Thesis (MPA)--Stellenbosch University, 2000.<br>ENGLISH ABSTRACT: Local government is a sphere of government which consists of municipalities and its executive and legislative authority is vested in the respective municipal councils. The council is responsible for exercising its powers and functions on behalf of the community it represents and it makes decisions in that regard. A municipality as an organisation which is comprised of two main components: on the one hand, the council as a body of elected representatives and, on the other, officials who have been employed by the council. Whilst it is generally accepted that it is the function of the council to determine policy and of the officials to execute the determined policy, it is accepted that in .practice there is a degree of interfacing between these two functions. It is further accepted that, although there is a clear distinction between the roles of councillor and official, it is possible that there may be a degree of misconception about their respective roles. The purpose of this study was to determine whether councillors and officials have misconceptions about their roles in the decision-making processes of the municipality and whether such misconceptions have a negative impact on service delivery. The research was initiated by a study of decision making in general, followed by a study of decision making in local government in order to establish a basis for the field of study. Oostenberg Municipality was then analysed, with specific reference to its decision-making systems as well as its macro-organisational structure. A questionnaire was sent to the top structure of the council as well as the top management structure of the municipality; the views of these respondents were used to determine whether there were any misconceptions about their roles. The study found that the councillor study group presented a 30.56% degree of misconception about their role as councillors in the decision-making process of the municipality, and in the case of the top management structure there was a 29.86% degree of misconception. The study further established that this degree of misconception impacted negatively on service delivery. In VIew of the above, it is recommended that councillors be subjected to appropriate training, that the political party caucuses be accommodated in the formal decision-making process of the municipality, and that members of the top management structure be subjected to dedicated training on their role in the decision-making processes of the municipality. It is also recommended that the top management structure of the municipality should be in possession of appropriate academic qualifications.<br>AFRIKAANSE OPSOMMING: Plaaslike Regering is 'n sfeer van regering wat uit munisipaliteite bestaan en ten opsigte waarvan sy uitvoerende en wetgewende gesag in sy munisipale raad gesetel is. Die raad is namens die gemeenskap wat hy verteenwoordig vir die uitoefening van sy magte en funksies verantwoordelik en neem hy besluite in daardie verband. 'n Munisipaliteit as 'n organisasie bestaan uit twee komponente, te wete die raad as 'n liggaam van verkose verteenwoordigers aan die een kant, en aan die ander kant, amptenare wat deur die raad in diens geneem is. Terwyl dit algemeen aanvaar word dat dit die raad se funksie is om beleid te bepaal en dit die amptenare se funksie is om die uitvoering aan die gestelde beleid te gee, word daar ook aanvaar dat daar in die praktyk, 'n mate van interfase tussen hierdie twee funksies bestaan. Dit word voorts aanvaar dat terwyl daar 'n duidelike onderskeid tussen die onderskeie rolle van raadslid en amptenaar is, dit moontlik is dat daar 'n mate van wanbegrip van hul onderskeie rolle bestaan. Die doel van hierdie studie was om te bepaal of raadslede en amptenare wanbegrip van hul onderskeie rolle in die besluitnemingsproses van die munisipaliteit ervaar en of sodanige wanbegrip 'n negatiewe impak op dienslewering het. Om as basis vir die studieveld te dien is algemene besluitneming eerstens bestudeer, gevolg deur 'n studie van besluitneming in plaaslike regering. 'n Ontleding van Oostenberg munisipaliteit met spesifieke verwysing na sy besluitnemingsprosesse en makro-organisatoriese struktuur is daarna uitgevoer. 'n Vraelys met as respondente die topstruktuur van die raad sowel as die top bestuurstruktuur van die munisipaliteit was aangewend om te bepaal of daar 'n mate van wanbegrip van onderskeie rolle bestaan. Die studie het bevind dat die raadslid studiegroep 'n graad van wanbegrip van 30.56% ten opsigte van sy rol as raadslid in die besluitnemingsproses van die munisipaliteit toon, en in die geval van die top bestuurstruktuur, is 'n graad van wanbegrip van 29.86% aangetoon. Die studie het verder bevind dat die bepaalde graad van wanbegrip, negatief op dienslewering impakteer. Met inagneming van die voorafgaande is daar aanbeveel dat raadslede aan toepaslike opleiding blootgestel word, die akkommodering van die politieke party koukusse in die formele besluitnemingsprosesse van die munisipaliteit, sowel as die toepaslike opleiding van die lede van die top bestuurstruktuur van die munisipaliteit ten opsigte van hul rol in die besluitnemingsprosesse van die munisipaliteit. Daar is ook aanbeveel dat die lede van die top bestuurstruktuur van die munisipaliteit oor toepaslike akademiese kwalifikasies behoort te beskik.

