Abstract:
Forensic science television shows, especially CSI: Crime Scene Investigation, have been said to influence the public's perception of how forensic science is used and create interest in studying forensic science and pursuing jobs in the field. This study investigates this claim through a variety of methods. First, definitions of the CSI effect are discussed, including how it was first used and mentioned in the media. Second, survey data from students in a forensic anthropology course regarding interest in forensic science media and educational and career choices are analyzed. Third, the number and debut dates of forensic science non-fiction books, novels, non-fiction television shows, and television dramas are investigated. Finally, a content analysis of the television show Bones is undertaken in order to understand how the forensic anthropology presented in this show differs from the actual practice of forensic anthropology. Results of this study indicate that, overall, students who wanted to pursue forensic science careers and graduate study did not watch more forensic science television shows and read more forensic science novels than those who did not want to pursue forensic science careers and graduate study. Also, based on the decreased interest in a number of forensic careers, it appears that respondents may have started the course with false perceptions regarding the actual job descriptions of these careers. Regarding the number and debut dates of forensic science media, this study found that the majority of non-fiction forensic anthropology books, non-fiction television shows, television dramas debuted after CSI appeared, corroborating the claim that CSI led to an increase in interest in forensic anthropology. In addition, this study found that while much of Bones is fictionalized for entertainment purposes, many of the techniques and analyses presented on the show have a peripheral basis in scientific methods.

Images of crime and authorities' attempts to protect society from evil, which saturate dramatic programming on television, have the potential to influence public perception of crime and of crime-solving tools used in the real world. Although "Criminal Minds," a popular broadcast series, shares this potential, it distinguishes itself from others of its genre through its use of criminal profiling as its crime solving mechanism. Using standards provided in Douglas et al.'s "Crime Classification Manual: A Standard System for Investigating and Classifying Violent Crimes, Second Edition," the "Diagnostic and Statistical Manual of Mental Disorders, Fourth Edition," and the "Hare Psychopathy Checklist Revised" as theoretical frameworks, this Communication thesis examines how the criminal profiling depictions of two "Criminal Minds" episodes conform to established criminal profiling conventions utilized by law enforcement. Overall, the results of these analyses suggest that the criminal profiling portrayals in the episodes "L.D.S.K." and "Fear and Loathing" adhere to legitimate real life criminal profiling considerations

Abstract:
In the last decade the use of closed-circuit television or similar electronic devices (CCTV) has started to play a significant role in courtrooms, both as a silent witness and as a device through which to receive testimony. The benefits of optimising the use of CCTV for receiving testimony are numerous. This paper focusses on two, namely easier access to justice through criminal courts, and bridging the gap between the protective measures created by legislation with regard to vulnerable witnesses and the effective implementation of said measures. The requirements for using CCTV to receive testimony, if interpreted in a reasonable way, does not limit the type of device or facility to be used. It merely stipulates that the facilities at a remote point be overseen by a designated official, and that the device to be used must allow all parties, both at the court point and at the remote point, to hear and see the other parties, and to be able to follow the proceedings. In recent years technology has advanced to such an extent that audio-visual capable devices are readily available. It is proposed that if the above interpretation is followed, the facilities through which testimony can be given by means of CCTV need not be stationary, it can travel to where it is needed thereby making courts more accessible, and alleviating trauma with regards to vulnerable witnesses who can testify at a designated buildings and no longer needs to go to court, a place designed to be intimidating.

Abstract:
Between good and evil there's a whole lot of gray: Welcome to The Circuit. A shady private security firm recruits criminals straight out of prison and sells its services to the highest bidder, saint and sinner alike (mostly sinners). Through the trials and tribulations of a diverse ensemble cast, the show explores some of my absolute favorite themes in storytelling: gray morality, found families, and unlikely heroes. Follow our gritty and guarded lead Shaye as she struggles to tame a group of talented and contentious ex-cons under the shadow of her ambitious and manipulative father, all the while struggling to maintain her integrity in a world where nobody's the good guy. This thesis is an original television drama series, and consists of two full episodes as well as thirteen episode synopses for season one. It is also a work in progress, so feedback is welcome.

