Étudier « Le couple pénal : coupable / victime » c'est étudier une union et un duel. Un couple suppose la réunion de ses deux agents. Le tout est de savoir comment les protagonistes vont se réunir ? Dans quelles circonstances ? Et selon quel scénario ? Les questions se multiplient mais ce qui est certain c'est que ce n'est pas le hasard qui dicte toujours la victimisation. Victime latente, victime prédisposée, victime désignée, victime idéale, victime déterminée ou encore victime sociale, toutes sont convoquées par l'agresseur. Il reste cependant à comprendre le choix de la victime. Celle-ci peut-être porteuse d'un trait caractéristique innée ou encore d'une étiquette imposée par son parcours social. Dans les deux cas la victime apparait comme une cible désignée, désignée par le groupe auquel elle appartient à un groupe vulnérable, par la nature même de ses sujets. Dans d'autres cas, la victime est initialement non déterminée. C'est elle qui attire le coupable vers elle, créant ainsi une certaine interaction entre les deux agents. Et c'est d'ailleurs, cette interaction qui concrétise au mieux la définition du couple pénal. En effet, un couple est amené à échanger. Lors de cet échange apparait nettement le rôle de la victime. Victime et coupable représentent une dualité difficile à dissocier. L'interaction entre eux peut trouver sa base dans une relation entre les deux. Cette relation favorise la compréhension du pourquoi de certaines infractions. Et c'est pour cette raison qu'elle a été retenue par le législateur pour dicter des infractions spéciales avec une qualification juridique indépendante en raison de cette relation (infanticide, inceste, parricide, harcèlement). L'interaction entre les deux protagonistes peut trouver sa base dans le comportement de la victime face au coupable. Dans ce sens, la victime n'est pas tout simplement un sujet prédisposé, elle va s'avérer réactive, collaboratrice même. Parler de la collaboration, de la culpabilité, de la responsabilité de la victime peut prêter à équivoque. Comment peut-on accepter de tels adjectifs qualificatifs pour un agent censé être la partie qui subit le mal ? Cette terminologie parait choquante mais son apport ne fait pas le moindre doute. C'est la pièce maitresse même de toute la discipline de la victimologie. Le tout est donc de la comprendre dans son vrai contexte pour éviter tout détournement. Face à ce qui vient d'être relevé, on retient un coupable qui se présente comme l'agent actif qui commet le tort et une victime qui s'avère être l'agent passif qui le subit. Le rythme entre les deux sujets s'accélère jusqu'à ce que le mal soit fait. L'infraction étant consommée, le rythme entre les deux diminue. L'existence du couple pénal continue cependant à s'inscrire dans le temps. Le coupable découvert ne jouit plus de son rôle actif. Les rôles s'inversent alors. Après que le mal soit fait, les regards se tournent vers la victime. Que va-t-elle faire ? La victime n'est plus uniquement la personne qui subit, mais la personne qui se venge. Au fond, la victimisation est loin d'être une phase facile dans la vie de la victime. C'est une expérience effrayante et déstabilisante. Elle n'est pas un événement fugace. C'est un processus qui s'étend dans le temps. D'abord, la victime doit faire un pas en avant et apprendre à dénoncer. Puis sa victimisation ne doit pas être une condamnation à perpétuité. Elle doit réclamer ses droits. Cette revendication expresse des victimes est une revendication de dignité, de considération et d'honneur. Le procès pénal apparaît à ses yeux comme producteur de vérité. C'est le moment tant attendu pour exprimer sa souffrance et sa douleur. C'est par excellence une scène de justice pour apaiser la victime. C'est aussi une scène de conciliation permettant de "négocier" la justice afin d'apaiser le couple pénal. On entre alors dans la démarche de la justice restauratrice permettant le coupable de prendre conscience de la répercussion de son acte<br>To study " The penal couple: culprit / victim " it is to study an union and a duel. The questions multiply but what is certain that it is not the coincidence that always dictates the victimization. Latent victim, amenable victim, indicated victim, ideal victim, determined victim or social victim, all are convened by the aggressor. However, It remains to understand the choice of the victim. This one can be carrier innate characteristic or still a label imposed by its social course. In both cases the victim appears as a designated target , designated by the group to who she belongs to a vulnerable group, by the nature of her subjects. In other cases, the victim is initially not determined. It is her who attracts the culprit towards her, so creating a certain interaction between both agents. And it is moreover, this interaction which concretizes at best the definition of the penal couple. Indeed, a couple is brought to exchange. During this exchange appears clearly the role of the victim. Victim and culprit represent a duality difficult to separate. The interaction between them can find its basis in a relation between both. This relation favors the understanding of why of certain offenses. And this is why it was held by the legislator to dictate special offenses with an independent legal qualification because of this relation (infanticide, incest, parricide, harassment). The interaction between both protagonists can find its basis in the behavior of the victim in front of culprit. In this sense, the victim is not simply an amenable subject, she is going to turn out reactive, collaborator. To talk about the collaboration, about the guilt, about the responsibility of the victim can be ambiguous. How can we accept such adjectives for a supposed agent to be the part which undergoes the evil? This terminology countered shocking but its contribution does not make the slightest doubt. It is the major component of all the discipline of the victimology. Thus the whole is to understand her in its real context to avoid any diversion. In the face of what has been raised, we hold a culprit who appears as the active agent who commits the wrong and the victim who turns out to be the passive agent who undergoes him. The rhythm between both subjects accelerates until the evil is made. The offense being consumed, the rhythm between both decreases. The existence of the penal couple keeps however joining in time. The guilty overdraft does not enjoy anymore its active role. The roles are then reversed. After the evil is made, the looks turn to the victim. What is she going to make? The victim is more only the person who undergoes, but the person who takes revenge. At the bottom, the victimization is far from being an easy phase in the life of the victim. It is a terrible and destabilizing experience. It is not a fleeting event. It is the process which extends in time. At first, the victim has to make a step forward and learn to denounce. Then his victimization should not be a life sentence. She has to demand her rights. This express claiming of the victims is a claiming of dignity, consideration and honor. The penal trial appears for him as producer of the truth. It is the long-awaited moment to express its suffering and its pain. It is archetypal a scene of justice to calm the victim. It is also a scene of conciliation allowing "to negotiate" the justice to calm the penal couple. We enter then the approach of the justice restaurant owner allowing the culprit to become aware of the repercussion of its act in the life of the victim and to try to repair the caused evil. This emotional restoration including excuses establishes a very important compensation in the eyes of the victim. She can forgive and hope by this gesture to arrive at the forgetting