Abstract:
The main objective of the study is to explore the accountability of the ward councillors through the application of the Batho Pele principles in Lukhanji Municipality. Accountability is regarded as the key aspect for any government in which it should be monitored and maintained. The main problem to be addressed by this study is the ways in which the ward councillors can improve accountability applying the Batho Pele principles. To address the research problem and to achieve the aims of this study, an empirical research was done by distributing self-administered questionnaires to the participants in Lukhanji Municipality. The research findings revealed that in Lukhanji Municipality poor accountability of the ward councillors in which it needs improvement. Another finding is that poor accountability is caused by the lack of understanding of the Batho Pele principles, lack of understanding of the accountability mechanisms and poor relations between the community and ward councillors. The research findings of the study pointed to the necessity to make a set of recommendations on improving accountability through the application of Batho Pele principles in Lukhanji Municipality.

Abstract:
In terms of section 152(1)(a) of the Constitution of the Republic of South Africa, 1996 local government should provide a democratic and accountable service to local communities. Therefore, elected representatives and municipal officials must be accountable for their actions. This study investigates the influence of public participation in enhancing the accountability of ward councillors in the Buffalo City Metropolitan Municipality (BCMM). For the purpose of the study, the hypothesis was formulated that accountability of ward councillors is hampered by improper public participation mechanisms in Buffalo City Metropolitan Municipality (BCMM). In order to achieve the goal of this study and to test the hypothesis, it was essential to review literature on the accountability of ward councillors and public participation in local government. Primary data was obtained by interviewing ward committees and ward councillors from Buffalo City Metropolitan Municipality. Interviews were conducted with ward councillors and ward committees in wards 13 and 14 of BCMM. The major findings of the study, inter alia, are that ward councillors give feedback to their constituencies. Ward committees are instrumental in encouraging members of the public to attending these meetings. The most popular forum for public participation is the Independent Development Planning (IDP). It was established that approachability, accessibility and visibility of both ward councillors and ward committees in the community enhance public participation. The study concludes with recommendations that will assist the BCMM to enhance the accountability of ward councillors through public participation.

This study was conducted at Intsika Yethu Local Municipality of Chris Hani District Municipality in the Eastern Cape Province, in the Republic of South Africa. The study has as its main thrust: The role of councillors in service delivery: The case of the Intsika Yethu Local Municipality of Chris Hani District Municipality. This municipality consists of 21 wards and 21 ward councillors. The Preamble to the Constitution of the Republic of South Africa, 1996, states that the injustices of the past have to be addressed and those who suffered for justice and freedom in the country should be honoured. The results of the 1994 national and 1995 local government elections marked a political breakthrough in South African politics. The new democratic and social reconstruction agenda necessitated the transformation of the legislative framework in various areas. The legislative prescriptions that underpin the operations and activities of municipal councillors in delivering public services to citizens and in ensuring the effective and efficient implementation of government policies are therefore crucial. In this study, the role of ward councillors in service delivery was interrogated and investigated to establish whether the Intsika Yethu Local Municipality community in Tsomo and Cofimvaba has benefited in accessing basic services. Furthermore, the study seeks to find ways through which the relationship between community and ward councillors could be managed to harmonise the relationship between them in order to improve service delivery in Intsika Yethu Local Municipality. In this regard, a legislative framework regulates and guides municipal councillors in performing their developmental duties to achieve local government developmental outcomes.

