La lecture est une activité essentiellement privée, circonscrite à la sphère domestique; il existe des « cercles de lecture » où les ouvrages littéraires sont lus et présentés en avantpremière. En revanche, il n’y a pas de lecture à l’intérieur des monastères, car les moines ne connaissent qu’un tout petit nombre de textes et ne pratiquent bien souvent que le psautier. Le haut Moyen Âge occidental présente un panorama profondément différent: la lecture est habituellement silencieuse ou murmurée. La lecture privée chez les laïcs est un phénomène rare, car les livres sont lus dans les institutions ecclésiastiques: évêchés et monastères. Il n’existe, par ailleurs, aucun hiatus entre lire et écrire, puisque la copie des textes pieux concourt elle-même à l’instruction chrétienne. Ces différences très marquées ont leur source dans des facteurs qui relèvent à la fois de l’anthropologie et de l’histoire culturelle, voire de la pratique quotidienne.

Cet article étudie les statuts et les enjeux de l’archive dans le cas particulier de la réécriture faite par Jacques Roubaud, dans le recueil Quelque chose noir (1986), du Journal (1984) d’Alix Cléo Roubaud, son épouse, décédée en 1983. Nous analyserons ce diptyque en nous intéressant à l’effet de répétition produit par le dispositif intertextuel, et surtout aux libertés prises par le poète à l’intérieur de cette copia (déplacements sémantiques, grammaticaux ou syntaxiques). Nous tenterons d’observer comment le travail de deuil et la réorganisation de la mémoire privée, intime, visent à une réinvention de formes appartenant à la tradition, notamment celle du tombeau poétique et, plus généralement, celle du poème lyrique, en ce qui a trait à la représentation et à la récitation. Enfin, nous montrerons comment ce travail sur l’archive convoque de manière paradoxale une pensée à la fois de la disparition et de l’inscription, qui s’accorde aux thèses roubaldiennes sur la création poétique et la mémoire.

Le Bustân al-Azhâr fî Manâqib Zimzim al-Akhyâr wa Ma'dan al-Anwâr Sidi Ahmad b. Yûsuf al-Râchidî al-Nasab wa'l-Dâr de Muhammad b. Muh. al-Sabbâgh al-Qal'î est sans doute la Vie de saint la plus célèbre au Maghreb. Ses copies manuscrites se comptent par dizaine dans les bibliothèques publiques et privées. Nous-même avons eu accès à quatre copies différentes. En Algérie, sa popularité est telle qu'il est la seule Vie de saint à avoir eu droit au privilège de l'édition imprimée en 1927. Cette édition du Bustân est, toutefois, si rare que seules quelques bibliothèques privées en possèdent des exemplaires. La Bibliothèque Nationale d'Alger, par exemple, qui possède deux copies manuscrites du Bustân ne dispose pas de cette édition.

In 1831 in London, two formidable women met: Mary Prince, an ex-slave from Bermuda, who had crossed the Atlantic to a qualified freedom, and Susanna Strickland, an English writer. The narrative that emerged from this meeting was The History of Mary Prince, which played a role in the fight for slave emancipation in the British Empire. Prince disappeared once the battle was won, while Strickland emigrated to Upper Canada and, as Susanna Moodie, became an often quoted 19th century Canadian writer. Prince dictated, Strickland copied, and the whole was lightly edited by Thomas Pringle, the anti-slavery publisher at whose house the meeting took place.This is the standard account. In contesting this version, the paper aims to reinstate Moodie as co-creator of the collaborative Mary Prince text by considering multiple accounts of the meeting with Prince and to place the work in the context of Moodie’s pre- and post-emigration oeuvre on both sides of the Atlantic.

