce au secours des autres moyens qui lui sont offerts par la loi. Et là encore, c’est à prendre avec des réserves. Due to its synallagmatic nature, the transport contract places the responsibility of the sender or the recipient, as the case may be, with the obligation to pay the price of moving the goods. Thus, in the event of refusal to pay the price of the transport, the carrier has the right to withhold the goods transported until full payment of his debt. But despite the fact that the carrier's lien has been raised to the rank of security, it is sometimes with difficulty that its exercise by the carrier leads to a spontaneous payment by the debtor of the transport price. The realization of the security is not in principle possible; the disinterestedness of the carrier can be assured only thanks to the help of the other means which are offered to him by the law. And there again, it is to be taken with reservations.

Abstract:

Pendant le XIVe siècle Majorque apparaît comme une des plus importantes zones de contact commercial entre la Couronne d'Aragon et les ports maghrebins. Une partie du secteur marchand de l’île qui s'intéressait au commerce avec le nord de l’Afrique et la Grenade nasri constituaient des 'associations' commerciales. L'origine de ces associations peut être datée sûrement de la période du 'royaume privatif` de Majorque qu'elles apparaissent comme un moyen de protection des intérêts majorquins face aux marchands de la Couronne d'Aragon et aux italiens, surtout. Au commencement, les associations étaient contractées exclusivement par des marchands chrétiens de l’île; mais, postérieurement, au cours d'un processus qu'on peut dater au milieu du XIVe siècle, on admit aussi les marchands juifs, résidents à Majorque, et qu'avaient acquis la qualité de citoyen de Majorque. On connait les associations d'Alger, Mostaganem et Mazagrán, Honein, Alcudia et Almeria. Un dépouillement plus exhaustif de la documentation notariale majorquine nous permettra, probablement, au cours de futures recherches, de trouver d'autres associations. La principale fonction de ces associations était d'obtenir des moyens de transport quand les associés en avaient besoin. L' importance de ce fait se révèle clairement au travers d'un strict controle des moyens de transport, avec l'interdiction d'embarquer des marchandises dans les embarcations nolisées par des négociants étrangers ou par des négociants non affiliés a l'association. En conséquence, on peut parler de véritables tentatives de 'monopole' des échanges entre le port de Majorque et quelques ports maghrebins par un contrôle des bateaux qui faisaient route vers l’Afrique du Nord.

Abstract:

Le devoir de coopération qui préside aux relations qu'entretiennent les parties dans un contrat international impose que chacun informe autrui sur le contenu et sur les circonstances permettant la parfaite exécution du contrat. La nécessité d'un plus grand souci de rigueur dans l'exécution des contrats a conduit l'auteur à s'interroger sur la place qu'occupe l'obligation de renseignement dans les contrats internationaux et particulièrement dans les contrats de vente internationale de marchandises. Dans la présente étude, l'auteur tente de déterminer les modalités d'application de l'obligation de renseignement dans cette sphère d'activité. Il s'appuie, au départ, sur une analyse doctrinale et jurisprudentielle pour ensuite se consacrer à l'examen de certaines dispositions de la Convention des Nations Unies sur le contrat de vente internationale de marchandises pour montrer le rôle croissant de l'obligation de renseignement dans le droit des contrats internationaux.

Abstract:

Le document analyse les aspects juridiques de l’agence commerciale et du contrat de distribution en tant que techniques pour l’exportation de marchandises à la C.E.E. Il conclut que l’agence commerciale est sujette à beaucoup plus de contraintes juridiques que le contrat de distribution. La directive du 18 décembre 1986 de la C.E.E. favorise très nettement la position de l’agent en ce qui concerne la rémunération et les droits de l’agent à la fin du contrat. En règle générale, les normes du droit communautaire sur la concurrence ne s’appliquent pas à l’agence commerciale. Les contrats de distribution exclusive sont soumis au droit de la concurrence. Cependant, en l’absence de toute tentative de cloisonner les marchés nationaux, la distribution exclusive pourrait être acceptée soit parce que l’exemption par catégorie prévue par le règlement 1983/83 s’applique, soit parce que les bienfaits économiques pour les participants et les consommateurs qui découlent d’un contrat donné amènent la Commission à lui accorder une exemption individuelle. La distribution sélective est acceptée par les autorités communautaires mais uniquement pour les biens de haute technicité et qualité.

Abstract:

Aux xviie et xviiie siècles, les lettres de voiture sont des actes qui décrivent les clauses du contrat de transport de marchandises. Elles peuvent être utilisées par les parties comme preuve et sont employées par le pouvoir royal pour contrôler le transport. Le droit qui régit leur forme et leur contenu leur permet de remplir ces deux fonctions. Néanmoins, les mesures royales peuvent être contraignantes pour les marchands et les voituriers. Le droit relatif à ces actes fait ainsi apparaître l’antagonisme qui a pu exister entre les intérêts commerciaux et ceux du pouvoir royal.
