Abstract:
This chapter comments on Article 44 of the Rome Statute of the International Criminal Court. Article 44 is the basic text governing the appointment of qualified staff which make up the bulk of the employees of the Court. Earlier international criminal tribunals never bothered with such a provision. Most of its ‘norms’ merely stated the obvious. Nevertheless, article 44 addresses some contentious issues, notably the status of gratis personnel. Judges, the Prosecutor, the Deputy Prosecutors, the Registrar, and the Deputy Registrar are not contemplated by this provision, and are not considered ‘staff’ for the purposes of the Rome Statute.

This chapter comments on Article 47 of the Rome Statute of the International Criminal Court. Article 47 sets out the disciplinary measures for elected officials of the Court, that is, judges, the Prosecutor, Deputy Prosecutor, Registrar or Deputy Registrar who have committed misconduct of a less serious nature than that set out in article 46. Disciplinary measures that may be imposed consist of a reprimand or a pecuniary sanction, not to exceed six months of the salary of the person concerned. The procedural guarantees governing removal to office, pursuant to article 46 of the Statute, are also applicable in the case of disciplinary proceedings.

There are two grounds for removal from office. An official may be removed from office where he or she is ‘found to have committed serious misconduct or a serious breach of his or her duties under this Statute, as provided for in the Rules of Procedure and Evidence’, or if he or she ‘is unable to exercise the functions required by this Statute’.

This chapter comments on Article 43 of the Rome Statute of the International Criminal Court. Article 43 sets out the functions and responsibilities of the Registry, one of the four organs of the International Criminal Court listed in article 34. It is a neutral body, charged with judicial and administrative support functions for all organs of the Court. In terms of budget and size, it is the largest. With the Registrar at its head and under the supervision of the Presidency, the Registry ensures the non-judicial aspects of the administration and the servicing of the Court. These include responsibilities with regard to the defence, victims and witnesses, outreach, and detention.

Historically, likelihood of confusion has been the core infringement test for trade mark law, and it remains the most frequently applied test in infringement actions by far. However, there are noticeable differences in how it is applied by the Court of Justice of the European Union (CJEU), the General Court, and national courts; and questionable outcomes when it is applied in novel situations. This book is the first comprehensive and systematic account of the confusion test within the harmonised European trade mark system. It considers how the test is applied by national trade mark registries across EU member states, by the European Union Intellectual Property Office (EUIPO), by national courts, and by the CJEU. It offers practical guidance, while also evaluating the viability of more recent developments such as initial-interest confusion, post-sale confusion and consumer responses to uses of trade marks on the internet. The book analyses three distinct strata of legal doctrine: the decisions of the CJEU, including the General Court; the extensive body of decisions by EUIPO; and the application of harmonised trade mark law by courts of member states, focusing on leading decisions as well as wayward ones. It also draws upon the legal position in the US to illuminate these issues.

Over the past two decades, a growing number of Christians in England have gone to court to enforce their right to religious liberty. Funded by conservative lobby groups and influenced by the legal strategies of their American peers, these claimants — registrars who conscientiously object to performing the marriages of same-sex couples, say, or employees asking for exceptions to uniform policies that forbid visible crucifixes — highlight the uneasy truce between law and religion in a country that maintains an established Church but is wary of public displays of religious conviction. This book charts the changing place of public Christianity in England through the rise of Christian political activism and litigation. The book explores the ideas and contested reception of this ostensibly American-inspired legal rhetoric. It argues that legal challenges aimed at protecting “Christian values” ultimately jeopardize those values, as moralities woven into the fabric of English national life are filtered from their quotidian context and rebranded as the niche interests of a cultural minority. By framing certain moral practices as specifically Christian, these activists present their religious convictions as something increasingly set apart from broader English culture, thereby hastening the secularization they seek to counter. The book offers a unique look at how Christian politico-legal activism in England simultaneously responds to and constitutes the religious life of a nation.

Article 92 grants the Court authority, ‘[i]n urgent cases’, to request the provisional arrest of the person sought, pending presentation of the request for surrender and the documents supporting the request as specified in article 91. When a request is made to a State in accordance with article 92, the Registrar ‘invites’ the State to inform him or her of the arrest, and ‘to provide, inter alia’, personal details and other information concerning the arrest, including a confirmation of ‘the information given to the arrested person in respect of his or her rights’.

This chapter comments on Article 113 of the Rome Statute of the International Criminal Court. Article 113 establishes the legal significance and role of the Financial Regulations and Rules. Consist of thirteen articles, plus an Annex, the Regulations provide that the Assembly of States Parties is to ‘establish detailed financial rules and procedures in order to ensure effective financial administration and the exercise of economy’. The Rules describe themselves as being ‘in complement to, and limited by the Financial Regulations. They shall govern all the financial administration of the Court, except as may otherwise explicitly be provided by the Assembly of States Parties, or specifically exempted therefrom by the Registrar’.

This chapter discusses miscellaneous provisions in the Singapore International Arbitration Centre (SIAC) Rules. Both Singapore law and the SIAC Rules exclude liability for the acts or omissions of those administering and deciding arbitrations. SIAC Rule 35 requires the parties and the tribunal to treat all matters relating to the proceedings and the award as confidential. The decisions of the President, the Court, and the Registrar with respect to all matters relating to arbitration shall be conclusive and binding upon the parties and the Tribunal.

This chapter discusses the corporate structure of the Singapore International Arbitration Centre (SIAC). The SIAC administers arbitrations for which it is responsible by appointing arbitrators, managing the financial and practical aspects of cases, carrying out supervisory functions entrusted by the SIAC Rules, and scrutinizing and issuing awards. It performs these roles through the following organs: (a) the board of directors, which is under the supervision of a chairman; (b) the SIAC Court, which is led by a president; (c) the chief executive officer; and (d) the secretariat, which includes the registrar. In addition, the SIAC has three overseas liaison offices which do not administer cases but promote the SIAC as an arbitral institution.