Abstract:
This thesis occupies an uneasy space: not within or even at the leading edge of any one tradition, but in the anomalous and almost unoccupied space in which three traditions fail to connect. In keeping with this standpoint, it employs a range of approaches from a cross-paradigm perspective. It draws the main hypothesis that it tests from the cognitive developmental paradigm and develops its main methodological tools from methods of discourse analysis, supplemented by a variety of other instruments, quantitative as well as qualitative. This thesis makes five main claims: (1). Modality judgements, issues and perceptions in relation to television programme content are significant elements in a complex, active and creative process of learning for children in the contemporary world. (2). Children's modality judgements and processes of understanding are significantly different from those of adults in important respects. (3). A further significant developmentally-related phenomenon that emerges from the data is the importance of moments of rupture in developing modality schema and strategies. (4). Children's programme preferences, as refracted through modality structures and strategies typical of different ages, reflect a coherent learning context in which children tackle modality experiences, problems and dilemmas that are well suited to their needs at that point in their development. (5). Children's talk about issues of modality is also a species of social action, in and through which children position and reposition themselves in a variety of social contexts, constructing not only maps and versions of the world, but versions of their selves and tactics to maintain their specific interests. Many of the generalisations in this thesis are still tentative, in need of further development. Some of them, however, are more solidly grounded and would be able to contribute to current debates in education and public life on the role and functions of television in the lives of children.

Abstract:
The thesis is a historical study from a socio-legal perspective of debates about, and developments in, criminal investigation law in NSW since 1945. In that period, the NSW parliament has enacted extensive criminal investigation powers and safeguards. This can be seen as the result of the increasing political sensitivity of 'law and order'. Politicians have sought to exercise (and demonstrate) greater control over the criminal justice system. Legislation has been employed to provide a framework for police actions, and to define a role for others, including judges, magistrates and the Ombudsman. Political focus on law and order has also reversed the incentive structure for the police hierarchy. In the 1950s, there were strong incentives not to push for extra powers, lest policing practices and effectiveness receive unwanted scrutiny. In the 1970s, police were dragged into debate about their powers, in the face of the 'authorise and regulated' model suggested by numerous inquiries. More recently, police organisations have often initiated calls for new powers, in part to explain past failings. Another important factor driving debate and reform in recent decades has been the proliferation of oversight agencies, and academic insights that have debunked the 'rotten apple' paradigm. The Federal Government and Parliament have also been increasingly active in what would once have been considered purely State/Territory realms of criminal justice law and politics. These major influences have been coupled with a host of others, including the impact of a series of Royal Commission and law reform reports, the ongoing war on drugs, and the campaign against police verbals in the 1970s and 1980s. The examination of the forces that have influenced debate and reform yields other insights. For example, the complexity of the phenomenon of 'non-reform' is apparent from an examination of debates about policing in the 1950s. Prevailing trends in law and order politics (eg, that populist politics supports additional powers) can be seen to be anchored in the contemporary political context rather than being timeless truths. The multiple roles of law, in governing relationships between state agencies and actors, not just between police and suspects, are also highlighted.

Abstract:
This thesis is a study of the ways a group of primary school children read print and television narratives. It begins by exploring everyday views of reading and television, arguing that such views are not natural or universal but are culturally constructed. The thesis continues by presenting an alternative view of these two concepts drawn from the research literature, framed around the question "How do we read?". This looks at the respective roles of reader, text and community as considered by pedagogical, literary and media theory before examining existing research comparing reading and television viewing. The issues raised by this review are developed into a theoretical consideration of the relationship between language, thought and culture which argues for the pivotal role of narrative in this relationship and the role of narrative in the reading process, which it suggests should be seen as a social act. The presentation and analysis of data begins with a consideration of the social contexts in which the children in the study watch television and read, followed by an investigation of the expectations which the children bring to the viewing or reading process from these contexts and by a detailed analysis of the children's approaches when reading three television and three printed narratives. The conclusion argues that, despite the differences in the two media, children draw on their underlying knowledge of narrative to transcend these differences and so do use similar strategies in each situation. Most significant here is the collaborative nature of the children's responses and their use of modality features to adjust their expectations and interpretations. The thesis argues that recent contributions to the debate about pedagogy do not take sufficient account of children's prior knowledge as shown by this study and that teachers should be encouraged to extend their strategies for doing so.