Pour passer de l'état amoureux à l'engagement amoureux, de la passion à un couple psychique, les partenaires vont constituer un lien spécifique, le lien conjugal. Ce lien crée un écart entre les conjoints, écart nécessaire pour être en lien et exister comme individus. Plus le désir fusionnel est à l'œuvre, plus l'écart pend une forme concrète, absence de relations sexuelles, somatisations, violence, tiers réel. Le symptôme de couple, création du couple, vient en lieu et place de l'intériorisation du tiers. Le lien organise des collusions défensives, points de fixations en écho de l'histoire prégénital des conjoints. Le retour du refoulé débouche sur la constitution de symptômes et sur la crise. Le travail psychique accompli pour dépasser les crises élabore les collusions. Les conjoints l'un par l'autre, l'un avec l'autre dénouent peu à peu ce qui s'y était condensé. Cette élaboration ouvre soit sur la dissolution du lien soit sur son renforcement, elle permet à chaque conjoint l'intégration progressive d'éléments en attente de symbolisation organisés jusque là dans la collusion. Dans ces conditions le travail psychique accompli par le couple peut être pensé comme un organisateur/réorganisateur du psychisme. Il permet une réélaboration du deuil originaire et du deuil des parents œdipiens. Un cadre groupal suffisamment fiable, le niveau objectal et libidinalisé du lien soutiennent ces élaborations. La proposition de thérapie en couple aux partenaires en souffrance venant en consultation est celle d'un nouveau groupe permettant la reprise de la constitution du lien, de la différentiation à l'intérieur de la dyade et celle des projections de l'objet interne sur l'objet réel<br>For love as a feeling to become a form of commitment, for passion to turn into a psychic couple, members will byuild a specific link, the conjugal bond. This link creates a gap between the partners, such a gap being necessary for each of them to be connected, and to live as an individual. The greater the desire for fusion, the more concrete the gapbecomes, leading to no sexual intercourse, somatizations, violent behaviour, appearence of an outsider. Under such circumstances, the psychical work provided by the couple may be seen as organising or reorganising its psyche, and enabling the partners to work over again the original mourning and that of the oedipien parents. In order to achieve this work, the setting and the couple as supporting group agencies must be reliable and the link must be objectal and libidinal enough. Dual therapy offers consulting ailing partners to form such a supporting group agency. It enables the link to be created afresh, the workin out of the differentiation inside the dyad and the projections of the internal object upon the real objects

Two studies were conducted. Study 1 consisted of 63 stepfamily couples who were in a committed relationship (married or cohabiting) and who had earlier taken part in an intervention program. It was hypothesised that positive couple relationship outcomes could be predicted by low couple aggression, high couple negativity, low couple withdrawal, high parenting disagreement, and high dysfunctional parenting over a 5-year period. The results did not support the hypotheses possibly due to low power in the design. In Study 2, 122 stepfamily couples who been living together (married or cohabiting) as a stepfamily were assessed on couple and stepfamily factors, and these were tested for their association with couple relationship adjustment and stability, using both self-report questionnaires and interview data. As predicted, stepfamily factors accounted for variance in couple stability above that accounted for by couple factors. Furthermore, stepfamily factors were associated with couple stability independent of couple adjustment. The influence of stepfamily couple relationship adjustment and stability seem distinctive from first-marriage couples. It was concluded that stepfamily relationship education programs for stepfamilies should address the unique needs of stepfamilies such as parenting education for inexperienced stepparents, the development of positive stepparent-stepchild relationships, and the building of stepfamily cohesion.

<p> Integrative Behavioral Couple Therapy (IBCT), an empirically supported and evidence-based third-wave behavioral approach for treatment of couples, is examined in this multiple case study. Specifically, the qualitative experiences of therapists using IBCT in their work with intercultural couples are examined through each therapist’s typed responses to open-ended questions. Each participating therapist in this study contributes by describing one case in which IBCT was used to help the couple navigate cultural differences as part of treatment. This study describes the various stressors faced by intercultural couples, therapists’ formulations of cultural differences, change processes and change mechanisms during treatment, and similarities and differences across therapists’ reports. The study concludes with participating therapists’ recommendations for treatment of intercultural couples in general, and recommendations for utilizing IBCT with intercultural couples. Lastly, implications for future research are provided.</p>

The purpose of this study was to explore transgender couples? beliefs and experiences of couple and family therapy. This study utilized a secondary data set of interviews from seven transgender participants and three partners. A queer feminist framework guided this study. The results of this project indicate that participants believe couple and family therapy to be relevant to their lives and therapeutic needs of transgender couples and their families. However, participants expressed unfamiliarity with the field and uncertainty that couple and family therapists are equipped to provide affirmative care.

