La documentación y estudio del flujo de nuevos meteoritos revela la trascendencia de las bases de datos para el análisis científico de estos fenómenos. Para ello, se acude a los repositorios más importantes en la catalogación y comprensión de los impactos como la Meteoritical Society, el Meteor Data Center de la Unión Astronómica Internacional y la Earth Impact Database. A través de un recorrido por los eventos de impacto más significativos que han afectado a ecosistemas, personas o bienes (Chicxulub, Cráter Barringer, Tunguska, Sikhote-Alin, Sylacauga, Peekskill, Carancas, 2008 TC3, Cheliábinsk, San Carlos y Menisa) se refuerza la necesidad de conocer en profundidad estos eventos para poder anticipar las estrategias de mitigación de riesgos, pero también de recogida, custodia y conservación de meteoritos, la posibilidad de resolver las cuestiones en torno a la propiedad, así como el examen de las consecuencias legales tras los daños provocados. Además, se resalta el caso de España, donde el hallazgo y estudio de meteoritos en nuestro territorio subraya la necesidad de establecer un marco legal nacional que garantice su protección y uso con fines científicos y educativos.

A nivel mundial, una de las zonas geográficas con mayor diversidad biocultural es América Latina, en cuyo territorio habitan 522 pueblos indígenas hablantes de 420 idiomas (Maffi, 2007; Unicef, 2009), además de un importante número —aún no determinado— de pueblos tradicionales, campesinos y afrodescendientes. This chapter discusses Article 7 of the Convention against Torture, covering the chronology of draft texts, analysis of Working Group discussions, and issues of interpretation. Articles 6 and 7 establish increased obligations for State parties in whose territory a suspected torturer is present (the so-called forum States). They shall ensure the presence of such persons by effective custodial or non-custodial measures in accordance with Article 6, carry out preliminary inquiries into the facts, and notify other State parties of the custody and the findings of their investigations in order to facilitate possible extradition requests. After conducting these preliminary steps, the forum State has an obligation under Article 7(1) to submit the case to its competent authorities for the purpose of prosecution. In other words, the strongest obligation to avoid a safe haven for perpetrators of torture by bringing them to justice before their domestic courts applies to the forum State.

Suspects arrested by the police spend their time in police custody out of public view: custody visitors check on the welfare of detainees being held in police custody and report on their findings. The key issues are policy, independence and effectiveness, and the key concepts are power and the ideology of criminal justice. The research was carried out by a former visitor, and was specially designed to suit the subject matter, centring on an in-depth local case study. The setting, custody, remains very much the police’s territory, where legal representation is inadequate. Custody visiting is a type of regulation as part of the United Kingdom’s National Preventive Mechanism: police behaviour in custody blocks should be subject to more, and more effective regulation.

Abstract This chapter looks into the provisions concerning the provisions of remands, consequential amendments, and offences committed outside the UK. Further provisions in Section 40 allow for remand in custody or on bail ad provide time scales in defined circumstances. England and Wales' criminal law jurisdiction was extended to have extra-territorial effect concerning the offence enacted in accordance with the Istanbul Convention's Article 34, which requires the UK to ensure that the intentional conduct by a UK national. The chapter discusses the extension of territorial jurisdiction through the amendments of the Protection from Harassment Order (Northern Ireland) 1997, the Criminal Procedure (Scotland) Act 1995 and the Sexual Offences (Scotland) Act 2009. It also considers the consequential amendments of provisions concerned with strangulation and suffocation offences.

Burbridge ordered the retaliatory executions of over sixty people for guerrilla attacks in Kentucky. He ordered that four prisoners in military custody be shot for every Unionist citizen killed in a guerrilla raid. The idea was that such reprisals would restrain the guerrillas in the field, but his postwar critics attacked the killings as illegitimate military murders. This chapter argues that, while there were irregularities in the proceedings leading up to the executions, retaliation was (and is) an accepted part of the rules of war. Moreover, the criticisms of Burbridge’s enemies posited that anyone who had ever enlisted in the Confederacy—in uniform or out, in Union territory, or engaged in hostile actions—was entitled to prisoner-of-war status. Burbridge, subject to the Union’s understanding of the laws of war, saw these combatants differently.

Abstract The sixteenth-century Protestant Reformation brought far-reaching changes to Western constitutionalism. The Lutheran reformers vested each territorial state with much of the jurisdiction held by the medieval church, arguing that the magistrate was the custodian of both the religious and civil duties set out in the Ten Commandments. They also merged church courts and state courts, placing both legal and equitable power in the hands of conscientious Christian judges. The Anabaptists ascetically withdrew from civil and political life into small, self-sufficient, and often intensely democratic communities governed by simple biblical principles and dialogical forms of internal governance. Despite ample persecution, Anabaptists were fervent champions of religious liberty and separation of church and state. The Calvinist reformers separated the offices of church and state but called both authorities to help create an overtly Christian local polity governed by written constitutions based on the Bible and natural law but with detailed positive laws tailored to local needs. Calvinists also developed robust Bible-based theories of natural and positive rights, whose persistent and pervasive breach by a tyrant triggered the rights of resistance and revolution.
