Abstract:
As the United States and the world continue to experience unsustainable growth in the rates of chronic disease and rising healthcare costs, most urgently needed are upstream solutions—far before the point of people needing and seeking medical treatment. What is required to address this untenable situation is a shift in the underlying premises of the health and medical philosophies and infrastructure. This chapter will propose that an evidence-based solution lies in a convergence between an integrative approach to health and medicine and health literacy. That convergence inherently embraces cultural competency and leads health systems, healthcare professionals, and the people they serve to work together as a newly integrated whole that is greater than the sum of the parts.

Abstract:
The late stages of a project life cycle raise interlocking challenges of sustaining participation and producing results. External incentives and material challenges weigh more heavily, requiring attention to sociability and the transitions of junior researchers. With mutual knowledge gained, research team activities can shift from generative ambiguity to clarification, identifying unexpected points of convergence and laying out the stakes of irreconciliable differences. These activities in Göttingen offered hindsight to be reaped in subsequent projects regarding mechanisms for capturing emergent insights as well as sustaining an ecology of project "outputs": scholarly and public, disciplinary and interdisciplinary publications. In the absence of consensus on policy recommendations, projects can serve the public through communication elucidating the stakes of hot problems and the institutional contexts of proposed solutions.

Full text
Abstract:
Regime theory and policy precedents are used to propose a strategy for international governance reform. Bargaining issues tied to international “coordination” and “cooperation” are contrasted, suggesting a strategy to link coordination and cooperation mechanisms to reduce policy frictions. A regime design that relies on achieving a minimum baseline of authoritative international agreements mixing “soft” and “hard” government commitments is proposed. Soft rules are binding on governments, creating specific policy capabilities, not narrowly defining solutions. These baseline agreements reinforce confidence in good-faith conduct by countries while setting parameters that reduce divergence among varied national policies to achieve quasi-convergence of national policies. Governance, not policy, is the focus because private innovations by industry and civil society must complement government decisions and rules. Incorporating expert multistakeholder organizations from civil society into governance is needed to implement a strategy that stresses experimentation and flexibility in response to rapidly changing technological and economic circumstances.

Abstract:
In this chapter, I argue that although the existing growth model has worked well so far, Poland and the rest of the region needs to re-adjust it to sustain a high growth rate. I then introduce the concept of the ‘Warsaw Consensus’, a set of ten policy prescriptions that should guide further convergence of Poland and CEE with the West. The ‘Warsaw Consensus’ upgrades, corrects, and enhances the ‘Washington Consensus’ and embeds it in the specific context of CEE. It deals with the key challenges to the region’s growth and offers policy solutions. I argue that implementation of the ‘Warsaw Consensus’ should be based on a new policy approach of experimenting, evaluating, and pragmaticizing (being pragmatic), and be assessed against its impact on economic growth, well-being, and happiness. Countries should also ensure that they minimize the risks of crises and become anti-fragile.

Bartolini, Giulio, ed. A History of International Law in Italy. Oxford University Press, 2020. http://dx.doi.org/10.1093/oso/9780198842934.001.0001.

Full text
Abstract:
This volume critically reassesses the history of international law studies in the Italian context. It aims to address such basic questions as: How have such studies been driven by the convergence of global dynamics and context-dependent solutions based on local features, through a constant process of attrition and cross-fertilization? To what extent have historical and political turning points had an influence on such studies, scholars being part of broader academic or public debates or even active participants as legal advisers or politicians? Was international law used—or misused—by relevant actors in such contexts? Mixing scholars specialized in both international law and legal history this volume first provides a historical examination of the theoretical legal analysis present in the Italian context, in order to explore its main features, mainstream ideas, and dissident voices. The second part assesses the impact on international law studies of key international and domestic historical and political events involving Italy and, conversely, how the latter have been influenced by international law evaluations. Finally, a concluding part puts such analysis into broader and contemporary perspectives. This volume thus intervenes in a growing debate on the need to explore international law from comparative and situated viewpoints, a debate that has increased awareness of how regional, national, and local contexts have contributed to the shaping of international legal rules, institutions, and doctrines and, conversely, how the international dimension has influenced solutions at local levels, in light of the continuum pendulum between center and periphery of the international legal system.

Abstract:
When it comes to educating deaf and hard-of-hearing (DHH) learners, everything works for somebody, but nothing works for everybody. They frequently enter and leave school with less content knowledge than their hearing peers. The resulting academic underachievement—and explanations for it—have persisted for decades. Even large-scale studies have accounted for only a fraction of the total variability in DHH learners’ academic achievement. It has been argued that teachers and instructional issues likely explain most of this variability, yet we have failed to capture ways of documenting or measuring that impact. Language abilities are central to DHH learners’ academic progress, but several language-related factors associated with it in earlier grades do not predict later achievement. Convergence of these achievement and language issues is not coincidental, but indicates possible sources of such findings and offers new directions toward understanding challenges to both DHH learners’ academic progress and research addressing it.

Loke, Alexander. Insights from Comparing the Contract Laws of Asia on Formation and Third Party Beneficiaries. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198808114.003.0023.

Full text
Abstract:
This chapter draws out the insights and lessons that the chapters in this book reveal. A broad divide in the philosophical foundations of contract can be found in the bargain theory of contract and the theory of contract as the concordant expression of wills. These help make sense of the starting points adopted by jurisdictions situated in different legal traditions, though the final resolution might very well take surprising turns given that jurisdictions tend to be pluralistic in selecting the rules to be transplanted. At the same time, functional convergence often occurs despite disparate analytical approaches, whether because of a common sense of the just solution, the influence of international norms, or the imperative to honour parties’ agreements. A useful operating precept is to be conscious of the forces of convergence while being alert to the values and policy considerations which finally determine the legal outcomes.