L'importance des interactions professionnelles dans la construction des identités professionnelles a été abondamment analysée par la sociologie du travail, qui leur accorde une prééminence épistémologique, occultant ainsi l'impact des dynamiques familiales et du genre. La recherche, menée à partir d'un corpus de récits de vie croisés de couples d'employé(e)s, ouvriers et professions intermédiaires, s'est attachée à cerner l'incidence de la vie conjugale et du genre sur l'identité et la trajectoire professionnelle de chaque conjoint. Une première partie analyse les modalités, délibérés ou implicites, selon lesquelles s'effectue la mise en commun du vécu professionnel au sein des couples. L'intimité, en particulier, suscite un mode d'interaction spécifique qui modèle l'identité et la trajectoire de chacun. La démarche théorique et méthodologique adoptée en deuxième partie s'attache à élaborer un modèle d'analyse du changement identitaire, intégrant la diversité des appartenances tant biographiques que simultanées. Enfin, la troisième partie synthétise le rôle du conjoint dans le processus de changement identitaire. A cet égard, deux grands modèles se dégagent. Dans une première configuration, l'espace professionnel joue un rôle moteur. Nous montrerons que les trajectoires professionnelles,même celles qui semblent les plus autonomes, nécessitent une négociation conjugale qui les valide voire les infléchit. Dans une deuxième configuration, l'interaction conjugale en pesant sur les ressources subjectives initie le changement identitaire. Le conjoint joue alors un rôle actif de soutien, allant de la simple confiance au management actif de la carrière, en passant par la valorisation des capacités du partenaire. Cependant, cette nouvelle définition de soi-même doit être reconnue au sein de l'espace professionnel pour devenir réalité. Le rôle spécifique joué par la relation conjugale, en terme de validation ou d'initiation du changement identitaire, la rend complémentaire des interactions professionnelles. Cette complémentarité permet de penser la double appartenance et l'enjeu que constitue la reconnaissance identitaire au sein de chacune des deux sphères professionnelles et familiales lors des phases de changement.

La consécration sur la scène juridique, en 1999, des modes de conjugalité alternatifs au mariage - le concubinage et le PACS-, a contribué à renouveler l'appréhension de la notion de couple, placée au coeur des préoccupations législatives. De plus en plus envisagé comme une notion unitaire, le couple est désormais compris dans une acception qui transcende les modes de conjugalité, au point que la réalité d'un droit commun du couple encouragé par le législateur est aujourd'hui tangible. Dans cette logique, on observe un rapprochement des processus de rupture résultant de l'extension de certaines règles protectrices du divorce aux ruptures du PACS et du concubinage. Dès lors, le développement d'un droit commun de la rupture du couple au détriment de la spécificité du divorce est-il inéluctable ? ou à l'inverse, la rupture est-elle encore le symbole des différences fondamentales entre les modes de conjugalité, en révélant ce qui est l'essence irréductible de chacun d'eux -et ceci, dans un contexte du droit de la conjugalité profondément renouvelé par l'appréhension nouvelle du mariage en tant qu'union ouverte aux personnes de même sexe ?Telle est l'alternative pour le législateur à qui il incombe de donner une nouvelle cohérence au droit de la conjugalité<br>The arising on the legal scene in 1999 of various types of union as alternatives to marriage (cohabitation and french civil partnership -PACS-) contributed to reconsider the very notion of couple as the core of legislative priorities. More and more understood as a unitarian concept, the couple is now included in an understanding that goes beyond the type of union, to the point where a common law of couples becomes a reality, promoted by the legislator. Doing so, the legal ways of ending a cohabition or a PACS are now obviously converging with the way of ending a marriage, thanks to the extension of protective laws that initially concerned only married couples.From here, must we consider inevitable the development of a common law of ending a couple, at the expense of the specificity of divorce ? Or, at the opposite, is the ending of a couple still the best representation of the fundamental differences between unions, revealing their very nature - moreover now that the laws of conjugality have been deeply reconsidered through the legalization of same sex marriage ?Such is the alternative for the legislator, who has now to give a brand new coherence to the laws of conjugality

<p> Although one-third of partners in couple therapy have experienced childhood abuse, our field has developed few specific interventions that address the lingering effects of child abuse on current couple dynamics. A common impact on adult survivors is the struggle to trust their intimate partner. Furthermore, asymmetrical gendered power processes often erode trust. Given the propensity for adult-survivor couples to experience a distrusting emotional culture, this dissertation studied the effect of gendered power dynamics on trust in partner interactions, as well as identified clinical processes of Socio-Emotional Relationship Therapy (SERT) that helped adult-survivor couples change power disparities to a mutually supportive and trusting emotional culture. </p><p> This dissertation includes two publishable papers. The first article articulates relational trust theory, which integrates feminist, social constructionist views with relational ethics. This theoretical conceptualization describes how the intermingling of gendered power interactions and adult-survivor power responses negatively impact emotional connection. The second article presents the results of a longitudinal grounded theory study of video and transcripts of 40 SERT sessions with four heterosexual adult-survivor couples. The findings from the research were applied to an additional four couples to refine the final grounded theory on how to work with the intersection of trust, gender, and power issues of adult-survivor couples. Three key themes on gendered power processes emerged: 1) gendered fear of being vulnerable, 2) unique gendered power approaches, and 3) distrustful reactions. The analysis identifies five key clinical processes to enhance trust: 1) recognize gendered power’s effects on relational safety, 2) comprehend the socio-emotional experience of partners, 3) accentuate relational needs, 4) initiate partners sharing power, and 5) identify trustworthiness of partners. The study also delineates components of relational vulnerability that augment trust. </p><p> The final dissertation chapter compares the findings from the grounded theory analysis to current CFT models with adult-survivor couples and discusses clinical implications for addressing the complex interplay of gender, power, and trust in partner interactions. A significant contribution of this dissertation is a better understanding of the link of trust with gender and power dynamics in adult-survivor intimate relationships and how to sensitively address relational processes interfering with trust.</p>

