Resumo: A proposta deste trabalho é mapear o lugar e os valores da história para clérigos e leigos em Portugal nos séculos XIV e XV, quando a história passa a ser vista como um importante instrumento não só de legitimação do poder, mas também na formação dos próprios homens do reino. Serão cotejadas as Crónicas Breves, produzidas no mosteiro de Santa Cruz de Coimbra no século XIV, e aquelas escritas pelos cronistas oficiais Fernão Lopes, Gomes Eanes de Zurara e Rui de Pina no âmbito do Arquivo régio no século XV. Com o objetivo de examinar se houve uma mudança de perspectiva no modo de se conceber a história entre os cronistas monásticos e os cronistas leigos, propomo-nos analisar até que ponto se pode falar em permanência e/ou ruptura entre os valores religiosos e laicos na conservação do passado. Em especial, procuraremos mostrar como os cronistas monásticos e régios pensaram a história em uma oposição Bem/Mal e a estruturaram a partir do jogo entre momentos de paz e de guerra. É através da discussão acerca da necessidade da guerra e da importância da paz que será possível compreender o modo como os cronistas concebiam a existência social dos grandes nobres e o papel que atribuíram a esses homens na missão de tornar Portugal o representante por excelência do Bem na Terra
Abstract: The purpose of this study is to map the place and values of the story the clergy and the laity in Portugal in the 14th and 15th centuries, when the history comes to be seen as an important tool not only for the legitimization of power, but also in the forming of the men of the kingdom. Will be collated the Crónicas Breves, produced in the monastery of Santa Cruz de Coimbra in the 14th century, and those written by the official chroniclers Fernão Lopes, Gomes Eanes de Zurara and Rui de Pina in the File regal in the 15th century. With the objective of to examine if there was a change of perspective in the way of conceiving the history of the monastic chroniclers and lay chroniclers, we will consider the extent to which there can be continuously and / or split between the religious and the secular conservation of the past. In particular, we aim to show how the royal and monastic chroniclers thought the story in an opposition Evil / Good and structured from the game between moments of peace and war. It is through discussion about the need for war and the importance of peace that you can understand how the chroniclers conceived of the social existence of the great nobles and the role attributed to these men in the mission to make Portugal's representative par excellence of the Good Earth

Full textThis Ph.D. thesis contributes to the new history of European law by proposing the results of in-depth biographical research on the first judges, advocates general and registrar who worked at the European Court of Justice during the first twenty years of its existence (1952 - 1972). Firstly, it sheds new light on the professional and personal trajectories of the Court's pioneers and of those who pronounced some of its most commented judgments, those who laid the foundation of the 'constitutionalization' of the European legal order. Secondly, it leans on the collected biographical data in order to bring to the surface new elements of knowledge on three precise points with regard to a question which political scientists have been interested in for two decades - and which now also historians address: how did the European Court of Justice, from the 1960s onwards, succeed in seriously limiting the Member States' sovereignty, especially by imposing the principle of primacy of European law, without provoking a rebellion by national decision-makers? It first of all analyzes the nomination process of the first judges and advocates general, in order to establish whether governments did, or did not, use the appointment mechanism to curb down ECJ activism. It then studies the members of the Court's views and convictions with regard to European integration and their role in the European Communities. Finally, it looks at the political affiliations of the first members of the Court of Justice and their unofficial interactions with national decision-makers

Full textAdmissibility is the heart of the judicial process. It studies the criminalization of international life. It seems to account for the judicial response to the international resentment against the great criminal acts, whatever was the territory of commission.This thesis deals with the notion of admissibility before the ICC. With the creation of the ICC, International Criminal Justice is a new dimension. The practice of the Court is still new. The study is an excuse to investigate the operation of the ICC. States have tried to limit the ability to receive from the Court. They did so based on the principle of complementarity. It compensates the action or inaction of failing states, which have a duty to prosecute international crimes. Article 17 RS sets out exceptions to declare a case admissible before the ICC. Thus, the admissibility of a case which is the subject of an investigation will be accepted only, if it is shown that States did not intend genuinely to carry out prosecutions. And that furthermore, the threshold of gravity of a case is reached. The universal nature of the jurisdiction of the ICC is undermined by the conditions of admissibility. Analyzing the admissibility of competence as a condition rightly, for it is the failure of the state to ensure effective prosecution to justify that the case will be declared by the Court itself, admissible. The requirements for the Court to act, it is clear involvement of the system of admissibility as on the organization of the Court that its relationship with the United States. These are not insignificant. In fact, the system will evolve admissibility. It is characterized by its ability to influence the law. Thus, the decision to receive should encourage States to adapt their domestic law. The viability of the Court, in the long run depends on maintaining a synergy of cooperation with national courts of States Parties and other States. The system of admissibility tends to highlight indicators emerging in the practice of the International Criminal Court. This is especially striking realignment of the roles of international actors and the new relationship established between the States and the Court. The system of admissibility of the Court tends to erode the principle of state sovereignty, without itself being swept by the opposition of sovereign states

This study describes some of the currently adopted solutions by federal courts for court hearing recording , as well as it points out to the opportunity that interactive environment of Brazilian Digital TV offers for framework proposal of office electronic document, serving as support to court hearing recording outcome (text, sound and image) as well as to contribute for paradigm shift of current procedural systems (software). It aims to establish standard-based public policy (Brazilian Electronic Government and the Brazilian System of Terrestrial Digital TV), where there are no commercial restraints to the use of new communication technologies and information in regard to minimally focusing on social inclusion without loss of efficiency. The work here consisted of two types of content: textual part and digital part. The textual part contains research outcomes conducted by federal courts, as well as it presents main points from Brazilian Electronic Government and the Brazilian System of Digital Terrestrial TV. It still describes the standard built in the making and accomplishing of the digital part. In turn, the digital part brings together the material used for prototypes presentation (Videos and applications examples), to demonstrate interactivity possibilities of the Brazilian Digital TV and benefits that both those under jurisdiction and law operators, would reach with the proposal.
Este trabalho descreve algumas das soluções atualmente adotadas pelos tribunais federais para a gravação de audiência, bem como indica a oportunidade que o ambiente de interatividade da TV Digital Brasileira oferece para uma proposta de modelo de documento eletrônico de escritório que sirva de suporte para o resultado da gravação de audiência (texto, som e imagem), bem como possa contribuir para a mudança de paradigma dos atuais sistemas processuais (softwares). O objetivo é estabelecer um padrão fundamentado em uma política pública (Governo Eletrônico Brasileiro e Sistema Brasileiro de TV Digital Terrestre), onde não existam restrições comerciais quanto ao uso das novas tecnologias de comunicação e informação no que se refere ao mínimo para se privilegiar a inclusão social sem perda de eficiência. O trabalho é formado por dois tipos de conteúdo: parte textual e parte digital. A parte textual contém o resultado de uma pesquisa realizada junto aos tribunais federais, bem como apresenta os principais pontos do Governo Eletrônico Brasileiro e do Sistema Brasileiro de TV Digital Terrestre. Ainda descreve a estrutura montada na elaboração e realização da parte digital. Por sua vez, a parte digital reúne o material utilizado para a apresentação de protótipos (vídeos e exemplos de aplicações), para demonstrar as possibilidades de interatividade da TV Digital Brasileira e dos benefícios que os jurisdicionados e os operadores do Direito alcançariam com a proposta.
