Zusammenfassung Der Diskurs der spanischen Liberalen konstituierte sich im wesentlichen in den politischen Auseinandersetzungen in den Cortes (1810-1813) und der Presse von Cadiz und wurde von Themen getragen, die bereits die Aufklärung und Französische Revolution beherrschten. Dabei entwickelten die Liberalen zwei grundlegende Diskursstrategien. Einerseits übernahmen sie die Sprache der Revolution (z. B. „Libertad“). Andererseits suchten sie sich gegen den französischen Sprachgebrauch und damit den ihrer Feinde im Unabhängigkeitskrieg (1808-1814) abzugrenzen (z. B. Ablehnung von „revolución“) und orientierten sich an mittelalterlichen Traditionen, die ihnen auch Bezeichnungen für neue Institutionen und Errungenschaften lieferten (z. B. „Cortes“).

The main aim of this study es the treatment that the Spanish Constitution of 1812 gives the jurisdiction in Chapter V, the longest one in the Constitution. This is preceded by a detailed analysis of how Spanish libreralism planned to implant an independent judiciary power within a state of rights, sometimes taking the initiative in a tentative reforms facing our monarchas in the XVII century and builing the toundations in the Cortes de Cadiz after establishing through those same courts the so called «provisional Regulation» for the judiciary power, which together with the abolition of torture and the paring down of criminal causes preceded the passing of this Chapter V. Indeed in this topic, the Cadiz Constitution of 1812 would have an impact in subsequent Spanish constitutionalism as well as that of other nations.El tema central que es objeto de este estudio es el tratamiento de la Constitution de 1812 da a la potestad judicial en su Título V, el más extenso de cuantos la integran. Esta materia nuclear es precedida de un análisis pormenorizado de cómo el liberalismo español se plantea implantar un poder judicial independiente en el seno de un Estado de Derecho, superando la dura realidad de la justicia en la Monarquía absoluta, tomando pie en ocasiones en las titubeantes reformas afrontadas por nuestros monarcas ilustrados en el siglo XVIII y construyendo unos cimientos en las propias Cortes de Cádiz al establecer por las propias Cortes de Cádiz el llamado Reglamento provisional para el Poder Judiciario, que junto a la abolición del tormento y la abreviación de las causas criminales precedieron a la aprobación de este Título V. También en esta materia la Constitución gaditana va a tener influjo en el constitucionalismo español posterior y en el de otras naciones.

El centro de la pesquisa está dirigido a la Constitución española de 1812, en especial a los debates que se produjeron en las Cortes Constituyentes respecto al problema colonial. Primeramente se caracteriza la situación de la sociedad cubana desde el punto de vista político, económico y cultural. En un segundo momento se realiza una valoración de la trascendencia de la Constitución en Cuba, teniendo en cuenta algunas de las propuestas realizadas por los diputados que se plasmaron en los artículos. El análisis está dirigido a su primer período de aplicación, se destacan sus implicaciones respecto al problema de la esclavitud y a posibles cambios referidos a la administración colonial, no obstante se resalta que no produjo ningún cambio significativo en estos aspectos, aunque sí fue fundamental su impacto en el aspecto político e ideológico

Les deputes hispano-americains aux cortes de cadix (1810-1814) ont presente de nombreuses propositions de reforme, qui visaient la "decolonisation" de l'amerique a l'interieur de l'unite hispanique. Elus par les provinces unies a l'espagne, ils etaient porteurs de revendications locales, mais les exigences d'un travail legislatif pour tout l'empire espagnol les ont amenes a adopter un point de vue plus global et continantal. Ils souhaitaient l'integration des indigenes et des castas dans la societe utile, mais exprimaient aussi les prejuges de la societe blanche contre les populations de couleur. Ils proposaient un modele d'economie liberale sans restrictions qui permettrait aux creoles d'exploiter toutes les richesses du continent, mais voyaient aussi les obstacles objectifs au developpement des provinces americaines. Ils reclamaient une rationalisation de l'organisation territoriale et la formation de provinces plus petites dans lesquelles le pouvoir local serait assume par les americains. Ils souhaitaient la creation d'amples autonomies regionales. Ils se sont montres solidaires des premieres juntes erigees en amerique, mais n'etaient pas favorables a l'independance absolue qu'ils jugeaient hasardeuse. Pour les deputes americains liberaux, la constitution de 1812 etait un motif supplementaire d'attachement a l'espagne. Mais a cette date l'union avec la metropole n'allait pas de soi : elle etait une option politique<br>The hispano-american deputies at the cortes of cadiz proposed numerous reforms aimed at the "decolonization" of america within the framework of spanish unity. Elected by the provinces faithful to the metropolis, they asserted local rights, but the requirements of legislative work for the spanish empire as a whole led them to adopt a more general continental view. They supported the integration of the indigenous population and the "castas" into "useful" society, but also displayed the prejudices of white society against the coloured population. They proposed a model of an unrestricted liberal economy, which would allow the creoles to exploit the resources of the american provinces. They argued for a rationalization of territorial arrangements, and the establishment of smaller provinces in which the spanish-american themselves would exercise local power. The deputies solidarized with the first juntas set up in south america, but were not in favour of absolute independence, which they regarded with suspicion. For the liberal american deputies, the 1812 constitution was an additional reason for sentiment attachment to spain. But by then union with the metropolis was a matter of debate rather than a self-evident political fact