O objeto primordial desta dissertação é conceituar a investigação criminal defensiva, sob a ótica da eficiência e do garantismo, e demonstrar a necessidade deste instituto nos ordenamentos jurídicos em que a investigação pública é tendencialmente acusatória. Para tanto, nos dois capítulos iniciais, esclarecem-se alguns aspectos gerais condizentes ao tema em análise, a saber: a definição de investigação criminal e suas principais características; a questão da parcialidade do Ministério Público e a investigação do crime por este órgão; e a definição de inquérito policial e sua disciplina legal no Brasil. Em seguida, aborda-se a relação da investigação defensiva com os princípios constitucionais da igualdade e da ampla defesa, que se encontram na base de um processo penal acusatório e asseguram às partes igual oportunidade de comprovarem os seus argumentos. Por conta disso, se um sistema jurídico prescreve a investigação do crime pelo próprio órgão acusatório, é de rigor que o imputado tenha direito equivalente, sob pena de se violar os mencionados direitos fundamentais. Ademais, a investigação defensiva, ao permitir a obtenção de elementos que serão contrapostos à investigação pública, amplia o campo cognitivo do Magistrado, o qual disporá de um maior número de dados materiais para fundamentar decisão acerca da viabilidade da acusação e da adoção de medidas cautelares. Após a análise constitucional da investigação defensiva, estuda-se o tratamento conferido pelo Direito estrangeiro a esta matéria, particularmente na Itália, onde o tema está em voga e é objeto de importantes e auspiciosos debates jurídicos. Ao final, a dissertação cuida da concretização da investigação defensiva, isto é, o modo como deve se desenvolver, as suas limitações, a utilização do seu resultado e a possibilidade de inserção no ordenamento jurídico pátrio.
The main subject of this dissertation is to create a concept of the criminal defense investigation, under the efficiency and the guarantism perspectives, and to demonstrate the need of such institute in the legal system in which the public investigation has an acusatory tendency. For this purpose, in the first two chapters, the dissertation clarifies certain general aspects regarding the subject under analysis, such as: the definition of criminal investigation and its main characteristics; the question of partiality of the Public Prosecutor\' s Office and the criminal investigation ran by this office; and the definition of criminal investigation and its legal regulation in Brazil. Following, the dissertation approachs the relation of defensive investigation with the constitutional principles of equality and of full defense, which are in the base of an accusatory criminal procedure and assure the parties equal opportunities to prove their arguments. For this reason, if a legal system provides for a criminal investigation to be conducted by the accusatory party itself, it is imperative that the accused has equivalent rights, otherwise the legal system will be violating the above mentioned fundamental rights. Furthermore, in allowing gathering elements which shall be confronted with the official investigation, the defense investigation expands the cognitive field of the Magistrate, who will have more material data to pronounce a decision regarding the accusation\'s viability and the adoption of cautionary measures. After the constitutional analysis of the defense investigation, the dissertation enters into the foreign law on this subject, particularly from Italy, where the matter is highly in evidence and is the subject of important and auspicious legal debates. In the end, the dissertation provides for the materialization of the defense investigation, i.e., the manner in which it shall be developed, its limitations, the use of its results and the possible insert in our national legal ordinance.

This two-part study of the criminal investigation process first evaluated the frequency with which patrol officers solve cases assigned to the investigations division and then examined how detectives spent their time, both on case assignments and on other activity not related to current case assignment. Cases assigned to the investigations division for follow up were examined to determine how often a case was cleared by the patrol officer. The detective's time was then evaluated in order to determine how much time detectives spent on investigative tasks and other activities. This study confirms that the patrol officer should be given more time to conduct preliminary investigations for specific cases, and that tasks performed by detectives could be shifted to other personnel in the department. Both actions should serve to positively impact case clearance rates.