Abstract:
The aim of the study is to critically examine the leadership and accountability of ward councillors in South African municipalities: A case of Buffalo City Municipality. The theory of communicative action by Jürgen Habermas was used to interpret the manner in which ward councillors are expected to interact with the members of the community when performing their leadership and accountability roles. The study adopted a case study design that assisted in establishing what is required from ward councillors with regard to their leadership and accountability roles in local governance. Qualitative and quantitative data collection instruments were used to collect data. The focus group interviews with ward committee members (n=100) from twenty-five (25) wards identified themes that relate to leadership and accountability constructs. The identified themes were verified in the quantitative phase in which questionnaires were administered to fifty (50) ward councillors. The qualitative data was analysed thematically using NVivo and quantitative data was analysed using MS Excel. Generally, the views of the ward councillors regarding their leadership and accountability were positive. However, their leadership and accountability were largely dependent on their individualised communication skills and emotional intelligence. Hence the study established that unless ward councillors are equipped with skills and knowledge in communication and emotional intelligence respectively, their leadership and accountability roles will not be able to contribute effectively to local governance. Subsequently, the study made a set of recommendations in this regard.

A dissertation submitted to the Faculty of Commerce, Administration and Law in fulfillment of the requirements for the Degree of Master of Public Administration in the Department Public Administration at the University of Zululand, 2018.<br>The South Africa government and various interested parties have extensively debated the relevance and place of traditional leadership in our democracy. The core of the debate is the notion of incompatibility of this institution with democracy and human rights. The 1996 Constitution of the Republic of South Africa set the tone for the recognition of traditional leaders in a democratic dispensation. The study assessed the role of traditional leaders and ward councillors in promoting community development in uMlalazi Municipality. The aim was to identify the limitations in community development programmes and how much does traditional leaders observe government regulations in service delivery and the impact that it has created. Questionnaires were administered to a sample of 82 participants, but only 72 questionnaires were returned. The research participants were businesses, churches, ward committee members, ward councilors, traditional leaders, and community members. Both quantitative and qualitative research methods were used to analyse the data. The study revealed the challenges facing communities regarding development. It also became apparent that the South African Constitution does not clearly define the roles and responsibilities traditional leaders should play in society. Possible solutions were identified in a form of recommendations, that in the implementation of the Integrated Development Planning programmes they should consider Batho Pele principles.

The transition of local government from the previous model that existed under apartheid to an inclusive democratic and developmental model, ushered in huge challenges. The transformational agenda for local government that was conceived by the new democratic government, introduced new key performance areas which included infrastructural development of previously neglected residential areas, service delivery to all, accountability and transparency in local government financial management, good governance and capacitation of those assigned to champion these issues. Councillors, being one of the most important stakeholders in local government, had to allow for additional responsibilities in the advancement of the transformational agenda of local government. As provocateurs of good governance which is indispensable for the successful developmental transformation of society, they are required to meet certain standards. This research investigates the factors that may negatively impact on good governance in the NMBM. Firstly, it examines conditions that undermine the development of a culture of good governance within its geographical confines. Secondly, it investigates the suitability and preparedness of councilors on a number of terrains. The research was conducted in the light of the public debate concerning the caliber of councilors in the NMBM while adding value to the academic discourse on this emotive issue. This is achieved by employing a qualitative research approach using a questionnaire and interviews with a specific target population.