Mestrado em Biologia Marinha<br>Este trabalho foi realizado em vários locais das margens Espanhola e Marroquina no Golfo de Cádis (NE Atlântico), ao longo de uma faixa batimétrica entre os 300 e os 900m caracterizada pela ocorrência extensiva de crostas carbonatadas e recifes de corais pétreos em declínio. Os objectivos principais desse trabalho são: i) compilar informação sobre a biodiversidade da megafauna e do impacto humano na área de estudo através da análise de imagens digitais obtidas durante os mergulhos com o submersível de operação remota e ii) caracterizar, em termos de abundância e biomassa, a composição e a estrutura das comunidades de macroinvertebrados bentónicos associados aos habitats de crostas carbonatadas e recifes de corais através do estudo de amostras de sedimento colhidas com um “boxcore” circular. Verificou-se que a megafauna associada aos habitats estudados mostra uma grande variedade de organismos sésseis, principalmente esponjas e antozoários, e vágeis, nomeadamente decápodes, cefalópodes e peixes. Foi compilado um atlas com imagens representativas da biodiversidade da megafauna. As imagens recolhidas permitiram ainda verificar a ocorrência de vários tipos de impacto antropogénico nestes habitas profundos, incluindo artes de pesca perdidas, detritos diversos (artefactos de vidro, plástico, metal e têxteis) e efeitos da pesca de arrasto. Foram ainda identificados 145 taxa de macroinvertebrados bentónicos nas nove amostras de sedimento recolhidas em diversos locais. A comunidade bentónica estudada é constituída maioritariamente por espécies de artrópodes, anelídeos e cnidários, tendo-se verificado uma grande heterogeneidade na composição e estrutura das amostras recolhidas. Em termos de abundância as comunidades são geralmente dominadas por várias espécies de crustáceos enquanto que os cnidários e os equinodermes dominam claramente a biomassa. As amostras estudadas apresentam geralmente uma diversidade (H’: 2.0-3.3) e equitabilidade (J’: 0.740-0.974) elevadas e uma dominância baixa (espécie mais abundante com valores de 10-40% do total). Os valores do índice de Hurlbert (ES(50): 11-33) reflectem a elevada biodiversidade dos habitats estudados. Este estudo é um contributo para o conhecimento da biodiversidade associada aos recifes de coral de profundidade, habitats de reconhecido valor ecológico e económico que se encontram cada vez mais expostos ao efeito de impactos antropogénicos.<br>This work was carried out in different locations within the bathymetric range of 300-900m in the Spanish and Moroccan margins of the Gulf of Cadiz (NE Atlantic). This area is characterised by the occurrence of extensive carbonate provinces and mostly dead cold-water coral reefs. The main objectives were: i) to obtain information on the megafaunal biodiversity and human impact in the study area using digital images obtained during ROV (remote operated vehicle) dives, and ii) to characterise, in terms of abundance and biomass, the composition and structure of the benthic macroinvertebrate assemblages associated to the carbonate crust and coral reef habitats using sediment samples collected with a circular boxcore. The megafauna associated to the studied habitats showed a high variety of sessile organisms, mainly sponges and anthozoans, and swimming organisms (e.g. decapods, cephalopods and fish). Some representative images were compiled in a biodiversity atlas. The images showed that these deep habitats are suffering from the impact of anthropogenic activities. Some examples are the lost fishing gear, different types of litter (glass, plastic, metal and textile) and also trawl marks on the seabed. From the nine sediment samples that were collected, a total of 145 macroinvertebrate taxa were identified. The benthic assemblages were highly heterogeneous in composition and structure and were represented mainly by arthropods, annelids and cnidarians. The crustaceans usually dominate the assemblages in terms of number of species and individuals but the cnidarian, sponges and echinoderms clearly dominate the biomass. The macroinvertebrate samples show high diversity (H’: 2.0-3.3) and evenness (J’: 0.740-0.974) and low dominance (dominant species representing 10-40% of the total abundance). The Hurlbert’s expected species numbers (ES(50): 11-33) reflect the high biodiversity of the studied habitats. The high ecologic and economic importance of cold-water coral reefs is presently highly valued by the society. Mestrado em Biologia Marinha<br>The Gulf of Cadiz is an extensive seepage area between the south Iberian and north Moroccan margins, west of the Strait of Gibraltar (NE Atlantic). It encompasses numerous carbonate mounds characterised by accumulations of mostly fossil deepwater corals, isolated coral patches and coral rubble, and over 40 submarine mud volcanoes at depths ranging 