This article discusses the approach taken by Hong Kong courts to award indemnity costs against applicants who were unsuccessful in resisting enforcement of New York Convention awards. Under general principles, an indemnity costs order is penal in nature and is usually awarded in exceptional circumstances. In the case of A v. R, the High Court of Hong Kong held that the unsuccessful application to resist enforcement of an award warranted the indemnity costs order. This approach was justified on the basis of Hong Kong’s Civil Justice Reform (CJR) and its implications, and was given endorsement b

The traditional objective of a costs award in general civil litigation was to indemnify the successful party for the legal and other costs incurred to defend an unproven claim or pursue a valid legal right. However, Canadian courts have recognized that the traditional view of costs is outdated and that an additional and more important use of costs awards is promotion of the efficient and orderly administration of justice. A principal object of the Woolf Reforms was to control costs, which Lord Woolf described as ‘the most serious problem besetting our litigation system’. Under CPR 44, the court must, when considering its order as to costs, take into account all the circumstances of the case, including all aspects of the parties’ behaviour both during and before trial. Abstract:
The amendment to the Law on Civil Procedure from 2019 introduced certain novelties with regard to the costs of the procedure, which was intended to increase the level of efficiency in the resolution of court cases, and there was an intention that the procedures be conducted within a reasonable time, as well as that the parties, depending on their role in the procedure, bear responsibility for own actions and costs incurred during the procedure. In the article, the authors will refer to the conceptual arrangement of litigation costs and its components, authorized persons and those liable for re

Abstract:
We analyze the outcomes of 332 cases from a labor court in Mexico in which a judge awarded money to a plaintiff who claimed to have been fired by a firm without cause. The judgments were enforced in only 40% of the cases. A plaintiff may try to enforce a judgment by petitioning the court to seize the firm's assets when the firm refuses to pay. Thirty eight percent of the enforced judgments required at least one seizure attempt. We estimate the parameters of post judgment games in which the worker does not know if a seizure attempt would ultimately succeed and show that these models explain the

Abstract:
Problem-solving courts (PSC) are a problem-solving approach targeting the complex needs of individuals within the criminal or family justice systems. Over the last 20 years, PSC have been introduced into the UK to address the personal, social and structural factors underlying behavioural issues that often contribute to re-offending. In June 2023, the Ministry of Justice launched three courts with problem-solving components referred to as Intensive Supervision Courts (ISC). Focusing on rehabilitative outcomes, PSC combine intervention programmes with judicial oversight through regular reviews.

Abstract:
The 1991 Colombian Constitution strengthened the checks and balances of the political system by enhancing the role of Congress and the Constitutional Court, while somewhat limiting the powers of the President (who nonetheless remains extremely powerful even by Latin American standards). As a consequence of the larger number of relevant players, and the removal of barriers that restricted political participation, the political system has gained in terms of representation. However, political transaction costs have increased, making cooperation harder to achieve. The authors show that this has be

Full text
Abstract:
Since the birth of the first baby conceived through in vitro fertilization (IVF) in the UK in 1978, millions of people around the world have built their families using fertility treatments. One in six people of reproductive age worldwide experience infertility in their lifetime. That statistic does not account for single parents by choice, for 2SLGBTQI+ couples wanting to have children, or for those who require fertility preservation for medical reasons (such as a cancer diagnosis), who will need fertility care to form their families. Although it is often the only option for those who want to

Singh, Anjali. Ultimate Guide to Automated Cell Counter: Plus Purchasing Tips. ConductScience, 2022. http://dx.doi.org/10.55157/cs20220614.

Full text
Abstract:
An automated cell counter is a machine that uses either image analysis or electrical impedance principles to count cells automatically. The electrical impedance principle involves measuring changes in electrical resistance as cells pass through an aperture, while the light-scattering principle observes how cells scatter light when exposed to it. There are four main types of automated cell counting methods: Coulter Counter, Image Analysis Method, Flow Cytometry, and Stereological Cell Counting. Each method has its benefits and limitations, offering faster and more objective cell counting compar

Full text
Abstract:
The United States is planning a $1.7 trillion overhaul of its entire nuclear arsenal, designing new warheads and investing in new bombers, missiles, and submarines to carry them. The new warheads, in turn, are driving demand for new plutonium “pits”—the bomb cores that begin the chain reaction in every US thermonuclear weapon—despite the fact that the United States has thousands of surplus pits in reserve. Producing new pits would not only be expensive, time consuming, and logistically challenging, but is also technically unnecessary and politically destabilizing. It would actually decrease na

Abstract:
This study analyzes the impact of judicial inefficiency on small businesses in Peru. It is based on the hypothesis that chronic problems in the region's judicial systems have negative consequences on the development of micro, small and medium-sized businesses. The analysis focuses, first, on the relationship between small businesses and the legal system. Secondly, it looks at decisions made by small businesses to mitigate the effects of poor performance by the courts. Lastly, it identifies several ways in which judicial inefficiency is transferred to the business sector. The analysis also atte

It also investigated correlations between COs and base factors (district, project type, contract type, award amount, geographical area (rural vs. urban)), and sought to understand the effect of the root causes but not to predict CO based on root causes. Unlike the base factors, the root causes are unknown prior to construction. The study developed models that forecasted CO characteristics—CO likelihood, CO frequency (count), and CO severity (magni

Abstract:
White-tailed deer (WTD) can exert substantial impacts on the ecosystems in the Southeastern United States, particularly by overabundant WTD populations that are sheltered from recreational hunting pressure such as those in the National Parks. Information on WTD abundance and density is indispensable for science-based WTD population management. WTD populations in Vicksburg National Military Park (VICK) have not been surveyed since 2010. Management of WTD populations has been challenged by the lack of reliable, cost-effective methods, such as a deer visual count-density calibration coefficient,