The crisis affecting the Brazilian criminal justice system is often attributed to the inefficiency of the Judiciary Police and the ineffectiveness of the police investigation as a means of investigation of criminal acts. However, the problem takes another relevance when we analyze the criminal investigation in depth in accordance with the democratic principles and constitutional values. We pass, then, to realize that the shortcomings of the investigation procedures are not structural in nature but rather due to interpretive paradigms built under the aegis of political exception regimes. This reveals the need to put in place a contemporary criminal procedure hermeneutics, in which proper criminal investigation, constitutional and legally produced, is regarded as fundamental rights protection instrument, unfolding as real tool for promoting human dignity. Grounded on these assumptions should follow the doctrinal and jurisprudential construction and legislative reforms aiming to improve the extra-judicial phase of the criminal prosecution, consolidating the police investigation as true procedural criminal procedure of a garantista nature, aimed at achieving the constitutional ideal of due process, a principle of the Democratic State of Law
A crise que acomete o sistema de Justiça Criminal brasileiro muitas vezes é imputada à ineficiência da Polícia Judiciária e à ineficácia do inquérito policial como meio de apuração de fatos delituosos. Contudo, a problemática toma outro relevo quando analisamos a fundo a investigação criminal à luz dos princípios e valores constitucionais democráticos. Passamos, então, a perceber que as deficiências do procedimento investigatório não são de cunho estrutural, mas sim decorrentes de paradigmas interpretativos edificados sob a égide de regimes políticos de exceção. Isso nos revela a necessidade de colocar em prática uma hermenêutica processual penal contemporânea, em que a devida investigação criminal, constitucional e legalmente produzida, seja encarada como instrumento de proteção de direitos fundamentais, desvelando-se como verdadeira ferramenta de promoção da dignidade humana. This thesis is a study of a new specification for end user interactivity developed by the Open Mobile Alliance, the specification is called OMA BCAST Service Interaction Function. The specification is one part of the OMA BCAST Service Enabler, which enables service delivery to mobile devices, where the most common service is mobile television. The Service Interaction Function enables end user interactivity related to a service, this could be a poll about the current television program or a chat where every message is presented to the users that are watching the same channel.

The specification is still of draft version and the scope of this thesis has been to investigate the Service Interaction Function and implement a PC prototype.

Abstract:
When offenders commit crime there is the potential that they may leave behind trace amounts of their DNA, even when there has been no apparent body fluid spill. During the examination of crime scenes, scene investigators try to identify areas that may be sampled to locate these traces. Specialist techniques are then required within the laboratory to enable such small amounts to be analysed to obtain a profile. These techniques are referred to as Low Template DNA analysis (LTDNA), of which Low Copy Number DNA (LCN DNA) is one instance. In 2008, following the Omagh Bombing trial, and comments made by Judge Weir, the UK Forensic Regulator commissioned a review of the science of LTDNA analysis. The subsequent report made specific mention of the fact that there was no available information on the success rate of the use of such DNA techniques and that there seemed to be confusion over what constituted a success. The report went on to state that there was no information on where such trace amounts of DNA were likely to be found, or what factors could influence the likelihood of obtaining a trace DNA profile (Caddy, 2008). This research considered the outcomes of LCN DNA analysis from 3,552 samples to try to establish where trace amounts of DNA could be found, whether some areas sampled were more successful in generating profiles than others, and the likelihood of the profiles obtained being of use to a criminal investigation. Analysis of results identified areas that were more successful in generating profiles of use to an investigation and highlighted significant differences in results across a variety of items from which samples were taken. DNA samples taken from items associated with communication such as mobile phones were much more likely to produce a profile useful to a criminal investigation than those taken from fixed surfaces within premises. The results obtained showed that obtaining a DNA profile did not necessarily correlate with the profile being of use to a criminal investigation. This was due to the fact that a large number of these profiles were anticipated eliminations from legitimate sources. Items that produced high numbers of profiles but were anticipated eliminations, and therefore of no value to an investigation, came from items associated with skin samples and clothing. The research went further to identify key factors that affected the profiling rates. Factors that had a positive influence on the ability to obtain a profile included: any area that had been in close proximity to saliva (direct contact was not required); samples that had been recovered from the inside of premises or vehicles and therefore protected from the elements; those that were dry; items that were of a porous nature; and those that had a rough texture. No differences were found between the actual surface materials (plastic, glass, wood, metal), as all showed a propensity to generate profiles. Other factors that were considered but proved to have no effect on the profiling rates included seasonal differences and whether the area targeted for sampling was clearly defined. Items that had had high contact with a victim, were recovered from outside or had been wet, all proved to be less useful to an nvestigation. A further finding of the research was that swabs that had been recovered and stored frozen appeared to deteriorate in their ability to profile. This was particularly notable if they were submitted later than 5 months after recovery. Items stored in dry conditions did not deteriorate in this way. Overall the research can be used to provide investigators with the knowledge of what areas of crime scenes are most likely to yield trace DNA material, the key factors that can affect the likelihood of obtaining a profile, and those areas that are more likely to produce profiles useful to criminal investigations.