Abstract:
According to the Constitution of the Republic of South Africa, Act 108 of 1996, Local Government is the closest sphere of government to the people and thus regarded as the service delivery mechanism of government. In the same context municipal councils are accorded a legal status and authority of a deliberative legislative body. This is considered critical for the municipal council to establish appropriate structures, processes and systems for effective oversight, particularly, oversight of budget execution and administrative processes. However, indications are that, the current legal and institutional measures need to be strengthened to enable municipal council to exercise oversight of the budget execution. In this study, the researcher conducted extensive literature on the roles and responsibilities of Councillors as prescribed in the Local Government: Municipal Systems Act and Municipal Structures Act respectively. An extensive review of the relevant local government legal provisions highlighted the authority of the municipal council, internal rules, reporting processes, council committees and the research capacity, as key aspects of the institutional measures required for oversight of budget execution. Equally, the review accentuated the ability and willingness of non-executive Councillors to exercise oversight in the affairs of the Municipality. A total of 20 research sample was selected for this research. Research participants were given research questionnaires for them to complete. This was completed and returned to the researcher for analysis. Key findings of the research was that, the municipal council must use its legal authority to reinforce mechanisms for effective oversight of budget execution. In addition, the municipal council needs to provide an enabling leadership and governance environment that encourages and support non-executive Councillors to actively engage in oversight processes and activities of the municipality. Further to the findings of this research, it was strongly recommended the further research in order to unearth the mechanisms that can further enable the Councillors to ensure optimum utilisation of resources.

The Constitution of South Africa, 1996, requires local government to be democratic and accountable to local communities. Municipalities are also constitutionally bound to encourage the involvement of the communities in the affairs of local government. Section 152 of the Constitution of South Africa, 1996, sets out the rights of communities to be involved in the affairs of local government.Participation is not only about communicating information and addressing the needs of the community. Participation is also about building partnerships with the community, being accountable to the community, allowing the community to take part in policy decisions, capacitating the community to understand their rights and obligations as citizens, and allowing the community to participate actively in social, political and economic affairs. Local government as a sphere of government closest to the peopleplays a critical role in advancing the participation of the community. Chapter 4 of the Municipal Structures Act of 1998 requires that municipalities should establish ward committees in order to enhance participatory democracy. Ward committees were therefore established, as community structures, to play a role in advocating needs, aspirations, potentials and problems of the community. However, studies appear to be critical on the functionality of ward committees and argue that most ward committees are not functioning as intended. The purpose of the study is to establish whether MatlosanaLocal Municipality has created the environment for active participation through the ward committee system in order to enhance participatory democracy. Thestudy further investigates whether the ward committees are functioning as intended and according to what the law requires. The researcher used a qualitative method to determine how Matlosana Local Municipality uses the ward committee system to enhance participatory democracy. The investigation revealed a number of challenges facing the ward committees which hinder their effectiveness. However, recommendations are recommended to assist the management of the municipality in making the system more effective.<br>Thesis (M. Abstract:
The purpose of this study was to investigate the empowerment needs of councillors in a municipality. The main focus was to assess the successes or inadequacies of the empowerment programmes previously offered to councillors by the King Sabata Dalindyebo Local Municipality. In order to achieve the research objectives an in-depth literature study was undertaken. A survey was also conducted to examine the level of empowerment being offered by the King Sabata Dalindyebo Local Municipality to its councillors and the data was collected by means of self-administered questionnaires. The literature study proved the hypothesis to be correct, which stated that empowered councillors could enhance effective public participation, effective communication which could result in effective service delivery. The empirical study revealed that certain councillors require adequate training in areas such as communication skills, council’s rules of procedures and new developmental mandate assigned to local government. The empirical survey also revealed that there is limited mutual trust between councillors and the senior officials, immediate intervention is required to restore trust between councillors and officials. It has been recommended that King Sabata Dalindyebo Local Municipality should not only provide regular “in house” training, but also training conducted by outside agencies is required. In certain instances, one may find that municipalities may not have fully capacitated persons for “in house” training. Thus, outside agencies which possess the relevant expertise such as universities and SALGA should be encouraged to also facilitate capacity training for councillors.

