Full textThis research aims to analyze Gabriel Naudés theory of the coups détat , one of the main authors of reason of State on the 17th Century. Interpreting Naudés magnum opus, Considérations politiques sur les coups dÉtat (1639), I intend to explore not only his conceptual basis but the theoretical tendencies leading to his writings. Through this investigation it is possible to deem prudence as the major supporting notion of the theory of the coups détat, which was essentially influenced by the works of Justus Lipsius and Pierre Charron. Thence, I intend to deconstruct Naudés notion of prudence in order to point out the weigh of Lipsius and Charrons ideas on his work, showing the existence of other references in the formulation of the reason of State on this epoch, besides Niccolo Machiavelli.

Full textEducational research conducted as part of this thesis aims to explore ways of formalizing gender debate in three subject areas in elementary school : literature, science and philosophy. More specifically, this research focuses on the update of this school disciplinary gender in different areas of the school building in cycle 3 (CE2 - CM1 - CM2): spaces prescription, advocacy, and reported practices actual practices. The study disciplinary configurations debate in each of these spaces is constructed empirically using a collection and analysis of specific data: Official Instructions for the three disciplines of debate for analyzing spaces prescription, 25 editions textbooks (18 French and 7 in science) for the analysis of spaces recommendation statements cycle 3, 184 teachers on their practice debates for analysis of areas reported practices and the transcript of three sets of debates in discussion literature , science and philosophy led respectively by four teachers from cycle 3 of the suburbs of Lille (two teachers teaching classes in classical and two teachers in alternative education classes). This methodological and disciplinary approach that allows comparisons lead us to highlight the specific disciplinary formalization of debate based on different spaces. We observe how particular instructions made to students in textbooks guide disciplinary debates how management discussions by teachers reveals a tension between the development of a consistent place left to students during debate and building contents disciplinary, or why and how the script content by teachers during times of debate allows students to establish as teaching subjects

Full textMy objective in this doctoral thesis is to analyze the political and theoretical formation of the Organização Revolucionária Marxista Política Operária(The Revolutionary Marxist Organization Workers Politics, ORM-POLOP) based on the three organizations which composed the base of the group. The three groups that formed the orghanization were: the Liga Socialista Independente (Independent Socialist League, LSI) based in São Paulo under the leadership of Hermínio Sacchetta, a veteran Trotskyist activist. Another group in the base of ORM-POLOP was the Juventude Socialista da PSB (Socialist Youth of the Brazilian Socialist Party, PSB), organized in Rio de Janeiro, but with influence in other states. The third force that formed the groups base was the Mocidade Trabalhista do PTB (Labour Youth of the Brazilian Labour Party, PTB). My focus on this last group will be on its section in the state of Minas Gerais since the group that adhered to ORM-POLOP came from Belo Horizonte, the capital city of the state. My aim is to present and discuss each of these three groups, understand their theoretical presuppositions, the possibilities for the conciliation of these distinct political positions and, finally, how such differences contributed to the split in the organization. The study covers the period from 1957 when the LSI initiated its activities until 1967 the year in which ORM-POLOP split into diverse groups.

Full textBetween 2008 and 2011, the French bioethics laws were examined for the second time. On that occasion, a lot of polemical debates were re-opened, during a broad consultation involving “experts”, representatives of civil society and, for the first time in this field, ordinary citizens. This original procedure, the “états généraux de la bioéthique”, is studied through the controversy over legalization of gestational surrogacy. The Habermasian public sphere and deliberative democracy theory is used to question the discussion process initiated by social mobilizations, managed by public authorities and finalized by the promulgation of a law. Legitimacy is at the core of this doctoral research, which is wondering about its foundations and highlighting its ambiguities. The decision is progressively built and legitimated through the consultation of committees, the participation of citizens and the vote of the Parliament. In this case, the “états généraux de la bioéthique” play a crucial role by conveying some specific perspectives about participatory democracy, general will definition and “French style” law