Abstract:
La faculté de copie privée, admise depuis longtemps et figurant à l’article L. 122-5 du Code de la propriété intellectuelle, est présentée par la doctrine majoritaire comme une exception au droit d’auteur. Elle permet à une personne de dupliquer une œuvre pour son usage personnel sans avoir à demander l’accord préalable de l’auteur et s’illustre dans deux cas : la copie pour son usage personnel faite par le propriétaire d’un exemplaire, laquelle est facile à admettre ; et celle faite par un tiers, notamment un emprunteur de l’exemplaire, laquelle s’impose aussi. On observe que la copie privée, parce qu’elle ne réalise pas une communication au public, doit être considérée comme étant hors du champ du droit d’auteur, qui trouve ici une de ses limites. Récemment, le législateur a considéré que, du fait de l’évolution des techniques, la copie privée entraînait un préjudice pour l’auteur. Il a prévu une rémunération pour le compenser. Puis, celle-ci a été cantonnée aux seules copies de source licite, en même temps qu’ont été incriminées les copies de source illicite. Mais cette pénalisation est mal vécue et peu appliquée. Et l’absence de rémunération est injuste pour l’auteur. Il serait bon de supprimer la distinction entre copie privée licite et illicite. On étendrait alors la compensation à toutes les copies privées et on se dispenserait ainsi d’assumer la charge de la répression de la copie privée illicite. On admettrait en même temps que l’auteur limite par voie contractuelle le nombre de copies privées, notamment en utilisant des mesures techniques de protection et d’information, mais sans pouvoir interdire totalement cette faculté de copie privée à l’utilisateur
The private copying’s faculty, admitted for a long time and contained in article L. 122-5 of the Code of Intellectual Property, is presented by the majority doctrine as an exception to copyright. It allows a person to duplicate a work for his personal use without having to seek the prior consent of the author and it is illustrated in two cases : the copy for his personal use made by the owner of a copy, which is easy to admit ; and the one made by a third party, including a borrower of the copy, which is also required. It is observed that private copying, because it does not make a communication to the public, must be considered as being outside the field of copyright, which finds here one of its limits. Recently, the legislature considered that, due to the evolution of the techniques, the private copy entailed a prejudice for the author. He has provided compensation to compensate him. Then, it was confined to the only copies of lawful source, while were reprimanded the copies of illicit source. But this penalty is poorly lived and little applied. And the lack of remuneration is unfair for the author. It would be good to remove the distinction between lawful and unlawful private copying. Compensation would then be extended to all private copies and the repression’s burden of unlawful private copying would be dispensed with. In the same time, it should be admitted that the author limits the number of private copies by contractual means, especially by using digital rights management, but without being able to totally prohibit this private copying’s faculty for the user

La fabrication additive plus communément nommée l’impression 3D est une « innovation de rupture », car elle bouleverse les modèles économiques actuels et met en marche une troisième révolution industrielle. Désormais, tout est quasiment imprimable, peu importe la matière, le prix et le domaine concerné. Cette technologie aux potentiels incommensurables pour l’innovation et la production doit trouver son équilibre avec les droits de la propriété intellectuelle. De nombreuses doctrines se sont accordées sur le fait que le droit de la propriété intellectuelle français disposait des outils nécessaires pour appréhender ces technologies et donc que des interventions à court terme n’étaient pas nécessaires. Cependant, l’objectif de ce mémoire est de montrer que le droit de la propriété littéraire et artistique tend à être impacté par l’impression 3D. En effet, cette technique propice à la fabrication de contrefaçon met à mal l’exception de copie privée et le marché de l’art. Les conditions nécessaires pour caractériser l’exception de copie privée ne sont pas adaptées à l’impression 3D. De ce constat résultent des situations où les frontières entre la copie privée et la contrefaçon deviennent poreuses au détriment des particuliers, mais aussi des créateurs qui ne bénéficient pas de la compensation équitable de l’exception. D’autre part, le recours aux impressions 3D avec des techniques limitées porte atteinte à l’intégrité et au respect des œuvres. Alors qu’avec une technique sophistiquée elle permet de reproduire des œuvres quasi identiques sans moyen d’identifier la contrefaçon de l’original. De cette dernière situation découlent des risques d’introduction de faux dans le marché de l’art. La problématique principale de ce développement repose donc sur un meilleur contrôle de la contrefaçon pour la contrecarrer et rétablir la frontière entre l’exception de copie privée et la contrefaçon. Il est donc nécessaire d’anticiper le potentiel de cette technologie en proposant un encadrement plus protecteur des droits des auteurs, des intervenants du processus de création d’un objet imprimé et des consommateurs sans freiner son développement. L’interconnexion de modifications légales sur la responsabilité des intervenants et sur l’exception de copie privée, des interventions contractuelles avec la mise en place d’offre légale, le recours à des outils techniques en amont et en aval du processus de création d’un objet tridimensionnelle pour contrôler, identifier et tracer les objets ainsi qu’une sensibilisation des intervenants permettront de mettre en place un encadrement plus protecteur et efficace sur le long terme.