This study was researched at Mnquma Local Municipality of Amathole District Municipality in Eastern Cape Province, in the Republic of South Africa. The study is about: The assessment of relationship between the traditional leaders and ward Councillors and its impact on service delivery: A case of Mnquma Local Municipality. This municipality consists of 61 wards and 41 ward Councillors. The purpose of this study was to investigate what causes tensions in the relationship between traditional leaders and ward Councillors and also how can it be managed and or be improved as it affects production in service delivery and development. Furthermore, the study seeks to find ways through which the relationship between traditional leaders and ward Councillors could be managed to harmonize the relationship between them in order to improve service delivery in Mnquma Local Municipality. Most municipalities which are based in rural areas in South Africa are faced with a lot of challenges which has left development staggering and thus in long run inefficiency in service delivery is caused. As a result of poor service delivery Mnquma Municipality is faced with the challenge of instability towards its management, whereby several Mayors have been chased away through protests, as result service delivery has been hampered and delayed. These challenges are the results of the poor relationship between traditional leaders and ward Councillors over land ownership, control and authority of resources for development. The legislations that govern traditional leaders are ambiguous or rather vague when it comes to their roles and functions in development and service delivery in the new democratic government of South Africa and thus cause the traditional leaders to feel that they are undermined by the ward Councillors whom according to traditional leaders feel they that ward Councillors are more recognized than them. It is in this context that this study seeks to investigate the causes of conflict between the traditional leaders and ward Councillors and how the conflict impacts on service delivery and development and also can it resolved to harmonize the situation. The researcher used a qualitative method to collect data, the questionnaires and interviews were conducted to Municipalities, Traditional Leaders, Municipal Managers, Ward Councillors, Ward Committees and the community. Data was collected and analysed using descriptive method. The researcher came out with the following summary of the findings: The management of relationship between traditional leaders and ward Councillors over ownership of projects, control, land distribution and authority is very poor. Traditional leaders felt that the present democratic government has given too much power to the ward Councillors for most development programs. There is no absolute proper consultation of traditional leaders by neither local government officials, municipalities and ward Councillors before any development is done in their areas. Poor recognition of traditional leaders by ward Councillors and other politicians. There is allegation by the community members and traditional leaders that ward Councillors are bias in delivering services, preference is given to the group that belongs to their party of interest. When there is development projects employment opportunity is not given to the local communities of that area. Traditional leaders are not allowed to actively participate in council meetings.

The aim of the study was to assess the impact of traditional leaders and ward councillors‟ roles on service delivery in Mnquma Local Municipality. Not much research has been conducted in this field. The researcher wanted to ascertain the extent of conflict between traditional leaders and ward councillors in providing services to the communities and provide mechanisms to harness these. In this study relevant literature and legislative frameworks were reviewed. From the literature review, it was evident that service delivery is essential to the communities, and as such, municipalities have a critical role to play. The data collection instruments used, were questionnaires and interviews. In order to achieve the objectives, questionnaires were distributed to the participants and interviews were conducted. After analysing the data, the researcher formulated conclusions and from those conclusions, some recommendations were made.

A pesquisa que dá lugar a presente tese de doutorado tem como seu objeto de estudo a carreira política dos vereadores paulistanos eleitos para seis legislaturas que compreendendo o período que vai da eleição de 1982 até a de 2004. A hipótese principal é de que a Câmara Municipal de São Paulo (CMSP), a maior do país em Magnitude (55), caracteriza-se como sendo um incentivo político para a vida política daqueles que em sua maioria procuram progredir em direção a outros cargos públicos, mas precisam do capital político necessário para tornar tal empreendimento viável. Tal incentivo, embora não seja uma exclusividade da câmara paulistana, encontra-se nas poucas edilidades de maior Magnitude. Paradoxalmente, esta mesma instituição, que tem o condão de recrutar os candidatos que irão assumir diferentes postos na administração pública brasileira, depara-se com enorme dificuldade para estimular uma carreira que se faça no próprio município, o qual lida com significativo orçamento público, elevado quadro de funcionários, conta com importantes empresas públicas e privadas, gera muitas riquezas para o próprio Brasil, atrai recursos humanos de diferentes quadrantes do Brasil e do mundo, entre tantos outros fatos de grande relevância.<br>The subject of the present research is the political career of the São Paulo councilors elected along six terms, from 1982 till elections of 2004. The main hypothesis is that as the largest City Council of Brazil, with magnitude of 55 seats, the municipal legislative branch is eventually an important incentive to those whom want to go ahead in the political career, as getting an incumbency of state legislative, federal representative or in the executive branch. Besides, São Paulo municipality is the richest of Brazil local governments, its public budget is around R$ 15 billions (2004), and its councilors are able to pass bills of several different important matters. Paradoxically, the City Council is not being a sufficient incentive to develop a permanent career, once the most councilors have only one term (although law affords they can run for office any time they want) or run for state and federal levels.