Gottman identified the phenomenon accepting influence in couple relationships, defining it as the action of letting one’s partner influence their opinions, as well as the approach of being open-minded towards one’s partner. In this study, we examine accepting influence among a dyadic sample of military couples (N=242 couples). We first replicate Gottman’s findings which link accepting influence to couple satisfaction, and then expand this area of research by examining how accepting influence within the couple relationship relates to family-level outcomes based on theoretical underpinnings from systems theory and the spillover hypothesis. To model relationships within and between partners, we utilize an actor-partner interdependence model. Results demonstrate that accepting influence is related to both couple and family satisfaction in military families, although these were primarily actor effects (i.e., perceptions of accepting influence were primarily associated with personal reports of couple and family satisfaction). Implications for practice and research will be discussed.

Le couple constitue dans notre société une structure favorisant la solidarité. Il trouve une expression sous trois modes de vie reconnus par la loi : le mariage, le Pacs, le concubinage. Tous trois sont ouverts sans condition de différence de sexe. La loi a construit un cadre juridique à cette solidarité (très organisé, impératif, où la volonté contractuelle qui a plus de place aujourd’hui est soumise au contrôle du juge) dans le mariage, puis dans le Pacs où a été laissé une place bien plus grande à la volonté contractuelle. Elle a abandonné à la jurisprudence le soin de remédier aux conséquences que l’absence de texte relatif au concubinage pouvait avoir dès lors que l’équité et la justice le commandaient. Lorsque la loi ne les a pas prévus, c’est la jurisprudence qui a construit les mécanismes juridiques justifiant l’existence d’une solidarité du couple. La solidarité relève donc bien de la nature même du couple. Il existe une unité à la vie de couple parce que celle-ci répond à des caractéristiques, à des nécessités, qui sont identiques quel que soit le mode de vie, qu’il y ait ou non différence de sexe dans le couple. Les différenciations auxquelles aboutit la reconnaissance de plusieurs modes de vie en couple apparaissent aujourd’hui de plus en plus inadéquates. It finds an expression under three lifestyles recognized by the law: the marriage, Pacs, the common-law marriage. All three are open without condition of difference in sex. The law built a legal framework with this solidarity (very organized, imperative, where the contractual will which has more room today is subjected to the control of the judge) in the marriage, then in Pacs where a place much larger was left with the contractual will. It gave up with jurisprudence the care to cure the consequences that the absence of relative text to the common-law marriage could have since equity and justice ordered it. When the law did not envisage them, it is the jurisprudence which built the legal mechanisms justifying the existence of solidarity of the couple. Solidarity thus concerns well the nature even of the couple. There exists a unit with the life of couple because this one answers characteristics, with needs, which are identical whatever the lifestyle, that there is or not difference in sex in the couple. Differentiations to which the recognition of several lifestyles in couple leads appear increasingly inadequate today. The recognition of the only one official shape of life in couple would constitute the means of erasing the differences in the implementation of solidarity and would thus make it possible to correct the negative effects related to solidarity of the couple. This legal framework would consist of a set of obligatory rules, essential with the life of couple, concerning as well the patrimonial extra interests as the patrimonial interests; a place would be left with the contractual organization of the life of couple. Traditional couple counseling research focused on why people end relationships, with research only recently addressing what factors contribute to relationship satisfaction and stability. Yet, throughout this research, minimal attention has been paid to the role of play in couple counseling. The research available on play in couple counseling had varied definitions of couple play and was not based on current couple counseling theory. The research and anecdotal data on couple play proposed a strong relationship between couple play and the factors that predict successful, long-term couple relationships, individual physical health and emotional health. This study applied current couple counseling theory and research to define couple play and the relationship between couple play and couple bonding, physical health and emotional health. The hypotheses of the study were couple play would predict couple bonding; couple play would predict individual physical health; and couple play would predict individual emotional health. The results from a sample of 30 couples demonstrated couple play predicted measures of couple bonding, including relationship satisfaction, communication, conflict resolution, and the couple's view of the relationship. Couple play demonstrated no relationship to individual physical or emotional health. Previous research has shown that both children and couples within stepfamilies have poorer outcomes than those in first marriage (intact) families and that couples within stepfamilies break-up at much higher rates than couples in first marriage families.