As a proactive, information-based policing approach, problem-oriented policing emphasizes the use of crime analysis techniques in the analysis of the underlying causes of the problems that police deal with. In particular, analysis applications can be powerful tools for criminal investigation, such as crime reconstruction, profiling, IAFIS, VICAP, and CODIS. The SARA Model represents a problem-solving strategy of problemoriented policing. It aims to address the underlying causes of the problems and create substantial solutions. However, implementing problem-oriented policing requires a significant change in both the philosophy and structure of police agencies. Not only American policing but also the Turkish National Police should consider problem-oriented policing as an alternative approach for solving criminal activities.

Within the context of debates surrounding the consumption of global media by local audiences in Third World countries, this study explores the reasons behind satellite television subscription, and consumption of international news among a sample of young professional men and women in contemporary Zimbabwe. The study seeks to uncover how the research participants respond to news broadcast on SABC Africa's '60 minutes live in Africa', a programme which they can only access via satellite television in their country. Working within the frame of audience studies which insists on understanding media consumption and reception in context, this study examines how the respondents, situated within the specific Zimbabwe context, characterised as it is by serious social, economic and political challenges, respond to both regional news and news about their country on '60 minutes live in Africa'. Within the frame of qualitative research the study employs a two-stage sampling procedure and data collection strategy to uncover the factors that underpin international media consumption and reception by professional men and women situated in a country undergoing rapid change. The findings of the study point to the various social and individual factors that underlie media consumption choices as well as to the different socially patterned reasons why local audiences are either attracted to, or reject global media. The study found that SABC Africa's '60 minutes live in Africa' is more popular and better received than Western-broadcast programmes on channels such as BBC, CNN, and Sky News among Zimbabwean professionals. I also uncovered some evidence that cultural proximity and relevance are of supreme importance in determining which media audiences chose to consume and what level of engagement they bring to their reception of global media. These and other findings directly confront media models that privilege beliefs in cultural imperialism and the dominance of Western media and their effects on Third World audiences.

The purposes of this paper are to investigate the reaction of installation of closed circuit television and its effect on satisfactions of criminal investigation in Kaohsiung. Questionnaire method is used and 152 questionnaires are sent to people governed by all police substations of Siaogang precinct of Kaohsiung Municpal Police Department. Of which 152 questionnaires, 100 questionnaires are used to investigate the issue, representing 66% of all subjects. The result of this research is as follows. First, perceived satisfactions of criminal investigation are not different from age and living time. However, they are different from sex, levels of education and neighborhood. Second, perceived cognitions of surveillance system management and installation are not different from sex and age, but different from living time and neighborhood. Third, sex, age, level of education, living time and neighborhood are not significant factors in perceived satisfactions of surveillance system management and perceived cognition of labor substitution. Fourth, this study finds that the higher perceived cognition of surveillance system management, the more perceived satisfactions of crime investigation. As a result, it indicates that continuing improvement in surveillance system management will be helpful to satisfactions of criminal investigation, and it is also an indicator of video surveillance system in the future.