(Public and Development Management))--University of the Witwatersrand, Faculty of Commerce, Law and Management, Graduate School of Public and Development Management, 2014.<br>This paper investigates the challenges facing female councillors in Ekurhuleni Metropolitan Municipality. It is based on the assumption that female councillors are still faced with numerous challenges despite all efforts to address that problem. The factors that discourage participation of women in politics are classified as ideological factors, political factors, socio-cultural factors, economic factors and media. It becomes very important for Ekurhuleni Metropolitan Municipality to understand that these challenges exist so that proper and relevant interventions may be developed, to assist in addressing those challenges. Gender mainstreaming is discussed, which explains a variety of tools and instruments used at international, regional and local levels. These tools are meant to address gender equality: Millennium Development Goals (MDGs), Elimination of All Forms of Discrimination against Women (CEDAW), Beijing Declaration and Platform for Action (BPA), Constitution of the Republic of South Africa, Municipal Structural Act and Municipal Systems Act. A qualitative study was used to respond to the research questions that focused on challenges faced by female councillors, support structures available for female councillors and the effectiveness of these support structures. The focus is on feminist social research. The assumption is that men and women have different perceptions of life because of their social status. The findings of the research are that society is still divided along gender roles. Women are considered as the main care givers for the family. Women are not part of political inner circles, where major political decisions are taken, including deployment to key and strategic positions. Socially, women are still facing challenges of low education levels that result in a lack of communication skills, which in turn hampers their ability to lead effectively. In terms of economy, most women are in low income paying jobs. This makes it difficult for women to campaign for strategic decision-making positions, as campaigning involves the use of money. Women leaders are also not using media effectively to market themselves. iii There is laxity in terms of implementation of gender equity policies. Support structures and system exist solely on paper. There is no proper assessment to check if systems implemented to support women are effective and relevant.

MPM<br>Oliver Tambo Institute of Governance and Policy Studies<br>The aim of the study investigates the significance of Auditor General in the control of public funds in local government with specific reference to Mopani District Municipality in order to make recommendations that can assist in improving the control of public funds. The research identifies and assesses weaknesses in how Mopani District Municipality has been controlling its public funds by analyzing the Auditor General reports for the past three financial years and its implications to service delivery. The research further assesses the role played by Auditor General in influencing the internal financial control of the municipality and in auditing the performance of the municipality since in other municipalities money is paid to contractors for services not rendered. The study provides academic input into public administration, specifically in the area of improving service delivery performance, control and financial performance management in municipalities. The study could contribute to the establishment of effective ways of monitoring the control of public funds by municipalities.<br>NRF

Abstract:
The theoretical part of this presented text specifies circumstances of social exclusion of caring families and the system of supportive measures in the Czech republic that should prevent the above mentioned social event. In compliance with the title of the work there has been a goal set: to identify the risks causing social exclusion of families caring for children with a disability.. To get the most complex view of the said problems the author undertook a partial inquiry by both social workers, by whom she was assessing the limits of their knowledge and skill potential, and by political representatives of municipalities, by whom she concentrated on the causes of limited application of municipal policy determining social exclusion of families caring for children with a disability. The above mentioned goal of this research was carried out by means of sociological qualitative and quantitative methods. The investigator was at the same time interested in how the caring families themselves used the means of civilian participation relating to improvement of their life situation.
