Abstract:
This chapter examines the Universal Democratic Republicans, which formed the core of the union of “liberal societies” by early 1854. The listed participants included both the “Free Democratic League (Americans, opposed to the Extension of Slavery)” and the “Ouvrier Circle (American workmen).” Given that the personnel of these groups overlapped, the Brotherhood of the Union in New York saw itself alongside the revolutionary secret societies of Europe and their successors and, in an American context, as part of the radical wing of the antislavery movement. This coalition addressed American politics on its own. That July, it recommended Hugh Forbes's Manual for the Patriotic Volunteer as “indispensable for the Revolutionists” and endorsed the view of American politics reflected in Forbes's “Catechism” that described the Democrats and Whigs as existing “to procure public occupation in the diplomatic service, custom house, post office, treasury, patent office, land office, municipality, police, or any other where salary and profit can be enjoyed.”

This chapter revisits the colonial state’s legal justifications of the exertion of arbitrary authority over labor for public works. Focusing on the debates in colonial Punjab regarding the entitlements of the state to draught animals and manual labour for public works, Bhattacharya draws out how the languages of law were pressed into service to draw on the extensive history of begar (forced labour) by pre-colonial states of the region and lay the violent foundation of the official commandeering of forced labour as a legal convention or custom.

Abstract:
This chapter asks what role the sources of international law can play in establishing or generating the normativity of international law. While sources of law are typically treated as determinants of the validity of international legal norms, this chapter argues that the normativity of international law is not co-extensive with the idea of legal validity. The chapter first develops a series of jurisprudential arguments which treat the full normativity of law, including international law, as dependent upon both the procedural and substantive values of its norms. It then turns to international law specifically, arguing that the sources of international law can contribute towards international law’s full normativity only if they carry forward values that respect the autonomy and responsibility of those who are subject to the law. The chapter finally concludes with a discussion of the normativity-generating potential of first treaties and custom.

Every year, in North American immigrant communities, thousands of infants experience separations from their parents when left or sent to live with extended family overseas. The practice of transnational, temporary boarding is widespread and poorly understood. This practice has been documented in North American Chinese, South Asian, Caribbean, and Filipino communities. This custom has raised concerns among child developmentalists and clinicians about potentially harmful consequences to children and parents. However, such separations may be misunderstood and prone to unnecessary stigma based on a lack of cultural appreciation. This chapter examines motives for and repercussions of separating parents and infants for extensive periods of time. The authors contextualize their analysis within a framework of stress management during the process of settlement and acculturation and consider the protective benefits of cultural values and practices in addition to risks. They use the Chinese immigrant community as an exemplar for the proposed framework.

Abstract:
This book aims to clarify, critically discuss, and propose solutions for the application of international rules of attribution of conduct to States under public international law and international investment law. In a nutshell, the issue is that of the applicability of the principles of ‘attribution’ to States of acts that are in breach of their obligations under international custom or international treaties, with a focus on their commitments pertaining to the treatment of foreign investors under international investment agreements (IIAs), mostly bilateral investment treaties (BITs), and their application by arbitral tribunals. Of special interest and the object of extensive debate within this context is the responsibility of States when the alleged breach has been committed not by the State itself through its organs, but by entities which have separate legal personality under domestic law, which, nevertheless, may engage the responsibility of the State under international law, such as State-owned enterprises (SOEs). The book addresses the relevant issues in a systematic way, approaching them first in general terms on the basis of the Draft Articles on Responsibility of States for Internationally Wrongful Acts (ARSIWA) on attribution, finalized by the International Law Commission (ILC) in 2001, and proceeding thereafter to the specifics of international investment law, based on an accurate examination of the law, practice, and case law, with full knowledge and consideration of the academic debate. To this extent, the book submits that the general principles on attribution are fully applicable within international investment law, which is not a closed system governed by different principles, and that tribunals have to apply them as they generally do.

Courtship in Georgian England was a decisive moment in the life cycle, imagined as a tactical game, an invigorating sport, and perilous journey across a turbulent sea. This book brings to life the emotional experience of courtship using the words and objects selected by men and women to navigate this potentially fraught process. It provides new insights into the making and breaking of relationships, beginning with the formation of courtships using the language of love, the development of intimacy through the exchange of love letters, and sensory engagement with love tokens such as flowers, portrait miniatures, and locks of hair. It also charts the increasing modernization of romantic customs over the Georgian era—most notably with the arrival of the printed valentine card—revealing how love developed into a commercial industry. The book concludes with the rituals of disintegration when engagements went awry, and pursuit of damages for breach of promise in the civil courts. The Game of Love in Georgian England brings together love letters, diaries, valentines, and proposals of marriage from sixty courtships sourced from thirty archives and museum collections, alongside an extensive range of sources including ballads, conduct literature, court cases, material objects, newspaper reports, novels, periodicals, philosophical discourses, plays, poems, and prints, in order to create a vivid social and cultural history of romantic emotions. The book demonstrates the importance of courtship to studies of marriage, relationships, and emotions in history, and how we write histories of emotions using objects. Love emerges from this study as something that we do in practice, enacted by couples through particular socially and historically determined rituals.

Based on extensive archival research, the extraordinary stories of ordinary people’s lives in this book explore many facets of young people’s intimacy from meeting to courtship to the many occasions when untimely pregnancies necessitated a range of strategies. These might include marriage but could also be efforts to induce abortions, arrangements for out-of-wedlock delivery, charging the father with custody, leaving the baby with a foundling hospital, or infanticide. Clergy, lawyers, social welfare officials, employers, midwives, wet-nurses, neighbors, family, and friends supported young women and held young men responsible for the reproductive consequences of their sexual activity. These practices of intimacy reframe our understanding of multiple aspects of the Old Regime. Young people’s intimate experiences challenge the belief that disciplining female sexuality was a critical early modern goal of state formation and religious reformation. They suggest rethinking the history of a sexual double standard in local and long contexts, the history of marriage, and the role of law in the politics of communities and institutions. The lives of young people also reshape many more specific debates, for instance, about the history of emotions, infanticide, attitudes to illegitimacy, pre-modern workplaces, and the body. The book reveals the important role of the young people’s working communities, where the norm was local management of intimacy with a heavy emphasis on pastoral care and pragmatic acceptance of the inevitability of out-of-wedlock pregnancy.

Anagarika Dharmapala was one of the most prominent public figures in late nineteenth- and early twentieth-century Sri Lanka (then known as Ceylon). This book goes into a detailed exploration of Dharmapala’s multifaceted personal and public life. This analytical narration of the ethos in which he lived and worked provides an essential background. The author makes extensive use of Dharmapala’s assiduously kept diaries to weave his story. In its initial chapters, the book relates the confrontation and resistance of a nascent nationalist movement in the form of a renaissance of the country’s main traditional religion, Buddhism, against the all-pervading colonial ethos. Dharmapala, with all the enthusiasm of his youth, plunged into this movement, which received the support of American theosophists led by Col Henry Steel Olcott. He became the live wire of the Buddhist Theosophical Society, formed on the advice of the theosophists, and went around the country hectoring his compatriots to join a movement of national resurgence. Dharmapala eventually broadened the arena of his interests and action. The restoration of the prominent sacred places of Buddhism in India, while bringing them back to Buddhist custody, became his life’s mission. In this endeavour, he sought and received the support of the intellectual and professional nationalist elite of Bengali society. In pursuit of his cause, Dharmapala was single minded. But he had an even a wider interest—that of propagating Buddhism throughout the world. He devoted much of his energy in later life to establish Buddhist centres in Europe, and ended his life as a Buddhist monk.