Additive manufacturing, more commonly known as 3D printing, is a "breakthrough innovation" because it disrupts current business models and sets in motion a third industrial revolution. From now on, almost everything is printable, regardless of the subject, the price and the field concerned. This technology with huge potential for innovation and production must strike a balance with intellectual property rights. Many doctrines have agreed that French intellectual property law has the necessary tools to apprehend these technologies and therefore that short-term legal interventions are not necessary. However, the purpose of this dissertation is to show that 3D printing does impact the law of literary and artistic. Indeed, this technique conducive to the manufacture of counterfeit undermines the exception of private copying and the art market. The conditions necessary to characterize the private copy exception are not suitable for 3D printing. This analysis results in situations where the boundaries between private copying and counterfeiting become porous to the detriment of individuals, but also creators who do not benefit from the fair compensation of the exception. Moreover, the use of 3D printing with limited techniques undermines the integrity and respect of works. While with a sophisticated technique allow a reproduction of almost identical works without any ways to identify the counterfeit from the original. From this last observation, arises the risks of introducing forgeries into the art market. The main problem of this development therefore lies in a better control of counterfeiting in order to counter it and restore the border between the private copying exception and counterfeiting. It is therefore necessary to anticipate the potential of this technology and prevent its negative effects by providing a more protective framework for the rights of authors, stakeholders in the process of creating a printed object and consumers without curbing its development. An interconnection of legal changes on the responsibility of the stakeholders and the exception of private copying, contractual interventions with the establishment of legal offer, the use of technical tools upstream and downstream of the process of creation of a three-dimensional object to control, identify and trace objects as well as stakeholder awareness will help set up a more protective and effective framework in the long term.

La tesis realiza un estudio del régimen jurídico de la compensación equitativa por copia privada en España. La regulación española es también contrastada con la normativa vigente en la región de América Latina y el Caribe. Para enmarcar el estudio, el primer capítulo aborda el derecho de reproducción, mientras que el capítulo segundo nos introduce en el controvertido tema de los límites a los derechos de propiedad intelectual. El tercero, se centra específicamente en el estudio del límite de copia privada. Por su parte, los capítulos cuatro y cinco analizan el régimen jurídico de la compensación equitativa por copia privada en España (el cuarto, desde una visión histórico-cronológica y el quinto, profundizando en la regulación española actual, cuya normativa al respecto ha sido recientemente modificada). Finalmente, el sexto capítulo, analiza la regulación de la copia privada y la compensación en América Latina y el Caribe.
The thesis carries out a study of the legal regime of fair compensation for private copying in Spain. Spanish regulation is also contrasted with current regulations in the Latin American and Caribbean region. To frame the study, the first chapter addresses the right of reproduction, while the second chapter introduces us to the controversial issue of limits to intellectual property rights. The third one focuses specifically on the study of the private copy limit. For its part, chapters four and five analyze the legal regime of fair compensation for private copying in Spain (the fourth, from a historical-chronological view and the fifth, delving into the current Spanish regulation, whose regulations have recently been modified). Finally, the sixth chapter analyzes the regulation of private copying and compensation in Latin America and the Caribbean.

A selection of Trentin’sdiaries from 2001-2006, some unpublished pages on his political activity in the European Parliament and the elaboration of The Freedom Comes First: these works allow us to enter Bruno Trentin's intellectual laboratory and to follow, from the inside, the editing of the essays and the realization of the volume. Public and private intertwine in a melee with a heavy depression, which demands to "cope with death by accelerating the production of writings that can clarify or conclude my testimony." The notes on the Italian and international situation after September 11th, 2001, the American intervention in Iraq in 2003 and the European Constitution project are significant. The section is completed by some coeval political interventions, including the last article of July 2006 on meritocracy and the affirmation of individual rights.

Abstract:
This research paper focuses on alcoholic beverages and their price affordability between 2000-2016 in the member states of the European Union. Based on the data from OECD, WHO, Eurostat, and the European Commission, the paper primarily discusses development of prices and consumption of alcoholic products, level of excise duties, and the development of average wages. Overall alcohol consumption has decreased in most EU member states over the past two decades, even though price affordability has increased due to relatively dynamic development of average wages. As consumption of alcohol products is decreasing, producers of alcoholic beverages are now pushed to increase the prices of alcoholic products to keep their level of revenues, which means that the price of alcohol is growing naturally. Those facts raise a question about the role of excise duties on alcohol, whether it is an effective tool for reducing alcohol consumption or just a fiscal tool, whose further increases might lead to market distortions.