Le mariage, le pacte civil de solidarité et le concubinage apparaissent ainsi comme le reflet d’une conjugalité qui se veut plurielle, dont les effets sont progressifs mais qui est de plus en plus contrarié par l’unité de la notion de couple. D’ailleurs, les relations patrimoniales quotidiennes des époux, des partenaires pacsés et des concubins sont organisées autour des mêmes principes : un renforcement des collaborations économiques et des exigences de protection patrimoniale. Il peut alors être proposé d’introduire au Code civil, de lege ferenda, une définition unitaire de la notion de couple ainsi qu’un socle de règles applicables à tous les couples, sans égard pour leur mode de conjugalité. Les relations patrimoniales quotidiennes du couple seraient ainsi régies par des règles identiques conformément à l’unité de la notion de couple. Adults may acquire a hearing impairment through natural aging processes (presbycusis), exposure to loud noises, illnesses (e.g., Meniereâ s disease), and hereditary factors. Because hearing loss affects basic communication processes, couples often have to adjust their ways of interacting when one spouse develops a hearing loss. Extant literature presents relevant information about couple relationships in later life, individual adaptation to a hearing loss, and couple relationships where one spouse has a hearing loss. The current study was conducted to explore couple resilience processes.
The family resilience theoretical framework guided this study (Ganong & Coleman, 2002; Walsh, 1996), with an emphasis on meaning that couples give to their experiences. The interaction of belief systems was explored in connection with resilience processes and the development of couple relationships. Qualitative semi-structured interviews with couples was the main method of data collection. Couples were recruited through audiologists and through a snowball sampling method. At least one partner was 60 years of age or older. Audiograms were requested from audiologists, and couples completed a marital satisfaction scale.
Themes describing meaning and resilience processes emerged from interviews with eight couples in which one spouse was hearing-impaired.
Themes related to meaning included couplesâ acceptance of the hearing loss, and demonstrations of the beliefs and values regarding their loss such as optimism, humor, gratitude, and pleasure through hearing. Couples reported having confidence in their communication skills. They also said that models of resilience, assistive listening devices, and faith in God, helped them to adapt to hearing loss stressors. Couples demonstrated healthy spousal caregiving relationships during the interviews.
A focus group with marriage and family therapists (MFTs) was conducted to obtain clinical interpretations of the themes that emerged from the couple interviews. Cliniciansâ responses focused on couple relationship dynamics, possible clinical situations with these couples, and the therapist/client relationship.
Many couples facing the hearing impairment of one spouse are living resilient lives together. However, there are likely many that are struggling. Implications for audiologists and MFTs are shared. As professionals are informed about the often unspoken and unheard stories relating to hearing loss, they can then serve with greater knowledge, empathy, and hope.<br>Ph. D.

Les procédures méthodologiques utilisées conduisent vers une étude qualitative et quantitative pour atteindre nos objectifs et vérifier nos hypothèses. Les instruments utilisés étaient l'entretien semi-directif et le questionnaire. Les entretiens ont été soumis à deux types d'analyses : de contenu -thématique et séquentiel-, et lexicographique à l'aide de l'Alceste ; pour le questionnaire, le processus statistique SPSS. L'interprétation de nos résultats s'est faite en fonction de trois dimensions d'analyses : l'idéal, le vécu et le réel idéalisé. Ces personnes font alors l'expérience du handicap moteur. Cette expérience déstabilisante ne peut être réduite à sa seule dimension corporelle. Elle implique, pour l'individu, de devoir composer avec une prise en charge institutionnelle (à l'hôpital, puis dans un centre ou une unité de rééducation et de réadaptation, pendant plusieurs mois, voire années), de reformuler son existence, ainsi que de reconstruire sa relation conjugale. Most couples eagerly anticipate the birth of their first child. However, the transition to parenthood is also associated with significant lifestyle changes and approximately 50% of couples report a moderate to severe decline in relationship satisfaction and quality. Low relationship satisfaction is associated with increased couple conflict, individual psychological distress, negative parent-child relationships and poor child outcomes. Despite our increasing knowledge of the factors that predict enhanced couple adjustment, few evidence-based programs are available to assist couples' adjustment to parenthood. In this first randomized controlled trial evaluating the effectiveness of a flexible delivery psycho-education program, entitled 'Couple CARE for Parents', 71 pregnant couples were assessed on self-report and observational measures of couple relationship and individual functioning and then randomized into either the Couple CARE for Parents program (n = 35) or a comparison program (n = 36). Couple CARE for Parents was a six unit program, comprising of an antenatal workshop, two home visits and three telephone support calls, and included skill-training in key relationship processes that are predictive of couple relationship quality, with the addition of parenting and baby care information. Among intervention couples the typical decline in female relationship satisfaction was prevented, with only 13% of intervention females reporting a decline in relationship satisfaction from pregnancy to 5 months postpartum, compared to 42% of females in the comparison program. Observed couple communication also improved as a result of the intervention, with Couple CARE for Parents couples showing reliably lower rates of negative speaker and listener skills at post-intervention relative to comparison couples. Couples were highly engaged in Couple CARE for Parents and there was a low drop out rate across the 7 month intervention period. These findings are promising and add to the early intervention studies showing positive effects of couple-focused psycho-education during the transition to parenthood by demonstrating that flexible delivery programs are feasible and attractive to couples. Providing cost-effective couple relationship education to expectant and new parent couples opens another window of opportunity for health professionals and governments to minimize the rates of relationship distress and divorce and their associated negative effects on individual, couple and family functioning.

Over the years, many interventions have been used to ameliorate couple distress and increase relationship satisfaction. These interventions have been getting shorter in duration. The purpose of this pilot study was to test the feasibility and impact of a brief intervention using a solution-focused approach (SFBT) for couples. The brief intervention included two two-hour consultations. Data were collected from 30 couples and were analyzed using a repeated measures design. The analyses yielded mixed results. There were statistically significant improvements in the areas of individual well-being and relationship knowledge. There were no significant differences in terms of marital satisfaction, communication skills, and readiness to change, although positive trends were observed in this pilot phase. Implications for future research and development are discussed.