Forensic evidence originating from CCTV images is admitted as evidence into various criminal courts in Australia and overseas. It is used predominately to identify persons of interest from images captured by CCTV cameras but other forms of forensic evidence and intelligence are also possible. Using a mixed method research design, this study examines the reliability of CCTV images when used as forensic evidence. A range of strategies including case studies, empirical experimentation and phenomenological inquiry is used to investigate the application of this new form of evidence. Understanding the reliability of evidence derived from photographic sources requires a highly complex interdisciplinary and multifaceted approach. This study has found serious reliability problems with the current use of CCTV images when used as forensic evidence. Serious miscarriages of justice are inevitable if the reliability of photographic evidence practices are not more carefully considered and validated. The study argues that reliability will be improved by establishing more robust methods that enhance the scientific model of repeatability and validation. Thisstudy also establishes a new theoretical model that examines the application and relationship between photographic evidence and physical evidence. Furthermore, the work develops a method for more reliable photointerpretation. The study also recommends that the principles cited in the Daubert ruling be considered for photographic evidence to provide safeguards and improve the reliability of this new form of forensic evidence.

Most research about television studies its impact on viewers. This thesis asks instead how TV influences what is in front of the camera. The dissertation investigates how TV reshapes other institutions as it broadcasts their activities, using four ethnographic studies of televised crime and policing. These studies examine: 1) the reality-TV show "Cops"; 2) the televising of surveillance footage and home video of crime and policing: 3) television and Vancouver's Stanley Cup riot; 4) the law-breaking television stunts of Greenpeace. The four studies provide empirical contexts to draw together and compare for the first time three diverse strands of sociological theorizing which can be used to analyze how TV influences other institutions. My data show the most powerful players, exemplified by the police, tend to dictate which situations are televised, and to produce the "authorized definitions" of these situations, and thus control their institutional consequences. Invoking the notion that "seeing is believing", TV is uniquely effective at warranting these "authorized definitions". Many understandings of television over-emphasize its visual aspect; often instead verbal interpretations of televised events by the most powerful players are more important. The meanings of these televised episodes are produced within a broader culture which tends to support the established order. Television and source institutions create new social roles for audiences in these situations. However, these roles tend to limit audiences to involvement which simply reproduces institutional power. The implications for the three theoretical perspectives being compared are as follows. Rather than having a democratizing effect in these situations as predicted by "medium theory", TV mostly has various influences which reinforce existing power relations. These criminal justice situations are reshaped by the cultural logic of television, fitting with the "media logic" perspective. Televised activities tend to become more institutionally important, tightly managed, dramatic, simplified, and are shaped to fit dominant values. However, powerful source institutions, particularly the police, tend to control television's influences, often harnessing them for their own legitimation and surveillance purposes, consistent with the "institutional" perspective. My data thus lead me to support key aspects of these latter two perspectives, and to produce a synthesis of these two.

Since the consummation of Second Criminal Chamber of the Supreme Court in 2012 was done to explain Article 163 of Criminal ProcedureCode,modified adversary system for the criminal litigation system has become the most important principle of the Criminal Procedure. According to the present practice of trial,protecting the defendants’rights on purpose,the court may need surving evidence by inquisitorial investigation,the shortcoming is too partial toward protecting the defendants’right, may count against justice. Terms of survey evidence, the prosecutor should be the fact that the burden of proof of crime, the court investigation is led by the parties to the court only needs to be clarified in the truth,or is to safeguard the vital interests of fairness and justice and the defendant only when the launch Terms of investigation of evidence. The best way to solve the difficulty is talking the adversary system into consideration,Article163 of Criminal Procedure Code should be amended: 「If the evidence has probably been investigated,it's necessary for the court to focus on truth-finding, the court should give explicit instructions to the parties,they certainly ask for surving evidence.」