Full textConstitutional interpretation has become a recurrent issue in modern world. Since the law is subject to interpretation by anyone (judges, doctrine. ordinary citizens), so that "jurists and ordinary citizens accept and affirm (or doubt and refuse) proposals on what the 'law says' of their nation or their state" (Ronald Dworkin), the question is who, among these various actors, is the most legitimate to affirm a finalist interpretation of the law imposing itself on everyone. At the center of this question is the constitutional judge, the empowered interpreter, his judgments and the criticisms raised by the latter. But the judge's interpretation is sometimes. even often, poorly accepte1 which contributes to the weakening of his authority in a competitive legal system marked by pluralism, bath at the stage of the production procedure and al that of the application of the law. Thus, if the judge has the privilege to judge, he also has the necessary vocation to b in turn judged. This necessity is explained by the fact that "Ali power is wicked as long as it can, [but becomes] wise when it feels judged (Alain). In such a context, the question of methods and tools used by the interpreting judge also becomes central because the latter are scrutinized by everyone, often at the expense of the complex interpretative work of the judge. Among these tools and methods c interpretation used by the judge is the use of preparatory work (Hansard). As the basis of a legal interpretation method, the latter become problematic. Beyond the question of the definition of the concept of preparatory work, it should be raised the questions of the role, fore and value of the latter in constitutional interpretation. Thus, this paper aims to try to give an initial answer to these questions, through general reflection on this interpretation method that has been debated, at least, from the Middle Ages

Full textIn March 31, 1964, a civil-military coup détat ousted the Brazilian president João Belchior Marques Goulart (his administration began in September 7, 1961 and finished in April 1, 1964), starting a period of about twenty one years of military dictatorship in Brazil (since April 1, 1964 up to March 15, 1985), in which the presidency was occupied by a sequence of generals, inspired by National Security Doctrine. Devised by Superior War School (ESG, an institution comparable to the American National War College) and structured under geopolitical concepts, the National Security Doctrine was based on a binomial expression development and security which enveloped the quest for rapid economic development and a concern for national security against subversive agents from international communism. The military governments also believed in the possibility of transforming the country into a power able to exercise full leadership in South America and its Atlantic area, realizing thus an old national aspiration: the construction of Brasil Potência (Brazil Power). The coup détat in Brazil, an event that is often considered the most important battle within the Cold War, had strong material and ideological support from the United States, and started an important partnership between the two countries in order to block any possibility of success to leftist ideas in Latin-America. To ESGs policy makers, an US-Brazil alliance was given, since Brazil as a Western, Christian and democratic country, should be a partner with the U.S. in the fight against communism. This association is inevitably reflected in the conduct of Brazilian foreign policy. The aim of this dissertation is to investigate and understand Brazils international posture and foreign policy during the first three governments of the military regime (1964-1973) especially the Costa e Silva and Emílio Médici administrations. The dissertation covers the construction of the information system and the repression of social movements and opposition politicians, as well as the Brazilian intervention in the internal affairs of neighboring nations, its ties with the United States and the centrality of the small cadre that led the executive branch in the definition and formulation of these objectives.

Full textGreat Britain saw in the 1880s, at the end of a period of intense technical change and before the publication of Mahan’s classic on Sea Power, the decline of the material way of thinking about naval affairs and the rise, from the years 1885 and 1886, of the historical school of John Knox Laughton. Proponents of a material method established the idea that technological change altered naval warfare in a fundamentally way. They were, however, opposed by the partisans of a historical method who supported the idea that naval warfare is set on some timeless principles which can be discovered by the use of the methods of the new historical profession. Throughout the decade, the material method, successful in an era of rapid technological change, quickly subsumed to Mahan’s precursors. In a debate originally dominated by tactics, we observe the introduction of strategy by the French materialist Jeune École. Consequently, strategy became the core of the historical school and seems closely linked to the rise of strategy as a subject of reflection. The Jeune École believed that the torpedo would democratize Sea Power in making the powerful navies to use its mastery over the oceans. The Jeune École’s original success was so great, in France and abroad, that it influenced the English’s debate. Although materialists in Great Britain where more moderate than in France, they finally got marginalize by the historical school using the Jeune École’s wildest claims to disqualify the materialist point of view. Studying the debates through the Royal United Service Institution Journal, this thesis shows the existence, in Great Britain, of a debate centered on two method of thinking naval warfare and contributes to reassess current historiography which still focuses solely on the rise of Mahan’s precursors.