Pour autant, la specificite du droit social ne doit pas etre exageree. Il n'existe pas de modele economique du couple et le modele du mariage demeure la reference. La veritable difference entre le droit social et le droit civil, relativement a la notion de couple, se manifeste au travers de l'etude des relations entre les membres du couple. Alors que le droit civil a constamment evolue vers une plus grande autonomie des individus, le droit social reste attache a une veritable interdependance des membres du couple comme en temoignent l'importance essentielle que les droits derives gardent dans notre systeme de protection sociale. The real difference between social and civil law about what a couple is appears through the study of relationships between the members of a couple. While civil law has steadily evoluated in the sense of a greater autonomy of individuals, social law stands for an interdependance of couple members as shown by the substantial part played by derived rights in social protection. La première approche, d'inspiration structurale, vise à dégager les éléments constitutifs de la figure et son scénario permanent. L’analyse conduite sur la base de cette approche confirme l'existence de deux matrices, l'une fondée sur le couple Macbeth, l'autre sur le couple de libertins des Liaisons dangereuses. La seconde approche, qui relève d'une démarche herméneutique, met en évidence le substrat biblique de la figure du couple machiavélique dans sa version shakespearienne, qui serait une réécriture du récit de la Chute de la Genèse. La version laclosienne du couple machiavélique serait pour sa part le marqueur de la dégradation des relations amoureuses dans leur conception post-courtoise. Enfin, la troisième approche est esthétique: elle vise à étudier la construction de la figure, son effet sur le lecteur, et sa valeur ajoutée par rapport à la figure canonique du Méchant. This approach confirms the existence of two matrix, one based on the couple of Macbeth and the other on the pair of libertines of Laclos’ novel Les Liaisons dangereuses. The second approach is interpretative and underlines the biblical basis of the figure of the Machiavellian couple in its Shakespearean version, which is a rewriting of the Fall of Adam and Eve while the couple of Laclos signals the deterioration of romantic relationships in a courtly meaning. The third approach deals with aesthetics and aims at studying the forms and poetics of the figure and its effect on the reader as well as its added value in relation to the “Canon figure” of the Villain. Mais étant donné que tous ces montages peuvent être risqués s’ils ne sont pas correctement réalisés, il nous paraît essentiel de savoir comment réaliser le juste montage, qui ne sera pas susceptible d’être sanctionné par la justice. C’est pourquoi la problématique de ce travail consiste à démontrer comment parvenir à une optimisation maximale du patrimoine immobilier du couple par l’intermédiaire d’une SCI. Nous allons voir qu’il est possible de proposer une solution non seulement optimale, mais sécurisée et pérenne.Pour y parvenir, il conviendra de s’assurer que la protection du couple ne contrevient pas à celle des tiers non associés. Ainsi, divers éléments devront être intégrés dans le schéma du stratège. Certains consisteront à connaitre les objectifs licites, ou non, et les montages qui peuvent être réalisés à travers une SCI. We will see that many companies and techniques can be combined with the SCI in a patrimonial optimization. But, considering that all these legal arrangements may be risky if they were not correctly realized, it seems essential to know how to realize the right setting, which will not be sanctioned in front of a court. Therefore the issue of this work will be to demonstrate how to achieve a maximum optimization of the couple’s housing wealth through an SCI. We will see, indeed, that it is possible to propose a solution not only optimal, but also secure and perennial.To achieve this, it will be necessary to ensure that the legal protection of the couple does not infringe the legal protection of non-related third. Thus, various elements will have to be integrated into the strategist’s scheme. Some of them will consist in knowing the licit purposes, or not, and the clever legal arrangement which can be realized through a real estate civil company. Others will serve to a defense in court, when for example a company, although lawful, is questioned. L’influence libérale en droit de la famille et l’essor de l’idéologie individualiste ont provoqué un pluralisme des formes de conjugalité et ont considérablement accru la diversité des règles et des méthodes applicables aux couples en droit international privé contemporain.L’analyse des couples en droit international privé nous a alors conduit à repenser le droit international privé du couple. La déconstruction de la matière met en lumière l’inadaptation actuelle de la méthode conflictuelle classique et l’insuffisance de la méthode de la reconnaissance. En effet, l’actuel droit international privé du couple ne permet pas de garantir la continuité internationale du lien conjugal, pas plus qu’elle ne permet d’assurer un traitement juridique cohérent des problèmes auxquels sont confrontés les couples internationaux. Une réflexion quant à une possible évolution méthodologique de la matière était donc nécessaire. Cette étude vise à démontrer qu’une adaptation de la méthode conflictuelle classique à l’aune des objectifs de la méthode de la reconnaissance et fondée sur un raisonnement en termes de conflit d’autorités est possible. Elle apporterait aux règles de droit international privé du couple une meilleure cohérence tout en assurant aux rapports conjugaux internationaux une réelle stabilité<br>The liberal influence in Family Law and the rise of individualist ideology have led to a multiplication of conjugal life forms and considerably increased the diversity of laws and methods applicable to couples in International Private Law. To analyse couples under International Private Law leads us to rethink the International Private Law of the Couple. Deconstructing this subject brings to light the current non-adaptation of the classic conflict of laws method and the insufficiency of the recognition approach. In fact, current International Private Law as it pertains to couples neither guarantees the international recognition of theconjugal bond nor ensures a coherent legal treatment of legal problems faced by international couples. It is therefore necessary to examine a possible methodological evolution of thesubject. This study aims to demonstrate that it is possible to adapt the classic conflict of lawsmethod by taking into account the objectives of the recognition approach whilst founding iton the lex auctoritas rule. This would not only bring better coherence to International Private Law of the Couple but it would also assure a real legal stability for international conjugal relationships