200 to 4,000m. This tectonically active area has a long geologic history and a central biogeographic location. The complex circulation of water masses ensures oceanographic connectivity with the Mediterranean Sea, Equatorial and North Atlantic regions. At the Gulf of Cadiz, the Pen Duick Escarpment, a feature with 4 km length and 100 m height, is located at ca. 500 m depth, on the south-eastern branch of the Renard Ridge, westwards of the El Arraiche mud volcano field. Cold-water corals, vulnerable, slow-growing metazoans that inhabit cold dark waters in the deep-sea, have been receiving increased attention in recent years. Under the framework of the research programs MiCROSYSTEMS and Moundforce (European Science Foundation), selected sites along the Moroccan margin were investigated, aiming to describe the composition, abundance and community structure of the benthic macrofaunal assemblages living in association with fossil cold-water coral reef habitats present in the vicinity of mud volcanoes and carbonate mounds. Sampling was undertaken during the cruises M2005 (64PE237), M2006 (64PE253) and M2007 (64PE268), onboard the RV Pelagia. From the 120 box-core subsamples collected at depths ranging 220 to 900 m, 426 macroinvertebrate taxa were identified. The macrofaunal assemblages were highly heterogeneous in composition and community structure and were mainly represented by arthropods, annelids and molluscs. Multivariate analyses supported significant differences between distinct geological features and between distinct substrate types. High diversity, abundance and evenness were common in mound, coral and mud volcano assemblages, whilst off mound sediments and areas without hard substrates were represented by less diverse and less abundant assemblages. The assemblages are dominated by a relatively low percentage of the most common taxa and include mainly polychaetes, sipunculids and tanaidaceans. Analysis in relation to depth also revealed differences in taxa richness and abundance. The results obtained are discussed in relation to previous knowledge on carbonate mounds, fossil coral reefs, El Arraiche mud volcanoes and surrounding area, reinforcing the hypothesis that the presence of carbonate mounds and fossil cold-water coral reefs increases deep-sea habitat heterogeneity and support a highly diverse assemblage of benthic invertebrates.<br>O Golfo de Cádis, localizado entre a margem sul Ibérica e a margem norte Marroquina, a oeste do Estreito de Gibraltar (NE Atlântico), engloba inúmeros montes carbonatados caracterizados pela acumulação de corais de profundidade fósseis e, mais de 40 vulcões de lama submarinos, a profundidades entre os 200 e 4000 m. Esta área localizada na interface de várias regiões biogeográficas, é tectonicamente ativa e caracterizada por uma longa história geológica; a complexa circulação de massas de água assegura a conectividade oceânica entre o Mar Mediterrâneo e as regiões Equatorial e Norte do Atlântico. No Golfo de Cádis, a Escarpa de Pen Duick, com 4 km de comprimento e 100 m de altura, está situada a cerca de 500 m de profundidade no ramo sudeste do "Renard Ridge", na parte ocidental do campo de vulcões do El Arraiche. Os corais de água fria, organismos vulneráveis e de crescimento lento que vivem em águas frias e escuras no oceano profundo, têm vindo a receber atenção acrescida nos últimos anos. No contexto dos programas de investigação MiCROSYSTEMS e Moundforce (Fundação Europeia para a Ciência), locais selecionados ao longo da margem Marroquina do Golfo de Cádis foram investigados, com o objetivo de descrever a composição, abundância e estrutura das comunidades de macrofauna bentónicas que vivem em associação com habitats de recifes de corais de água fria predominantemente fósseis presentes nas proximidades de vulcões de lama e montes carbonatados. A amostragem decorreu durante as campanhas M2005 (64PE237), M2006 (64PE253) e M2007 (64PE268), a bordo do NO Pelagia. Foram analisadas 120 subamostras de box-core recolhidas a profundidades entre os 220 e 900 m, nas quais foram identificados 426 taxa de macroinvertebrados. As comunidades de macrofauna revelaram ser altamente heterogéneas a nível de composição e estutura, sendo maioritariamente representadas por artrópodes, anelídeos e moluscos. As análises multivariadas revelaram diferenças significativas entre estruturas geológicas distintas e entre diferentes tipos de substratos. Elevada biodiversidade, abundância e equitibilidade são comuns entre as comunidades de montes carbonatados, áreas coralinas e vulcões de lama, enquanto que nas zonas de referência ("off mound") e áreas sem presença de coral as comunidades de macroinvertebrados demonstraram ser caracterizadas por menor diversidade e abundância. No geral, estas comunidades são dominadas por uma percentagem relativamente baixa dos taxa mais comuns, incluindo principalmente poliquetas, sipúnculos e tanaidáceos. A análise em relação à profundidade também revelou diferenças a nível da riqueza de taxa e abundância. Os resultados obtidos são discutidos em relação ao conhecimento prévio acerca da Escarpa de Pen Duick, montes carbonatados, recifes de coral fóssil, vulcões de lama da região de El Arraiche e área circundante, reforçando a hipótese de que a presença de montes carbonatados e recifes de coral de água fria fósseis aumentam a heterogeneidade de habitats no mar profundo e suportam uma comunidade de invertebrados bentónicos altamente diversa.
