Abstract:
Late medieval Roman and canon law jurisprudence provided the origins of European notions of a universal rule of law in two senses: a legal order of universal extent and a structure of higher norms of universal application. Whereas modern international law is primarily concerned with the horizontal relationship between states, medieval jurists mainly considered the vertical relationship between universal and territorial powers. They developed de iure–de facto arguments to justify a plurality of sovereign states within an overall universal legal structure. Contributions to the elaboration of theories of just war were also made. We must be cautious about claiming that late medieval jurists contributed to the development of early international law as normally understood. Nevertheless, early-modern theorists of international law referred back to the work of their medieval juristic predecessors. A new research question is emerging about the usefulness of using the term ‘international’ in interpreting medieval jurists.

Abstract:
The Anglican Communion has recently experienced a sea change in its understanding of and approach to canon law, hitherto a matter lacking worldwide attention amongst Anglicans. Whilst the worldwide Communion has no global system of canon law applicable to its member churches, each church (or Province) is autonomous, with its own system of law and government. These individual legal systems deal with such subjects as government, ministry, doctrine, liturgy and ritual, and church property. However, in recent years there have been key developments. The chapter describes, explains (particularly in the context of the juridical experiences of other international ecclesial communities which are ecumenical partners of Anglicans), and evaluates the process leading up to, and the terms of, the document the Principles of Canon Law Common to the Churches of the Anglican Communion, launched at the Lambeth Conference 2008, and the juridical aspects and issues which relate to the Anglican Communion Covenant.

Abstract:
This chapter observes that early writers on the law of war or on the law of peace offered their contributions in an intellectual context that was very different from our own. They were attempting to provide explanations for the questions related to war and peace, and in doing so drew upon interesting elements in Roman or canon law. Yet, none of the sources available to them were sufficient to offer a comprehensive response to related legal issues. Although these authors were all largely relying on the Bible and on ancient or contemporaneous history, some also drew information from their own life experiences. The majority, however, built their theories on the basis of their own readings and legal knowledge. Furthermore, only very few authors addressed the question of the sources of international law.

Abstract:
This chapter considers the historical development of medieval canon law. The term ‘canon law’ refers to the body of law developed by the Catholic Church to govern the body of Christ on earth. In time, canon law came to designate the totality of laws, legislation, judicial processes, and institutions promulgated by the Church and enforced by its officers upon Christians, and sometimes non-Christians. This chapter covers the successes of canonists in consolidating their text base and laying the ground for an increasing professionalization of their discipline; the professional competition between canonists and theologians, which emerged in part out of a divide between those who understood the Church as a pastoral institution and those that understood it as a rigorously hierarchical administrative entity; and the emergence of new legal practices.
