Abstract: There is an increasing focus on the giving of credit advice. Under the 2008 Consumer Credit Directive, there is an obligation to give consumers 'adequate explanations'. The 2011 proposal for a Directive on credit agreements relating to residential property not only gives notice of a corresponding obligation but also proposes laying down 'advice standards' for housing loans. Such credit advice can be necessary in an ever more complex financial market, characterized by over-indebtedness, and it can ensure that the recipient of the advice makes the decision that is most advantageous for

Economic life is inseparable from daily life in running a business to create prosperity, and one way to do this is through borrowing capital. The “Credit Holidays ”is quite an interesting institution that has been regulated by law. In the period of the spread of the COVID-19 pandemic, bearing in mind the difficulties in repaying liabilities to banks, initially on the part of the Polish Bank Association and the banks themselves, there were proposals to postpone repayment of principal and interest instalments or principal instalments. In this way, “non-statutory credit holidays” were created, and it was up to the lender and the borrower to specify the necessary contractual changes. The granting of credit by banks to debtors is not solely based on trust but also adheres to the principle of prudence, taking into account the risks and feasibility of the debtor. One crucial step in credit agreements is the application of the 5C principles (Capacity, Capital, Character, Collateral, Condition), aimed at assessing the debtor's ability and suitability to fulfill their obligations. However, in the implementation of credit agreements, defaults or breaches of contract by debtors often occur, whether due to negligence, intentional actions, or force majeure.