La modélisation de l'usinage doit actuellement être réalisée en considérant des méthodologies permettant de lier le Couple Outil Matière (COM) et le système Pièce Outil Machine (POM). Ces méthodologies sont basées sur des modèles physiques, et sur des résultats expérimentaux. Dans ce contexte les paramètres limites du COM en tournage conventionnel, en tournage dur et aussi lors de la coupe aux chocs sont étudiés. Une méthodologie pour déterminer la plage de la vitesse de coupe est établie. L'étude de l'influence de la vitesse de coupe sur les paramètres du COM a montré l'importance du phénomène de fissuration du copeau. La durée de vie est importante pour déterminer des coûts d'usinage. Il est très difficile d'établir une loi robuste. Il est absolument nécessaire de passer par l'expérience. Néanmoins, des valeurs moyennes des exposants de la loi d'usure (Taylor) peuvent utilisés une première approximation basé sur ces études expérimentales, les données nécessaires au métier de l'usineur sont analysées pour établir une méthodologie globale de construction d'un modèle d'information. L'étude est divisée en deux niveaux : le niveau des données basé sur la norme STEP, et le niveau sémantique basé sur les ontologies et PSL. Les grands standards internationaux sont considérés pour proposer une démarche consensuelle<br>The Machining modelling must be at present realized by considering methodologies allowmg to lmk the Couple Workpiece Tool (CWT) and the Machine-Tool-Workpiece (MTW) system. These methodologies are based on physical models, and on experimental results. In this context the CWT limit parameters COM in conventional turning, in hard bad turnind and also during sbock cutting are studied. A methodology to determine the cutting speed range is established. The tudy of the influence of the cutting speed on the CWT parameters showed the importance of the cbip fissuring phenomenon. The tool life time is important for determining manufacturing cost. It is very difficult to establish a robust law. It iS absolutely necessary to realize some experiments. Nevertheless, mean values of the Taylor's wear law exponents can be used in first estimation. Based on these experimental studies, the data necessary for manufacturers are analyzed to estahlish a global methodology for the construction of an information model. The study is divided into two levels: the data level based on the STEP standard, and the semantic level based on ontologies and PSL. Le contexte de la rupture du couple, qu’il soit marié, uni par un pacte civil de solidarité, fiancé ou en concubinage, est un moment propice à la lésion des intérêts de ses membres. La question de la réparation des préjudices subis surgit alors, et la tentation est grande d’en imputer la responsabilité à l’autre membre du couple, surtout s’il est à l’origine de la rupture. Le droit commun de la responsabilité civile délictuelle, fondé sur l’article 1382 du Code civil, est une voie empruntable par chacun pour obtenir réparation ; demeurait la question de son adaptation à la matière. L’analyse des décisions qui le mettent en application à un cas de rupture de couple révèle une tendance nette, celle de l’utilisation à titre de sanction d’un mécanisme en principe réparateur. Cette résistance jurisprudentielle au mouvement d’objectivation et à la neutralité croissante du législateur dans l’organisation des rapports de couple se devait d’être précisée et expliquée. La présente étude vérifie, d’abord, la réalité du phénomène : l’article 1382 du Code civil est utilisé comme peine privée, ce qui met en avant la fonction répressive de la responsabilité civile. Elle s’attache ensuite à déterminer les valeurs que le juge cherche à protéger par la mise en œuvre de cette sanction. Au-delà de la diversité des comportements sanctionnés, c’est le travail d’équilibre réalisé par le juge entre droit à réparation et liberté de rupture que la thèse vise à souligner<br>The context of a couple’s break-up, whether they are married, in a civil partnership, engaged or cohabiting, is conducive to prejudice the respective interests of either person in the couple. As the issue of compensation for damages emerges, the temptation is to blame the other person, especially when this one can be regarded as the cause of the break-up. An action can be brought on the basis of tort liability in the section 1382 of the French civil Code. The question of its implementation was still open. A detailed analysis of the case-law shows that this legal basis, which is supposed to award compensation, is actually used as a punishment. This resistance to the development of objectification and to the increasing legal neutrality in the organization of the couple’s relationships had to be clarified and explained. The first objective of the study was to grasp the reality of the phenomenon : tort liability is used as a “private penalty”, which highlights its repressive function. The second purpose was to determine the values that judges are trying to protect through this particular way of application of the law. Beyond the diversity of sanctioned behaviours, the thesis aims at bringing out the role of judges in finding a right way between the right to compensation and the freedom to break-up

Audit is found increasingly in clinical settings, and attempts are being made to extend its impact and effectiveness. This has given rise to debates about its relevance as a form of intervention into professional practices in spheres as different as accountancy, engineering, medicine, and psychoanalysis. These debates are examined, together with attempts to develop forms of `clinical audit' relevant to psychotherapy services in general. A case is made that psychoanalytic psychotherapy has not been subject to successful or convincing audit processes. This is especially true of couple psychoanalytic psychotherapy. A case is made for the development of forms of `conceptual research' in psychoanalytic modalities - particularly ones which respect the unique nature of the psychoanalytic `clinical fact' and the influence of the practitioner's pre-conscious. The development of couple psychoanalytic psychotherapy in the UK from its early roots in the Family Discussion Bureau to its current institutional practice at the Tavistock Marital Studies Institute and its private practice within the Society of Psychoanalytic Marital Psychotherapists is examined to show how couple psychoanalytic psychotherapy has developed as a discrete modality of psychoanalytic treatment. A research project is described which attempted to survey the field of couple psychoanalytic psychotherapy. A questionnaire gathered demographic data, theoretical orientation and conceptual orientation data, and approaches to clinical material and concepts. The analysis of the research data (utilising quantitative and qualitative methods including those of Grounded Theory) showed that within the field of couple psychoanalytic psychotherapy there are clear groupings of practitioner, with a good degree of congruence between their self-reports and their practice when approaching clinical material. The reasons for, and make-up of, these groupings is described. Recommendations are made in three areas of couple psychoanalytic psychotherapy practice: audit, training and research. The need for audit processes to be developed out of the psychoanalytic experience is underlined as part of a way of developing reflexive couple psychoanalytic psychotherapy practitioners.