In the quest for market mechanisms that are easy to implement, yet close to optimal, few seem as viable as posted pricing. Despite the growing body of impressive results, the performance of most posted price mechanisms however, rely crucially on "price discrimination" when multiple copies of a good are available. For the more general case with non-linear production costs on each good, hardly anything is known for general multi-good markets. With this in mind, we study the problem of social welfare maximization in a Bayesian setting where the seller can produce any number of copies of a good but faces convex production costs for the same. Our central contribution is a structured framework for decision making and static item pricing in the face of uncertainty and production costs, i.e., the seller decides how much to produce and posts a single price per good that is common to all buyers, the buyers arrive sequentially and purchase utility maximizing bundles of goods. The framework yields constant factor approximations to the optimum welfare when buyer valuations are fractionally subadditive, extends to more general valuations and also settings where the seller is completely oblivious to buyer valuations. Our work presents the first known results for non-discriminatory pricing in environments with non-linear costs where we only have access to stochastic information regarding buyer preferences. At a high level, our results imply that it is often possible to obtain good guarantees without discriminating against buyers, i.e., charging them differently for the same good.

Abstract:
The presented contribution focuses on describing the Value Added Tax refund to foreign tourists, specifically the Tax-Free Shopping incentive, that increases tourists’ propensity to buy retail goods where shopping can even sometimes be the primary reason for traveling. To have a practical analysis and comparison, four economies from South America were chosen. Colombia and Ecuador whose tax-refund system is entirely operated by the State and Argentina and Uruguay whose governments have decided to outsource their VAT refund service to tourists having private companies operate them. Adding to this, an evaluation of the main characteristics of these countries regarding the competitiveness of their tourism sector was gathered with data obtained from the Travel & Tourism Competitiveness Index (TTCI) Report (2019). The findings of this research provide a benchmark to tourism policymakers interested in assessing changes overtime on this type of incentive.

Discriminatory pricing policies, even if at first glance can be perceived as unfair, are widespread. In fact, pricing differences for the same item among different national markets are common, or forms of discrimination based on the time of purchase, like in tickets' sales. In this work we propose a framework for capturing the setting of ``fair'' discriminatory pricing and study its application to multi-unit markets, in which many copies of the same item are on sale. Our model is able to incorporate the fundamental discrimination settings proposed in the literature, by expressing individual buyers constraints for assigning prices by means of a social relationship graph, modeling the information that each buyer can acquire about the prices assigned to the other buyers. After pointing out the positive effects of fair price discrimination, we investigate the computational complexity of maximizing the social welfare and the revenue in these markets, providing hardness and approximation results under various assumptions on the buyers valuations and on the social graph topology.

Abstract:
Competition law serves as an important tool for regulation of undertakings. In order to conduct a competition law analysis, one must first define the relevant market. However, this task is becoming more intricate in today’s digital era, especially in relation to so-called zero-price markets. These markets are characterised as markets where users of products or services do not pay for the use, at least they do not pay by money. This paper asks how to define relevant market in such case. Three methods of relevant market definition are presented, namely qualitative analysis, SSNIP test and SSNDQ test. The paper briefly explores positive and negative elements of these tests and compares the findings with the European Commission’s 2019 report. It leads to the answer that qualitative method might have certain advantages in this regard.

Abstract:
This article is focused on technical-economic evaluation of the efficiency of corn silage in comparison with manure in case of combined production of electricity and heat. Mentioned energetical sources are used for production of biogas by fermentation in biogas plants, which include equipment for cogeneration. We analysed resources՚ efficiency of installations with installed capacity of 1MW. We found the the use of manure with deterministically defined value, NPV 2 508 303 EUR and IRR 26.35% is more effective. NPV for corn silage was 1 690 562 EUR and IRR 21.37%. Price of electricity, use of electricity and initial investment in both projects have the greatest impact on the change of criterion. Taking into account the risk from Monte Carlo simulation, we found, that with any risk aversion, the NPV of the monitored projects will never be negative. Functions of density and distribution confirmed the ranking of energy resources՚ efficiency obtained using NPV and IRR criteria. It can be stated that both investment plans are very perspective.