Or cet individualisme militant constitue un réel obstacle à la vie à deux. En effet, la notion de lien inhérente au couple se révèle a priori antinomique de l’impératif de protection de la personnalité : à l’unité s’oppose l’individualité. Cela signifie-t-il pour autant que les aspirations identitaires caractéristiques de notre société post-moderne conduisent à ne voir dans le lien de couple que la simple association de deux individualités strictement autonomes ? Chacun perçoit presque instinctivement qu’il ne peut en être ainsi. Le couple ne laisse jamais la protection de la personnalité indifférente : à l’altération de la protection de la personnalité par le couple correspond en effet un enrichissement de celle-ci grâce au couple. La libération du mariage et la reconnaissance d’autres formes de conjugalité (concubinage et pacte civil de solidarité) ont en effet abouti à l’émergence d’un couple protéiforme, fondé sur une transcendance mesurée des personnalités, elle-même source d’un épanouissement personnel. Cette interaction à la fois négative et positive du couple sur la protection de la personnalité n’est cependant pas uniforme. Elle varie non seulement en fonction des prérogatives de défense de la personnalité (droits de la personnalité et libertés civiles), mais aussi des modes de conjugalité. In fact, the notion of a tie inherent in the pair proves to be a priori antinomic with the demand of a support of personality : individuality goes against unity. Does it mean therefore that the yearnings for identity, typical of our post-modern society lead to consider the relation between woman and man as fellowship of two strictly independent individualities? Everyone can, by instinct, easily discern it can’t be so. The pair never shows any indifference to the fate of protection of personality : an enrichment of the personality, thanks to the couple, will suit to the imparing of the support of personality by the pair. Il s'agit moins ici de l'enfant apprehende dans sa problematique singuliere que d'un enfant imaginaire porte par les parents, faisant ecran a une ecoute de l'enfant reel. Notre lecture psychanalytique du materiel receuilli par entretiens cliniques s'est faite aux trois plans suivants (distingues pour notre etude): a) l'investissement de l'enfant dans le discours maternel et paternel b) la place de l'enfant dans la "collusion conjugale" du couple c) la place assignee a l'enfant en reference aux generations anterieures outre une fantasmatique liee a l'enfant, nous avons tente d'ebaucher l'illustration de mythes qui en periodes de crises se structurent de facon symetrique opposant les lignees paternelles maternelles. Ces mythes "incluant" l'enfant sur le plan imaginaire font butee par rapport a une elaboration psychique et un deuil. La comparaison du groupe-divorcants avec la population-temoin montre que si la dimension "biologique" de la parentalite est souvent evoquee sur le versant maternel (hypothese), il apparait que c'est surtout la problematique oedipienne qui est prevalente chez les deux parents. Par ailleurs le couple est souvent ebranle dans ses liens au cours de periodes precises du developpement libidinal de l'enfant (reel). Enfin apparait aussi le poids d'identifications de l'enfant, dans la problematique parentale, a des objets generationnels, placant l'enfant imaginaire hors-psyche en quelque sorte. Le groupe-divorcants met en lumiere la problematique parentale en general, se specifiant par des caracteristiques attachees au narcissime primaire des sujets, sujets profondement affectes dans leur identite et leur capacite a se prolonger dans une filiation, et ainsi jouer un role de "transmission" d'une generation a l'autre<br>From a group of divorcing poeple, in conflict about the keep of their child (ren) by law, this research aims to circle the caracteristics of the expression about child. We are less concerned here by the child in his singular personality, but an imaginary child carried by the parents. This one creates a barrier to the understanding of the real child. Our psycho-analytical reading of the clinical material collected from personal interviews is made in three following manners (showned for our study): a) the child-investment in paternal and maternal expressions b) the place of the child in the "collusion" of the couple c) the place designated to the child in reference to the previous generations. Either than a fantasy about the child, we tried to show some examples of myths which appear in a symetrical way in a moment of crisis, opposing the maternal paternal family lines. Those myths "inclose" the child in the imaginary field. They form an obstacle to a psychological work and bereavement. The comparaison of the divorcing-group with the control-group shows the following points: if the "biological" dimension is often raised with the maternal aspects (hypothesis), it appears that the oedipian problematic is prevalent in both parents. Then the couple is often unsettled in its relations during precise periods in the libidinal (real) child development. Finally it also appears the importance, in the parental problematic, of the child identifications to some generational objet(s). Those identifications place the imaginary child outside a mental space in a certain way. The divorcing-group brings to light the general question of parental-ness, caracterising itselfby some aspects bounded to the primary narcissism of subjects. Those subjects are deeply touched in their identity and their capacity to perpetuate themself in a filiation, and so "to transmit" from generation to generation
